Numărul infectărilor scade vertiginos în toată țara, indiferent de numărul de vaccinați sau nevaccinați, dar Starea de Alertă se prelungește. În Europa, cu toate că numărul vaccinaților a atins procente apropiate de 100%, numărul infectărilor și al deceselor crește.

De ce? Nu se chinuiește nimeni să explice.

Dar să revenim la România, unde prin continuarea măsurilor aiuristice anti-pandemice Guvernul și Guvernele din ultimii doi ani, aceste Guverne de Teroare Națională adusă la rang de politică de stat, arată că hârtia suportă orice și modifică din pix, cum se spune, numărul de cazuri noi și numărul de decese.

Desigur, așa cum am mai spus-o, Sărbătorile vor fi Liniștite iar românii vor putea petrece pe săturate, unde și cu cine vor, că așa o să le dea voie Marii și Înțelepții Conducători ai Țării.

Ana-Maria Baciu: Simion&Baciu a pornit, în mod predestinat parcă, de la o propunere de modificare a legislației în domeniul jocurilor de noroc, în anul 2015.

M-am întâlnit atunci cu Cosmina, cu totul întâmplător, fiecare dintre noi acordând, la mo­ mentul respectiv, asistență juridică câte unui membru al unei importante asociații inter­na­țio­ nale de operatori de jocuri de noroc la distanță.

Asociația era interesată direct în parcursul legislației din România, așa că prin natura lucrurilor am ajuns să lucrăm împreună la poziția ce urma a fi transmisă către ONJN – ca inițiator al propunerii legislative – din partea asociației.

A fost evident pentru noi, de la prima interacțiune, că am func­ționa mult mai bine îm­ pre­ună decât funcționam deja separat. La acel moment, fiecare dintre noi con­du­cea prac­tica de Technology, Media & Telecom, respectiv IP, IT & Jocuri de noroc, în două dintre cele mai impor­tan­te case de avocatură din Ro­mânia, una internațională și una locală. A fost totuși destul de simplu să luăm decizia să ne unim forțele pentru a crea ceea ce urma să devină una dintre cele mai puternice și recunoscute echipe de avocați specializate, printre altele, în domeniul jocurilor de noroc.

Vreme de 4 ani această echi­pă a activat și a asistat clienții ca parte din echipa celei mai vechi și mari case de avocatură locale.

Ana-Maria Baciu: Simion&Baciu started, predestined as if, from a proposal to amend the legislation in the field of gambling, in 2015.

We met then, quite by chance, each of us providing, at that time, legal assistance to a member of a major international association of remote gambling operators. The association was directly interested in the Romanian legislation, so by the nature of things we came to work together on the position that was to be transmitted to the ONJN - as the initiator of the legislative proposal - from the association.

It was obvious to us, from the first interaction, that we would work much better together than we already worked separately. At that time, each of us was leading the practice of Technology, Media & Telecom, respectively IP, IT & Gambling, in two of the most important law firms in Romania, one international and one local. However, it was quite simple to make the decision to join forces to create what would become one of the most powerful and recognized teams of lawyers specialized, among others, in the field of gambling.

For 4 years this team has been activating and assisting clients as part of the team of the oldest and largest local law firm.

Things changed on the first summer day of 2019, when, by detaching the team we were already coordinating from the former organizational structure, Simion&Baciu was officially

Cosmina Simion: Simion&Baciu provides assistance to its clients in niche areas such as gambling, technology & media, personal data protection, the pharmaceutical & health industry, as well as general areas such as intellectual property, consumer protection, corporate law & M&A or litigation.

Although we like to believe that we excel in all the areas we have taken on, our main areas of activity today are gambling, intellectual property, consumer protection and litigation.

Deși ne place să credem că excelăm în toate domeniile pe care ni le-am asumat, domeniile noastre principale de activitate în prezent sunt jocurile de noroc, proprietatea intelectuală, pro­ tecția consumatorilor și litigiile.

➤ Cum vedeți situația pandemică actuală, ca o provocare sau ca o sursă de noi oportunități?

Cosmina Simion: Situația actuală – cu toate consecințele sale, econo­mice, sociale și medicale – a re­­pre­­zentat și continuă să re­pre­zinte pentru noi, în egală mă­­sură o provocare, o sursă de opor­ tunități, un moment potrivit să ne extindem ariile de interes și echipa, o perioadă dificilă dar și o șansă să demonstrăm și să ne demonstrăm că putem. Orice și în orice condiții. ➤ Este domeniul jocurilor de noroc un business constant pentru voi sau doar sporadic?

Ana-Maria Baciu: Domeniul jocurilor de noroc a fost de la început și continuă să fie unul dintre mo­­toarele profesionale ale Simion&Baciu.

➤H ow do you see the current pandemic situation, as a challenge or as a source of new opportunities?

Cosmina Simion: The current situation - with all its economic, social and medical consequences - has been and continues to be a challenge for us, a source of opportunities, a good time to expand our areas of interest and team, a difficult time but and a chance to prove and prove that we can. have been active for a long time and in which the experience gained helps us to cover all aspects of interest to our clients. Our understanding of the field is holistic, as is our customer support. ➤Y ou are a member of IMGL, what does it represent and especially how is it reflected in your activity?

Ana-Maria Baciu: IMGL (International Masters of Gaming Law) is a non-profit association with over 340 members worldwide. Its members are recognized as the foremost experts in their gambling jurisdictions and are involved in most gambling developments and issues around the world.

We were the first members in Romania, and we are still exclusive members for Romania in this organization.

Cosmina is currently a member of the Executive Committee of this organization, and in this capacity participates in executive decisions regarding both internal issues, structure and members of the organization, but also the organization of annual IMGL conferences, participation of the organization as a partner in other events. profile including ICE in London, SIGMA in Malta, G2E Las Vegas etc.

Ana-Maria is co-chair of the Membership Committee, the committee that selects the future members of the organization.

Each year, IMGL hosts two major conferences, as well as IMGL masterclasses at international gambling events and exhibitions, where IMGL presents speakers who are experts in the gambling industry, as well as topics at the forefront of all the top developments in the global gambling sector.

Belonging to this organization, as well as the events we participate in as members, help us to be constantly aware of regulatory trends in all jurisdictions but also to maintain close relationships of collabo-

Este un domeniu în care activăm de mult și în care ex­pe­ riența dobândită ne ajută să acoperim toate aspectele de interes pentru clienții noștri. În­țe­legerea noastră cu privire la domeniu este holistică, și la fel este și asistența acordată clienților. ➤ Sunteți membri IMGL, ce reprezintă și mai ales cum se reflectă în activitatea voastră?

Ana-Maria Baciu: IMGL (International Masters of Gaming Law) este o asociație non-profit care cuprin­ de peste 340 de mem­bri la nivel global. Membrii săi sunt re­cu­noscuți ca fiind cei mai im­ por­ tanți experți din juris­ dic­­ții­le lor în domeniul jocurilor de no­­roc și sunt implicați în majorita­ tea evoluțiilor și problemelor din sec­ torul jocurilor de noroc din întrea­ga lume.

Noi am fost primii membri din România, și suntem încă membri exclusivi pentru România în această organizație. În prezent, Cosmina este membru în Comitetul Executiv al acestei organizații, iar în aceas­tă calitate participă la luarea deci­zii­ lor executive în ceea ce privește atât aspectele interne, structura și membri organizației, dar și organizarea conferințelor anuale IMGL, participarea or­gani­zației ca par­­ tener la alte eve­ nimente de pro­fil incluzând ICE la Londra, SIGMA in Malta, G2E Las Vegas etc.

