Over 15 Years Experience As A Licensed Real Estate Agent/Broker Question:In Today’s market, What do you think about Renting or doing a Lease Purchase? We all know the ups and downs of renting, but few really understand the benefits of a Lease Purchase. If you are even considering doing a lease purchase, first check your Security Deed to see if there are any stipulations to prevent you from being able to do one. If you are still not sure, consult with the lien holder, your closing attorney or contact me and I will help you determine whether you can or not. The down side on a lease purchase is if the lien holder does not allow it they could foreclose on you. Not only that, the Buyer could do damage to the property and then not close. The lien holder foreclosing on you is probably highly unlikely in today’s market if the payments are being made on time. The benefits of a Lease Purchase is the fact that you normally get a down payment of around 5-10% and a monthly payment each month until you close. A word to the wise is you may want to be sure your mortgage payment is at least covered each month with the monthly payment. The benefit to the buyer is the buyer will receive a small amount of the monthly payment as a credit towards the purchase amount. This amount is determined in negotiations. You want to make sure it is in writing that if they don’t close for any reason after they move in, they will lose the down payment and any payment credits that they paid. Other benefits include that if they quit paying you do not have to foreclose on them to get the property back, you simply file an eviction since the title to the property never changes until actual closing. It gets even better, if you evict that person you can then do the same thing again and again and get a down payment each time you lease. This could result in a higher profit on the home.
