Brian Spencer, with the Colorado Department of Health and Environment, said the state health department is closely monitoring the increase in pediatric hospitalizations caused by group A strep.
Group A strep is a bacteria that can cause many di erent infec-

tions. Group A strep infections most commonly cause sore throat, a mild and common condition that doctors say can be easily treated. While rare, group A strep infections may be severe and cause diseases like pneumonia, sepsis, toxic shock syndrome and necrotizing fasciitis.
“We are working with hospital partners in a coordinating role to ensure resources are available for those
who need them,” Spencer said in the Dec. 15 news release.
According to the state health department, two school-age children with group A strep died in the Denver metro since Nov. 1.

That changed in the spring of 2019 after the city discovered that as many as 24 boat owners had circumvented the city’s quarantine protocols, potentially exposing the reservoir – the main drinking water supply for the cities of Westminster, Northglenn and Thornton – to invasive Zebra and quagga mussels.
Westminster banned powered
boating on the reservoir, and the ban was strengthened months later by an intergovernmental agreement signed by the three cities. Powered craft, from jet skis to larger motor boats, were banned. Smaller hand powered draft – canoes, kayaks, paddle board and shells that can be easily inspected and cleaned – are still allowed.

“It was like going to your family if you had a private lake,” Gary Gambino, a former boater on the lake.
Many members of Standley Lake’s boating community saw a huge aspect of their community taken away with the ban of trailered boats in 2019. Gambino used to work a graveyard shift and after, went straight to the lake.
“I would come home, hook up my boat, go out onto Standley, take it out in the back bay anchor in and take my four hours of sleep,” he said.
He saw the boating community as a family unit. Everyone was willing to help each other and got to know each other very well.
His son, Vincent Gambino, grew up in Arvada and had many boating friends. ey used to bring their boats and camp in the park.
Gary Gambino said the community promoted camaraderie and was important for kids growing up in the area. It taught them respect and provided a learning opportunity on multiple fronts, including safety.
Having it taken away was “horrendous.”
Mike Bakarich bought a boat that cost more than $50,000 for the lake just before it was outlawed. His parents learned to water ski on the lake, then he grew up learning how to
water ski on the lake and wanted to pass it down to his kids. Now, that’s not possible.
“It’s just a huge resource that was taken out of Je erson County,” he said.

Bakarich drives to Boulder but it proves tough with three kids. He said Colorado has limited lakes and saw Standley Lake as a hidden gem for boating.
“I can’t say that that was the wrong decision for the city and the parties involved, but I will say that it does hurt,” Bakarich said.
For Lee Merritt, the loss of boating at the lake meant moving north to Lone Tree reservoir and talks of divorce.
“It put our family through a lot of strain, a lot of stress. Talks of divorce here and there and you look back on it, and it all started with Standley Lake closing. If it hadn’t closed we would have just stayed in our house. We were very happy where we were. I think our entire life would be di erent,” he said.
Merritt sat on the committee that tried to come up with a solution to maintain water quality while still allowing boats in 2019.
“I kind of feel like the committee that we were on was put in place as kind of a dog and pony show and just to kind of buy time until they redid the IGA,” he said.
He hoped a solution could be struck that satis ed both parties, but an Intergovernmental Agreement has ultimately signed that banned trailered boats on the lake.
Merritt said that some who are disappointed with the outcome may start purposely throwing the Zebra Mussels into the lake.
“ ose people could now purposely go get the Zebra Mussels and put them into the lake,” he said. “I’m sure people have tried to put mussels in that lake since they took the boat o .”
With Westminster’s city council

revisiting the item, Northglenn’s council sent a letter signed by all council members indicating they will not be revisiting the item.
“Northglenn’s water in Standley Lake is irreplaceable, valued at more than $209 million dollars. ere is no level of risk that our community is willing to accept when it comes to protecting our drinking water supply,” the letter reads.

It’s best to act before sunrise, they say. Soldiers ride at dawn, paper boys aim for mailboxes as street lights guide their throw and truckers start their engines with a layer of dew still covering their windshields.

“Six in the morning, there’s snow on the mountains, pelicans and eagles flying overhead and you are working harder than you have ever worked in your life but you’re making no noise. It’s fantastic, serene and marvelous,” said Katja Stokley, one of those rowers in the boat.
Stokely appreciates the environmental beauty every time she rows. Westminster banned motorized watercraft in 2019. After about three years of no motorized boats on the water, the wildlife came back, Stokley said. Forests of aquatic plants can be seen with Coots, Ospreys, Pelicans and Eagles meandering around in the quiet place.

Not only the environment, but Stokley appreciates the ability to do her sport. She’s an athlete who uses a wheelchair and got hooked on rowing the rst time she learned how.
She’s part of a group of rowers who formed PEAK Rowing, which is a rowing club that o ers adaptive rowing for veterans and people with disabilities. Standley Lake invited them to check out the space, and they were thrilled.
“Standley Lake is wheelchair accessible and is willing to make things more wheelchair accessible, and the fact that there are no powered watercraft at Standley creating wakes,” Stokley said.

at creates the ideal location for the group. Stokley explained since rowing shells are very long and thin, they are susceptible to side wakes, which can potentially crack the thin craft.
Lisa McMath, a member of PEAK Rowing, said there are less than 60 adaptive rowing clubs in the country. In the region, there were none, until PEAK Rowing.
McMath explained that while there are other rowing clubs nearby, their waiting lists for Learn to Row
programs are very long, and are unable to accommodate adaptive rowers who require a little more help.
But even if the lists were shorter, the presence of motorboats makes it much too dangerous.
It’s quieter too. e powered boats don’t just trigger bigger waves, their noisy engines may trigger veterans with Post Traumatic Stress Disorder.
Standley Lake proves special in that aspect, something other bodies of water in Colorado don’t. Cherry Creek Reservoir and other areas host many rowers and rowing clubs, but motor

boats and jet skiers also take up the space. Union Reservoir allows tailored boats and maintains a no-wake rule, but not everyone follows that rule.
“I don’t want to demonize the motorboat people, but it’s just like how cars and bikes don’t coexist,” Stokley said.
Another problem? ose other bodies of water don’t have low enough docks for people with limited mobility to enter the boat.
“We recognize that this would be a fantastic venue for (motorboats) and it would be,” she said. “For us, it’s not like you can pick and
choose from your six rowing clubs, all of which have this wonderful, no-wake situation. ere are lots of places for people with trailer boats to go, and there are not lots of places for us to”
While the motorboats have been taken o the water, Standley Lake has attracted more paddleboards, kayaks, canoers and other paddle-powered craft, according to McMath.
“It’s good for water quality, no noise pollution, no air pollution. And it’s a really low-impact activity to have in this nature preserve,” she said.