Ana-Maria este co-chair al Membership Committee, comitetul care realizează selecția viitorilor membri ai organizației. În fiecare an, IMGL găzdu­ iește două conferințe majore, pre­­cum și masterclass-uri IMGL la eve­ni­men­te și expoziții interna­ țio­­na­le de jocuri de noroc, unde IMGL pre­zin­tă speakeri care sunt experți în industria jocurilor de

noroc, precum și subiecte aflate în fruntea tuturor evoluțiilor de vârf din sectorul jocurilor de noroc la nivel global.

Apartenența la această or­ga­ nizație, precum și evenimen­ tele la care participăm în calitate de membri ne ajută în egală măsură să fim constant la cu­rent cu trendurile de reglementare în toate jurisdicțiile dar și să menținem relații strânse de colaborare și prietenie cu avo­cații specializați din firmele de avocatură din aceste jurisdicții cât și cu avocații interni, care coordonează asistența ju­ ridi­că în cadrul operatorilor in­ter­ națio­nali de jocuri de noroc.

Prietenia și încrederea pe care ne-o arată toți aceș­ tia ne ono­rează și ne responsa­bili­zea­ ză, și ne sunt de un real aju­tor în dezvoltarea noastră per­so­nală și profesională. ➤ Anul 2021 v-a adus multe recunoașteri. Cum v‑au influențat aceste recunoașteri carierele și mai ales cum au influențat activitatea firmei?

Cosmina Simion: Într-ade­ văr, atât firma, în integralita­tea sa, cât și diferiți membri ai echipei noastre, suntem recunos­cuți de directoarele independen­ te inter­ na­ționale în domeniile cer­ce­tate.

Principa­lele astfel de recu­noaș­­te­ ri vin de la ghidurile din do­meniul jocu­rilor de noroc și pro­ prie­tății intelectuale.

Aceste clasamente se ba­ zează pe o serie de criterii care pot diferi de la publicație la pu­bli­ cație, dar toate evidențiază echi­ pe­ le din zona de practică care oferă cele mai de ultimă oră și ino­va­toare sfaturi.

Cercetarea se bazează de obicei pe feedback-ul a nu­ me­ roși clienți din întreaga lume, informații transmise de la firmele de avocatură și interviuri cu avo­ cați de practică privată de top, rea­li­zate de echipe de cerce­tători care au o experiență vastă pe pia­ța juridică.

These rankings are based on a number of criteria that may differ from publication to publication, but all highlight the teams in the practice area that offer the latest and most innovative advice.

În mod egal, aceste recu­ noaș­ teri confirmă pentru clienții noști alegerea în ceea ce pri­veș­ te avocații pe care îi folosesc în România, dar ne ajută și în procesul de recrutare al noilor avocați care, din ce în ce mai mult, iau în considerare (și) aceste aspecte în momentul în care aleg firmele în care să își înceapă sau să își continue cariera. ➤ Ce părere aveți despre legislația actuală în ceea ce privește măsurile anti covid și cum credeți că impactează aceste măsuri industria jocurilor de noroc?

Ana-Maria Baciu: Prin natura activității unei părți importante a clienților noștri – jocuri de noroc, retail, HORECA – am fost de la început, și rămânem foarte aproa­ pe de reglementările adoptate de autorități începând din martie 2020, care au fost provocate, direct sau indirect, de apariția și continuarea, încă, a pandemiei. În mod evident, o mare parte a măsurilor adoptate au fost necesare și justificate, pe lângă motivul evident – riscurile la care suntem expuși, și de frica de necunoscut prin care am trecut cu toții.

Credem, de asemenea, că aceste reglementări ar putea fi îmbunătățite, și în special mai bine adaptate realităților pe care le trăim și diverselor domenii de activitate afectate în mod direct.

De asemenea, și aici industria jocurilor de noroc tradiționale a fost probabil cel mai expus do­ meniu, credem că ar fi fost necesară o mai bună corelare a măsurilor impuse pentru stoparea / încetinirea efectelor pandemiei cu măsuri de protecție a operatorilor, care să aibă în vedere realitățile cu care aceștia se confruntă. ➤ Cum vă protejați clienții în această perioadă și ce sfaturi le dați?

Cosmina Simion: În această perioadă, ca de altfel în toate

perioadele prin care am trecut în viața noastră de avocați, fiecare venită la pachet cu provocări mai mari sau mai mici pentru clienții noștri, recomandarea noastră rămâne ca fiecare decizie pe care o iau să fie luată în deplină cunoștință de cauză.

Sigur că este important ca fiecare dintre ei, în activitatea lor, indiferent de domeniul în care activează, să respecte toate prevederile legale aplicabile. Nu putem însă să ignorăm faptul că, uneori, aceste prevederi legale sunt neclare, sau – cel puțin parțial – inaplicabile perfect unei anumite situații de fapt. Dar chiar și în aceste situații, factorii de decizie tot trebuie să ia decizii. Iar aceste decizii trebuie să fie bazate pe informații corecte și complete în ceea ce privește prevederile legale aplicabile, posibilele interpretări ale acestora, dar și riscurile implicate de adoptarea uneia sau alteia dintre aceste interpretări – furnizarea tuturor acestor informații fiind, în special în cazul clienților noștri care nu au un departament juridic intern spe­ cializat în drept românesc, în sarcina și responsabilitatea noastră. ➤ Unde vă vedeți peste cinci ani? Dar la anul pe vremea asta?

Cosmina Simion: Gluma noastră preferată este, de când ne cunoaștem, că peste unul, trei sau cinci ani ne vedem pe o plajă în Maldive.

Lăsând puțin gluma la o parte, sperăm ca viitorul să ne găsească făcând în continuare ceea ce ne place, împreună cu colegi care ne plac și cu care să continuăm să facem ce știm cel mai bine, pentru clienții cărora le suntem utili și care ne apreciază. ➤ Vreți să adaugați ceva pentru cititorii Casino Life & Business Magazine?

Ana-Maria Baciu & Cosmina Simion: Vă mulțumim pentru timpul alocat citirii acestui in­ter­viu.

Suntem la un e-mail sau un telefon distanță în cazul în care doriți să ne transmiteți ceva, sau aveți orice întrebare la care considerați că am putea răspunde.

Equally, these recognitions confirm for our clients the choice regarding the lawyers they use in Romania, but they also help us in the recruitment process of the new lawyers who, more and more, take into account (and) these aspects when choosing the companies in which to start or continue their career. ➤W hat do you think about the current legislation regarding anti-covid measures and how do you think these measures impact the gambling industry?

Ana-Maria Baciu: Due to the nature of the activity of an important part of our clients gambling, retail, HORECA - we have been from the beginning, and we remain very close to the regulations adopted by the authorities since March 2020, which were caused, directly or indirectly, by the appearance and the continuation, still, of the pandemic.

Obviously, much of the action taken was necessary and justified, in addition to the obvious reason - the risks to which we are exposed, and the fear of the unknown that we have all gone through.

We also believe that these regulations could be improved, and in particular better adapted to the realities we live in and the various areas of activity directly affected.

Also, here the traditional gambling industry was probably the most exposed field, we believe that it would have been necessary to better correlate the measures imposed to stop / slow down the effects of the pandemic with measures to protect operators, taking into account the realities which they face. ➤H ow do you protect your customers during this period and what advice do you give them?

Cosmina Simion: During this period, as in all the periods we have gone through in our life as lawyers, each coming

with more or less challenges for our clients, our recommendation remains that every decision they make be taken in full knowledge of the cause.

