Pursuant to amendments included in the Infrastructure Investment and Jobs Act (the “Act”) to the Public Utility Regulatory Policies Act of 1978, 16 U.S.C. § 2601 et seq., as amended, the Board of Directors of Cass County Electric Cooperative Inc. (the “Cooperative”) will hold a paper hearing on Monday, July 24, 2023, beginning at 9:00 a.m. at 3312 42nd Street South. Fargo, ND 58104 to consider the following:
Electricity is a value. It powers our everyday lives, often for around $5 a day. Being a member of an electric cooperative – like you are – offers even MORE value to your dollar, because you’ll likely get some of that dollar back.
It’s a nice little system we like to call CAPITAL CREDITS
Electric cooperatives operate as not-forprofit utilities, which means that any excess revenues (or margins) are returned to members, not shareholders. The margins are allocated every year according to how much energy the members each buy. Then they are retired later on and paid out to those members to which they were allocated.
In March the CCEC board approved the retirement of $3 million to members for capital credits, estate and early retirement payments. Let’s break down the process using this wheel above.
Capital credits are not necessarily returned every year – that depends on the current financial needs of the cooperative. The co-op and board work together to keep rates as low as possible while still having the revenue needed to ensure safe and reliable electricity. It pays to be a member of an electric cooperative!

1) Whether the Cooperative will (i) promote the use of demandresponse and demand flexibility practices by commercial, residential, and industrial consumers to reduce electricity consumption during periods of unusually high demand, and (ii) establish rate mechanisms for the timely recovery of the costs of promoting demand-response and demand flexibility practices. 16 U.S.C. § 2621(d)(20).
2) Whether the Cooperative will consider measures to promote greater electrification of the transportation sector, including establishing rates that (i) promote affordable and equitable electric vehicle charging options for residential, commercial, and public electric vehicle charging infrastructure, (ii) improve the customer experience associated with electric vehicle charging, including by reducing charging times for light-, medium-, and heavy-duty vehicles, (iii) accelerate third-party investment in electric vehicle charging for light-, medium-, and heavy-duty vehicles, and (iv) appropriately recover the marginal costs of delivering electricity to electric vehicles and electric vehicle charging infrastructure. 16 U.S.C. § 2621(d)(21).
All members of the Cooperative, the U.S. Secretary of Energy, and affected utilities and their customers may participate and submit written comments for consideration of the Board by delivering to the Cooperative at its address set forth below by the close of business on June 9, 2023, a written statement detailing their position relative to the adoption of one or both of the standards and their response to the written position of the Cooperative staff relative to all of the standards to be available on or before May 9, 2023. If you are a Cass County Electric member and are interested in becoming a director, contact Sarah Rhea at 701-356-4405 for a 2023 director election petition packet. In compliance with bylaw requirements, a petition, biographical information, and such other information as the board or credentials committee may require to establish and verify the qualifications of the proposed director to serve must be delivered to the cooperative office no less than (90) days (by Jan. 18, 2023) before the date of the annual member meeting of Tuesday, April 18, 2023, at which an election will be held.

The Cass County Electric board of directors met in person on Oct. 25, 2022, and discussed the following topics:
• Moved to approve the October 2022 consent agenda of the regular board meeting consisting of minutes, monthly department reports, director expense report, and the September Purchased Power Adjustment (PPA).

Directors are elected by ballot for a three-year term.
Following the cooperative bylaws, the CCEC board of directors appointed District 1 member Paul White to fill the open District 1 term. An election will be held at the 2023 annual meeting to confirm his seat.

Nominees in Districts 1, 4, 5, and At Large must be bona fide residents of the director district in which they are seeking directorship (see district map).
The names of all candidates who submit the required information in the time and manner specified in Article III. Section 3.6 of the bylaws will be submitted to a credentials committee consisting of between three and eight members, as determined by the board of directors. The credentials committee may require candidates to provide and verify additional information deemed relevant by the credentials committee. • President/CEO Marshal Albright gave the President’s Report reporting on updates from meetings and conferences attended.
• Received the September and third quarter 2022 financial reports.
• Received reports from the Minnkota Power Cooperative and NDAREC board meetings.
• Moved to approve A/V changes to the boardroom.
• Moved to approve a cost of living adjustment to the non-union pay scales for 2023.
• Received the 2021 Key Ratio Trends Analysis presentation from NRUCFC.
• Received a report from the Operations and Administration Committee.
• Received a report from the Rate, Audit, and Finance Committee.
• Moved to approve revisions to 21 policies.
• Moved to approve the October 2022 Capital Credit estate payments.
• Reviewed upcoming meetings and events.
The next board meeting is Thursday, Dec. 22, 2022.