Gene Campbell provides recreational therapy sessions to veterans, rst responders and families of those. He said engaging in the outdoors is a proven therapeutic method to help with PTSD, anxiety and depression.

“Colorado waters are absolutely overrun,” he said.


He found a “diamond in the rough” at Standley Lake.
“It truly maximizes the e ciency of recreational therapy. is is an area where they do not have to be concerned with overcrowded people in it,” he said.
Campbell explained Standley Lake isn’t big enough to handle more than
four boats at a time in the rst place, he said. Adding in sh rafts, paddleboards and kayaks spell trouble.
“In a perfect world, everybody would be boating safely. But recreational boating in general tends to have folks not paying attention,” he said.
e Romans Warrior Foundation is available for veterans, rst responders and their families and is free. e objective is to connect paddlers with each other so they know they aren’t alone in the challenges they face.
Standley Lake is perfect, he said, because of the lack of noise and the ability to put a beginner on the water without fear of a wave tipping their paddleboard, kayak or canoe.
With the wildlife refuge close by with hiking trails, it provides an outlet for mental illness. Campbell has seen participants improve rsthand. Putting them in a peaceful environment puts the focus on them.
While he understands why boaters want to come back to the lake, he thinks the lake is in a unique situation as it stands now.
“You go there and you don’t feel like you’re sitting in the middle of Westminster. e noise quiets down, and there are bald eagles nesting in the area. It’s beautiful,” he said.
Teacher pay to rise in 27J

27J Schools Superintendent Chris Fiedler said in written statement prioritized this action based on feedback from voters in a post-election survey.
“We listened to our community when it told us its rst priority was to keep our
talented sta and improve our ability to recruit high-quality candidates. We acted quickly because we care about our sta and we want people to know we’re doing our part to support them,” Fiedler said.
Representatives from the teachers association and the district agreed to increase all areas of the teachers’ salary schedule by $4,900 e ective July 1, 2023. is increase now creates a new
teacher salary schedule which will be used in the spring as the starting point in the traditional negotiations process which includes compensation for length of service and advanced education attainment.
All support sta will receive a pay increase of 2.6 percent which will boost all portions of the support sta salary schedule beginning July 1, 2023. Like the teachers, this increase will serve
as the starting point for additional negotiations with support sta starting in March.
“We’re thrilled to make this long overdue announcement about salary increases for our teachers and support sta . anks to our voters who approved a mill levy override last month, we’re making good on our promise to our community that we improve sta compensation,” Fiedler said.
Anythink nature library plans to preview
STAFF REPORTResidents and library users can get a glimpse of Anythink Library’s plans for a new outdoor branch - and the chance to in uence those plans.
Anythink Libraries and the City of ornton have entered an agreement to build a nature library on the current Aylor Open Lands property at 136th Avenue and Quebec Street in ornton.
Now Anythink has launched Dream & Design: Exploring Nature and Architecture, an immersive experience at Anythink Wright Farms where visitors can learn about and contribute ideas for the future Anythink Nature Library. e Wright Farms branch is located at 5877 120th Blvd. in ornton.
People of all ages are invited to create a diorama using natural materials, guided by a prompt related to one of the library’s ve focus areas: boundless, wellbeing, environmental stewardship,

heritage and create beauty. Every two weeks, visitors are invited to respond to a new prompt, so the space will evolve over time.
e Anythink Nature Library architects and design team will use these ideas to inform the new library’s design.
e ornton City Council and the Anythink Board of Trustees signed an intergovernmental agreement in June 2022 that would lease 15 acres to the district, with plans to build a 35,000-square- foot nature library. e other 140 acres of open lands will be programmed by the Anythink team, and reserved for nature learning and exploration. Construction will tentatively begin third quarter 2023, with an anticipated open date in 2025.
“ is library belongs to our community, and so we believe it’s crucial for our community to be represented in the design process,” says Anythink Nature Library manager Maria Mayo. “We look
forward to seeing what members of our community dream up as they design spaces and experiences inspired by nature.”

State Supreme Court rules in favor of Kulmann
Thornton, filed a suit that said the mayor already served her two terms — six years as a councilor and two as a mayor. The city argued that councilors and the mayor are different positions.

“For these reasons, we conclude that under the plain and unambiguous terms of both the Thornton Charter and Code, the offices of Mayor and of Ward Councilmember in the City of Thornton constitute separate and distinct offices for purposes of section 11’s term limitations. Accordingly, on the undisputed facts before us, we further conclude that Kulmann will soon complete her first term as Thornton Mayor, and, consistent with section 11, she may seek one more consecutive term in that office,” the opinion reads. The Supreme Court overruled the Adams County District Court’s opinion, which seemed to favor both sides. Since Kulmann did not finish her full term as a city councilor, the judge granted her the option to serve as mayor until 2023 because, according to the judge, Section 11 doesn’t apply to partial terms.

The Supreme Court said that the phrase “in office” “plainly and unambiguously refers to a specific office, and not to an institution or governing body,” it reads.
The opinion also says a person should not be able to serve two terms as a Ward Councilmember and then two terns as Mayor. However, due to language of the city’s charter, it’s permitted, directing council or the voters to change it if they feel inclined to.
Justices Gabriel, Boatright, Marquez, Hart, and Samour joined to deliver the opinion of the court, while Justices Hood and Berkenkotter dissented.
The arguments
Attorney Josh Adam Marks, representing Kulmann and the City of Thornton, said mayor and coun-
cilor positions are separate, and that a partial term does not count towards the two-term restriction.
He narrowed his argument down to three different “significant” factors — the way the mayor is elected, the way the charter defines the office of mayor and the office of councilperson, and the way the charter views additional powers on the mayor.
Justice Hart pointed out to Marks that with his argument, a councilmember could serve two consecutive terms, then serve two more consecutive terms as mayor, and then continue that cycle. Marks said Section 11 wasn’t meant to limit government service.
Marks pointed out that throughout Thornton’s charter, the positions of councilmember and mayor are separate — it doesn’t read “mayor/councilmember. “
As well, he said the mayor is elected at large and council members are elected by ward. He also noted that Section 4.8 of Thornton’s charter outlines different powers the mayor has, such as during emergencies.
In regards to partial term limits, he said Section 11 doesn’t address partial terms.
“The voters did not intend partial terms to count while calculating the two-term limit,” he said.