But even in these situations, decision makers still have to make decisions. And these decisions must be based on correct and complete information regarding the applicable legal provisions, their possible interpretations, but also the risks involved in adopting one or another of these interpretations - the provision of all this information being, especially in the case of our clients. who do not have an internal legal department specialized in Romanian law, in our task and responsibility. ➤W here do you see yourself in five years? Scutirea, de care pot beneficia jocurile de noroc, este motivată de considerente de ordin pur practic, legate de faptul că operațiunile de jocuri de noroc nu se pretează la aplicarea TVA-ului, care este un impozit pe consum și a cărui bază de impozitare o constituie suma primită `n schimbul furnizării unui serviciu, iar acest sistem nu este ușor de aplicat jocurilor de noroc, `n condițiile `n care consumatorii plătesc mize, `n schimbul unei șanse de a obține un câștig, de o valoare superioară, eventual.

on, were adopted as a result of the provisions of art.135 of Directive 2006/112, by which the provision of services, in the activity of gambling, are exempt from VAT, but not because these services would correspond to a reason of general interest and this exemption is also not intended to ensure a favorable treatment of these activities.

The exemption, which can benefit from gambling, is motivated by purely practical considerations, related to the fact that gambling operations are not suitable for the application of VAT, which is a consumption tax and whose tax base is is the amount received in exchange for the provision of a service, and this system is not easy to apply to gambling, given that consu-

o taxă specială, aplicabilă jocurilor de noroc, interpretând aceste dispoziții `n sensul că statele membre au posibilitatea de a supune, fiecare joc de noroc, fie unei redevențe speciale, fie TVA-ului, așa cum concluzionează, pe acest aspect, Avocatul general Bot — `n Cauza C-58/09.

Deci, prin această directivă, UE lasă la latitudinea statelor membre dreptul de a stabili nivelul și modul de impozitare al activității jocurilor de noroc, dar prin acordarea acestui drept nu `nseamnă și faptul că aceste impozite speciale pot constitui o abatere de la sistemul european de impozitare sau că statele membre ar putea schimba natura acestor impozite, ele trebuind să rămână impozite pe serviciul prestat și, la fel ca TVA-ul, impozite indirecte, datorate ca urmare a serviciului prestat și incluse `n venitul realizat. ~n acest context trebuie precizat faptul că reglementarea specială, a jocurilor de noroc din România, prevede faptul că licența de organizare și autorizația de exploatare a jocurilor de noroc permit operatorului economic care le-a obținut să desfășoare activitatea pe `ntregul teritoriul României, fără a fi necesară obținerea de autorizații, aprobări, taxe suplimentare, avize ori licențe din partea altor autorități.

Prin urmare orice modificare sau restrângere unilaterală, din partea statului, a condițiilor impuse la data acordării acestui drept, `n privința desfășurării activității, prin introducerea unor restricții, de orice tip (a timpului, a spațiului ori selectarea jucătorilor) și pe care organizatorii de jocuri de noroc nu puteau să le anticipeze, la momentul obținerii licenței sau autorizației, trebuie să constituie motive legale și suficiente pentru recalcularea și ajustarea taxelor datorate.

De altfel statul recunoaște și confirmă cele de mai sus, prin adoptarea art. IV din OUG 106/2020, stabilind faptul că taxele aferente autorizațiilor de exploatare a jocurilor de noroc nu sunt datorate, de către operatorii care exploatează jocuri de noroc tradiționale, pe perioa-

Destul de bizară, această interpretare arbitrară, `n condițiile `n care norma legală nu are nici o prevedere fermă și clară a faptului că ajustarea taxelor nu se referă și la suspendarea parțială a activității, așa cum se `ntâmplă, practic, `n această perioadă, respectiv, suspendarea a 70% din suprafața maximă de exploatare, suspendarea programului de lucru pentru anumite perioade sau intervale de timp, suspendarea activității pentru jucătorii nevaccinați etc.

Moreover, the state recognizes and confirms the above, by adopting art. IV of GEO 106/2020, establishing that the fees related to gambling exploitation authorizations are not due, by the operators operating traditional gambling, during the alert state, in the conditions in which the activity carried out by them is suspended. In practice so far, but without relying on any legal basis, the competent authorities are trying to restrict this right to adjust the fees due, considering that this adjustment can be applied only if the gambling activity is completely suspended. Quite bizarre, this arbitrary interpretation, given that the legal norm has no firm and clear provision that the adjustment of taxes does not refer to the partial suspension of activity, as is practically the case during this period, respectively, suspension of 70% of the maximum operating area, suspension of the work schedule for certain periods or time intervals, suspension of activity for unvaccinated players, etc.

It should also be noted here that, in situations where the competent authorities find that the regulation is not clear and comprehensive enough, for the above force majeure situations, instead of interpreting the legal provisions arbitrarily and unarguedly and before taking any action, or to the contrary, it should implement the principles governing any practical situations which could not be clearly and fully covered by the legal rule, such as: - the principle of fiscal neutrality - which precludes, in particular, the provision of similar services, which are there-

re se află, așadar, `n concurență unele față de celelalte, să fie tratate diferit, așa cum s-ar `ntâmpla dacă organizatorii de jocuri de noroc ar trebui să plătească integral taxele de autorizare anuale, stabilite `n sumă fixă, față de organizatorii de jocuri de noroc care recalculează taxele `n funcție de venitul realizat (dar la care, prin restricțiile impuse, venitul realizat se diminuează și atunci și taxa datorată se diminuează) sau față de același tip de activitate, dar care se desfășoară `n localități diferite și care, la rândul lor, pot avea restricții care diferă `ntre ele, dar ar fi obligați să plătească același nivel de taxe; - principiul privind certitudinea impunerii, prin elaborarea de norme juridice clare, care să nu conducă la interpretări arbitrare, iar termenele, modalitatea și sumele de plată să fie precis stabilite pentru fiecare plătitor, respectiv aceștia să poată urmări și `nțelege sarcina fiscală ce le revine, precum și să poată determina influența deciziilor lor de management financiar asupra sarcinii lor fiscale; - dacă organizatorii de jocuri de noroc, afectați de deciziile restrictive privind activitatea desfășurată, impuse de stat, dar fără să le poată anticipa și fără posibilitatea de a se opune sau de a recalcula și ajusta taxele datorate, `nseamnă că ei trebuie să suporte atât pierderea proprie de venituri, ba mai mult decât atât, să suporte și pierderile pe care statul ar trebui să și le asume, ca urmare a deciziilor luate. Acest tratament discriminator `ncalcă flagrant principiul privind justețea impunerii sau echitatea fiscală - principiu care trebuie să asigure faptul că sarcina fiscală, a fiecărui contribuabil, este stabilită pe baza puterii contributive, respectiv `n funcție de mărimea veniturilor sau a proprietăților acestuia; Ca urmare a măsurilor succesive de prelungire a stării de alertă, pe `ntreg teritoriul țării, instituită prin hotărâri ale guvernului, organizatorii jocurilor de noroc tradiționale, pot să pună `n aplicare măsuri practice, `n scopul atenuării consecințelor economico-soci-

ale și pentru protejarea afacerilor.

Având `n vedere faptul că obligațiile bugetare, ale organizatorilor de jocuri de noroc, se stabilesc pe bază de declarație de impunere, singura soluție, pentru stabilirea situației de fapt fiscală, `n baza căreia se stabilește existența drepturilor și obligațiilor fiscale, o reprezintă recalcularea și ajustarea taxelor speciale, pe baza declarațiilor rectificative (depuse `n interiorul termenului legal de prescripție), cu unicul scop ca acestea să reprezinte, `n final, determinarea corectă a situației fiscale a contribuabilului.

