Apparently the conflict / special operation in Ukraine is going to last and slowly the world is losing interest in it.

După câte se vede conflictul/operațiunea specială din Ucraina are de gând să dureze și, încet-încet, lumea își pierde interesul pentru ea. Și totuși postacii, răspândacii și influensării care au umplut netul cu știința lor plurivalentă trebuie să trăiască în continuare. Și așa, pe neștiute, se insinuează primele idei despre un neașteptat val 6 al pandemiei, cu un și mai neașteptat virus mutant (al câtelea oare?).

Încetarea stării de alertă pe teritoriul României...

România și implicit industria jocurilor de noroc tradiționale au parcurs timp de mai bine de doi ani una dintre cele mai dificile perioade din istoria recentă. Cu toate că a fost o perioadă plină de provocări și fără precedent, `n cele din urmă efortul nostru comun a dat roade.

Mulțumesc industriei pentru responsabilitatea de care a dat dovadă, pentru că a `nțeles să respecte regulile de protecție sani­tară și au ales să se vaccineze, limitând astfel răspândirea pandemiei, `mpreună reușind să depășim momente grele. ~ncepând cu 9 martie și-a `ncetat aplicabilitatea Hotărârea Guvernului nr. 171 din 3 februarie 2022 privind prelungirea stării de alertă pe teritoriul României și stabilirea măsurilor care se aplică pe durata acesteia pentru prevenirea și combaterea efectelor pandemiei de COVID-19, astfel, `ncepând cu aceeași dată, au `ncetat toate restricțiile, precum și restrângerea sau interzicerea unor activități așa cum erau prevăzute `n actul normativ menționat.

Nu este un secret că `ntreaga industrie a fost afectată `n acești ultimi 2 ani dar datorită experienței acumulată de operatori dublată cu măsurile adoptate de guvern `n perioada pandemiei lucrurile vor intra ușor `n normalitate.

Vă reamintesc cu această ocazie că `n conformitate cu prevederile Legii nr. 55 din 15 mai 2020 privind unele măsuri pentru prevenirea și combaterea efectelor pandemiei de COVID-19: ”Valabilitatea documentelor eliberate de instituțiile și autoritățile publice, precum și de entitățile private autorizate conform legii se menține pe toată perioada stării de alertă, precum și pentru o perioadă de 90 de zile de la `ncetarea acestei stări”.

La `nceput de an, urmare efortului nostru comun continuu am reușit să ducem la bun sfârșit proiectul reglementărilor sectoriale `n domeniul prevenirii și combaterii spălării banilor și a finanțării terorismului, proiect `n cadrul căruia un aport important a fost adus de reprezentanții pieței prin consiliul consultativ.

Este primul proiect cu impact de amploare, care deși apare mai târziu decât ne-am propus, este un exemplu de dimensiuni europene și internaționale.

Riscurile de spălare a banilor și de finanțare a terorismului reprezintă o preocupare majoră pentru sistemul financiar al Uniunii Europene și pentru securitatea cetățenilor săi.

Din 2018, Uniunea Europea­ nă are `n vigoare norme mai stric­te `n materie de combatere a spălării banilor. Aceste norme `ngreunează ascunderea fon-

Argumentele care motivează lip­sa de reacție a autorității sunt numeroase, enumerarea lor nefiind importantă. Este vital să știm cine suntem, astăzi, ca să putem proiecta unde ne dorim să ajungem, mâine. E un drum etapizat, iar fiecare nou an trebuie să fie un pas `nainte pe acest drum.

Jocurile de noroc nu ar trebui niciodată să aibă un cost uman de aceea este important cum promovăm jocurile de noroc mai sigure `n comunitate, ajutând păr­ țile interesate din industrie să diminueze riscurile și să minimizeze daunele și să descoperim noi perspective despre jocurile de noroc și impactul acestora asupra oamenilor, afacerilor și comunităților.

Căutăm să influențăm schim­ bări pozitive și să promovăm stan­dardele de jocuri de noroc responsabile deoarece oamenii au dreptul să se simtă `n sigu­ ranță, să trăiască fericiți și să aibă acces la sprijin atunci când au nevoie. Parteneriatele cu industria jocurilor de noroc pot minimiza riscurile pentru clienții

lor, reputația și performanța lor comercială, prin crearea de comportamente sigure și durabile `n domeniul jocurilor de noroc be­ ne­ficiază atât jucătorii, cât și industria.