Attorney Robert McGuire, representing Salazar, said he sees the
charter as unambiguous and the mayor is a member of the council.
Hart said there are multiple different spots in the charter where the mayor and city councilor are clearly spelled out as different offices. McGuire said despite the charter referring to different duties of councilors and mayor, he said the mayor is a seat on the council.
He said the charter doesn’t define the office of mayor, it refers to the office. If the charter did define the office, that argument, he said, would then lead to the conclusion that a Ward 1 councilor is different from a Ward 2 councilor since the charter also refers to those positions.
That’s similar to his rebuttal of Marks’ electorate argument stating that each councilor is chosen by a different electorate, their own respective wards.
He also sees the charter defining the city council, which consists of nine members, one of whom shall be mayor.
“What we are arguing is that the mayor is a council member first and foremost, and (is equal) to other councilmembers,” he said.
“The mayor can’t serve without being a council member.”
McGuire said that the mayor votes with the city council, can’t veto, and the vote doesn’t break a tie.
Free meals coming to most school districts

The initiative comes on the heels of two school years where the federal government waived income eligibility requirements for federally subsidized meals, allowing schools to offer free breakfast and lunch to all students. The waivers expired this fall, but lawmakers and advocates found a way to bring back the free meals for next year by asking Colorado voters to approve new funding through Proposition FF. Voters said yes.
The measure will generate more than $100 million a year by reducing income tax deductions available to households earning
$300,000 or more.
Many district officials are enthusiastic about the prospect of feeding more students as they did during the first two years of the pandemic. When school meals were free under the waivers, Boulder Valley officials saw a 40% increase in students eating school meals, District 27J saw a 20-30% increase, and Aurora saw a 7-10% increase.

Flu cases, hospitalizations on the rise
O cials push for vaccinations Flu cases are on the rise, and according to state health o cials, hospitalizations are higher this year than they have been in the past 10 years. e surge has a variety of causes, including people not getting the u shot as consistently as in past years.
Dr. Ben Usatch, UCHealth ER director at Highlands Ranch Hospital, said COVID vaccinations brought on this onslaught of “mixed emotions” that resulted in other annual shots being a ected — u shots being one of them.
“ e bottom line is u vaccines are the best protection to get through the season,” Usatch said. “ ey do not hit the target right on the head, but they make a big di erence.”
In reality, said Dr. Reginald Washington, HealthOne chief medical o cer for Presbyterian/St. Luke’s Hospital and Rocky Mountain Hospital for Children, with all the u strains, the vaccine’s e ectiveness is between 50% and 70%. But even with those odds, people fare better through the season with the shot that has nothing to do with COVID.
“Flu vaccines are not 100% e ective,” Washington said, “they never have been. is year, it is 70% e ective. People are just tired of being told to get a vaccine. But it does need to be updated every year.”
According to the Centers for Disease Control and Prevention and Prevention (CDC), recent studies show that getting a u vaccination can reduce the risk of u illness between 40% and 60% during u season.
Even with the vaccination burnout, Colorado residents have already exceeded last year’s u-shot numbers, according to the Colorado Department of Health and Environment, with 1.68 million getting the u shot. Last year at the same time, 1.66 million were vaccinated. Still hospitalizations are increasing and health o cials say people are not getting the shot at rates they did before the COVID pandemic.

Brian Spencer, with the state health department, provided data showing that pre-pandemic numbers had higher rates of vaccinations in Colorado. During the 2018-19 u season, 1.9 million got the u shot. In 2019-20 just over 2.1 million got the annual shot.
“In some states, u cases and hospitalizations are at their highest marks since the H1N1 u pandemic back in 2009,” said Dr. Eric France, chief medical o cer of the state health department. “Flu vaccines are recommended for everyone aged 6 months and older, with rare exceptions. Flu vaccines are the best way to prevent spreading the u to people who are most at risk, including older adults, young children, people who are pregnant, and people with certain chronic health conditions.”

On a national level, the CDC reported at least 13 million have had the u already this year, with 120,000 hospitalized. ere are more than 7,300 deaths reported.
According to state health data, cases in Colorado include:


• ere were 306 people hospitalized with in uenza during the week ending Dec. 3, for a total of 952 people hospitalized with u since Oct. 2.
• ere have been 1,700 RSV-associated hospitalizations in the ve-county Denver metro area, which includes Adams, Arapahoe, Douglas, Je erson and Douglas counties, since Oct 1.


e state health department recommends:



• Adults 65 years and

older should get one of three speci c u vaccine types. If one of these three products is not available, people aged 65 years and older can get any other age-appropriate in uenza vaccine. People can talk to their doctors about which vaccine is best for them.
• Children younger than 9 years old who are either getting the u vaccine for the rst time or have only previously received one dose of the vaccine should get two doses of the vaccine. e second dose should be given at least 28 days after the rst dose.
• Pregnant women have more serious complications if they get the u. e u vaccine can be given in any trimester of pregnancy.
Medicare, Medicaid, CHP+, and most private health insurers cover the full cost of the u vaccine. Coloradans without health insurance can still get the

u vaccine for free at certain health care providers. Call ahead or schedule online with your local pharmacy or health care clinic to make an appointment for the u vaccine.
With the trifecta of COVID, RSV and u cases increasing, Dr. Sam Dominguez, the infectious disease specialist at Children’s Hospital Colorado, said children should not only get updated u vaccinations but should also have the COVID and chickenpox vaccinations.

With RSV and group A strep cases increasing, Dominguez advised parents that being fully vaccinated and keeping kids home when sick will help decrease illness this season.
Washington said besides vaccinations, practicing good hygiene in washing hands and getting tested for COVID, RSV and the u when symptoms are persistent is important.

Local health o cials are concerned because kids and adults can get strep along with other viral respiratory illnesses like COVID, u and RSV at the same time.