Desigur, ulterior, organul fiscal poate să examineze, `n mod obiectiv, starea de fapt și este `ndreptățit să aprecieze, `n limitele atribuțiilor și competențelor ce `i revin, relevanța stărilor de fapt fiscale prin utilizarea mijloacelor de probă prevăzute de lege și să adopte soluția `ntemeiată pe prevederile legale, precum și pe constatări complete asupra tuturor `mprejurărilor edificatoare `n cauză, raportat la momentul luării unei decizii.

This discriminatory treatment blatantly violates the principle of tax fairness or fiscal equity - a principle that must ensure that the tax burden of each taxpayer is determined on the basis of contributory power, respectively according to the size of his income or property; As a result of successive measures to extend the state of alert throughout the country, established by government decisions, the organizers of traditional gambling, can implement practical measures to mitigate the economic and social consequences and to protect business.

Given the fact that the budgetary obligations of gambling organizers are established on the basis of a tax return, the only solution for establishing the fiscal situation, based on which the existence of fiscal rights and obligations is established, is the recalculation and adjustment. special taxes, based on the amending declarations (submitted within the legal limitation period), with the sole purpose that they represent, in the end, the correct determination of the taxpayer's tax situation.

Of course, the tax authority may subsequently examine the facts objectively and is entitled to assess, within the limits of its powers and competences, the relevance of the tax facts by using the means of proof provided by law and to adopt the substantiated solution. on the legal provisions, as well as on complete findings on all the edifying circumstances in question, reported at the moment of taking a decision.

1. Cadrul legislativ Tombola reprezintă categorie de jocuri de noroc prevăzută expres, reglementată de Ordonanța de urgență 77/2009 privind organizarea și exploatarea jocurilor de noroc (OUG 77/2009) și de Normele metodologice din 2016 de punere `n aplicare a OUG 77/2009 (Normele metodologice). Potrivit art. 10 alin. (1) lit. n) din OUG 77/2009, tombola prezintă următoarele caracteristici: l Reprezintă o activitate de extragere de numere, de litere sau de alte simboluri, indiferent de caracteristicile dispozitivelor mecanice, electronice, digitale sau video, utilizate pentru generarea acestora sau pentru efectuarea extragerilor (cupe, urne, roți și alte asemenea mijloace); l Poate fi desfășurată ca joc de noroc tradițional sau ca joc de noroc la distanță (online); l Poate fi organizată sau nu `n prezența fizică a jucătorilor; l Premiile `n cadrul tombolei pot fi acordate doar `n natură, fiind fixe, și nu depind de numărul și prețul biletelor vândute, al taloanelor, al jetoanelor și al altor mijloace care atestă participarea la tombolă; l Valoarea premiilor nu poate fi mai mică de 50% din valoarea totală a mizelor plătite pentru participarea la tombolă; l Numărul câștigătorilor este `n prealabil stabilit, aceștia fiind desemnați prin extragere aleatorie; l Tombola se organizează `n baza unui regulament afișat `n prealabil (`n locație sau pe pagina web) și aprobat de Comitetul de Supraveghere al O.N.J.N. Legiuitorul a dedicat și o secțiune specială, `nsă doar pentru tombola - joc tradițional, respectiv art. 108-110 din Normele metodologice. Astfel, `n art.

108 este definită tombola – joc tradițional, definiția fiind asemănătoare cu cea prevăzută `n art.

10 alin. (1) lit. n) din OUG 77/2009, precizându-se că extragerile din cadrul tombolei se realizează prin folosirea unui sistem informatic independent a unor dispozitive specifice mecanice sau electronice, iar `n art. 109-110 se stabilesc o serie de condiții specifice pentru organizarea jocurilor tradiționale

cu tombole. ~n primul rând, operatorii eco­ no­mici care intenționează să or­ ganizeze o tombolă – joc tradi­ țio­nal, trebuie să dețină biletele de participare la tombolă tipărite doar de Compania Națională “Imprimeria Națională” - S.A. De asemenea, trebuie să fie constituit un comitet format din 5 membri care să gestioneze și să valideze fiecare ediție de joc (tombolă), ediții ce vor fi evidențiate pe hârtia imprimantei calculatorului.

Hârtia imprimantei calculatorului reprezintă un document contabil și va prevedea obligatoriu o serie de date, și anume: enumerarea cronologică a extragerilor organizate `n cadrul ediției de joc, după caz, data și ora `nceperii fiecărei extrageri, ora `ncheierii, prețul biletelor de participare vândute pentru fiecare joc, intervalul de serie vândut pentru fiecare extragere, intervalul seriilor de bilete de participare anulate pentru fiecare extragere, premiul acordat pentru fiecare joc, valoarea individuală a fiecărui premiu acordat, numărul și seria biletelor de participare desemnate câștigătoare pentru fiecare joc, validarea fiecărui joc.

La sfârșitul fiecărei ediții de joc, sistemul informatic deținut de organizator va opera sinteza jocurilor, numărul de jocuri executate, sumele `ncasate, valoarea premiilor acordate și alte date sintetice. După această sinteză, hârtia de imprimantă va fi barată, urmând ca situația ediției de joc să fie verificată și semnată de fiecare membru al comitetului de validare. Fiecare dintre semnatari va `nscrie personal numele, ora semnării, funcția, urmate de semnătură.

La finalul acestei proceduri, comitetul de validare a premiilor va `ntocmi procese verbale pentru fiecare ediție de joc. Procesele verbale sunt transmise și către ONJN, `n cel mult 3 zile lucrătoare, `mpreună cu evidența biletelor de participare din gestiunea organizatorului cu evidențierea biletelor de participare vândute pentru jocul de noroc respectiv. Organizatorul trebuie lunar să `ntocmească o situație pentru jocul de tip tombolă (inclusă `n situația veniturilor lunare).

1. Legislative framework Raffle is a category of gambling expressly provided for, regulated by Emergency Ordinance 77/2009 on the organization and operation of gambling (GEO 77/2009) and the 2016 Methodological Norms for the implementation of GEO 77/2009 (Methodological Norms). According to art. 10 para. (1) let. n) of GEO 77/2009, the raffle has the following characteristics: l Represents an activity of extracting numbers, letters or other symbols, regardless of the characteristics of mechanical, electronic, digital or video devices, used for their generation or for performing extractions (cups, urns, wheels and other such means); l It can be played as a traditional gamble or as a remote gamble (online); l It can be organized or not in the physical presence of the players; l Prizes in the raffle can only be awarded in kind, being fixed, and do not depend on the number and price of tickets sold, coupons, chips and other means of participation in the raffle; l The value of the prizes cannot be less than 50% of the total value of the stakes paid for participation in the raffle; l The number of winners is determined in advance, and they are designated by random draw; l The raffle is organized based on a regulation posted in advance (on location or on the website) and approved by the Supervisory Committee of the O.N.J.N. The legislator also dedicated a special section, but only for the raffle – traditional game, respectively art. 108-110 of the Methodological Norms. Thus, in art. 108 is defined raffle – traditional game, the definition being similar to the one provided in art. 10 para.

(1) let. n) of GEO 77/2009, specifying that the extractions from the raffle are made by using an independent computer system of specific mechanical or electronic devices, and in art. 109-110 establish a series of specific conditi-

ons for the organization of traditional games with raffles.

First of all, the economic operators that intend to organize a raffle – traditional game, must hold the raffle participation tickets printed only by the National Company “Imprimeria Naționala” – S.A. A 5-member committee must also be set up to manage and validate each game edition (raffle), editions that will be highlighted on the computer printer’s paper.