Ca o noutate, urmare a dis­ cuțiilor purtate `n cadrul Ministerului Finanțelor cu reprezentanții Rombet și a concluziilor desprinse după această `ntâlnire, Oficiul Național pentru Jocuri de Noroc are `n vedere reanalizarea reglementărilor `n ce privește jocul responsabil, pentru a se putea operaționaliza activitatea de prevenție, educație și tra­ta­re. ~n acest sens, prima so­luție adop­ tată pentru deblocarea activității Serviciului Promovare Joc Responsabil din cadrul ONJN, a fost revederea condițiilor de ocu­ pa­ re a posturilor vacante, res­pec­tiv prin transformarea pos­tu­ri­lor va­cante din personal con­trac­tual `n func­ționari publici, ast­fel ni­ve­lul de sa­larizare fiind mai atrac­tiv.

După ocuparea tuturor posturilor SPJR va fi finalizată procedura sub condițiile căreia veniturile activității proprii vor putea fi utilizate pentru prevenirea de­ pendenței de jocuri de noroc și vor fi alocate pentru activitățile și programele de protecție a tinerilor și a jucătorilor `mpotriva jocurilor de noroc, prevenirea și tratamentul dependenței de jocuri de noroc, realizarea promovării și publicității responsabile, soluțio­ narea promptă și eficientă a litigiilor dintre un organizator de joc și un jucător. ~n continuare ne asigurăm că interacțiunea dintre autoritate și operatori este fundamentată pe profesionalism, integritate și imparțialitate, cu `ncrederea că eforturile noastre comune sunt concentrate `n direcția corectă.

Ne-am asumat o misiune pe care intenționăm să o ducem la bun sfârșit, am ales acest lucru pentru că este greu, nu pentru că este ușor. Un sprijin real și un efort comun este al asociațiilor de profil, Rombet fiind cea mai activă asociație din industrie participând la un dialog constant atât cu Oficiul cât și cu celelalte instituții ale statului.

Gambling should never have a human cost, so it’s important how we promote safer gambling in the community, helping industry stakeholders reduce risk and minimize damage, and discover new perspectives on gambling and its impact. on people, businesses and communities.

We seek to influence positive change and promote responsible gaming standards because people have the right to feel safe, to live happily, and to have access to support when they need it. Partnerships with the gambling industry can minimize the risks to their customers, their

reputation and their business performance, by creating safe and sustainable gambling behaviors that benefit both players and the industry.

As a novelty, following the discussions held within the Ministry of Finance with the representatives of Rombet and the conclusions drawn after this meeting, the National Office for Gambling intends to reanalyze the regulations regarding responsible gaming, in order to operationalize the activity of prevention, education and treatment. In this sense, the first solution adopted to unblock the activity of the Responsible Gaming Promotion Service within ONJN, was to review the conditions for filling vacancies, respectively by transforming vacancies from contract staff into civil servants, so the salary level is more attractive.

Once all SPJR positions have been filled, the procedure will be completed under the conditions under which their own income will be used to prevent gambling addiction and will be allocated to activities and programs to protect young people and gamblers against gambling, prevention and treatment of addiction. gambling, responsible promotion and publicity, prompt and efficient resolution of disputes between a game organizer and a player.

Domnule Ghiță, România este o piață foarte interesantă, în care structura este exact aceeași cu celelalte teritorii.

După cum știm, site-urile web ale operatorilor ilegali sunt blocate, dar mai sunt câțiva operatori internaționali care își pot desfășura afacerea cu licențe internaționale. Ați putea detalia mai multe despre acest subiect, cum este reglementată piața și care sunt detaliile în acest sens?

Organizarea și funcționarea jocurilor de noroc online în România sunt reglementate în principal de prevederile Ordonanței de urgență a Guvernului nr. 77/2009 privind organizarea și exploatarea jocurilor de noroc și Normele metodologice de aplicare a OUG 77/2009, aprobate prin Hotărârea Guvernului nr.

111/2016.

Activitatea poate fi desfă­ șurată în România numai de către persoanele juridice care au licență de organizare și autorizație de exploatare a activităților de jocuri de noroc online eliberate de Oficiul Național pentru Jocuri de Noroc acelor persoane juridice care îndeplinesc cerințele legale românești. Site-urile web ilegale sunt într-adevăr, monitorizate și blocate prin decizie a Autorității pentru jocuri de noroc. În conformitate cu legislația în vigoare a jocurilor de noroc, sin­ gura autoritate română în

mă­ sură să acorde licențe de or­ga­ni­zare și autorizații de exploa­ ta­ re pentru activități de jocuri de noroc este Oficiul Național al Jo­curilor de Noroc, persoană ju­ri­dică în subordinea Guvernului României. În cadrul Oficiului Național pentru Jocurilor de Noroc func­ țio­nează Comitetul de Suprave­ ghere, structură constituită din re­ prezentanți ai autorităților implicate în domeniul jocurilor de noroc, direct sau indirect, având ca principale atribuții: i) acordarea operatorilor de jocuri de noroc a licențelor de organizare și a autorizațiilor de exploatare a activităților de jocuri de noroc; ii) eliberarea licențelor pentru operatorii care desfășoară activități conexe pentru operatorii de jocuri de noroc, în condițiile prevăzute de lege; iii) aplicarea reglementărilor privind jocurile de noroc și a re­ gulilor interne aplicabile operatorilor licențiați.

