Premarital agreements: what to do before you say “I do”

By TOSHA RAE HEAVICAN, SENIOR ASSOCIATE ATTORNEY AT HIGHTOWER REFF LAW A friend of mine once told me the best advice she ever received in picking a life partner: “Never marry someone you can’t stand being divorced from.” For so many reasons, this rings true. While premarital agreements often get a bad rap - words like “unromantic”, “distrust”, and “greed” come to mind - the reality is, a carefully drafted premarital agreement can help create a culture of financial openness in a marriage, as well as provide a framework for an amicable untangling of the parties, in the unfortunate event of divorce.

Premarital agreements in Nebraska are governed by the Uniform Premarital Agreement Act. Most importantly, a premarital agreement by definition is a contract entered into by prospective spouses in contemplation of marriage, and is to be effective upon marriage. As recently as 2016, the Nebraska Supreme Court reaffirmed the court’s position that Nebraska law does not allow postnuptial agreements unless such agreements are concurrent with a separation or divorce.

All of this is to say that, if you are considering a premarital agreement, it has to be made before the wedding.

A premarital agreement can outline the disposition of pre- and post-marital assets in the event of divorce. It can also set expectations for things like alimony and distribution of the parties’ debt. A word to the wise: give yourself and your partner more than a few days to consider 18 |

the document. Allowing ample time to generate a document that suits both parties’ needs will increase the likelihood of success by its terms, and allow for full, open and honest communication for everyone involved.

Keep in mind that premarital agreements don’t just deal with divorce; the document can also help govern the distribution of your assets in the event of your death. This is particularly helpful for families formed by a second marriage. Consider a home owned by one spouse prior to the second marriage.

If that spouse dies during the marriage, does the surviving spouse get the home?

Does it pass to the deceased spouse’s children or beneficiaries? Or is it sold, and if so, who receives the payout? In the case of second marriages, having a comprehensive premarital agreement done before marriage allows the parties to preserve their estate planning options down the road, and to foster harmony in the blended family.

Thinking of divorce before getting married may seem unromantic, but marriage is a contract on multiple levels. Parties promise to “love, honor, and cherish”; they also amass assets, debts, and dependents. In the event of marital discord, legal documents such as a premarital agreement establish the rights and responsibilities of each party to a marriage. Mitigating the emotional

and financial points of contention by defining each person’s expectations and boundaries up front can save a great deal of money, time, and pain down the road.

Saffron Urban Indian Kitchen offers a modern twist on traditional cuisine

ometimes life takes you in a direction you never thought possible, and that is exactly what happened to Executive Chef Diwesh Bhattarai, who recently realized a long-time dream—Saffron Urban Indian Kitchen—when it recently opened in the Aksarben Village neighborhood.

OUR food Bhattarai arrived in the United States from Butwal, Nepal in 2007 as an engineering student, working toward a Computer Science degree at Bellevue University. To fund living expenses, he took a job as a dishwasher in the kitchen of a local Indian restaurant but soon found himself fascinated by the inner workings of a professional kitchen. He became more and more comfortable in the space, and on one fortuitous occasion a line cook was absent so the chef asked Bhattarai to step in. After the shift, the head chef, recognizing a natural affinity for the craft, encouraged the fledgling line cook to consider attending culinary school.

Under the tutelage of instructors like Chef Brian O’Malley at Metropolitan Community College Institute for the Culinary Arts, the budding chef began learning classical French techniques and the terminology that described them. He already possessed the skill and palate to cook Indian food, but culinary school enabled him to bring new techniques to familiar flavors. Immediately after completing a culinary arts degree in 2015, he returned to complete the hospitality program, wanting to further his front of house knowledge.

The tendency toward hospitality has always been a part of his life, “In Nepal, when a guest is in your home, they are the first priority, ‘anything you want, right there for you’ that is how we want guests to feel when they dine with us – so very welcome.” To this day he makes time to observe the dining room by quietly sitting in different corners before starting pre-shift meetings with his staff.

For several years after completing culinary school, Bhattarai honed his craft by working in various kitchens across the city. After meeting local businessman Sagar Gurung at a golf outing, the pair bonded over an affinity for food and ambition to open restaurants. Saffron is the realization of years of conversations—they dreamed of a spot serving cuisine reminiscent of Indian flavors and traditions with a completely reinvented ambiance.

as well as a small herb garden that provides fresh mint and other herbs for the bar and kitchen.