The computer printer paper is an accounting document and will provide a series of data, namely: chronological enumeration of draws organized during the game edition, as appropriate, the date and time of start of each draw, end time, price of tickets sold for each game, the range of series sold for each draw, the range of canceled ticket series for each draw, the prize awarded for each game, the individual value of each prize awarded, the number and series of winning tickets designated for each game, the validation of each game.

At the end of each game edition, the computer system owned by the organizer will operate the synthesis of the games, the number of games played, the amounts collected, the value of the prizes awarded and other synthetic data. After this synthesis, the printer paper will be crossed out, and the status of the game edition will be checked and signed by each member of the validation committee. Each of the signatories will personally enter the name, time of signing, position, followed by the signature.

At the end of this procedure, the prize validation committee will draw up minutes for each edition of the game. The minutes are also sent to the ONJN, in maximum 3 working days, together with the record of the participation tickets from the management of the organizer with the highlighting of the participation tickets sold for the respective game of chance.

The organizer must draw up a monthly statement for the raffle game (included in the monthly income statement).

2. Licența și autorizația pentru organizarea jocurilor de noroc de tip tombolă Fiind o categorie expresă de jocuri de noroc, operatorii economici trebuie să dețină licență de organizare și autorizație de exploatare emise de ONJN pentru a desfășura tombola. Trebuie precizat că, potrivit legislației, tombola este considerată joc de noroc doar dacă desfășurarea acesteia generează venituri/profit pentru organizator din colectarea taxelor de participare ale jucătorilor. Această concluzie se desprinde din dispozițiile art. 11 alin.

(1) lit. a) din OUG 77/2009, care stabilesc că nu sunt considerate jocuri de noroc de tip tombolă și prin urmare sunt permise fără autorizare, tombolele organizate `n școli, `n grădinițe sau `n alte colectivități, precum și cele organizate de asociații sau fundații nonprofit și care au un caracter distractiv și nonprofit pentru organizatori. Caracterul tombolei este considerat nonprofit atunci când suma totală a taxei de participare este egală cu suma totală a premiilor câștigate, același principiu aplicându-se și atunci când este vorba de bunuri sau altele asemenea.

Cu această ocazie, mențio­năm că `n cazul jocurilor de noroc la distanță (online), licența de organizare nu este specifică produsului, spre deosebire de autorizație care este specifică și trebuie obținută pentru fiecare activitate de jocuri de noroc `n parte ce se intenționează a fi desfășurată, respectiv jocurile de noroc prevăzute `n art. 10 alin. (1) lit. a)-n) din OUG 77/2009. Prin urmare, pentru organizarea și exploatarea tombolei – joc la distanță, dacă un operator deține licența clasa I pentru organizarea jocurilor de noroc la distanță (online), va fi necesar să obțină doar autorizație pentru exploatarea tombolei – joc la distanță, `n caz contrar, trebuind să obțină atât licență, cât și autorizație specifică. ~n schimb, `n ceea ce privește tombola – joc tradițional, operatorii economici, indiferent dacă dețin sau nu licență (clasa I) de organizare și autorizație de exploatare pentru altă categorie de jocuri de noroc, trebuie să obțină atât

2.1. Licența de organizare a jocurilor de tip tombolă Pentru obținerea licenței de organizare a tombolei, joc de noroc tradițional sau joc de noroc la distanță, legislația nu prevede dispoziții speciale, astfel că se vor aplica regulile generale pentru obținerea unei licențe de organizare a jocurilor de noroc clasa I. ~n linii mari, obținerea licenței este reglementată de art. 15 din OUG 77/2009 și de prevederile din Anexa nr. 6 la Normele metodologice.

Astfel, pentru obținerea licenței de organizare a jocurilor de noroc tradiționale sau la distanță, un operator economic trebuie să facă dovada: i) existenței ca obiect principal de activitate organizarea de jocuri de noroc; ii) existenței avizului organelor de poliție acordat reprezentanților legali, precum și asociaților/acționarilor persoanei juridice; iii) constituirii capitalului social subscris și vărsat și a garanțiilor `n cuantumul prevăzut `n prezenta ordonanță de urgență, iv) lipsei de fapte `nscrise `n cazierul penal sau fiscal.

It should be noted that, according to the legislation, the raffle is considered a game of chance only if its development generates income / profit for the organizer from the collection of player participation fees. This conclusion follows from the provisions of art.

11 para. (1) lit. a) of GEO 77/2009, which establish that raffle games are not considered and therefore are allowed without authorization, raffles organized in schools, kindergartens or other communities, as well as those organized by non-profit associations or foundations and which are fun and nonprofit for the organizers. The character of the raffle is considered non-profit when the total amount of the participation fee is equal to the total amount of the prizes won, the same principle being applied when it comes to goods or similar.

On this occasion, we mention that in the case of remote gambling (online), the organization license is not specific to the product, unlike the authorization which is specific and must be obtained for each individual gambling activity that is inten-

2.1. License to organize raffle games In order to obtain a license to organize a raffle, traditional gambling or remote gambling, the legislation does not provide for special provisions, so the general rules for obtaining a license to organize gambling class I will apply. Broadly speaking, obtaining of the license is regulated by art. 15 of GEO 77/2009 and the provisions of Annex no. 6a to the Methodological Norms.

Thus, in order to obtain the license to organize traditional or remote gambling, an economic operator must prove: i) the existence as a main object of activity the organization of gambling; ii) the existence of the approval of the police bodies granted to the legal representatives, as well as to the associates / shareholders of the legal person; iii) the constitution of the subscribed and paidin share capital and of the guarantees in the amount provided in this emergency ordinance, iv) the lack of facts registered in the criminal or fiscal record.

An important role in the licensing process is played by the legal representative, who, through a statement on his own responsibility, will certify that the operator, as well as the administrator and the real beneficiaries, ha-

va atesta faptul că operatorul, precum și administratorul și beneficiarii reali, nu au fost condamnați penal și nu se află `ntr-o stare de incompatibilitate pentru organizarea jocurilor de noroc, faptul că nu au fost luate măsuri de administrative (anulare, revocare, suspendare licență sau autorizație) `mpotriva operatorului, că acționarii/administratorii nu au `ndeplinit aceste funcții la o societate care a intrat `n faliment, că administratorul are experiență `n domeniul jocurilor de noroc și cunoaște legislația jocurilor de noroc.

Operatorul economic trebuie să facă și dovada existenței sistemului informatic centralizator și dovada dreptului de proprietate sau folosință asupra drepturilor de proprietate intelectuală utilizate. ~n plus, numai pentru jocurile de noroc la distanță, operatorii economici să facă și dovada `ndeplinirii cumulativ a: i) existenței unui cont bancar pentru depozitarea fondurilor jucătorilor deschis la o bancă din România; ii) certificării `ntregului sistem informatic utilizat; iii) amplasării pe teritoriul național a serverului de siguranță și `n oglindă. Astfel cum am precizat, operatorii care dețin deja licență clasa I pentru organizarea jocurilor de noroc la distanță nu vor mai parcurge această procedură.

