Estate Planning for Unmarried Couples

Estate planning is important for everyone, but this month’s article focuses on couples in long term relationships that have not gotten, or choose not to get, married. While estate planning documents (powers of attorneys, wills, trusts, and related documents) are important for everyone, the failure to have these documents more severely impact unmarried couples. Below are a few common situations we see and how you can prevent them.

In the event of an unexpected medical emergency (car accident, stroke, etc) of your partner, the law provides you with no automatic decision-making authority and no right to stay informed, absent your partner’s consent. And, if you are in the unfortunate (but common) situation of not getting along with your partner’s family, you could be kept in the dark or restricted from visiting your partner altogether. A simple medical power of attorney executed by your partner can give you the right to make medical decisions if your partner is unable to do so.

Furthering that scenario, on the financial side, you may be left scrambling to manage your partner’s day-to-day affairs with no access to their assets to pay their mortgage, insurance, car note, taxes, and other bills and obligations, file taxes, obtain or renew insurance, and otherwise deal with the “business” of life. A durable (financial) power of attorney allows your partner to name you (or someone else) to ensure their financial affairs are dealt with timely and appropriately.

Taking it a step further, if your partner subsequently dies without having any estate

loved one wanted you to handle these arrangements. A simple way to avoid such a situation, especially when there is conflict amongst loved ones, is to execute an appointment for the disposition of remains, which would allow your partner to designate you as his/her agent to make decisions regarding burial, cremation and related matters. If you and/or your partner are older, you might also consider simply prepaying for funeral arrangements ahead of time, which will alleviate so much of the stress of dealing with the loved one’s death.

An equally devastating (and common) issue for unmarried partners arises with jointly owned real estate when one partner dies. In Texas, when two unmarried persons purchase a home, they will generally acquire such property as tenants-incommon, which means (among other things) the property does not automatically transfer to the surviving partner when one dies. There are numerous ways to address this issue – a will or trust, a transfer on death deed, and/or a cohabitation agreement

Talking about death, unexpected medical issues, property and how we want our affairs managed can be very difficult; however, failing to do so often causes unnecessary stress and turmoil for our loved ones. I encourage you to consult with an attorney about what documents you and your loved ones may need and also talk to your loved ones about your wishes.

Easter signals springtime and provides an opportunity to gather with loved ones to celebrate. However, hosting the get-together – whether brunch, lunch or dinner – requires planning and preparation to ensure the event is enjoyable.

From the guest list and menu to the decor and activities for the kiddos, consider these steps to get ready for Easter hosting duties.

Make a Guest List

When planning your gathering, first think about how many people your space can accommodate. Ensure there’s a place for everyone to sit and eat, even if that means bringing in extra tables and chairs or designating a “kids table” so all the adults can sit together. Once you know how many people you can invite – and have a plan for seating – send out festive invitations or create a group on social media with your preferred guests to gather RSVPs.

Take Inventory of Necessities

Once you have your guest list set, take inventory of serving dishes, utensils, linens and glassware. Depending on the number of guests, you may need to invest in extra supplies or borrow from a friend or relative to ensure you have everything you need. If you don’t have enough of one set of plates and flatware, mixing and matching is a trendy move and can serve as an additional aspect of your decor.

Teen Anxiety: Normal Worries or Something Else?

is a natural part of life, it's essential to distinguish between minor anxieties that serve a purpose and those that hinder a teen's overall well-being.

Benefits of Minor Anxiety:

Mild levels of anxiety can motivate teens to accomplish tasks, meet deadlines, and navigate challenging situations. For example, feeling nervous before a test may prompt a teen to study harder, leading to improved academic performance. Additionally, minor anxiety can help teens develop resilience and coping skills, preparing them to handle future stressors.

Identifying Problematic Anxiety in Teens:

While some anxiety is normal, it's essential to be aware of signs that indicate a teen may be struggling with problematic anxiety. Here are some key differences between typical teen behavior and problem anxiety:

Frequency and Intensity: While it's common for teens to experience occasional worries, problematic anxiety is characterized by persistent and intense feelings of fear or apprehension making it challenging to function in daily life.

Physical Symptoms: Physical manifestations of anxiety, such as rapid heartbeat, shortness of breath, trembling, or stomachaches, are common in both minor and problematic anxiety. However, teens with excessive anxiety may experience these symptoms more frequently and intensely, often without an apparent trigger.