While strep is a common infection kids get each year, Dr. Sam Dominguez, an infectious disease specialist at Children’s Hospital Colorado, said 2022 has seen a higher number of “invasive” cases of bacterial infections.
“It is common and easy to treat,” he said. “ e invasive cases are relatively rare to see.”




For health o cials at local hospitals and clinics, this is another complication to an already stressed system dealing with higherthan-usual cases of RSV in children along with u and COVID cases increasing.
In November, Children’s Hospital sounded alarms about the unseasonably high rate of RSV cases, noting that hospital beds were in short supply because of the severity of the respiratory virus.

Dr. Ben Usatch, the UCHealth ER director at the Highlands Ranch hospital,



said his doctors and sta have treated more younger patients this year than they are accustomed to.
With the Children’s Hospital south campus just across the street, Usatch said as they have lled up beds, the Highlands Ranch hospital is receiving an over ow of young patients.
“We will de nitely take them, happy to do it,” he said. “With adults and kids, we are seeing the big three — COVID, RSV and u cases are running rampant. With young patients, management is di erent and you have to make di erent decisions.”
Currently, Usatch said the hospital is lucky if they do not see more than 18 respiratory cases in the emergency department per day.
HealthOne Chief Medical O cer Reginald Washington said he has seen the e ects of the current season at both the adult and children’s level.


Washington, who serves adults at Presbyterian/St. Luke’s and children at Rocky Mountain Hospital for Children, said hospitals experience the trifecta of illnesses every year. is year, he said, is raising more concern as cases and hospitalizations are higher.
Washington said while treatable, u, COVID and RSV have similar symptoms to strep, which means kids
and adults could have strep along with another virus.
With u and RSV season starting earlier than usual, local health o cials said it is important for parents to be cognizant of a child’s symptoms and if anything is suspected, get them tested.
Washington said there is a speci c test to diagnose all current viruses spreading across the Front Range. While there are not as many treatments for respiratory viruses, Washington said the sooner a patient is diagnosed with strep the
better, because the disease is treatable and requires antibiotics.
Local health o cials said there are some unusual circumstances that could be causing the increased rate of illness this year. ose circumstances are three years in the making as the pandemic pushed society to wear masks to decrease the spread of COVID.
Now, masks are o and some kids are being exposed to viruses and infections for the rst time and their immune systems are

not used to it.

While there is no vaccine to prevent group A strep, the state health department said there are steps that parents, guardians and caregivers (including child care facilities) in Colorado can take to help protect children and families.
Washington and Dominguez said children should be up to date with COVID-19, u, and chickenpox vaccines, as getting these infections can increase risk for acquiring a group A strep infection.

Thornton Mayor Kulmann prevails in State Supreme Court decision

Not only can she serve out her current term, she may run for re-election as mayor. is legal decision had statewide consequences as numerous other home rule municipalities had similar wording in the city charters regarding two terms as a council member and a maximum of two terms as mayor. If the trial court’s
ast week, the Colorado Supreme Court on a 5-2 vote reversed the trial court’s decision on interpreting the City of ornton’s City Charter regarding the mayor’s term of o ce.interpretation had prevailed, it would have had a negative impact on how the “system” works.
Normally, candidates serve as council members before they run for the o ce of mayor although this approach is not mandatory. Gaining knowledge, procedures, budgeting and protocol as a council member is fundamentally bene cial for elected o cials before serving as mayor/ leader of the city council. Congratulations to Mayor Kulmann, the City of ornton and all involved municipalities in this important legal decision.
A major change at Hyland Hills restaurant
As the old saying goes, nothing stays the same. Well, after 25 years of serving hearty meals and o ering a nice variety of adult beverages, Ciancio’s Restaurant at the Hyland Hills Golf Course has hung up their “closed” sign for good. December 18 was their last day to be open.
Earlier in the year, the Hyland Hills Park & Recreation District Board of Directors decided to put out a request for proposals on the restaurant lease. e current lease with Ciancio’s was set to expire December 31 of this year. As it turned out, the Ciancio family (Don Jr., Donna and Ken) decided not to submit a proposal. e district did receive two proposals, but af-
ter thorough review and discussion with each proposing restauranteur the district chose a di erent approach. e Board decided to have the district operate and manage the restaurant. e district sta will be making some modi cations at the restaurant space along with hiring restaurant personnel in January and perhaps into February before opening for business. Plus, the liquor license will need to be transferred.
Ciancio’s restaurant was a “go to” place
Starting with Don Ciancio Sr., the family brought their restaurant talents and favorite Italian recipes to the golf clubhouse. ey quickly established the restaurant and banquet facility as one of Westminster’s “go to” places to eat, drink and meet. I know our Westminster Rotary Club met there for lunch for more years than I can remember.
Other organizations regularly relied on Ciancio’s for a meeting place and meal service. Numerous golf groups, both men’s and women’s, had their formal and informal gatherings there. Plus, Don Sr. brought his clientele from Mr. C’s Restaurant to round out the folks who became regulars at the golf course location.

is time of year, I have often written about goal setting and goal achievement in the past as New Year’s Eve in all its New Year’s resolution splendor calls for us to think about what we may want to change, do di erently, do better, or improve. Some take this time very seriously and have a well thought out and balanced plan for how they are going to enter the year, start strong and nish even stronger. Others take a more casual approach, maybe even waiting right up unto the clock strikes midnight before declaring their resolution.
And then there are those of us who simply do not believe in the nonsense of New Year’s resolutions — if we are going to make changes and improvements, we just get it done on our time and when we are good and ready.

a st week I was speaking with the CEO of one of our customers and he shared with me that although he has been in his role for almost two years, he feels like every door he opens presents itself with an opportunity for improvement. And although he was referring to the areas of his business, it made we wonder if the rest of us maybe looked for doors to open where we could also make improvements personally or professionally.Let’s revisit what my customer shared about opening doors and nding opportunities to improve. What would it look like if we put some intentionality behind this year’s game plan for our lives, goal setting, or business planning? Looking at all doors, every area of our personal and professional life, to identify areas that if we made some level of improvement, that it would bring us greater joy, success, wealth, vitality, or help to get us in better shape physically, mentally, or spiritually.
Maybe we start by looking to open those doors that we haven’t opened in a long time. As a matter of fact, these doors have remained locked for so long that we must give them a rm tug to pry them open. ese are those doors to opportunities that we have always known we should have opened long ago, but we made the decision to focus on those other areas of our lives to make changes to instead. Or our desire to change gave way to laziness, and then laziness gave way to procrastination, and procrastination eventually led to defeat.
Next, we can start with those doors of opportunities for change that we opened last year, last month, last week, or even yesterday and then for whatever reason we closed them. We had an inspiring or motivating moment, we opened the door, saw an area of life or work that we wanted to improve, and we may have even started before closing the door again. ese are the easiest doors to open and re-

e rst doors were those hard ones, the second doors were the easy ones, and now here are the most intriguing doors. ese are the doors of opportunity we have yet to think about. Behind these doors lie untapped potential, new and creative ideas, bold steps, and big goals. By opening these doors, we become energized with new direction, inspired by what we see, and motivated by what we might become along the route of this journey.