Având `n vedere că pentru acordarea licenței clasa I se prevede obligația pentru operatorul economic de a avea un capitalul social subscris `n limita prevăzută de OUG 77/2009, din analiza dispozițiilor legale, `n special prevederile pct. 2 din Anexa la OUG 77/2009, observăm că nu este prevăzută o astfel de limită și pentru jocurile de noroc de tip tombolă, de unde se poate trage concluzia că pentru obținerea licenței de organizare a jocurilor de noroc de tip tombolă, fie tradiționale, fie online, nu există obligația deținerii unui capital social minim. ~n ceea ce privește costurile obținerii licenței, pentru tombolă – joc tradițional, taxa licență este 5.000 euro (pct. 1, subpct. I, lit. O din Anexa la OUG 77/2009). Pentru tombolă – joc la distanță, dacă operatorul nu deține licență pentru jocurile de noroc la distanță, va trebui să achite taxa de licență,

a cărei valoare se calculează `n funcție de cifra de afaceri a organizatorului și poate varia de la 6.000 euro până la 120.000 euro (pct.1 lit. J din Anexa la OUG 77/2009). Dacă operatorul deține o astfel de licență, `ntrucât licența nu este specifică produsului, nu va mai exista obligația achitării taxei de licență și pentru organizarea tombolei – joc la distanță.

2.2. Autorizația de exploatare a jocurilor de noroc de tip tombolă Plecând de la legislația aplicabilă, se observă că obținerea autorizației de exploatare a jocurilor de noroc de tip tombolă – joc tradițional este reglementată expres `n Anexa nr. 7 Cap. 1 Subcap. 1 pct. I subpct. (7) lit.

G), `nsă jocurile de noroc de tip tombolă – joc la distanță nu se bucură de o astfel de reglementare expresă `n ceea ce privește obținerea autorizației de exploatare. Prin urmare, pentru autorizarea tombolei – joc de noroc la distanță se vor aplica prevederile pentru autorizarea jocurilor de noroc la distanță `n general. Cu toate acestea, `n principiu, autorizarea ambelor tipuri de tombolă presupune deținerea, `ntocmirea și depunerea unor documente asemănătoare, diferențele fiind determinate mai mult de deosebirile specifice dintre jocurile de noroc tradiționale și cele la distanță. ~n primul rând, pentru autorizarea tombolei - joc de noroc tradițional, trebuie constituit și de-

In addition, only for remote gambling, economic operators to prove the cumulative fulfillment of: i) the existence of a bank account for depositing players’ funds opened with a bank in Romania; ii) certification of the entire computer system used; iii) the location on the national territory of the firewall and in the mirror. As mentioned, operators who already have a class I license for the organization of remote gambling will no longer go through this procedure.

Considering that for the granting of the class I license, the obligation for the economic operator to have a subscribed share capital within the limit provided by GEO 77/2009, from the analysis of legal provisions, in particular the provisions of point 2 of the Annex to GEO 77/2009, we note that there

is no such limit for raffle gambling, from which it can be concluded that in order to obtain a license to organize raffle gambling, either traditional or online, there is no obligation to hold a capital social minimum.

Regarding the costs of obtaining the license, for the raffle - traditional game, the license fee is 5,000 euros (point 1, sub-point I, letter O of the Annex to GEO 77/2009). For raffle - remote game, if the operator does not have a license for remote gambling, you will have to pay the license fee, the value of which is calculated according to the turnover of the organizer and can vary from 6,000 euros to 120,000 euro (point 1 letter J of the Annex to GEO 77/2009). If the operator holds such a license, as the license is not specific to the product, there will be no obligation to pay the license fee and to organize the raffle - remote play.

2.2. Authorization to operate raffle gambling Starting from the applicable legislation, it is observed that the obtaining of the authorization for the exploitation of raffle-type gambling – traditional game is expressly regulated in Annex no. 7 Chap. 1 subchap. 1 point I subpct. (7) let. G), but the raffle-type gambling – remote game does not enjoy such an express regulation regarding the obtaining of the exploitation authorization. Therefore, for the authorization of the raffle – remote gambling will apply

pus spre aprobarea Comitetului de supraveghere al ONJN regulamentul de joc aplicabil tombolei. Acesta va cuprinde obligatoriu: l dispoziții privind modalitatea de desfășurare a activității; l cota procentuală acordată pentru câștiguri din totalul rulajului `ncasărilor; l natura și valoarea totală a câștigurilor acordate (care nu poate fi mai mică de 50% din valoarea totală a mizelor plătite pentru participarea la tombolă); l numărul minim de participanți la fiecare ediție de joc; l perioada prevăzută pentru achiziționarea biletelor de participare la joc; l data extragerii și locația `n care aceasta se realizează.

Regulamentul de joc este obligatoriu și `n cazul autorizării tombolei – joc de noroc la distanță, având `n vedere, pe de o parte, dispozițiile art. 10 alin. (1) lit. n din OUG 77/2009, potrivit cărora câștigătorii - un număr prestabilit de participanți - vor fi stabiliți prin extragere aleatorie `n conformitate cu un regulament afișat `n prealabil și aprobat de Comitetul de Supraveghere al O.N.J.N., și pe de altă parte prevederile generale privind autorizarea jocurilor de noroc la distanță, care stabilesc că `n vederea autorizării, trebuie depus regulamentul de funcționare a fiecărui joc `n parte (pct. 3 din Anexa 7 cap. 2 subcapitolul 2 pct. II (1).

Totodată, toate mențiunile obligatorii pe care trebuie să le cuprindă regulamentul de joc pentru tombolă – joc tradițional, precizate mai sus, deși nu sunt prevăzute expres și pentru tombolă – joc la distanță, va fi necesar să se regăsească, `n fapt, și `n regulamentul de joc aplicabil tombolei – joc la distanță, pentru că doar astfel se poate garanta `ndeplinirea tuturor cerințelor prevăzute expres `n art. 10 alin. (1) lit. n) din OUG 77/2009. Ca o mențiune, `n timp ce regulamentul de joc pentru tombolă – joc tradițional trebuie să prevadă locația `n care tombola se va organiza, regulamentul de joc pentru tombolă – joc la distanță trebuie să prevadă platforma online prin intermediul căreia se va organiza tombola.

~n vederea obținerii autorizației pentru tombola – joc de noroc tradițional, trebuie depusă și o descriere amănunțită a activității, inclusiv schița spațiilor de joc, cu locul de amplasare a mijloacelor de joc de bază și auxiliare. ~n plus, operatorul economic trebuie să facă dovada dreptului de proprietate sau de folosință a spațiului de joc și dovada că spațiul `n care se va desfășura tombola este `nregistrat ca punct de lucru la Oficiul Registrului Comerțului competent.

Cu privire la mijloace de joc utilizate pentru organizarea tombolei, operatorii trebuie să aibă `n vedere ca mijloacele de joc să fie verificate tehnic de un organism de evaluare licențiat clasa a II-a și să facă dovada provenienței legale a mijloacelor de joc de bază și auxiliare. ~n mod specific pentru tombola – joc tradițional, operatorul trebuie să elaboreze un ansamblu de norme privind organizarea și desfășurarea tombolei, care vor fi cuprinse `ntr-un regulamentul de ordine interioară. Acest regulament este structurat `n două părți: partea generală, `n cuprinsul căreia vor fi menționate prevederile obligatorii conform legislației muncii, și partea specială, `n care vor fi precizate detaliat: sarcinile și atribuțiile personalului, sistemul de evidență financiar-contabilă, modul de asigurare a securității documentelor, a valorilor și altele.