The adjacent whisky room is designed to make sippers feel as though they are royalty. According to Bhattarai, the beverage of choice for Maha-ra-jas was often whisky, so the space is adorned in luxurious fabrics and lined with gold-framed pictures—remakes of versions that hung in actual royal palaces. Growing up in Nepal just over the southern Indian border gave Bhattarai an affinity for certain aromas and flavors.

In addition to his mom’s cooking, the executive chef remembers fondly other childhood favorites snagged from the ubiquitous moving street stalls. Snacks such as samosas and panipuri, a hollow fried bread with a light puffy crust, filled with potatoes, peas, and tangy tamarind chutney evoke warm memories. These

flavors and aromas found their way to the appetizer menu at Saffron.

The team prides itself on crafting delicious food and providing stellar service. Acknowledgement and honesty are critical tenets imparted to staff. Bhattarai shared, “No matter how busy we are, it’s important to take a moment to make eye contact and let a new guest know we’ll be right with them.”

The saffron lamp chops are a delight to behold, and rib eye vindaloo melds Midwestern steak with Indian flavors in a lovely manner.

Focusing on smaller batches allows the team to focus on product quality and ways to retain flavor. “Once the farmer’s

market starts up again, we hope to curate dishes from the market and local producers,” shared the executive chef.

Bhattarai is grateful for his staff and for the lessons he’s learned from mentors.

What to do when your pain is gone Story by DUSTIN SPARKS, NuSpine Chiropractic If you’ve been under chiropractic care and have resolved your pain issues, should you continue to receive care? Is there any benefit to ongoing treatment?

only when their pain returns. But, should 100% of people get monthly tune-ups? Or is it a waste of time and money? Let’s look at some recent research.

ACTIVE VS. MAINTENANCE The term “active” care is treating an “active” complaint. Treating low back pain while it improves is “active” care. If you keep coming back once the back pain is gone, that is considered “maintenance” care. This maintenance care is for “maintaining” your current status of little to no pain, rather than working on an “active” painful issue.

Once a patient achieves the goals they laid out on the first visit (i.e. pain level of 1/10, sit for one hour without low back pain, etc.), we leave it up to the patient if they want to continue with chiropractic maintenance care. These visits can be considered “tune-ups” for the body. About 60% of our patients decide to get these “tune-ups.” The other 40% come back

THE RESEARCH In a 2018 study, 328 patients with low back pain were treated with chiropractic care. The average pain level was ~5.2/10, and after 6 visits the pain levels dropped to an average of ~2/10. At this point, the patients were split into two groups. The first group of patients received “maintenance” care over the next 52 weeks at regular intervals. The second group of patients were dismissed from care and were told to return when their symptoms returned (treat-as-needed group). At the end of the year, they looked at two things:

1. Which group had more days with bothersome low back pain?

2. Which group had more office visits?

The results? The group that underwent maintenance care had approximately 13 fewer days of bothersome low back pain in the year!

LAST WORDS Is chiropractic maintenance care worth it? That’s up to you. An almost 2-week difference in days with bothersome pain between the two groups is a big change though.

Another thing we need to mention.

Insurance does not cover “maintenance” care. Why? Insurance companies want you to get treated for an active issue. If your pain went away, they aren’t going to keep paying for a visit every few weeks or months. NuSpine does not accept insurance, and our prices are less than most co-pays (in addition to being open 7 days a week and taking walk-ins we accept HSA & FSA). Sidrony Jewelers provides timeless pieces in a modern setting

They are an investment that signifies a milestone and should be approached with the utmost care. It’s rare to find a local jeweler that resembles a family-owned store from the past. Sidrony Jewelers opened a year ago with the philosophy to provide old-fashioned, friendly customer service with the latest in jewelry and watches along with unique custom pieces.

Master Goldsmith and Watchmaker Garrett Peddicord grew up in the industry, but not through a family connection. At age 14, while working at a fast-food restaurant at a local mall in Baltimore, MD, he delivered breakfast every morning to the owner of a jewelry repair shop. His interest in the business led to an apprenticeship where he learned the craft of goldsmithing.

