About four months ahead of the trial date, a number of motions are pending in the Kmart flooding lawsuit. Several defendants have motions for summary judgment on the table, and motions seeking to exclude certain expert testimony are also pending. The trial is set for February in U.S. District Court. The Kmart Corporation seeks compensation for flood damage in the May 2010 deluge. The remaining defendants are The Kroger Co., E&A Southeast Limited Partnership, Fulton Improvements and Kansas City Southern Railway Company. Among the numerous recent filings, in a motion for summary judgment, Kansas City Southern Railway Company argues that Kmart can offer no admissible evidence that the railroad failed to adequately inspect and maintain its bridge over Elam Creek and that the plaintiff has no evidence of debris under the bridge at the time of the flood. Motorists creep along Main Street just before dusk. Faces are plastered against windows as individuals slowly make their way past the 816 address. Billy Hill is responsible for the curiosity. The 38-year-old has captured the attention of area residents with a huge Halloween display that spills from
his girlfriend’s rented home to the yard next door. “I have always been a Halloween and Christmas fanatic,� said Hill as he surveyed his creation on Monday. “Even as a kid, I just loved those two days.� As people travel past the home, they can see the Haunted Valley Cemetery, a guillotine, dangling heads, a masked spook performing surgery and several other fun spooky things
such as a crawling man and Rotten Realty sign in the yard. The display is so large that it goes into the yard of home owner Jana Arnold. “I kind of worried about how people would react to it here,� said Hill, who started the decorating around three years at his home in Eastview, Tenn. “I didn’t want to stir up any controversy.� He didn’t.

Handmade items from the heart can be crossed off the Christmas wish list at this week’s Crossroads Craft Guild Holiday Marketplace. The growing annual sale, now in its 27th year, will be held at Harper Square Thursday through Saturday. Hours are 2 to 6 p.m. Thursday, 10 a.m. to 6 p.m. Friday and 10 a.m. to 3 p.m. Saturday. Guild members such as Traci Underwood, who offers jams, jellies, salsa, homemade zucchini and banana nut breads with her mother, enjoy coming together with others to offer locally made items for gifting or for decorating for the season. “The crafters range from my eight-year-old daughter Bailey that does hair ribbons to middle age like myself to those that are retired and craft as a hobby,� she said.
