Lobel, Kaufmann & Anastasia Monthly Column by Bill Kaufmann, Esquire 1-877-CYCLE-LAW www.TheBikersLawyer.com IF MY CASE DOESN’T SETTLE AND A LAWSUIT HAS TO BE FILED, WHAT HAPPENS NEXT, WHAT DO I HAVE TO DO A large percentage of our bodily injury cases are settled favorably with insurance companies without the need for us to institute a formal lawsuit against the individuals and businesses responsible for causing our clients’ injuries/damages. If we have to file a lawsuit, we always advise our clients in advance what to expect in terms of their active involvement for the lawsuit. We tell our clients that the initial involvement they will have is to meet with us at some point to provide answers to written questions about the accident and injuries and damages sent to us by the insurance company lawyer. A second area of active involvement is for our client to attend a deposition which is where our client is asked questions about the accident and injuries suffered in the accident. The client is asked these questions by the insurance company attorney but we are with the client at all times during the deposition and we always meet with the client in advance of the day of the deposition to prepare the client for all the questions he/she is likely to encounter. The deposition is usually done in our office or the other attorney’s office. Of course, we also take the deposition of the people/business responsible for the accident. A third area of active involvement usually occurs when our client is asked to attend a physical examination performed by a physician chosen by the insurance company. We always attend the examination with our client. Pennsylvania Law allows such an exam after a lawsuit is initiated. The last or fourth area of active involvement is when an arbitration or trial of the case is to take place. We will meet with the client well in advance of the arbitration or trial to prepare the client for his/her testimony that will be given at the proceeding, as well as any likely cross-examination by the other attorney. It is important to note here that the vast majority of cases that we have to file a lawsuit for will eventually result in a settlement after our client is involved in any of the above referenced four areas of involvement. Only a very small percentage of cases actually go through an arbitration and even a smaller number of cases go through a full trial. We know the litigation process can be stressful for most clients, however, we always do everything in our power to make the process work as smoothly as possible for our clients. Well, that’s it! Summer 2012 is over and it’s been a pretty busy year but the year is far from over yet. Don’t believe me check out this month’s calendar of events. There will be plenty of rides over the next couple of months before it’s time to park your bike for the winter. I’ve been enjoying getting out and riding whenever I can and from what I’ve been hearing from many of you there’s a whole lot of riding going on out there. With September comes cooler riding days, there’s been plenty of hot days this year and the oncoming autumn weather is a welcome relief. If you’re planning any long rides that take you into the evening don’t forget to take some extra clothing with you, the evenings get very cool at this time of year. I’m continuing to work on the website and I’ve got several projects under way at this time. If I can pull together all of the loose strings I think you’re really going to enjoy some of what is coming to our website. Keep tuned in. If you haven’t yet subscribed to our email newsletter go to the home page of our website www.eastcoastbiker.net and on the right side you’ll see the sign link. This is how we will keep you up to date on what is happening. I’m looking forward to some great events this month which include Lansdale Bike Night and the Motorcycle Extravaganza, there are some others that I will attend as well. Riding with the Beijing HOG Chapter Story and photos submitted by Vern Nelson