Conform legislației în vigoare, activitățile de jocuri de noroc online includ activitățile desfășurate numai prin sisteme de comunicare (internet, telefon sau alte mijloace similare) și care presupun acordarea aleatorie de către organizator a câștigurilor materiale către participant, percepând taxe directe sau indirecte, conform legislației în vigoare. Could you elaborate more on this topic, how the market is regulated and what are the details in this regard ?

Organisation and operation of online gambling in Romania are mainly governed by the provisions of Government Emergency Ordinance no.

77/2009 on gambling organisation and exploitation and the Methodological Norms for application of GEO 77/ 2009, approved by Government Decision no. 111/2016.

The activity may be carried out in Romania only by the legal entities having a licence to organize and an authorisation to exploit online gambling activities issued by the National Office for Gambling to those legal entities that satisfy the Romanian legal requirements. Illegal websites are indeed, monitored and blocked by decision of the Gambling Authority.

In accordance with the gambling legislation in force, the only Romanian authority able to grant licenses of organization and authorizations of exploitation for gambling activities

Within National Gambling Office operates the Supervisory Committee, a structure constituted by representatives of the authorities involved in gambling domain, directly or indirectly, having as main responsibilities: i) granting gambling operators the licenses for organizing and authorizations to exploit gambling activities; ii) issuing the licenses for the operators performing related activities for gambling operators, as required by the law; iii) enforcing gaming regulations and internal rules applicable for licensed operators.

According to the legislation in force, online gambling activitiesinclude the activities carried out only through communication systems (internet, telephone or other similar means) and that involve the organiser’s random award of material winnings to the participant, charging direct or indirect fees, as per the Rules of the Game, issued by the operator and approved by the National Gambling Office.

This category includes different types of games: online casino games (which includes on-line roulette , slot-machines and poker), on-line betting (fixed-odds, pari-mutuel, betting exchange), bingo and keno or raffle.

Jocuri de Noroc.

Această categorie include diferite tipuri de jocuri: jocuri de cazinou online (care includ ruleta online, slot-machine și poker), pariuri online (cote fixe, pari-mutuale, schimb de pariuri), bingo și keno sau tombolă.

Licența de organizare a ac­ ti­vităților de jocuri de noroc on­ line poate fi acordată operato­ri­ lor economici, români sau com­ pa­nii­lor înregistrate într-un stat membru al Uniunii Europene, într-un stat care este parte sem­na­tară a Acordului privind Spațiul Economic European sau în Con­federația Elvețiană.

Licența conferă proprieta­ ru­lui dreptul de a organiza acti­ vi­tăți de jocuri de noroc online pe o perioadă de 10 ani de la data eliberării, dacă operatorul respectă cerințele legale și cu condiția plății taxei de licență.

Taxa anuală pentru licență de organizare a jocurilor de noroc se stabilește în funcție de cifra de afaceri a organizatorului și are o valoare minimă de 6000 Euro (pentru startupuri) sau maxim 120.000 Euro, datorată de companiile cu cifra de afaceri anuală mai mare de 10 milioane EURO. Cifra de afaceri aferentă nu se leagă doar de activitățile de jocuri de noroc desfășurate pe teritoriul României, iar taxa de licență se stabilește pe baza tuturor veniturilor solicitantului pentru anul fiscal precedent.

Autorizația de exploatare a activităților de jocuri de noroc on­ line se acordă operatorilor ca­re dețin licență de organizare a unei astfel de activități sau care solicită simultan ambele documente.

Autorizația este valabilă pe o perioadă de 12 luni de la eliberare, care poate fi prelungită pentru perioade similare, la cererea operatorului și cu condiția dovedirii că nu s-a modificat temeiul eliberării acesteia.

ropean Economic Area Agreement or in the Swiss Confederacy.

The license grants to the owner the right to organize on-line gambling activity for a 10-year period from the date of issuance, if the operator complies with the legal requirements and under the condition of payment of the license fee.

