Judge orders analysis of Zillow computers A Seattle judge has ordered a neutral, independent forensic analysis of employee computers at Zillow, appearing to bolster allegations that the company stole trade secrets from realtor.com®, its leading competitor, and attempted to destroy the evidence.

Realtor.com® operator Move Inc. and the National Association of REALTORS® filed suit against Zillow last year, claiming two top Move executives shared confidential information with Zillow before accepting high-placement positions there. Former realtor.com® President Errol Samuelson and former Move Executive Vice President of Industry Development Curt Beardsley engaged in deceptive and unlawful conduct by passing highly sensitive information to Zillow CEO Spencer Rascoff and others in the run-up to their March 2014 departures from Move, the suit alleges. The information they shared related to a then-con-

fidential potential transaction between Trulia and Move, as well as multiple business initiatives being undertaken by Move in support of realtor.com®. Samuelson and Beardsley are also named as defendants in Move and NAR’s suit.

Move and NAR have repeatedly alleged in the lawsuit that Zillow and its personnel hid and destroyed evidence to cover up unlawful conduct.

The forensic investigation of Zillow computers, to be led by a court-appointed forensic expert, will include USB devices, e-mail accounts, Zillow computers, and personal computers and tablets used by Samuelson and Beardsley.

NAR General Counsel Katherine Johnson says the judge’s order is another positive step that will help the association and Move prove its case.

Interest rates may remain lower longer than originally expected. The Federal Reserve released recent comments that suggested it may continue to hold off in raising short-term interest rates and weaker-than-expected consumer demand is all pushing Treasury yields lower.

Home owners trump renters in wealth Home owners’ net worth is significantly higher than renters. A typical home owner’s net worth is $195,400 compared to a renter’s $5,400, according to the Federal Reserve’s last data from 2013.

The Fed’s next survey of household finances, which is conducted every three years, is due out in 2016 and the renter to home owner gap is expected to widen further due to price increases.

Lawrence Yun, chief economist for the National Association of REALTORS®, predicts the figure to jump to $225,000 to $230,000 in median net worth for home owners in 2016 and around $5,000 for renters.

If that proves correct, the typical home owner will be ahead of a typical renter by a multiple of 45 on a lifetime financial achievement scale.

“Though there will always be discussion about whether to buy or rent, or whether the Yun stock market offers a bigger return than real estate, the reality is that home owners steadily build wealth,” Yun writes in his latest column for Forbes.com. “The simplest math shouldn’t be overlooked. A vast majority of home buyers take out a

30-year fixed rate mortgage to make a home purchase. After 30 years, there is no mortgage payment (nor rent payment). So the home price growth over that time period would be the equity that the home buyer would have accumulated.”

The majority of Americans do aspire to be home owners and the home ownership rate increases significantly through age. For example,

the home ownership rate among households under the age of 35 is 35 percent, but by the time people reach their prime-earning years of 45 to 55, nearly three-fourths are home owners. By retirement, nearly 80 percent are home owners, Yun notes. © Copyright National Association of Realtors.

Coldwell Banker Residential Brokerage was a proud Sponsor of The Colorado Springs 5k & Half Marathon Presented by Penrose-St. Francis Health Services that was held on September 27, 2015. In covering the 13.1 miles, runners toured the heart of Colorado Springs and passed through some of the city’s most beautiful and historic areas, such as The Old North End, Colorado College, America the Beautiful Park, Monument Valley Park, Memorial Park, and the Olympic Training Center. There were 957 registered runners and the fist runner for the Half Marathon finished in 1:06:25. Coldwell Banker Residential Brokerage had more than 25 agents volunteering at the event working the aid stations and handing out food at the end.

Sellers are more confident they’ll make money Home owners’ fear of selling their homes for less than what they paid is abating, as sellers grow more confident that they’ll recoup the amount they spent. Over the past two years, their confidence has grown 29 percent, according to a survey conducted by the National Association of REALTORS® of 1,000 adults in the nation’s 50 largest metro areas.

Seventy-one percent of home owners disagreed with the statement: “I do not think I could sell my house for what I paid for it.” That is up from 55 percent in 2009, 2010, and 2013.

Only 27 percent agreed with that statement, which is down from 42 percent in 2013, according to NAR. Sellers’ confidence will likely extend into next year too. Four in 10 Americans surveyed say they expect home prices to rise in their market over the next year.

Only 23 percent said they would like to move but don’t think they could sell their house in the current market, down from 38 percent two years ago. Some 74 percent of owners said that would like to move, but think they could sell their house, an

increase of 17 points over last years.