There were more than 50 bikes ready to leave the Wal-Mart th in Hatfield, PA at 6:45am on 16 of July. We were headed to a meet up with some Beijing HOG members that arrived the day before in NYC. They had 20 members with some wives and a couple of children with them. Jeff Ji of the Valley Forge HOG Chapter had arranged this the second visit of members from that chapter. The Valley Forge HOG Chapter was instrumental as sponsor of the Beijing HOG Chapter. Also in the group were a few riders from Shanghai where another HOG Chapter is being formed with sponsorship from the Bucks County HOG Chapter. We were to meet and tour Orange County Choppers. One of the Members of the Beijing chapter is opening two new OCC locations, one in Beijing and one in Shanghai. While there we saw some of the filming of an upcoming episode for the Discovery Channel. We didn’t see anyone throw anything or even do any hollering though. The next day, Tuesday, the plan was to tour center city Philadelphia. Having had a business in Philadelphia for over 15 years I volunteered to assist with the tour. I thought my familiarity with the historic part of town could be helpful, but was I mistaken. I began to sense that these folks knew very little about American history and were, to my surprise, not that interested either. After a presentation by Natalia Gamarra, of the Visitors and Convention Bureau, about Philadelphia we went to City Hall to meet David Oh, Councilmen at large, to tour the Council Chambers. David gave them a very brief and basic explanation of how our government works from the people up as opposed to from government top down. Next we went to Tiffany’s for shopping. I managed to keep my hands and money in my pocket but most of the visitors left with little bundles of precious mementos. We had lunch in Chinatown. There I sat with Li Xin and his brother Li Hong Wei and Chang Liu, wife of Li Hong Wei. Through an interpreter I learned a bit about Li Xin. He is single, the oldest of seven siblings and half siblings. He is a veteran of the Chinese Army and served in a communications unit. I told him about how I served in the Marines in Vietnam in a communications Battalion. After lunch he said through the interpreter that he would call me Comrade. I told him I would call him Buddy. We seemed to click as friends even though he spoke no English and I spoke no Chinese. That evening I rejoined them for dinner at Keen Wei Restaurant in King of Prussia after their shopping sprees at Valley Forge HarleyDavidson and the King of Prussia Mall.

On Wednesday the group meet at Dean’s HD in Souderton to get rental bikes for the week long visit. Fred Harris had rode up from St. Augustine, FL to serve as Road Captain for the group for the week. Once all the paperwork was finished and everyone had hydrated, temperatures were going to be in the very high nineties, we headed towards Lancaster and the Shady Maple Smorgasbord for lunch.

With a total of about 40 bikes we headed out with motor coach in trail with some of the wives and the children and all the luggage. Some of the Chinese riders were a bit uncomfortable on the turnpike at 70 MPH along side the tractor trailers. They don’t get that kind of riding over there. After that big smorgasbord lunch I said my farewells and headed for home. From there they were headed to York for a factory tour of the HarleyDavidson Plant, then they were headed to State College for the Pennsylvania State HOG Rally. They also planned on a visit to Gettysburg and then on to ride the Skyline Drive in Virginia before heading back to Philadelphia and then home to China. Although my time with these brothers of the road was brief I could see very easily the bond of bikers is strong, no matter what other barriers there may be. Be it geography, politics, language or culture, we could share that feeling of freedom of the road.

