This is the transfer of funds and ownership. A title company acts as an independent third party to facilitate the closing.

You and the Seller have agreed to the price and terms. After the earnest money is delivered, the home is effectively held for you until closing.

PRE-APPROVAL VS PRE-QUALIFICATION

There is no set definition in lending that outlines “pre-approval” vs. “pre-qualification”. Only one of these can almost certainly guarantee that you will never experience unplanned hurdles, surprises, delays and stress after you’re under contract, as both are not created equal.

Pre-Qualification WITHOUT Credit Review

– Your credit report, income, assets and employment documents are not requested from the appropriate resources or bureaus. Rather, the lender will request this information from you verbally over the phone or allow you to input it into their Web site form.

– The loan officer relies on this information alone and deems it to be accurate and reliable. This assumption ultimately determines your ability to obtain financing based on what is believed to be true. This is NOT a completed pre-approval.

LOCAL LENDERS OFFER INSIGHT, KNOWLEDGE AND EXPERIENCE IN OUR MARKET. ADDITIONALLY, THEY ARE AVAILABLE OUTSIDE OF REGULAR BUSINESS HOURS TO SUPPORT OUR OFFER NEGOTIATION. DO YOUR HOMEWORK BEFORE USING A BIG BANK, OUT-OF-STATE OR ONLINE LENDER.

Pre-Qualification WITH Credit Review

– Income, assets and employment documents are not requested from appropriate resources, though a credit report IS pulled and reviewed by the loan officer. Like above, income, assets and employment information are provided verbally or via form, by you. Income is assumed to be guaranteed salary etc.

– Problems or delays are apt to arise in this scenario in a multitude of ways. Surprises on pay stubs, tax returns and bank statements are not uncommon and can lead to last minute documentation requests and challenges in verifying income and assets. This can result in your closing being postponed due to complications in financing or a lack of financing entirely, thus NO closing. This is NOT a completed pre-approval.

Pre-Approval WITHOUT Underwriting Review

– Your credit report is requested from the appropriate bureaus and reviewed by the loan officer.

– Income, employment and asset DOCUMENTATION IS OBTAINED and reviewed by the loan officer. This means your employer is contacted directly, if necessary, to obtain accurate and verified employment and income information. All documents, even those provided by you, are official documents containing verified and true information.

– The loan officer places this information into an automated underwriting system and processes the file.

– A live underwriter has not yet seen or reviewed this file. Rather, they are the person who will later issue your final pre-approval when the time comes. This is NOT a completed pre-approval.

Certified Guaranteed Approval

– Your loan application is reviewed by your lender’s live underwriter, including a full and complete review of credit, assets, income and employment. All information received is verified and deemed to be accurate.

– Your conditional approval is issued by the underwriter. This means that any conditions that may be needed for your final approval have already been cleared.

– Aggressive offers, quick closing timelines etc. are now viable tools/ incentives that you may be able to use to your advantage when negotiating an offer on your dream home! You can have 100% confidence in being able to close on time, under budget, with no surprises. THIS IS A COMPLETED PRE-APPROVAL.

YOU DO NEED A REALTOR FOR NEW CONSTRUCTION!

I am often asked, “Should I use a Realtor if I’m interested in buying new construction from a builder?” The short answer is you absolutely need this partnership and here are the main reasons why:

Register - If you want to be sure you have someone looking out for your best interest, tell the builder on your very first visit that you are already working with a Realtor, or don’t visit without me. If you do not communicate this information upfront when you are buying new construction, I won’t be able to represent you and watch out for your best interest. I have 22 years of experience in new construction and there’s a good chance I already have a working relationship with the builder and knowledge of the community in which you are interested.

Representation - No matter how nice and friendly they are, the builder employees represent the builder’s best interest, not yours. I represent your interest and advocate on your behalf. Additionally, I will help you get the most value for the least amount of money and make the real estate transaction easy and frustration free.

What You See is Not What You Get - Touring model

homes is always fun! The challenge is that the model isn’t the base price of $500,000 that is being advertised. Rather, it’s likely $600,000 or greater because of the lot premium and all the upgrades. Top tier cabinets, countertops, backsplashes and flooring, upgraded appliances, built-in bookshelves, crown molding and tray ceilings are usually upgrades, and they add up. Many are designer upgrades and not offered at all. I will help make sure you’re aware of what’s included in the base price and what’s extra so your expectations are spot on. My business savvy will also come in handy in helping you determine what is best to purchase after the build, instead of paying the builder mark-up, as long as your cash position allows.

Negotiations - Even good negotiators have told us they are more effective when they negotiate for other people than they are when they negotiate for themselves because they don’t have an emotional connection to what they’re buying. I will look at the transaction from a dollars and sense perspective without being swayed by emotions. I also know what is and what is not negotiable. As you can imagine, it varies by builder. Builders are far more likely to negotiate on fees or upgrades than they are on price. Sales prices are recorded in public records, thus base price negotiation is seldom seen, as it will impact future sales. I will help guide you through negotiations and ensure you are getting the most for your money.