Cu privire la autorizarea tombolei – joc la distanță, operatorii trebuie să dețină `n mod legal dreptul de utilizare cu privire la programului informatic. Cu privire la mijlocele de joc, se impune dovedirea dreptului de proprietate sau de utilizare asupra mijloacelor de joc și asupra echipamentelor tehnice care asigură suportul pentru organizarea, exploatarea și transmiterea jocurilor de noroc. Aceste echipamente tehnice trebuie să fie auditate și deopotrivă, programul de joc, cota procentuală teoretică de premiere (RTP) și generatorul de numere aleatorii (RNG) să fie certificate de un organism licențiat clasa a II-a de către ONJN. ~n mod specific pentru autorizarea tombolei – joc de noroc la

However, in principle, the authorization of both types of raffle involves the possession, preparation and submission of similar documents, the differences being determined more by the specific differences between traditional and remote gambling.

First of all, for the authorization of the raffle – traditional gambling, the gambling regulations applicable to the raffle must be established and submitted for the approval of the Supervisory Committee of the ONJN. It must include: l provisions on how to carry out the activity; l the percentage granted for earnings from the total turnover of receipts; l the nature and total value of the winnings granted (which may not be less than 50% of the total value of the stakes paid for participation in the raffle); l the minimum number of participants in each edition of the game; l the period provided for the purchase of game participation tickets; l the date of extraction and the location where it is carried out.

The rules of the game are also mandatory in the case of authorizing the raffle – remote gambling, taking into account, on the one hand, the provisions of art. 10 para. (1) lit. n of GEO 77/2009, according to which the winners – a predetermined number of participants – will be determined by random draw in accordance with a pre-posted regulation approved by the O.N.J.N. Supervisory Committee, and, on the other hand, the general provisions on the authorization of remote gambling, which state that in order to be authorized, the rules of operation of each game (point 3 of Annex 7 chapter 2 subchapter 2 point II (1).

At the same time, all the obligatory mentions that must be included in the game regulation for the raffle – traditional game, specified above, although not expressly provided for the raffle – remote game, will be necessary to be found, in fact, in the game appli-

cable to the raffle – remote game, because only in this way can be guaranteed the fulfillment of all the requirements expressly provided in art. 10 para. (1) lit. n) of GEO 77/2009. As a mention, while the rules of the game for the raffle – traditional game must provide the location where the raffle will be organized, the rules of the game for the raffle – remote game must provide the online platform through which the raffle will be organized.

In order to obtain the authorization for the raffle – traditional gambling, a detailed description of the activity must be submitted, including a sketch of the gambling spaces, with the location of the basic and auxiliary gambling means.

In addition, the economic operator must prove the right of ownership or use of the gaming space and proof that the space in which the raffle will take place is registered as a working point at the competent Trade Register Office.

With regard to the means of play used for the organization of the raffle, operators must ensure that the means of play are technically verified by a licensed assessment body class II and prove the legal origin of the basic and auxiliary means of play.

Specifically for the raffle – traditional game, the operator must develop a set of rules on the organization and conduct of the raffle, which will be contained in a bylaw. This regulation is structured in two parts: the general part, in which the obligatory provisions according to the labor legislation will be mentioned, and the special part, in which the tasks and attributions of the staff, the financial-accounting system, the way of ensuring document security, values and more.

With regard to the authorization of the raffle – remote play, operators must legally have the right to use the software. With regard to the means of play, it is necessary to prove the right of ownership or use over the means of play and over the technical equipment that provides support for the organization, operation and transmission of games of chance. These technical

distanță, operatorul trebuie, să reglementeze condițiile privind utilizarea platformei de joc (termenele și condiții). ~n cazul ambelor tipuri de tombolă, `n vederea obținerii autorizației, trebuie să fie constituit un fond de garanție pentru acoperirea riscului de neplată a obligațiilor față de bugetul general consolidat și să se ateste, printr-o declarație pe proprie răspundere, că spațiul `n care urmează a fi exploatate mijloacele de joc, `n cazul tombolei – joc tradițional, respectiv `n cazul tombolei – joc la distanță, `n situația `n care dețin echipamentele tehnice pe teritoriul României, că spațiul/spațiile `n care urmează a fi instalate și utilizate echipamentele tehnice care asigură suportul pentru organizarea, exploatarea și transmiterea jocurilor de noroc, corespunde/ corespund din punct de vedere sanitar și respectă normele P.S.I. Nu este de neglijat faptul că operatorul trebuie să dețină dreptul de proprietate asupra bunurilor acordate ca premii și acestea să fie acordate câștigătorilor libere de orice sarcini.

Având `n vedere obligația de constituire a unui fond de garanție pentru ambele tipuri de tombolă și având `n vedere faptul că nu există o prevedere expresă referitoare la nivelul fondului de garanție pentru jocurile tip tombolă, apreciem că pentru stabilirea nivelului garanției pentru acoperirea riscului de neplată se va aplica nivelul fondului de garanție prevăzut de lege pentru jocurile de bingo, respectiv 5.000 euro, `ntrucât regimul aplicabil jocurilor de noroc de tip tombolă prezintă cele mai multe similarități cu regimul aplicabil jocurilor de bingo. ~n ceea ce privește costurile obținerii autorizației, pentru tombolă – joc tradițional, taxa pentru obținerea autorizației este `n valoare de 16% din veniturile din jocuri de noroc, realizate la nivelul organizatorului (cap. 1, subcap. II, lit. P din Anexa la OUG 77/2009). Pentru tombolă – joc la distanță, taxa de autorizație este `n valoare de 16% din veniturile din jocuri de noroc, realizate la nivelul organizatorului, dar nu mai puțin de 100.000 euro (cap. II lit. G din Anexa la OUG

77/2009), cu aceeași precizare ca `n cazul taxei de licență, și anume că taxa de autorizație va fi plătită doar de către operatorii care nu dețin autorizație de exploatare a jocurilor de noroc la distanță la momentul la care se dorește autorizarea jocurilor de noroc de tip tombolei.

3. Concluzii ~n concluzie, un operator economic poate desfășura tombola - joc de noroc numai `n baza deținerii unei licențe și autorizații de organizare și exploatare a jocurilor de noroc clasa I, valabil emise de ONJN, câtă vreme se intenționează să fie obținut un profit din colectarea taxelor de participare. Regulamentul tombolei ocupă un loc important, pe de o parte `n procesul de licențiere și autorizare, `ntocmirea acestuia fiind obligatoriu să fie realizată cu respectarea tuturor condițiilor legale, și pe de altă parte, `n relația cu participanții la tombolă, `ntrucât mecanismul tombolei trebuie explicat `n regulament `ntr-o manieră clară și previzibilă pentru ca jucătorii să `nțeleagă care sunt condițiile de participare.

Pentru organizarea unui tombole, nu trebuie pierdut din vedere și faptul că mijloacele de joc care stau la baza tombolei să fie certificate/auditate de un organism de evaluare a conformității, licențiat clasa a II-a, prin care să se asigure desemnarea câștigătorilor `n mod aleatoriu.

In the case of both types of raffle, in order to obtain the authorization, a guarantee fund must be set up to cover the risk of default on the general consolidated budget and certify, by a declaration on one’s own responsibility, that the space in which to be exploited the means of play, in the case of the raffle – traditional game, respectively in the case of the raffle – remote game, in case they have the technical equipment on the Romanian territory, that the space / spaces in which the technical equipment to be installed and used support for the organization, operation and transmission of gambling, complies / complies from a sanitary point of view and complies with PSI rules.

It should not be overlooked that the operator must own the goods awarded as prizes and be awarded to the winners free of any encumbrances.

In view of the obligation to set up a guarantee fund for both types of raffle and given that there is no express provision on the le-

vel of the guarantee fund for raffle games, we consider that in order to establish the level of guarantee to cover the risk of default will apply the level of the guarantee fund provided by law for bingo games, respectively 5,000 euros, as the regime applicable to raffletype gambling has the most similarities with the regime applicable to bingo games.