July’s heat and drought meant rain free riding in the tri-state area, but the record breaking heat had to be considered when planning a ride. The heat also affected road trips to neighboring states. My husband and I spent a week in Ohio to ride bicycles and look for good motorcycle roads, but we had to scramble to find a place to stay after our Holiday Inn in Mt. Vernon was closed due to lack of power. Our luck changed when we were able to find a room in the Super 8 motel further down the road . We also found some nice twisty roads as we looked for the Rails-to-trails bicycle trails in the area and traveled through interesting mid-western towns and Amish farms. Ohio residents take pride in their bicycle trail network. Each trail is paved with rest stops. Motorcycling is taken seriously too. As we moved from Mt. Vernon to the Springfield area, we found a Harley-Davidson dealership in nearby Xenia and a full service Honda dealership was just down the road from our motel in Springfield. I cannot recommend any particular road because riding on any road through the Ohio countryside was fun although the roads on gentle hills around Mt. Vernon are cooler than the ones in the Springfield area . Also the Amish farms provide different scenery from the corn and soybean fields that dominate the state. Jaded by riding in Pennsylvania, I never realized that if one avoids the cities in Ohio the entire state is a network two-lane scenic roads ideal for motorcycling. As the weather persisted, many events took place in the evening to avoid riding in temperatures over 100 degrees. July had several rallies that drew riders from other areas on the east coast. Gettysburg Bike week was held from July 12 to 15 where bands and vendors along with bike and field events took place every day. On the weekend of July 21, Carlisle Bike Fest drew riders from the Mid-Atlantic states to Carlisle, PA to watch stunt shows , view custom built bikes and enjoy food and music. Hagerstown Bike Week ran from July 5-8 where AMA Flat Track Racing took place with opportunities to relive Civil War history on rides through Antietam Battlefield on trails originating from the Civil War. Area women rode across country to the International Women & Motorcycling Conference held in Carson City, Nevada from July 26 to 29 where they attended seminars, parties and took demo rides. Every event was designed for female riders. Local clubs coped with the heat while providing a full schedule of activities for their members. Tri-State HOG ‘s calendar was filled with events and rides. The club participated in the annual Fourth of July parades of Glenolden and Norwood. Bob Daniels led the group to be in the parades. Charlie Dresden, the club’s Ride Coordinator, planned a full schedule for the club. July 1 he led a group to the First Sunday Ephrata Rally held each first Sunday of the month in Ephrata, PA. On July 7 he organized an overnight trip to Hagerstown, MD so members could attend AMA flat track races held as part of Hagerstown’s Bike Week. He also planned an ice cream run to help beat the heat on July 27 by scheduling it at 7:00 p.m from Hannum’s Harley-Davidson dealership in Chadds Ford, PA to the Woodside Farm Creamery in Delaware. The Keystone Chapter of Women on Wheels only cancelled their June 29 ride to St. Michael’s in Maryland due to the extreme heat. Several members rode to Greenville, SC to attend the WOW International Ride –In held from July 10 -12. A group also rode to Jim Thorpe, PA on July 29. The Delaware County Motorcycle Riders averaged two to three rides a week in the heat . The rides ranged from a trip to Front Royal , VA on July 8 to July 10, to Wednesday dinners like the one on July 22 at the Gas Light in Ridley Park, to day trips like Get Hot Dogs for Lunch ride on Monday July 23. A trip to the Battleship New Jersey took place on Monday, July 16, which left from the Manoa Shopping Center in Havertown, PA to ride to the ship anchored at Camden, NJ. July was filled with hot rides for riders in the Tri-State area.

Customized His Way

Doing the work himself gives great satisfaction Story and photos by Norm Keller

I always enjoy photographing bikes that were customized or built by the owners themselves. Such is the bike on this month’s cover. This beautiful ‘90 Harley-Davidson FX Softail/Springer is owned by Mike Johnston and he did most of the work himself as a labor of love. As a member of ABATE of Delaware Valley for the past 15 years Mike has been a supporter of the Philadelphia Toy Run. There’s been a lot of concern on whether the event would take place this year after 31 years of being the largest toy run on the east coast but it will be happening. Keep an eye in this magazine and our calendar of events or visit www.delawarevalleyabate.org, the ABATE website, for more information. Mike is a Navy veteran who worked as a Plane Captain on the A7E Corsair II bombers from 1982-1985. We had a good time sharing “war stories” as I was an Aviation Ordnance man while serving in the Marines. Today Mike works as a laborer for Local 57 in Philadelphia, currently working on improving the Pennsylvania Turnpike laying asphalt. You can thank Mike the next time you see him for the smooth ride on the turnpike. Mike put his natural mechanical aptitude to work when he bought this bike and began to customize it. The engine is an 88” Harley engine that has been stroked with S&S fly wheels, rods, pistons and heads to make it a high performance ride. Making a bike go faster is one thing but you also want it to look good as it’s sitting still and for this he went to JT Auto Body in Glenolden for the green flame paint job. The Samson up swept, fishtail exhaust gives it that old school look. The high handle bars and plenty of chrome finish it off making it an eye catching bike whether it’s flying by or sitting at a stop light. One more thing, Mike doesn’t trust belt drives so he added a chain drive and through out the belt. This bike is made to ride, not sit in a shop somewhere waiting for repairs. Mike takes pride in his bike and that is why he did most of the work himself, it makes it an extension of himself. This month’s cover girl comes from the ABATE family as well, her name is Brittni and she rides with her father, Mike Difiouro who is the Road Captain for the chapter. Brittni is studying to be a Physical Therapist Assistant with two more years of college ahead of her. In the mean time, to keep herself busy and to use her skills in dancing (she’s been dancing for 18 years and is trained in ballet, tap, jazz, hip hop and modern) she is a part of the “Fly Girls Dance Team” for a newly formed organization called the Philadelphia Spinners. The Spinners are a Frisbee team, the game plays a little like football on the same size field but with the Frisbee instead of the football. To find out more go to www.philadelphiaspinners.com