Several years later he became certified

through the Gemological Institute of America and also earned his Master Watchmaker certificate. By age 19 he managed a Zales location and a year later opened his own trade shop and serviced 11 jewelers throughout New England.

Jewelers location in Bellevue where he met Jon “JC” Sronce, Sidrony’s current Store Manager. He also earned a degree in Criminology from the University of Nebraska at Omaha and soon decided to engage in his next venture—the military. Peddicord spent the next 10 years serving in the Air Force as an airborne cryptologist language analyst and was deployed around the world, including 1,000 days in the Afghanistan war zone.

After completing his service, Peddicord felt the need to reignite his passion for the jewelry industry. His time in the military enabled him to save enough 40 |

money to open his own store and establish a jewelry business that he described as “deliberately different.” Peddicord said, “We have the small-town jeweler feel with great face-to-face service by a professional who is passionate and knows how to make jewelry. I wear my leather apron over my shirt and tie. Most people haven’t had the opportunity to work with a real jeweler and have the piece in your hands quickly.”

Peddicord attributes Sidrony’s success to the ability to listen to customers, calling it an “underappreciated quality.”

He said they try to make the experi-

ence non-intimidating but informative, because the experience you have in-store is such an important part of the process. From there, communication is the second half of the equation. Whether it’s finding something out of the case, changing the gemstone, or ring sizing while you wait, proactive communication and quick turnaround times are key.

Something you won’t find at Sidrony is the practice of negotiating price. “The industry has taught consumers to haggle, but marking up items just to give a discount is dishonest,” Peddicord said.

ing with the client to design something new and beautiful. Using Computer Aided Design, he can create it in-house, text screen shots, and keep the client part of the process every step. Repairs are also popular, which Peddicord performs in-house and is one of the parts of the business he likes the best, which goes back to his early days as a hands-on apprentice.

Sidrony is undergoing a big expansion, from 1,600 sq. ft. to 3,500 sq. ft. A majority of it will be dedicated to bridal displays and engagement suites. “Buying an engagement ring is a major life event,

and we don’t take that for granted,” Peddicord said. “We spend as much or as little time as you need and are devoted to that.”

The expansion will also enable the store to carry more watch brands, which Sidrony hopes to rival in size to its competitors’ watch selections. “I’m obsessed with beautiful gems, precious metals, and watches for their rarity and sentimentality and the impact they have on people’s lives,” Peddicord said. We participate in the most positive side of humanity, and we love being a part of that.

IMPLICATIONS OF THE ARPA The American Rescue Plan Act (ARPA) provisions provided 2021 tax relief in the wake of COVID-19. The impact of ARPA will be largely seen on

your 2021 tax return. Changes will also be in effect regarding the Recovery Rebate Credit, Earned Income Tax Credit, and Child and Dependent Care Credit.

Blake Martin serves as matchmaker for Heartland entrepreneurs

hen you hear the term “franchising,” most people tend to think of McDonald’s or other large food corporations. Although these types of establishments fall under this category, the word “franchise” has a lot of misconception behind it. Businesses such as McDonald’s have created an illusion that the opportunity to franchise only comes with a large expense and a lot of experience. For one individual, what started as a novel business idea in his 20s led to the purchase of his own franchise business venture.

Before Blake Martin was familiar with the world of franchising, he helped a colleague launch his own private senior homecare company in the 90s. Through trial and error, Martin learned the ins and outs of business management.

When the company decided to franchise, Martin helped build the business to a point where others could purchase their own location and use the original to study that community’s market.

The initial franchise was a success, and in time, Martin was recruited to Omaha by worldwide senior homecare corporation Right at Home. The company was seeking people like Martin, who went from little experience in fostering business growth to launching a successful franchise system, as mentors to their budding franchise owners. Martin assumed he’d be in the role for only a short time but stayed with Right at Home for 11

After years of guiding aspiring business owners through the strategic steps behind franchising, Martin realized he, too, wanted his own franchise. When news broke that Right at Home was to be sold, Martin recognized he would be out of a job and began the search for his own franchise. There are three options when looking into business ownership–build from the ground up, buy an existing company, or join a franchise. Martin said the educational aspect is crucial to ensure an informed decision is made about which option makes the most sense based on goals and priorities. One of Martin’s previous clients was a former senior executive for a Fortune 500 company who was ready for a new challenge taking on an existing business. The client wanted to take on a business that was already built and work to take control. The client approached Martin settled on a pizza franchise due to familiarity with the concept and a sentimental connection to the industry.