We’re grateful the court in Seattle has appointed a forensic expert to search for more indications of unlawful conduct,” she says.

Zillow filed a counter lawsuit against Move and NAR earlier this year after former Zillow Vice President Chris Crocker sent a whistleblower letter to Move detailing Zillow’s alleged attempts to steal realtor.com® databases and hide intellectual property in cloud storage accounts. A database was later located and produced in the case by Zillow. The metadata from the database confirmed it was indeed created and maintained

by Move but was accessed by a user identified as “Curt” before and after the date Beardsley joined Zillow in March 2014.

Zillow claimed in its countersuit that the letter, which was publicized in the media, contained falsehoods as well as trade secrets that hurt Zillow’s reputation and competitive position. National News Rates from 1 Freddie Mac reports the following national averages with mortgage rates for the week ending Oct. 15:

30-year fixed-rate mortgages: averaged 3.82 percent, with an average 0.6 point, rising from last week’s 3.76 percent average. A year ago, 30-year rates averaged 3.97 percent.

15-year fixed-rate mortgages: averaged 3.03 percent, with an average 0.6 point, increasing from last week’s 2.99 percent average. Last year this time, 15-year rates averaged 3.18 percent.

5-year hybrid adjustable-rate mortgages: averaged 2.88 percent, with an average 0.4 point, holding the same as last week. A year ago, 5-year ARMs

averaged 2.92 percent.

Local News Harvey named CAR Realtor of the Year George Harvey, broker/owner of The Harvey Team in Telluride, Colo., was named Colorado REALTOR® of the Year by the Colorado Association of REALTORS® (CAR) at its 95th annual convention in Keystone, Colo. The award is the most prestigious award given to a CAR member and is a culmination of a distinguished career within the REALTOR® organization— at the local, state and national levels.

In addition to activity within the association, the REALTOR® of the Year is a person active at the community level and successful in business.

A REALTOR® member since 1984, Harvey is a two-time Telluride REALTOR® of the Year (1993, 2007). With countless hours of volunteer time, he has proactively served his community and his industry for more than 30 years and has held a wide range of leadership positions at the local, state and national level throughout his career.

Harvey’s leadership includes serving as president of the Telluride Association of REALTORS® and president of the Colorado Association of REALTORS® in 2009-10 where he has also served on the executive committee.

Dawn become the woman and leader she is today; an inspiration to all business professionals. Roughly 30 years ago she began her journey by creating a successful advertising agency, For Your Image, in Fort Myers, Florida. As part of her dream, Dawn started the GEMS high school and college internship program for area students. This program gave area youth an opportunity to gain skills in marketing, graphic design, team building, and leadership.

After moving to our beautiful Colorado Springs, Dawn upheld her values in “education, leadership and relationships” by serving on the Board of Pack 83 of the Boy Scouts of America and volunteering in the D11 Schools attended by her grandchildren.

The promises Dawn has made as part of her presidential installation are based on the same values she has been practicing for the last 30+ years. Her work ethic is beyond reproach as demonstrated by her rise through our local real estate community. Dawn has Linda Schierholz Kathy M. Tutko been honored to receive the Local Chapter Immediate Past Treasurer President 2014 WCR Realtor Member of the Year award and has earned her GRI, CNE and CMRS. Haunted Houses It was a dark and stormy night, one of many in our real estate market between 2008 and 2011. Fear had spread across the land as property values plummeted and foreclosures exploded. Our communities became exposed to zombie borrowers, robo-signers, ghost inventory and dead deals. In a very short by michael podoyak time, we went from Happy Days to Nightmare on Easy Street.

Empire Title — But the foggy special effects have since cleared, and Colorado Springs is nowhere close to becoming a ghost town. In fact, our real estate market has improved so much that it’s downright scary – you could even say it has become Boo-tiful.

In the month of September this year, there were 3,215 active listings in the Pikes Peak Multiple Listing Service. Even though that represented a 5-month consecutive increase, the number of listings averaged over the previous 12-months was 2,952 for the month – by far the lowest average for at least a dozen years or more. Arrggghhhh – limited supply!

Of course, the relative lack of product on the market helps to drive up property values, which in turn, increases home equity. That helps to contribute to a drop in foreclosures – Ewwwww! In September of this year, only 95 foreclosure notices were filed in El Paso County – that is 4% fewer than the previous month, 15% fewer than the previous September and almost 24% fewer year-todate than the same period one year ago.

So, instead of vacant “haunted” houses in our neighborhoods, we now have sought after “hunted” houses across our region. And that boils down to one very important thing: better opportunities for Trick-or-Treating! Eeeeek!
