UP POLLUTION CONTROL BOARD: APPLICATION FOR NO OBJECTION CERTIFICATE What is UP Pollution Control Board? U.P Pollution Control Board is an organization having statutory nature endowed with the responsibility to implementing rules and laws pertaining to Environment. It falls under the jurisdiction of Uttar Pradesh State, India. The Water (Prevention and Control of Pollution) Act of 1974 gave birth to the Uttar Pradesh Water Pollution Prevention and Control Board, which was constituted on February 3, 1975. In addition to other duties under the Environmental Protection Act, 1986, under the 1977 Water (Prevention and Regulation of Pollution) Cess Act, the Board was vested with numerous powers and functions.


Application process for getting NOC Online application for NOC from up pollution control board can be obtained in the following manner: 1) An application has to be filed in accordance with the manner prescribed by the board. 2) There has to be submission of following details along with the form: a) Project related details b) Pollution reduction plans c) Registration certificate that has been issued by the industrial department 3) Submission of application to be made either to: member secretary or to the General Manager of District Industrial Centre. 4) 25 regional centers facilitate the process of application submission. Functions of UP Pollution Control Board Major functions of the board target to prevent, control and abate air and water pollution and assist businesses and entrepreneurs in meeting their regular basic environmental conservation obligations. The following functions performed by the board as under different legislations including that of Environment Protection Act, 1986: 1) Issuance of NOC keeping in mind environmental pollution 2) Issuance of consent with respect to section 25/26 of the Water (Prevention and Control of Pollution) Act, 1974. 3) The issuance of consent regulated by Section 21 of the Air (Prevention and Control of Pollution) Act of 1981 4) Assessment and collection of Water Cess, under the provisions of Water (Pollution Prevention and Control) Cess Act 1977. 5) Air quality assessment 6) Inland surface waters quality assessment 7) Awareness programs at mass level 8) Notification pertaining to standards of effluent and emission 9) To develop technologies pertaining to control of pollution 10) To institute action on legal basis against defaulters 11) Issuance of authorization detailed under Hazardous Waste Management Rule, 1989. 12) Implementing Biomedical Waste Rules, 1998. 13) Under the Manufacture, Storage, and Import of Hazardous Chemicals Regulations, 1989, identifying isolated storages and devising plans to handle onsite crises.


NOC from pollution control board Before the establishment of any industrial unit, pertaining to legalities of pollution control, all industrial units are required to seek “Consent to establish” i.e. NOC from the angle of pollution of environment. An application format is prescribed in this respect which is required to be submitted simultaneously with the documents deemed necessary enclosing information like: 1) Details of site 2) Plans to execute pollution control 3) Issuance of registration certificate from Industrial related department Application deemed complete needs to be submitted to either of the following: 1) General Manager 2) District Industrial Center (GM, DIC) 3) Member Secretary To be able to ease the method of acquiring NOC, decentralization of power to issue NOC is done by the board, further it has been delegated to the G.M, DIC and Regional officer, UPPCB. Is NOC required by all industries? NOC requirement need not to be fulfilled by all industries since certain industries according to be nonpolluting are subject to exemption. 221 industries enjoy the exemption status including that of software industries. How to fetch the NOC application? The official application is made available directly from the UP Pollution Control Board's official website. Both Hindi and English versions of the application form are available.


Documents to be furnished along with the application To be able to acquire the consent to establish certain documents are required to be attached along the form: 1) A cover letter specifying the type of business that the industry plans to carry out followed by allied activities. 2) Acquired copy of sale or lease deed by the company 3) In case of company, submission of memorandum of article has to be made and in case of partnership firm, the partnership deed need to be submitted. 4) Industry’s layout plan accompanied by details about: a) Equipment’s b) Plan to treat sewage c) Layout plan pertaining to building 5) A schematic diagram needs to be submitted regarding forests areas, residential areas, agricultural areas etc. present within the vicinity of 2kms of the industry 6) Full descriptions of the production process of each product to be manufactured by the industry. 7) Details with regard to material balance of the product produced by the industry. 8) certificate copy pertaining to land use 9) Chartered Accountant’s certified auditor certificate. 10) Information pertaining to balance of underground water 11) Consent fee copy that is payable under the Air and Water Act to the board. 12) Groundwater report copy 13) Sewage treatment plant (STP) proposal with full descriptions of the treatment technique that can be used and the mode of waste disposal by different units 14) Proposal for the installation of effluent treatment plants in the industry 15) A measure that will be adopted to regulate air pollution. 16) Data on the safety of products and steps to be taken in the event that hazardous chemicals are used as a material in the manufacture of any product. 17) MOEF’s Environment Clearance Certificate. 18) Proposal with respect to the purpose of installing a monitoring system based online for discharge of effluent of liquid disposal and air emissions. 19) Proposal pertaining to the setup of an online monitoring system for discharge of effluent. 20) Other statutory clearances like forest area clearance or eco-sensitive zones as applicable in the area. Appeal against order of UP pollution control board National Green Tribunal is a forum where any order passed by UP pollution control board can be challenged. The limitation period being 5 years to file a suit.
