BOONEVILLE — The family of a Booneville man who died last spring after being shot during an altercation with police officers has filed a civil lawsuit against the officers involved and the city of Booneville.
The sons of David Andrew Curtiss filed the suit in federal court in Aberdeen against Booneville police officers Rusty McCoy and Brian Mays and the City of Booneville last Wednesday. The family is seeking damages in excess of $150,000 for the violation of Curtiss’ civil
rights through the use of excessive force and other violations. Curtiss was shot and killed by McCoy on April 23, 2012, as officers responded to a 911 call reporting a domestic disturbance outside of his ex-wife Cheryl Curtiss’ home at 201 Stanley Street Extended.
Evidence in the case was presented last year to a Prentiss County Grand Jury which cleared the officers of any criminal wrongdoing. The family’s lawsuit claims Curtiss was unarmed and did not present a threat to McCoy when he approached him out-
side the home. The filing, which provides only the family’s side of the legal argument, states Curtiss was complying with McCoy’s orders when Mays shot him with a Taser stun gun. They claim McCoy then shot Please see LAWSUIT | 2A

Alcorn County’s changeover from the landfill to the transfer station for rubbish disposal is coming up next Thursday. Purchase Clerk Paul Rhodes said the county wants to remind residents of the Aug. 1 change and notify them of a slight difference in hours that comes as Waste Connections begins handling rubbish disposal at the transfer station. Hours will extend slightly compared to those that were offered at the landfill on Proper Street. At the transfer station on South Harper, hours will be 7 a.m. to 5:30 p.m. Monday through Friday and 8 a.m. to noon on Saturday. Residents will pay a $5 fee for disposal of normal loads while those bringing larger loads will pay a tipping fee of $22.98 per ton. Waste Connections is preparing the transfer station for opening, and the county is moving some equipment from there to the landfill where it will be cleaned up and likely sold. The county
Corinth Mayor Tommy Irwin will be in the driver’s seat on the Mississippi Municipal League’s Legislative Committee for 2013-2014. MML President Tim Waldrup, who is mayor of Ellisville, appointed Irwin to chair the committee. In that role, Irwin will lead the MML’s lobbying efforts during the upcoming 2014 session of the Legislature. It will be another opportunity to talk about his top issue, infrastructure. He was an outspoken proponent of an optional sales tax for cities through a Citizens for Economic Development Act during the last legislative session. “The pursuit to get income to help cities rebuild infrastructure is going to be at the top of the list,” said Irwin. While CEDA failed to pass in the 2013 session, Irwin expects another big push for the legislation in the upcoming session. “Basically, all of the cities in Mississippi are like Corinth — we’ve got to have a way to fix infrastructure,” he said.

Construction is underway on the stretch of U.S. Highway 45 that passes through Corinth. The $4.2 million project will provide a new overlay from just south of the Harper Road exit to the Tennessee state line. Approximately 17,000 cars pass through this section of U.S. 45 each day, said Northern District MDOT Commissioner Mike
Tagert. “This is an important corridor, not only for Corinth and Northeast Mississippi, but the entire tri-state area,” said Tagert. “A tremendous number of people pass through this area, and that is an indicator for economic growth.” Tagert said the project has been in the works for a number of years. “We do continuous monitor-
ing of the roads. Cracks and potholes are used as a measuring tool to prioritize the route,” said Tagert. “We’ve wanted to do this for the last couple of years.” The estimated finish date for the project is Sept. 10. Tagert said he believes the construction crews will meet the date. The project is funded jointly by the state and federal government. The contract was awarded to APAC Mississippi.

On Tuesday the Mississippi Association of Career and Technical Education honored Kossuth graduate John Andrews as the state’s Outstanding CTE Student for 2013. Andrews accepted the award at the state conference in Pearl. The award includes a $500 scholarship. He was nominated by Richard Turner, director of the Alcorn Career and Technology Center. “John is very deserving of this honor because of the caliber of student he is,” said Turner. “He has an excellent work ethic, positive attitude, friendly disposition, and has excelled in his
career and technical programs.” Andrews is a 2013 graduate of Kossuth High School and the son of Rodney Andrews and Jennifer Campbell. He has completed the Teacher Academy program at the Alcorn Career and Technology Center as well as two AEST courses at KHS. He has participated in the Career Pathway Experience at ACTC. The award-winning recent grad was involved in a wide range of school activities. In addition to being elected 2012-13 Mr. Kossuth High School, he is a member of the Future Educators Association (FEA) and the Future Farmers of America (FFA). He served as career del-
egate at that Alcorn Career and Technology Center and was selected as one of the ACTC’s Students of the Quarter, Rotary Student of the Month, ACTC’s Outstanding Nontraditional Student and ACTC’s Student of the Year for 2013. Andrews and teammates in the Kossuth FFA won second place in the State Livestock Judging Contest and first place in the State Dairy Evaluation Contest this year. Andrews won the State Champion Individual Overall in both contests. He was also a state competitor at the state FEA conference. As a member of Wheeler