Trump and friends get criminal referrals to DOJ
e House Special Committee on the January 6th Riot unveiled their ndings and recommendations last week in what I would call a not surprising conclusion.
After an exhaustive set of proceedings, interviews and retrieval of documents, the committee voted unanimously to urge prosecution of former President Donald Trump and associates via its criminal referral to the Department of Justice (DOJ). e committee’s action is mostly symbolic, but still has precedent setting, historic stature.
e committee cited violations of four criminal statutes by Trump involving the lead up to the insurrection plus the riot itself.

As 2022 quickly heads to the history books, we look ahead with the hope and faith that the New Year will be a better one around the world.
I particularly hope that the war in the Ukraine will end with a negotiated settlement for the sake of the Ukrainian people. It is horrid what Putin and his madness have done to these people and their cities as well as the lives of so many Russian soldiers.
Let’s pray for peace.

On the health front, may the COVID variants subside without experiencing another major round of a new variant. Health systems and medical personnel are worn out and we pray for their health and well-being.

Food insecurity is at a crisis level in America without much hope for a viable solution anytime soon. I can’t help but feel that governmental agencies are not treating it like a crisis. Homelessness continues to haunt our towns and cities without easy answers.
ere are bright spots such as local governments devoting more attention and funding to incrementally addressing the issue. Also, the passage of Colorado ballot issue 123 promises to bring major nancial resources to produce signicant housing opportunities over the longer haul.
On the political/government front e new year will bring change to the U.S. Congress with the Republicans taking control of the House of Representatives by a slim margin. A new Speaker of the House seems up in the air as Kevin McCarthy is getting push back from the ultra conservatives in his own party. President Biden’s agenda will be more di cult to get through the Congress. e Senate Democrat head count stayed the same in spite of incumbent Senator Raphael Warnock defeating Herschel Walker in Georgia. Arizona Senator

Kyrsten Sinema changed parties after the election and now is registered as an Independent. e Senate’s make-up will be 50 Democrats, 49 Republicans and one Independent giving the Democrats the edge even without Vice President Harris needing to weigh-in.
Our own state government will remain “very blue” with a Democrat trifecta - House, Senate and Governor. So, if anything, the Democrats will likely push more liberal causes in the new session given their victories.
In 2023, there will be municipal elections across the state. Westminster will have three council seats up for grabs--Bruce Baker, Lindsey Emmons and Rich Seymour. It’s a safe guess that the Democrats will try very hard to regroup and take a run at regaining the majority vote teaming up with current members Sarah Nurmela and Obi Ezeadi. I am speculating that at least Anita Seitz will throw her hat in the ring from the three who were defeated in 2021 (Seitz, Skulley and Voelz).

Paul was born in Burlington, CO. He worked on the farm until joining the United States Air Force at 21. Paul married Jackie in 1952. ey traveled around the U.S. and overseas for 20 years. Paul retired and moved his family to Westminster. Within a month he bought Bronco season tickets and remained a loyal fan for 51 years. Paul began his next career in mortgage banking, working primarily in the north area, retiring after 21 years.

Loveland Ski Area partnered with the Chris Anthony Youth Initiative Project to get fifth-graders onto the ski slopes























Coloradans can always look to the west and see the mountains in the distance, but for some who live in the inner cities of Colorado, actually getting to the mountains can be a bigger task.
irty- ve fth-graders hit the slopes in Loveland for the rst time on Dec. 13, some even experiencing the mountains for the rst time.
Students from Laredo Elementary School in Aurora came to Loveland Ski Area to ski with professional skier and Snow Sports Hall of Fame inductee Chris Anthony.
Anthony has been working with kids for many years and has hosted his youth program at Loveland for the past three.
e Chris Anthony Youth Initiative Project works to improve the lives of kids through educational enrichment. One of the ways the foundation does this is by busing classes of fth-graders out to Loveland ski area to spend a day learning to ski.
Anthony’s foundation pays for the bus, winter clothes, ski rentals and passes for the children to come experience the slopes. Most kids who come have never skied, and some have never spent time in the mountains despite living in Colorado.















Peter Zola is the teacher for the fth-graders at Laredo Elementary School.
“Every year we have at least two or three kids who have spent most of their life out on the plains in sight of the mountains but never in the mountains,” Zola said.
Zola has been taking his class to ski for eight years and said he always sees great behavior out of his students during this trip. He attributes that success to the active learning the kids get to see and experience on the mountain.
Anthony sees kids get o the bus with a wide range of emotions, from excitement to nervousness for the day. After a day on the slopes, he sees a common thread between all of them.
“No matter what, at the end of the day, all of them, you can see a bright light ignited in the process,” Anthony said.

headed out to the snow with the instructors. ey learned how to put on their skis and quickly learned how to get up after they inevitably fell down.
Dan Huston is the director of the ski and ride school at Loveland. He said one of the biggest barriers for people being able to ski is location/ transportation.
“ e mountains and ski areas usually aren’t very close to urban population centers. We’re unique in that we are 56 miles from Denver,” he said.
After working with the program for a few years, Huston knows the impact it has on kids.
“ ey’re gonna remember this for the rest of their lives,” he said.
Mailene Hernandez, one of the fth-graders on the trip, had a lot to say about the day. She said the bus ride to the ski area was full of mixed emotions, but mostly excitement.
“It was a little bit chaotic, but it was good,” Hernandez said. “I was kinda feeling excited and nervous at the same time.”
Hernandez took to the sport easily and said the process of getting into her skis was pretty natural.
“While I was putting them on I guess I felt a little wobbly, but it was pretty easy,” she said.
Hernandez also had some advice for other kids who might be learning to ski for the rst time.
“It’s really a fun experience, but I do recommend having some ski clothes because of how cold it is, and because you’re going to fall,” she said.

