ARTICLE 36 HEALTH BENEFIT FUND SECTION A – SCHEDULE OF CONTRIBUTIONS 1. The purpose of the Health Benefit Fund (Fund), as described in Section F, is to provide health and welfare benefits to active employees and eligible retired employees from the bargaining unit. Except as provided in Sections B and C of this Article, the Authority agrees to pay into the Fund according to the schedule set forth in Section A, Subsection 2 below, amounts per month per employee or eligible retiree covered by this agreement, as well as for new employees, beginning with the first day of the calendar month following 60 days of continuous employment. These amounts will be used to defray the costs and authorized expenses of the Fund designed for the benefit of the employees and eligible retirees represented by the Union. 2. The authority shall make a one-time payment of $3,600,000.00 to the Health Benefit Trust Fund, payable thirty (30) days after ratification and approval by the LACMTA Board of Directors. The authority shall make the following monthly contributions to the Health Benefit Trust Fund: March 1, 2013 Active Employees Eligible Retiree under age 65 Eligible Retiree age 65 and over

3. The sole obligation of the Authority is to make the monthly payments at the levels set forth in paragraph 2 above. Should the Fund be financially unable to provide or continue health plan coverage at the then current levels, it shall be the obligation of the Fund either to reduce the levels of coverage or seek contributions from employees and/or retirees or sources other than the Authority. The Fund's assets and income are to be used solely to provide health and welfare benefits to those employees, retirees, and their dependents identified above and pay reasonable expenses of administering the Fund. 3.
