Under the provisions of the WCO, should nitrate and/or DRP limits be exceeded, then “council must duly investigate potential and likely causes of that exceedance… [and] take such action as is practicably available in the exercise of its relevant powers”.

A similar obligation applies to low DO levels and reduced water clarity.

When The GB Weekly contacted TDC earlier this week to request a response, a council spokesperson explained that the environmental policy team were busy “poring over the document”, but were able to make the following interim statement: “We are still digesting the report and draft order to fully understand the implications for Tasman District Council and the community.

Given the draft order may be subject to an appeal process (parties have 15 working days to lodge an appeal) then we can’t really comment in detail on it.

However, the recommendation of a Water Conservation Order for Te Waikoropupū reflects the agreement from all parties involved that this is a very special waterbody and taonga for Mohua/Golden Bay, the Tasman region, and all of New Zealand.