Impact on Daily Functioning: Minor anxiety typically does not interfere with a teen's ability to engage in daily life. In contrast, anxiety disorders can impair their functioning in various areas of life, leading to academic difficulties, social withdrawal, or avoidance of certain situations.

Duration: While minor anxiety tends to be short-lived and resolves once the stressor is removed, problematic anxiety persists over time and may worsen without intervention. Teens with anxiety disorders may ruminate excessively about their worries, leading to chronic distress and impairment.

While minor anxiety can be a natural and adaptive response to stress, it's essential to recognize when anxiety becomes problematic and requires professional intervention. Time for Financial Spring Cleaning?

Spring is almost here, which means it’s time for some spring cleaning. This year, in addition to tidying your home and surroundings, you might want to consider sprucing up your financial environment, as well.

Here are some suggestions for doing just that:

• Improve your vision. Once the days are warmer and longer, you may want to get outside and clean all the winter grime and smudges from your windows, allowing

• Plant seeds of opportunity. Whether they’re planting camellias and crocuses or carrots and cilantro, gardeners are busy in the spring, hoping their efforts result in lovely flowers and tasty foods. And when you invest, you, too, need to plant seeds of opportunity in the form of investments that you hope will grow enough to enable you to make progress toward your goals. So, you may want to review your portfolio to ensure it’s providing this growth potential, given your individual risk tolerance.

• Reduce dangers. You may not think about it that much, but your home and surroundings can contain potential hazards. You might have ill-fitting caps on cleaning products with toxic chemicals, or sharp cutting instruments protruding from shelves in your garage, or heavy, cracked tree branches hovering close to your roof. Spending some time on a spring-cleaning sweep can get rid of these dangers — and devoting time to consider the possible threats to your financial security, and those of your family, can pay off, too. For starters, review your life insurance to determine if you’ve got enough. Your employer may offer some coverage as an employee benefit, but it might not be sufficient, so you may need private coverage. And the same is true for disability insurance, because if something were to happen to you, and you couldn’t work for a while, you’d still want to protect your family’s lifestyle.

Bonding with Your Four-Legged Friend

Your dog may be one of your best friends, but that bond doesn’t happen overnight. Investing in quality one-on-one time can have a big impact on the bond you build with your four-legged companion.

One of the best ways to show dogs love is by keeping them healthy and spending quality time with them. Dedicating time every day to your dog’s well-being can help establish a connection, give you opportunities to express affection and foster shared bonding moments.

Training

Teaching your dog obedience isn’t just about eliminating undesirable behaviors. Training allows you to clearly communicate your expectations to your dog. It also builds your dog’s confidence through positive feedback received after mastering a command or new trick. Most dogs thrive on meeting their owners’ expectations, so consistent commands they can recognize and follow help deepen your connection.

Another way to build trust through behavior training is establishing regular routines. Giving your dog a clear set of expectations helps build mutual trust. You can create routines around the key milestones of each day, such as mealtimes, walks and bedtime.

Grooming

Some pets love bathtime; others avoid it at all costs. Either way, you can make the experience more rewarding for you and your pet if you use it as an opportunity to spend some quality time together and shower your pet with extra affection.

Many pets are especially sensitive to grooming near their eyes, but keeping the eyes clean and free of dirt and buildup may help reduce the risk of infection, reduce tear stains and support your dog’s eye health. Exercise

Your dog needs daily exercise, just like you. Make your workouts do double duty by taking your dog along for a walk or jog. Also be mindful of the terrain and ensure your pet’s paws are safe from potential risks like sharp or abrasive surfaces and extreme heat or cold.

Down Time

While dogs need plenty of practical attention and structure, some of the best bonding comes from letting loose and simply enjoying interacting with your pooch. That might mean wrestling with a favorite toy, throwing a ball or just snuggling on the couch with plenty of petting and scratches.

A Sweet St. Patrick’s Day

Even if you’re not Irish, a green treat like this Luck o’ the Irish Mint Pie can get you and your guests into the festive spirit. With enough seasonal flavor to go around, this recipe makes two pies, so be sure to cut every leprechaun a generous portion.