Builder Incentives are Not All Created Equal - Some builders offer greater incentives than others. This is often not an apples to apples comparison without looking at their full pricing strategy and how they allow the incentives to be applied. For many years, one local builder provided $50,000 incentives. Their homes couldn’t appraise without the markdown and their design center upgrades were at 200% of cost. It wasn’t a greater incentive than another builder who was offering $15,000 with a more appropriate base price and lesser upgrade markups. You are also entitled and encouraged to have an appraisal done prior to closing and most lenders will require it to serve as additional confirmation of value.

Agent Fees - Buyers do not pay the Realtor fees, the seller or builder does. Builders view commissions to real estate agents as part of their cost of doing business. In fact, they rely on outside agents to bring clients to them. Builders will not credit buyers the commission they would otherwise pay to a Realtor. If they were to do so, Realtors would no longer bring clients through builders’ doors and ultimately it would impact their future sales. Therefore, there is no downside and no cost on your end to having an experienced Realtor like me to represent you.

Contract - How familiar are you with a real estate contract? Builder contracts are very builder centric and are a different animal than resale contracts. Do you know what to look for to make sure you are receiving all the benefits you’re supposed to receive? Are you aware of any hidden fees or community fees? I am an expert in the industry and am engaged in providing guidance throughout the real estate transaction. I review real estate contracts regularly and know what to look for to ensure everything is correct prior to signing.

Get Everything in Writing - Any concessions or guarantees provided by the builder should be confirmed in writing. Do not sign any paperwork or contracts without ensuring everything you’ve agreed upon, including upgrades, fees, timelines etc., is incorporated into the contract. If you skip this step, the builder does not have to deliver what they agreed upon and you will have no recourse. That’s why you have me! I will ensure all agreed upon terms are included in the contract.

MORE ABOUT NEW CONSTRUCTION

Quality of Construction - What is the reputation in the community regarding the builder? What is the quality of their construction? Previous/future land uses? Resource availability? Taxing districts? Neighborhood build-out timing? Other risks including location within the community? I know many additional questions to ask. There are hundreds of builders in the Denver metro area. I am familiar with all the major builders and their quality of work. With today’s shortage of licensed/qualified contractors and tradesmen, it is often not what it used to be and construction delays are frequent. I will attend scheduled and unscheduled walkthroughs and meetings with you, and I know what is right from wrong. I will help you navigate the process.

Inspections - You may want to consider a home inspection when buying new construction. The builder doesn’t necessarily want to promote inspection of their product, although you’re entitled to do so. Often times, homeowners think a new home warranty will cover any issues that arise. In certain instances, it does not. I have relationships with multiple independent inspectors who will look out for your best interest. I will even help you set the appointment with the inspector and review the inspector’s report to identify potential areas of negotiation, correction, repair or replacement with the builder. It is important to note that even the city/county inspectors miss things. Just recently, I’ve seen overdriven exterior nails allowing water intrusion, metal electrolysis causing rusting, unpainted spaces, incorrect tub/shower surround backer board, improperly installed LVT flooring, missing optional windows and an uninsulated attic, just to name a few.

A lot happens between an accepted contract and closing, and we’ll be there for you every step of the way. We’ll keep you educated and up to date on contract requirements with regular progress reports, update you with any addendums and changes, and predict potential hurdles so we can avoid them before they happen.

WHAT DOES YOUR AGENT DO AFTER YOU’RE UNDER CONTRACT?

• I deliver earnest money to the title company on your behalf, collect the receipt and provide to you and the lender.

• I provide, explain and review all seller disclosures with you. Once signed, I will turn in all contract and disclosure documents to our office. I will provide appropriate documents to the lender and verify that the title company has also received required documents from the listing agent.

• I will prepare you for what to expect from the inspection process and coordinate scheduling. I also facilitate drop-off times for additional/optional testing and secondary inspectors for specialty items. I attend all inspections and provide helpful hints and strategic insight throughout.

• I review due diligence documents and your complete inspection report with you and guide you through the process of properly drafting your request for repairs. I then spearhead the negotiation process for these items, advocating on your behalf.

• I verify that the lender has ordered the appraisal and ensure that the appraisal timeline aligns properly with your closing timeline and that any appraisal conditions are addressed.

• I will review the title commitment and other title related documents as well as HOA documents and the HOA status letter. I ensure that any title or HOA related conditions are properly addressed and cleared prior to deadlines.

• I monitor inspection related repairs being performed and ensure that all items are completed properly, as agreed upon and that all necessary documentation, permits, warranties, invoices and paid receipts are comprehensive and provided as requested. I will provide these to the lender and/or title company as necessary to ensure any credits to you. This will also make certain any items being paid from the seller’s proceeds, or held in escrow, are accounted for.

• I verify and compare figures from both the lender and title company to ensure accuracy. Once figures are finalized, I will provide and review all numbers with you prior to closing.

• I coordinate the time and place of closing and perform the final walkthrough with you prior to closing. This verifies the condition of the home and that all inspection items were properly addressed as agreed upon.

• I provide you with contact and process information regarding potential post-closing needs to include utility transfers, trash pick-up, home warranties and other relevant contractors.