She also went on to say how much
of a blessing Chris Anthony was to her class and how happy she was that they even got the opportunity to come.
After lunch, the kids got their skis back on and some of them graduated from the Magic Carpet over to the ski lift. Skiing down the hill was a good opportunity to work on turns and pizza wedges for the fthgraders.
Anthony himself skied along with the kids throughout the day, helping to pick them up when they fell. His presence made the day even more exciting for the kids, with high- ves all around.

e map is just a few weeks old. And the state isn’t done challenging the data collected by the Federal Communications Commission, said Brandy Reitter, executive director of the state’s broadband o ce.
“ irteen thousand is a lot but likely doesn’t include all missing locations,” Reitter said. “We are still submitting locations that are missing and not accurate to the FCC. Most of what is missing is located in higher density areas of the state that have experienced the most growth over the last several years. We will keep identifying these locations until the FCC maps are accurate. It’s an ongoing process.”

Referee protection, pay scale on CHSAA’s agenda

e proposed bylaw change applies to verbal assaults or threats to game o cials. If approved, the commissioners will work with school administrators to take necessary actions that could include banning individuals from school and CHSAA events.

Referee pay is also on the minds of CHSAA’s budget committee. Its proposal is to freeze membership and participation dues to promote an increased o cials’ fee proposal, something CHSAANow.com calls a “substantial” increase in fees across all sports over the next three years.

If approved, most o cials’ pay would increase $10 per game between now and the 2024 school year. An exception is a two-man crew for soccer. ose fees would increase $20 per game.
ere’s also a proposal to increase the mileage reimbursement for ofcials to 50 cents per mile for travel more than 20 miles away for 2023.
at rate would increase to 55 cents a mile in the 2024 school year and 60 cents a mile in the 2025 school year. ere are proposals to change the Sunday no-contact rule, courtesy of the CHSAA board of directors and the Continental League. e board wants to allow high-school coaches who also coach club ball to have contact with their high-school students during the o season.
e league’s idea would allow all high-school coaches to coach their students on Sundays outside of the competitive season.
If approved, CHSAANow.com said, it would be the largest change to the no-contact rule.
Another hot-button item for CHSAA is the transfer rule for athletes. At present, students who transfer to schools where their club coaches are coaching can play on non-varsity teams for all sports they played during the last 365 years. Four leagues would like to change that to apply to non-varsity teams that the club coach was associated with, not all sports.
CHSAA’s football committee wants to bring back the so-called “zero” week (starting the season one week early) with certain criteria. Wrestling teams may get an extra two tournament dates during the regular

But, overall, home prices are expected to keep going up, Abrams said.
As it is, the market is stagnating. Not only are there buyers like the Storinskys playing a waiting game, but many prospective sellers don’t want to leave behind the cheaper mortgage payments they clinched before, likely on mortgage loans with lower interest rates.

“Sellers are hesitant to sell at a lower price than their neighbors from last spring and leave their low interest rate behind, and buyers are afraid what the future will bring in terms of interest rates and home prices,” opined Kelly Moye, a Realtor in the Boulder and Broomfield area, in a statement.
A short break in price hikes

A deeper dive into the data shows that the median, or typical, price of a Denver area single-family home has seen a seven-month decline.
The price sat at $587,500 in November — still eye-catchingly high, but just a 1.3% increase from a year earlier, according to the Realtor association’s December report.
By contrast, in December 2021, the change in median home price was up a whopping 18.3% from a year earlier.
Something to keep in mind is that fall months typically see a slowdown in price growth and home sales each year. But the de-

Before the Great Recession, banks were giving loans to people they knew couldn’t keep up with them, Abrams said.
Another difference: Fewer houses are on the market today, Abrams said.
In metro Denver, there were about 7,300 homes on the market as of Nov. 1, but in 2006, there were about 3 1/2 times more homes available, Abrams said.
Though it’s tough to predict the market amid concerns over inflation and interest rates, the metro Denver housing market could behave in a more stabilized way in 2023.

What’s in a domain name?





Gov. Jared Polis’ administration wants to spend $2 million to change Colorado’s state government website and email domain extensions to .gov from state.co.us in a proposal billed as a way to mitigate cybersecurity risks and make it easier for state o cials to participate in federal brie ngs.
Until recently, all email addresses for state employees used the state. co.us domain name extension. e transition to .gov has already begun, but the Governor’s O ce of Information Technology is asking state lawmakers to let it spend $2 million to complete the switch.

Brandi Simmons, a spokeswoman for the o ce, declined to comment on the proposal since it’s still being considered by the legislature’s Joint Budget Committee. “We don’t have anything to share at this time,” she said.
But in a proposal sent to the JBC this month, the Governor’s O ce of Information Technology said the state.co.us domain extension poses a “serious security risk,” particularly when it comes to “phishing,” which is when bad actors try to use a deceptive email address to trick people into disclosing sensitive information or clicking on a dangerous link.
“.us domains are subject to phishing attempts,” the budget proposal said. “Anyone can register a .us domain through many of the publicly available domain registrar. For instance, someone could register ‘co. state.us’ or ‘state.col.us’ or ‘states. co.us.’ then email our users from these fake domains.”
Colorado o cials have also had di culty participating in security brie ngs with federal agencies and the White House because of the state.co.us domain extension, according to the proposal. at’s because a .gov email address is required to register for the brie ngs.
Exceptions have to be made for Colorado o cials when they want to join the federal security brie ngs, which the governor’s o ce called “a barrier to entry.”

Some state websites, including Colorado’s main landing page and the legislature’s website, already use the .gov domain extension. And some state employees’ email addresses now carry the .gov extension, too.
Jarrett Freedman, a spokesman for the Colorado House Democratic caucus, said his email switched over to the .gov domain extension Dec. 1.
But Colorado’s move to .gov isn’t complete.
e Colorado Secretary of State’s O ce website, for instance, is sos. state.co.us, though it’s in the process of transitioning fully to coloradosos.gov. And Simmons declined an interview request from e Colorado Sun from a state.co.us email address.