To avoid buyer’s remorse, Martin walked his client through the FranNet process and uncovered the client’s greater priorities beyond working in the pizza industry. These factors included working in a semi-absentee role, leading a solution-based business with consistent revenue growth, and scaling a company with a small team. Ensuring all priorities were best matched with the right industry, Martin’s client moved forward with a portable moving and storage container franchise. “You don’t go into business ownership thinking this will be easy,” Martin said. “It can be extremely rewarding if you choose the right one that provides opportunities you look for.”

Fully understanding the ins and outs of coverage, costs, and everything in between can even seem daunting at times. When business partners Tammy Darr and Chad Vacek set out to open Legacy Insurance Services, they aimed to solve this issue for their clients by not only offering quality insurance coverage but also top-notch customer service that goes beyond traditional expectations.

“For us, it was important to do things the right way and provide the best experience possible,” Vacek said. “We really try to act as an advisor that educates our clients. We also take time to learn what each business does, what they want, what they’ve done, and what they need for coverage. We are what you might call a ‘boutique’ insurance agency with a lot of horsepower.”

Equally as important to the co-owners,

Darr emphasized, is workplace culture.

“We’ve created a little family. We believe that when you have happy employees, you have happy customers. I think everyone has had a job where they don’t want to go to work and actually dread walking in the door. That’s not us. We allow our employees the option to be hybrid, so if they want to work from home part of the week, they can. A lot of the time, our employees will even feel left out if they choose to work at home because they want to be here with their team, and I think that’s very telling of our work environment.”

The company, which opened in May 2020, serves clients throughout Nebraska and the surrounding states and is now home to seven employees. Although small in size, the agency easily competes with larger national firms, Vacek said.

While the focus is on business insurance—property, general liability, work

comp, and auto—Legacy Insurance Services also handles personal lines, becoming a one-stop-shop for clients.

An experienced and dedicated team that understands the processes of the industry has been a huge contributing factor to growth. In fact, the company receives two referrals per week on average. Darr, who first entered the industry at age 16 when she began working part-time at her father’s insurance agency, said it’s been extremely beneficial to gain so many resources, mentors, and connections over the years.

Looking to the future, growth is certainly in the plans for the company.

“We’re not about setting quotas and we’re not money-focused,” Vacek said. “Our goal is to recruit good people to our team, educate them, and help them educate our clients. Our agents would lose sleep if they ever thought something was wrong with coverage or a claim. We do everything we can to deliver the best solutions.

We truly care about our customers and we always put them first.”

Edge: How did you learn to twist balloons?

Scott: One of my mom’s friends, Bethany, is a balloon artist and she made a giant balloon dog. It even had a leash! I wanted to learn how to do it. She sent me a few YouTube links, I went to a balloon warehouse store to buy supplies, and I started practicing. The supply store also has balloon jams once a month that I attend where other balloon artists gather and share tips and tricks.

We learn a lot from each other at those.

Cory Scott: I was blown away by how fast she can learn to do them. I asked her to make me a bicycle, and she said, ‘okay’ and then just did it.

Edge: How did you get started at the farmers market?

Scott: I started attending every Saturday and made them out of the back of my mom’s car. I have a book with photos and kids can pick which one they want.

I don’t charge, but I do take donations.

money at it. She also wants to do it for charities such as Children’s Hospital, but that hasn’t happened yet because of Covid restrictions. But she gets calls for birthday parties and other events.

Edge: What are some of your favorite things to make?

Scott: I really like making Christmas balloons, and I created my own snowman and decorated it with Sharpies.

The hardest is a snake because you have to curl the balloon. There’s also a technique called distortion, which is blowing up a balloon inside another balloon.

Christine Scott: It’s so interesting to watch it all happen!

Edge: Do you pop many balloons?

Scott: Yes! But I don’t scream anymore when it happens.

Edge: What supplies do you have?

Scott: I bought a large hand pump for $100 with my own money, lots of balloons, and a bag to keep them all organized. I love the chrome balloons and I really like the flower shaped balloons.

Edge: What other activities do you enjoy?