WHAT DOES YOUR LENDER DO AFTER YOU’RE UNDER CONTRACT?

• Provides updated loan figures specific to the property and introduces you to the loan processing team.

• Gives advice regarding locking in your interest rate once you’re under contract on a home and locks your rate if is advisable to do so at that time.

• Provides required loan disclosure documents for your signature based on the loan type.

• Orders any third party documents relevant to appraisal, flood zones, title work, homeowner’s insurance, condominium approval etc.

• Requests and updates any aged documents (pay stubs, bank statements etc.) prior to submission to underwriting for initial review.

• Engages appraiser to perform home visit after inspection has been completed and resolved.

• Performs final loan review and receives underwriting clear to close approval.

• Finalizes all loan figures (closing costs, prepaids, cash to close etc.) and provides closing disclosure for signature.

• Wires funds to title company prior to closing.

WHAT DOES YOUR TITLE COMPANY DO AFTER YOU’RE UNDER CONTRACT?

• Receives fully executed contract and orders title work.

• Educates buyers and sellers on wire fraud.

• Collects all processing information from Realtors and sellers (lien payoffs, HOA/tax information, judgments/IRS payoffs, commissions etc.) as well as lender information.

• Processes file for closing and obtains all appropriate documentation required for closing.

• Prepares final settlement statement and documents. Reconciles final figures to the original contract and to subsequent amendments.

• Orders final water meter reading to be completed on the day of closing, if not included in the HOA.

• Disburses all documents and funds to the appropriate parties.

WHAT TO EXPECT AT THE CLOSING TABLE

The closer will greet clients and make copies of both the buyer’s and the seller’s required identification so they can notarize all signatures.

The closer reviews the loan documents with the buyer and has the buyer sign the appropriate documents. This process usually takes about 40 minutes.

Any funding conditions are sent to the lender and wait for approval/authorization number (this may add additional time).

Real estate documents are reviewed for accuracy and signed, including the warranty deed which officially transfers title from the seller to the buyer (real estate side of the transaction).

The buyer and lender provide good funds to the title company.

The closer distributes funds to the appropriate parties per the closing instructions from all parties.

The closer offers two choices to all parties for how they would like to receive copies of their signed closing documents:

• Clients may receive paperless documents via email

• Clients may elect to receive paper copies of all documents before they leave the closing.

The house keys are transferred.

After the closing, the closing agent will immediately record the warranty deed, the deed of trust and any other pertinent documents with the county clerk’s office.

The title policy is generally issued within 30 days of the closing. Buyers will be reminded that this is an important document to expect and to file it with other legal documents.

✓ CHECK LIST OF ITEMS TO BRING TO CLOSING:

All buyers and sellers must bring a government issued ID: a valid driver’s license, a picture ID issued by the state, or a valid passport. If there has been a change in marital status, let your closer know immediately. The party whose name has changed will be asked to provide identification reflecting the new name, as well as a marriage license or divorce decree documenting the change. It is helpful to have these items prior to the closing, rather than at the closing table, so the closer can make sure all documents are prepared correctly.

Lenders typically require buyers to have a second form of ID as well, such as a library card or membership card.

In the event of a deceased party, any estate documents as listed in our title commitment, such as death certificate, letters of appointment, or personal representative’s deed.

Colorado law requires that buyers bring good funds to closing. Good funds can be a wire or cashier’s check made payable to the title company.

Sellers need to know their social security number (or tax identification number) to complete IRS documents at the closing table.

The seller typically brings house keys to give to the buyer. Other items pertaining to the house are typically left in the house for the future buyer.

Here are some of our best moving tips and a simple timeline that will help you stay organized.

2 WEEKS BEFORE:

File a change of address with the postal service.

2 MONTHS BEFORE:

Research your new community and contact new schools for registration and childcare.

Arrange for medical, dental and school records to be transferred to your new location.

Create a move file to keep track of quotes, receipts and other important details.

6 WEEKS BEFORE:

Discard any items you don’t want to move to your new home. Research your moving options. Do-it-yourself or moving company?

Get quotes from moving companies and make a moving budget. Start packing items. Gather moving boxes and packing materials for your move.

1 MONTH BEFORE:

Reserve your move with your moving company. Call utility services at your current and future locations to cancel and set up service.

Get your personal vehicle serviced so it’s in the best condition before the trip.

Notify your insurance company (life, health, fire, auto), credit card company and any monthly memberships of the upcoming move.

Arrange for parking of any moving equipment.

1 WEEK BEFORE:

Review moving plans to be sure you have all the information you need.

Tell your bank or credit card company about the upcoming charges. Pack an “essentials” box with items you’ll need upon arrival at your new home. Pack for travel.

Prepare appliances by draining gas and oil to lessen the chances of fire during your move.

DURING THE MOVE:

Clear a path so nothing is blocking the walkway.

Do a final walkthrough of the home to check for left-behind items.

Make sure utilities are off, doors and windows are locked and notify your real estate agent that you have left the property.

AFTER THE MOVE:

Clean the new home before unloading items.

Unpack everything and begin organizing.

Pick up any mail being held at the local post office. Get a new driver’s license and automobile tags.