“ e problem is that the FCC’s maps had previously relied on information that failed to paint the whole picture of who did and who did not have the internet,” FCC Chairwoman Jessica Rosenworcel said in a statement announcing the new map. “ e net result was maps that were overly optimistic, lacked location-speci c information, and subsequently glossed over gaps in coverage.”
But the FCC knows the new map may not be accurate so it’s asking consumers to chime in, too. e “pre-production draft” map, available online at broadbandmap.fcc. gov, allows consumers to challenge inaccuracies for their home by pressing the “Challenge Location” button.
Here’s the FCC video showing how to challenge the broadband status of an address:
“Individuals who see that the information on the maps does not match up with what they know from their lived experience will be able to submit challenges, or request corrections, directly through the map interface,” Rosenworcel added.
e FCC is accepting challenges through Jan. 13. But a big reason to get the data right is that there’s $42.5 billion at stake. Called BEAD, which is short for Broadband
Equity, Access, and Deployment, the federal program plans to invest money to build infrastructure and upgrade service in unserved or underserved areas with prioritization for ber-based internet that o er gigabit speeds, or 1,000 megabits.
If regions aren’t correctly counted, they could miss out on attracting federal dollars to improve internet service, said Anna Read, senior o cer at e Pew Charitable Trusts Broadband Access.
“Each state gets a $100 million baseline, but the remaining funding will be allocated based on a formula, which will be based on these new maps and the number of unserved locations in those states,” Read said.
Other states are also taking steps to improve their funding outlook. New York challenged 31,000 addresses. Pennsylvania is hosting webinars to encourage residents to challenge locations with incorrect internet data. Hawaii launched an e ort this week appealing to residents to help crowdsource internet service to help the state receive up to $250 million more than its allocation, reported news site Honolulu Civil Beat.
“ e accuracy of those maps and having an accurate representation of unserved locations is very important to the funding allocations,” Read said.
For the new map, the FCC asked internet providers to share the speci cs of the areas they serve. But the map is limited to what internet providers shared about available service and “does not include factors like quality or reliability of service or pricing,” Reitter pointed
out.
Some advocates for rural broadband said the maps are “quite inaccurate” and the FCC is relying on local governments to x the issue.
“My house is reported to be served by a wireless company that told the FCC it can do 1,000/1,000 Mbps. When I looked at their website, they wanted to charge $100+ for 2 or 3 Mbps connections,” said Christopher Mitchell, director of the Community Broadband Networks at the Institute for Local Self-Reliance, which has provided guidance to many Colorado communities on what it takes to build their own broadband services. “ e FCC has not weeded out phantom services and I’ll be curious how many challenges it will take to x this because the FCC o ers no real penalties for ISPs that simply lie about their coverage.”
Even internet providers are puzzled.
“Generally, the FCC map is showing the state as well-covered, which most Coloradans know isn’t the reality. Part of this mismatch has to do with the way the 182-acre hexagon blocks are created,” said Stacie McDonald, a spokeswoman for Visionary Broadband, which o ers ber-based internet service in Gunnison and Kremmling and is adding service in Cañon City, Lake City, Marble, Pagosa Springs and Walden.
“For example, our employee has a 200 Mbps connection at his home, so their entire 182-acre hexagon is showing as o ering 200 Mbps, which is not the case,” McDonald continued. “Along with ISPs, citizens can also report their coverage,
which can assist Colorado in getting their full BEAD allocation, since it’s based on the number of unserved locations.”
Colorado is also targeting faster speeds for everyone in the state.
e old FCC preference of 25 Mbps down and 3 up just isn’t good enough anymore, Reitter said, especially after students and workers stuck at home during COVID found themselves competing for bandwidth to sit through an online class or video conference.
Moving forward in Colorado, the unserved will include communities with download speeds below 100 megabits and 20 up. About 14% of the state is considered unserved or underserved at under 100/20 Mbps, and that includes urban areas like the Denver metropolis.
But Reitter said she needs to hear from the underserved Coloradans, who can share what’s actually happening at their home.
“While the FCC maps are an important resource, they only show reported broadband availability from ISPs who chose to provide their data,” she said. “(We) need help from the public to understand what is being advertised as being available to customers vs. what they are actually receiving as far as speeds and service at their location.”

General Intent
(A) The City Council finds that enforcement of the Westminster Municipal Code is an important public service, and that code enforcement is vital to the protection of the public’s health, safety and quality of life. The City Council further finds that a comprehensive code enforcement system that uses a combination of judicial and administrative remedies is critical to gain compliance with these ordinances.
(B) The Chapter provides for administrative penalties that may be imposed for violations of certain sections of the Westminster Municipal Code. The section of the Westminster Municipal Code specifically affected is:

(2) Title XI – Land Development and Growth Procedures

THE CITY OF WESTMINSTER ORDAINS: Section 1. Section 11-5-13(A) of the Westminster Municipal Code (W.M.C.) is hereby AMENDED to read as follows:
11-5-13: Public Hearings for Land Development Approvals:
(A) The following public hearing procedure shall apply to any application for the approval of Comprehensive Plan Amendment (property owner initiated), PDP, amended PDP, ODP, amended ODP, Specific Plan, or Specific Plan Amendment and any zoning or rezoning for which a public hearing is required pursuant to this chapter. For any City-initiated application, the term “applicant” shall mean the City.

(3) Notice of public hearings scheduled before the City Council shall be published and posted at least ten days prior to such hearing.

