Our PATBI program helps people with TBI navigate legal issues that may affect all aspects of their lives, including access to medical care, housing accommodations, workplace accommodations, and accommodations in school. We ensure that people with TBI and their families have access to information, referrals and advice, individual and family advocacy, legal representation, and specific assistance in self-advocacy.

Abuse & Neglect in Long-Term Care Facility

DRNY received a complaint from a woman living in a long-term care facility who stated she was being abused. The complainant reported that she was being medically neglected, harassed, and her property was being stolen. She decided to leave the facility and go live with a relative. Upon receiving this information, the facility allegedly stopped the discharge planning process.

DRNY contacted the facility to report the concerns of abuse and neglect, and to create a discharge plan for her. We facilitated a meeting with the administration, nursing director, social work staff, our client, and her mother. At this meeting, she was able to openly express her concerns about her care and treatment.

We assisted in developing a “game plan” to begin the discharge planning process, and to make sure that appropriate care was given while she waited to move. The facility agreed to prioritize her medical needs and they established an overarching discharge plan.

DRNY continues to monitor this facility to ensure that it is meeting the client’s basic medical needs such as doctor’s appointments and hygienic care, and its discharge planning responsibilities.