Regarding the costs of obtaining the authorization, for the raffle – traditional game, the fee for obtaining the authorization is worth 16% of the revenues from gambling, made at the level of the organizer (Chapter 1, Subchapter II, letter P of the Annex to OUG 77/2009). For the raffle – remote play, the authorization fee is worth 16% of the gambling income, made at the level of the organizer, but not less than 100,000 euros (Chapter II letter G of the Annex to GEO 77/2009), with the same specification as in the case of the license fee, namely that the authorization fee will be paid only by operators who do not have a remote gambling license at the time the raffle is authorized.

3. Conclusions In conclusion, an economic operator can conduct the raffle – gambling only on the basis of holding a license and authorizations for the organization and operation of gambling class I, validly issued by ONJN, as long as it is intended to obtain a profit from the collection of gambling fees participation. The raffle regulation occupies an important place, on the one hand in the licensing and authorization process, its elaboration being mandatory to be carried out in compliance with all legal conditions, and on the other hand, in relation to raffle participants, as the raffle mechanism must be explained in regulation in a clear and predictable manner so that players understand the conditions of participation. For the organization of a raffle, it should not be lost sight of the fact that the means of play underlying the raffle are certified / audited by a conformity assessment body, licensed class II, which ensures the designation of winners random.

u toate că, cel puțin la nivel declarativ, marea majoritate a operatorilor de jocuri de noroc `nțeleg responsabilitatea ce le revine `n cazul comunicării comerciale (publicității), prevederile legislative vagi, rămase la nivel de principii1, nu oferă un cadru legal clar, pe care operatorii și autoritățile să-l poată aplica fără echivoc2. De aici și ideea punerii `n dezbatere publică, la `nceputul anului 2018, `n calitate de președinte al ONJN, a Codul etic de comunicare responsabilă `n domeniul gamblingului. ~n cele ce urmează voi continua prezentarea celor mai importante prevederi ale acestui Cod. Așa cum am subliniat anterior, prevederile Codului nu ar fi avut caracter obligatoriu, ci ar fi reprezintat un set de norme de autoreglementare; pentru găsirea celor mai bune formulări sunt necesare discuții cu toți factorii interesați (operatori, organisme de reglementare, autorități, reprezentanți ai mass-media etc.).

Operatorii de jocuri de noroc online vor trebui să pună la dispoziția jucatorilor toate informațiile privind istoricul depunerilor, al sumelor jucate și al câștigurilor; ✔ Comunicarea trebuie să conțină cel puțin o atenționare care să transmită ideea de responsabilitate socială, `n sensul că practicarea unor jocuri de noroc `nseamnă un mod de a petrece timpul liber, asociat, eventual, cu ideea de a cheltui o anumită sumă de bani; ✔ Comunicarea comercială `n domeniul jocurilor de noroc trebuie să `ncurajeze jocul responsabil.

Exemplu: ”Jocurile de noroc sunt o modalitate de petrecere a timpului liber. Tu ai grijă să păstrezi controlul”. ~n ce privește conținutul propriu-zis al reclamelor: ✔ Comunicarea trebuie să fie clară, să nu se bazeze pe termeni vagi, care să poată induce `n eroare ori să amăgească jucătorii. Menționăm că versiunea 1.0 a Ghidului 10/2020 a fost adoptată la 15 dec. 2020, pentru consultare publică. ANS a semnalat adoptarea Ghidului `n site-ul propriu, la 21.10.2021.

tima de sine reprezintă un aspect fundamental pentru echilibrul nostru psihologic, deoarece ne afectează viața personală și cea profesională într-un mod pozitiv sau negativ, în funcție de nivelul la care se află. Pentru a putea evolua, pe toate dimensiunile gândirii și comportamentului nostru este necesar să o cultivăm zi de zi. Stima de sine reprezintă valoarea pe care neo acordăm, cea mai profundă idee pe care o avem despre noi înșine și despre calitățile pe care credem că le avem. Putem distinge 3 niveluri ale stimei de sine:

Stima de sine scăzută Când suntem la acest nivel, nu credem prea mult în resursele noastre și avem tendința de a ne concentra în principal pe defecte.

Stima de sine scăzută apare de obicei din situații de nesiguranță profundă experimentate în viață.

Stima de sine medie Când ne aflăm la nivelul unei stime de sine medii, suntem capabili să ne recunoaștem limitările, dar și resursele. Cu toate acestea, nu întotdeauna credem suficient în abilitățile noastre. În aceste cazuri, trebuie să ne încurajăm și să ne susținem la nivel conștient de câte ori este nevoie.

The weakening of beliefs triggered a negative thinking mechanism, which, repeated over time, was consolidated in our brain, creating true neural pathways. In reality, the ultimate goal of our action is precisely this, to be able to realize our desires and to overcome the difficulties that life inevitably presents to us. Unfortunately, there are days when we wake up without energy and motivation, we feel irritated and unhappy, to the point where we cannot find reasons to carry out our commitments and achieve our goals. We are afraid that others will not accept us, we believe that we are incapable and do not deserve enough, so our level of self-esteem decreases. It is normal to have such moments in our lives.

All we have to do is be convinced that we will overcome them. But

“The overall feedback has been people like us and appreciate the safety measures we did with COVID, but a complaint was we were just too small,” said Christopher Marzotto, marketing director of Spokane Tribe Casino. The expansion “allows us to spread out and give more amenities to players.”

The casino added more than 300 new slot machines and six table games. The casino will be reopening its craps table in late November, Marzotto said.

It’s in the process of hiring more staff and finalizing a partnership with “an industry-leading sportsbook partner” to bring sports betting to the casino, Marzotto said.

The Spokane Tribe received federal approval last month that allows sports wagering on tribal grounds.

When complete in November, the sportsbook is anticipated to be a significant draw to the casino, Marzotto said.

“I’m sure a lot of the players here will enjoy having the new amenity,” he said. “We’ll have a big TV board going in that will be able to be viewed throughout the casino.”

Whaluks, a casino-floor bar, will be rebranded into the Grill, a quickservice restaurant connected to the sports wagering area, Marzotto said.

Warner Gaming spearheaded development of the expansion project. Swinerton Builders of Spokane was the project contractor. The Minnesota-based Cuningham Group designed the expansion.

The casino expansion is expected to create more than 150 new jobs, Marzotto said. The casino will hold a grand opening celebration in the near future after all amenities are open, Marzotto said.

The project is the second phase of the Spokane Tribe’s $400 million economic development plan that calls for a hotel, convention center, dining, retail stores, entertainment center and a cultural center.

When complete in 2025, the Spokane Tribe’s hotel-casino property is expected to generate more than 2,000 jobs, Marzotto said.

“It’s a really exciting time to see the development and progress made, and there’s a bright future that’s ahead,” he said.

The West Plains is one of the fastest growing areas of the state with more than $750 million invested in land and buildings within the past two years, said Mark Losh, executive director of the West Plains Chamber of Commerce.

Losh said he thinks the casino expansion is a boon for the community. “Anytime that one of the businesses on the West Plains expands and grows means more economic development and jobs for the community,” he said. The expansion “helps overall growth on the West Plains.”

Spokane Tribe Chairwoman Carol Evans said she was excited about the project because the tribe had worked for years on obtaining approval to build the gaming complex on its ancestral homeland in Airway Heights.

“We are excited to be a part of the community and grow with Eastern Washington,” Evans said. “It’s a growing, thriving region and we’re just really excited to be able to provide a good place for people to eat a meal or have entertainment. I feel good about that and at the same time, we’re providing jobs for the area and our people.”