Luck o’ the Irish

Mint Pie Recipe

Makes: 2 pies (9 inches each)

3 3/4 cups heavy whipped cream, divided 8 ounces cream cheese, softened

1 1/4 cups, plus 2 tbsp, powdered sugar

5 drops green food coloring

1 1/4 tsp vanilla extract, divided 1/4 tsp mint extract

1 bag mint chocolate candies, chopped

2 chocolate cookie crusts (9 inches each)

1 bag mint chocolate candies

To make filling: In bowl of stand mixer, whisk 2 1/2 cups heavy cream until stiff peaks form. Transfer to bowl.

In separate stand mixer bowl, beat cream cheese on high 2 minutes. Gradually add 1 1/4 cups powdered sugar and green food coloring; mix until smooth. Add 1/4 teaspoon vanilla and mint extract; mix well.

Fold prepared whipped cream into cream cheese mixture. Fold 1 cup chopped mint chocolate candies into filling.

To make frosting: In bowl of stand mixer, whisk remaining heavy cream and remaining powdered sugar. Add remaining vanilla extract and mix until stiff peaks form.

Pour filling into crusts and smooth tops.

Fill decorating bag with frosting and pipe thick band around edges of pies. Then pipe circle dollops evenly around edges of pies.

Scatter 1 cup chopped mint chocolate candies in middle of pies. Place whole mint chocolate candies into each dollop of frosting around edges of pies.

Refrigerate until firm, 5-6 hours.

Meet The Team

Joan Imperato is a native New Yorker and moved from Pelham Manor, New York with her husband Ralph and their three young children, Ted, Jon and Alison and made Kingwood their home in 1982. Her family became very active in the community in school activities and sports and fell in love with everything Kingwood had to offer. In 1985, Joan began her real estate career. She immediately began to learn everything she could about Kingwood/Humble real estate. She was determined to be the go to person as her friends asked her for help with their real estate needs. Her desire to learn and educate herself and her clients continues to the present day. She has assisted over 3500 families and giving them the best service she can has always been her mantra. Among other awards, she was honored as the first woman in Texas to receive the Luminary of Distinction award. Her business is her passion and her family, including 10 grandchildren is her joy. She loves to cook for them and friends as well as volunteer for many organizations. She has been active with Mothers Against Cancer for 20 years, Family Time, past president of Donne Di Domani and past board member of Just About Kids. She and her family have been parishioners of St Martha’s Church since 1982.

Beth Ortiz has called Kingwood home for 28 years, alongside her husband Flavio, as they lovingly raised their two daughters. Jen grew up in Kingwood (since 1973) and has a vast knowledge of the area. Cindy Steinkamp and her husband Rick have lived in Kingwood for 25yrs. Rick is retired military after 27yrs so Cindy is tuned in and understands helping veterans and their families with their unique real estate needs. They have raised 3 boys in Kingwood. Matt being the oldest has his own successful marketing company called Square Frame Media in Georgia. Alex the middle son just graduated from Colorado State University and currently in the police academy in Colorado. Andy the youngest is a senior at the University of Utah studying International Business. After raising 3 active boys here she has volunteered in every aspect of their lives from swim team to Scouts! Being long time members of First Presbyterian Church Kingwood has also been an important aspect of their lives. Now being empty nesters the Steinkamp’s love to travel all over the world as a family.

There are so many places in the world to live but there is only one home. Liz Olsen, originally a Coloradan, has made her home Kingwood, TX. Her overwhelming love for Kingwood began precisely two minutes after driving into the tree lined streets in 2006. Her affection has grown over many years as she and her husband have raised their four kids in the “livable forest” experiencing all the amazing schools, parks, greenbelts & of course the trees! Liz loves to get involved with her community- she is a member of Mothers Against Cancer, on the HOSA board, NCL and many sports and school activities with her kids. While she loves all things Kingwood she realizes there are many fantastic places to live in the Greater Houston area. She wants to find the place that feels like home to her clients. She is an agent with big determination but a simple goal: Help her clients find home.

Anna Salton Eisen is the author of The 23rd Psalm: A Holocaust Memoir, The Twentieth Anniversary Edition (A National Jewish Book Awards Finalist in 2022) and Pillar of Salt: A Daughter’s Life in the Shadow of the Holocaust. She is the daughter of two Holocaust survivors and executive producer of the upcoming documentary film In My Father’s Words based on both of her books. Her writing has been published in The Jerusalem Post and The Forward, among other publications. As the founder of Congregation Beth Israel in Colleyville, Texas, site of the antisemitic synagogue hostage crisis in January 2022, Anna has been featured in numerous major news outlets, including CNN, The New York Times, The Washington Post, and Fox News.