(5) Notice of the public hearing shall be furnished and posted on the subject property by the applicant using one or more signs, in accordance with the requirements of this section, with each such sign having a minimum area of twenty (20) square feet, with two-inch high lettering, and using the format and layout provided by the City. The signs shall be placed at an appropriate location on-site, as determined by the City, that is reasonably visible to vehicular and pedestrian traffic passing adjacent to the subject property, with a minimum spacing of one (1) sign for every 660 feet of linear street frontage adjacent to the subject property. The signs must be of a durable material, weather resistant, and properly anchored, such that they will be in legible condition for the entire posing period. On the day the signs are placed, the applicant shall photograph the signs and provide digital copies to the Planning Manager. The applicant shall check the signs daily during the posting period to ensure they are still in good, clean, legible condition, and still properly posted and maintained at the locations designated. On the date of the public hearing, the applicant shall provide to the Planning Manager certification that the signs were properly posted and maintained consistently during the required notification period. The signs shall be removed, and any damage caused by the posting of the signs repaired, by and at the expense of the applicant, within 72 hours of the conclusion of the public hearing.
(6) The applicant shall send notice of the public hearing by first-class mail to all property owners and addresses within 1,000 feet of the subject property, except that mailings for variances shall be to addresses within 300 feet of the subject property. In instances where a notification radius intersects an additional subdivision, the entirety of such additional subdivision shall be added to the mailing notification; provided, however, that where such additional subdivision includes multiple filings, only the filing or filings intersected shall be included (in their entirety), rather than the entire subdivision. For properties within the prescribed notification radius that lay outside the City’s boundaries, only property owners of record shall be included, as tenant and/or resident data is not available to the City for these areas. The City shall prepare the form of the notice to be issued.
At least ten days prior to the date of the public hearing, the City will provide the applicant with the mailing list and a corresponding mailing map. Prior to the public hearing and within two business days of the mailing, the applicant shall provide to the Planning Manager a certification that the required notices were mailed and the date of such mailings.
(7) The Community Development Director shall have the sole discretion to expand the notification area based on a consideration of the complexity of the project, the geographic reach of potential adverse impacts, the extent of neighborhood compatibility issues, and similar factors. When a notification radius extends into a geographical feature such as a park, river or floodplain, public right-of-way, open space, or similar anomaly, the Community Development Director may expand the notification radius by the same distance that the radius extended into the feature.
(8) At the public hearing, the Planning Manager shall verify that the required notices were issued. Any person with actual notice of the public hearing shall have no standing to object to the commencement or conduct of the public hearing, even if such person failed to receive one or more of the forms of notice prescribed above. Hearings shall proceed despite claims of a lack of notice or insufficient
form(s) of notice.

Section 2. If any section, paragraph, clause, word or any other part of this ordinance shall be held to be invalid or unenforceable by a court of competent jurisdiction, such part deemed unenforceable shall not affect any of the remaining provisions.
Section 3. This ordinance will become effective upon the recording of a deed in the real property records of Adams County from Pillar of Fire to Westminster OC or its assignee, such recorded deed to be provided by Westminster OC to the City. If a deed from Pillar of Fire to Westminster OC or its assignee is not recorded on or before two years from the date of approval of this ordinance, this ordinance shall not become effective.

State looks at how ballot measures impact budget
BY JESSE PAUL AND ELLIOTT WENZLER THE COLORADO SUNTwo ballot measures approved by voters in November will reduce the amount of money the legislature has to spend by about $750 million in each of the next three years, but two economic and tax revenue forecasts presented to state lawmakers Tuesday predicted the reduction won’t cut into Colorado’s budget. e forecasts also indicate Coloradans can continue to expect tax refunds — albeit smaller ones than they would have received had the two ballot measures failed.
Proposition 121, which reduced the income tax rate to 4.4% from 4.55%, is expected to reduce state tax revenues by $620 million in the current scal year — which ends June 30, 2023 — and by some $400 million in the 2023-24 and 2024-25 scal years. Proposition 123 sets aside up to 0.1% of taxable income each year for a ordable housing programs, which is estimated to be about $150 million in the current scal year and roughly $300 million in the 2023-24 and subsequent scal years.
Should there be a deep recession, however, nonpartisan Legislative Council Sta and the Governor’s O ce of State Planning and Budgeting warned budget cuts may be possible and taxpayer refunds would be erased. And both agencies said the risk of an economic downturn remains high.

“Amidst this rapid monetary policy tightening, the housing correction and declining household balance sheets, we believe that risks to the forecast remain elevated and weighted toward the downside,” Je Stupak, a monetary policy and in ation analyst for Legislative Council Sta , told the legislature’s Joint Budget Committee, which writes Colorado’s budget.
Greg Sobetski, chief economist for Legislative Council Sta , said “we think a recession is very possible.” e legislature isn’t allowed to spend all of the money the state collects in tax revenue because of Colorado’s Taxpayer’s Bill of Rights cap on government growth and spending, which is calculated by annual in ation and population rates. Any money collected by the state in excess of the cap must be refunded to taxpayers. Refunds are expected
cap by $2.5 billion in the current scal year, $1.5 billion in the 202324 scal year and $1.4 billion in the 2024-25 scal year.
e tax revenue forecast from the governor’s o ce was less rosy. It predicted $2.4 billion in revenue above the TABOR cap in the current scal year, $469 million in the 2023-24 scal year and $736 million in the 2024-25 scal year.
Lauren Larson, who leads OSBP, said the reason for the discrepancy has to do with the agency’s expectation that there will be “a slight downturn for a couple of quarters in late 2023.”
After $225 million in TABOR excess is refunded as property tax relief in the current scal year, thanks to a bill passed in 2022, the legislature is still expected by nonpartisan legislative sta and the governor’s o ce to have more than $2 billion to refund.
e money can be refunded in a variety of ways. Earlier this year, the scal year 2021-22 TABOR excess was sent back to Coloradans via checks of $750 or $1,500 depending on whether they led their taxes individually or jointly.

Housing prices have caused the most signi cant contributors to ination across the U.S., according to Legislative Council Sta . However, those costs are falling nationally and in Denver as the market cools. Denver home prices are down 4.5% from their peak, though housing demand is still outpacing supply and rental prices are climbing.
Additionally, rising interest rates caused by the Federal Reserve’s hopes of cooling in ation have caused signi cant decreases in purchasing power for home buyers.
Stupak said that someone who could a ord a $550,000 home with a 20% down payment in 2021 had a monthly mortgage payment of $1,900.

e housing market uncertainty is part of the reason state economists are warning of a recession. Another indicator of a possible economic downturn are trends in consumer spending, which make up 70% of economic activity, according to the Legislative Council Sta .
“We’ve seen a falling savings rate, falling household balance sheets and kind of declining expectations from consumers for the economy in the future,” Stupak said.
e OSPB projects slow consumer demand and economic growth in the second half of 2023. “ e labor market and consumer spending are currently outpacing previous expectations for this year, but slower consumer demand and economic growth are expected in the second half of 2023,” said Bryce Cook, chief economist at OSPB.
Legislative Council Sta expects the annual in ation rate in Colorado to drop to about 4% in 2023 after hovering around 8% in 2022.
