When Judge A. Bruce Jones imposed a sentence of 110 years on Rogel Lazaro Aguilera-Mederos for causing a deadly semi-truck accident on I-70, killing four people and injuring several others, he said if it were up to him, he wouldn’t have given the 26-year-old truck driver such a long sentence. But it wasn’t up to Jones, because Title 18. Article 1.3. Sentencing in Criminal Cases Part 4, in Colorado’s Revised Statutes, 2014, required Jones to not only sentence Aguilera-Mederos to at least a mandatory minimum in terms of years for each count he was convicted on, but it specifies that many of those sentences be served consecutively instead of concurrently. In the case, the jury found AguileraMederos guilty of six counts of FirstDegree Assault — Extreme Indifference and 10 counts of Attempted FirstDegree Assault — Extreme Indifference. Both charges are considered “crimes of violence.” Colorado law states that “a person convicted of two or more crimes of violence arising out of the same incident Aguilerashall be sentenced for such Mederos crimes so that sentences are served consecutively rather than concurrently.” Those 16 counts (of 27 counts he was convicted of), totaled 110 years.
