In Spain, the only tax that applies to the purchase of a resale property is the transfer tax (Impuesto de Transmisiones Patrimoniales/ITP in Spanish).

10% + 1.2%

This is the tax levied on properties and annexe elements purchased directly from the developer (new projects).

21% + 1.2%

For plots or items not attached to properties, such as a detached garage, this tax rate applies.

NOTARY and REGISTRY FEES

Between €2.500 - €5.000

Notary and registration fees vary depending on certain elements of the property and the purchase transaction.

LAWYER’S FEES

1% + IVA

Lawyers charge a percentage of the purchase price, usually 1%, although this may vary with some lawyers and depending on the price of the property. We always recommend hiring a qualified solicitor to represent you to do the due diligence on the property and to advice you on all tax issues.