Scott: I’ve been playing drums since I was four and hope to play percussion in band at school next year. I also take dance lessons—jazz, tap, hip hop, pre-acrobatic, and pre-pointe.

Cory Scott: And she’s a straight ‘A’ student.

Scott: I really want to get into clowning too. I even have my clown name picked out—Sprinkles—and I have a big bow with sprinkles that I’d wear!

COMMUNICATOR Brooklyn Wrice | Senior | Papillion-LaVista High School Story by SHELLY NOSBISCH Photo by MICHELLE SLAMA Basketball is Papillion-LaVista High School senior Brooklyn Wrice’s true love. In addition to playing for her high school team, Wrice played with Omaha Sports Academy in middle school and then moved to The Basketball Factory and Retro Hoops in high school. She has had the honor of playing with many of the best in the state in the class of 2022. “I have a lot of life-long friends around the city and state as a result of playing basketball,” she said.

Playing at such a high level influenced Wrice. “I played with a lot of girls who are currently leaders on their teams across the state of Nebraska who plan to play in college, and when you play with girls like that, you learn a lot and you each take turns stepping up and lifting each other up depending on what is needed at that time.” Papillion-LaVista varsity girls basketball coach Cody Trofholz said Wrice keeps a positive attitude. “She encouraged her teammates to give their all and helped them when they may have been struggling. She always gave maximum effort. Brooklyn was an exceptional communicator for us both in practice and in games.”

Wrice plans to play basketball for Mt. Marty University in Yankton, South Dakota, and study nursing next year. Her goal is to become a nurse practitioner and serve marginalized populations. “As a young woman of color, I often struggle finding care providers that look like me and understand my unique needs. I hope to inspire other young black and brown kids to practice in medicine and to be someone they see as understanding their needs.”

Wrice is an active volunteer study participant for the Center of Childhood Deafness and the Institute for Human Neuroscience at Boys Town. “I have spent hours participating in studies to advance care in the areas of speech and hearing disorders and around the impact that trauma has on brain development.” She also helped establish the Papio PROUD group at her school, which focuses on diversity, equity, and inclusion. “As one of the several young persons of color who presented to a nearly entirely white faculty, I was encouraged by not only the receptiveness of the teachers to hear tough feedback about the experiences of the black and brown students in the school, but I was touched by the vulnerability and courage of my classmates. It was truly a gift and an experience that has strengthened my commitment to serving marginalized populations.”

Karsten Mathsen | Senior | Concordia High School Story by SHELLY NOSBISCH Photo by ADAM KANZMEIER Concordia High School senior Karsten Mathsen plays to win. “What motivates me is my competitiveness to win at everything I do,” he said. “I have had this competitive fire since I was very young. It doesn’t matter what I play, it can be cards, ping pong, knockout, anything, I play it to win.” Ken Kulus, Concordia head boys basketball coach, agrees. “Karsten is ultra-competitive and has never been afraid of big moments. He has always risen to the occasion and has never been scared of taking a big shot or stepping up to the free throw line for a big free throw. In big moments, he has always excelled.”

Mathsen’s parents were family teachers at Boys Town, so he was always playing sports with the boys on campus. “Playing as many sports as I could was highly encouraged by my parents.”

However, Mathsen had a life-changing experience his freshman year when his mom unexpectedly died. “I would not say I have overcome this and probably will never get over it in my life, but it has sculpted me into the person I am today. Never take anything for granted and truly enjoy every moment you get with loved ones.”

Playing team sports has been an important part of Mathsen’s life, and he enjoys the camaraderie of the team, both on and off the field.

“You build trust in other people,” he said. “You have to count on others to have success. The best part is that you have to work together if you want to have success and win. It can’t just be you.” Coach Kulus added, “Karsten is the ultimate student of the game. He watches as much film as I do, and usually comes up with a game plan before the coaches. His knowledge of the game is what sets him apart. He is able to call out defensive sets and alignments, he directs people into the right positions on offense, and he is the best communicator we have on our team.”

In the fall, Mathsen will be attending Northwestern College in Orange City, Iowa. “I am going to play basketball and study finance. I want to be a financial advisor and help people make good decisions with their hard-earned money.”

Undoubtedly his focus and communication will give him the skills he needs in his future career.