As many of you know our law firm has focused its practice on handling motorcycle accidents for over twenty years and although we strive to take cases where the liability is clear, there are certain cases where although the liability may be clear to us, it is not clear to the other insurance company. As a result, we are often forced to file a lawsuit against the at fault vehicle.

We do this primarily for two reasons; 1) because the offer the insurance company is making is too low based upon their version of liability and/or 2) an out right denial of liability. Depending on the facts, we then retain a motorcycle accident reconstructionist to help us put together a report which lays out, in their expert opinion, how the accident occurred, and who was at fault.

For example, I recently resolved a claim wherein my client was riding home from work in central PA and was taking a route that he has taken every day. Although he knew the road had curves in it, as he came around a right-sided curve and continued to travel within the speed limit, a vehicle pulled out of a driveway directly in front of him, causing him to apply his brakes and swerve in order to avoid a direct t-bone with the car. The other driver, who had lived in this home for many years and was well aware of the curvature of the road, pulled directly from her driveway into my client’s path of travel, causing the accident to occur. As a result, my client suffered permanent loss of smell and taste along with a broken shoulder and wrist, both of which required surgery. Although the defendant’s insurance carrier reimbursed my client for the damages to his motorcycle, once we made a demand for his injuries, it became very clear with the first offer that the insurance company was not taking our demand seriously. Suit was filed and we retained a motorcycle accident reconstructionist to begin the process of putting together a report that could be used to support our client’s version of how the accident happened. Upon being hired, our expert and his team went to the scene of the accident where they surveyed the site, took video and still photographs and conducted interviews with all of the witnesses including the ambulance staff, who are good sources of information, as they are usually the first on the scene. However, there are two sides to the story, once defense counsel became aware that we had hired a reconstructionist, they went out and hired their own motorcycle reconstructionist to put together a report in an attempt to discredit our experts report. It so happened that both experts knew ea ch other, which is not uncommon in this field. Long story short, regardless of the facts, once we were scheduled for trial and after a series of settlement conferences which included the Judge who would be trying the case, the case ultimately settled for an amount everyone was pleased with. It is not often that we are required to hire a motorcycle accident reconstructionist, however, when and if this situation arises, it is extremely important that the attorney you have retained has not only has experience handling motorcycle accidents, but also knows exactly where to look to find an experienced motorcycle expert who can deliver a report that not only supports their clients position, but the expert must also have the requisite skill to explain his findings to a Jury, if the matter goes that far, and be able to do so in a manner that the jury can understand and appreciate. Kudos go out to Pappa Jeff Campbell in putting together another successful event at the Cumberland Fairgrounds in south Jersey. If you missed it you missed a great time. All weekend the fairgrounds was filled with music, side shows and do I have to say it ..... GIRLS! Tents were set up around the fairgrounds as well RV’s and trailers of all sorts. There was plenty to eat, if yo went away hungry it was your own fault. If you went away and didn’t have a good time, well that was your own fault too. Bike shows, burnout pit, bike games and all around good fun was the order of the day. The bands I heard were outstanding and provided some of the best music I’ve heard and there was a good variety of music too. The weather played a hand in trying to dampen the weekend with showers happening around the area but it didn’t rain on party. Unfortunately the lack of support in this years event means it was the last one. Pappa Jeff worked hard all year long on the event and did an excellent job. I hope that things can work out yet and we’ll once again Party with the Jersey Devil. I read their Facebook page and it looks like a lot want it to come back, I hope it does. Call on me if you want to do it again and thanks Jeff for doing a great job.