The annual fee for gambling organising licence is determined by reference to the organiser’s turnover and it has minimum value of 6000 Euro (for startups) or maximum 120.000 Euro, due by the companies with annual turnover higher than 10 milion EURO. The relevant turnover shall not be connected only with gambling activity performed onto Romanian territory and the license tax shall be established based on all the incomes of the applicant for the previous fiscal year.

The authorisation to exploit online gambling activities is granted to operators holding a license to organize such activity or requesting simultaneously both documents.

The authorisation is valid for a period of 12 months since its issuance, that may be prolonged for similar periods, upon request of the operator and under the condition of proving that the basis for its issuance were not changed.

The annual authorization fee is 16% of the gross gaming revenues of the operator, but not less than 100.000 Euro. The minimum value of the tax shall be paid in advance, no later than the 25th of the month following the month when the request of the applicant was approved.

If the revenues exceed the minimum value (100.000 Euro), the tax is recalculated by applying the percentage shares to the revenues of the organizer.

Recalculation is made monthly, for the entire licence period, starting with the first month when the estimated results are exceeded.

De când piața on-line a fost reglementată, în 2015, România a devenit o destinație interesantă pentru investițiile străine.

Există 31 de licențe online valabile, dintre care doar 6 sunt deținute de investitori locali. Este de remarcat faptul că există un interes constant pentru piață și că, în contextul restricțiilor privind limitarea răspândirii COVID-19, numărul cererilor de licențiere a fost în creștere. Aceasta este pentru online.

Pentru retail, există peste 200 de companii care au licențe de bază și operează cazinouri live, aparate de slot și locații de pariuri. ➤ Care este tendința operatorilor offline de a lansa operațiuni online? Care a fost efectul covid asupra acestei tendințe?

Desigur, din cauza restricțiilor impuse de Autorități operatorilor offline în scopul limitării răs­ pândirii COVID-19, tendința este de a desfășura activitate on-line mai degrabă decât de a licenția sau reînnoi

licențele pentru ope­ra­țiunile offline, aceasta din urmă fiind negarantate și volatile. În ciuda sprijinului pe care Autoritățile Române l-au acordat operatorilor offline, activitatea acestora a fost puternic afectată de restricțiile menționate, în con­ se­ cință, în timp ce investițiile au devenit incerte, operatorii au so­ licitat măsuri suplimentare de pro­ tecție. În acest context, unii dintre operatori au evaluat opor­tu­ nitățile de extindere a activității în mediul online.

Acum, toată lumea se aș­ teap­ tă ca pandemia de COVID-19 să se termine și ca afacerea cu amănuntul să înceapă încet să-și revină. ➤ România are taxe atât pentru jucători, cât și pentru operatori. Cum funcționează, sunt jucătorii obligați să calculeze taxele și plătesc sau întreprind operatorii această activitate în numele jucătorilor? Începând cu anul 2018, toată responsabilitatea pentru calcularea, reținerea și plata impozitelor aferente activi­tă­ți­lor de jocuri de noroc a fost trans­ ferată companiilor. Nu există niciun demers sau pro­ ce­ dură pe care jucătorii să fie obligați să o îndeplinească în acest sens.

Companiile sunt obligate să plătească la Bugetul de Stat taxa de depozit (2% din transferul în conturile de joc), în timp ce taxa pe câștiguri se încasează și se plătește în numele clienților. Of course, due to the restrictions imposed by the Authorities to the offline operators for the purpose of limitating the spread of COVID-19, the tendency is to perform on-line activity rather than licensing or renewing the licenses for offline operations, the latter being unsecured and volatile.

Despite the support that Romanian Authorities have granted to offline operators, their activity has been strongly affected by said restrictions, consequently, while the investments have became uncertain, the operators have seeked additional protective measures. In this context, some of the operators have assessed the opportunities to extend their activity in the online environment.

Now , everybody is expecting the COVID-19 pandemic to finish and the retail business to slowly start recovering.

➤ Romania has the players’ taxation as well as operator taxes. How does it work, are the players liable for counting the taxes and are they paying or are operators undertaking this activity on players’behalf?

Starting with 2018, all responsibility for calculating, withholding and paying the taxes corresponsing to gambling activities has been transferred to the companies. There is no demarche or proceeding that the players are required to accomplish in this regard.

Companies are obliged to pay to the State Budget the tax on deposit (2% of the transfer to the game accounts), while the tax on the winnings are collected and paid on behalf of the customers. All taxes must be paid up to the 25th of the

month following the transfer to the game account or the payment to the customer (the withdrawal executed from the game account). ➤ For the international scale, what are the most interesting opportunities from Romania ? Is it entering the market, or are there products or service providers who are innovative and could be significantly contributing to the international companies?

Beside the advantages of having a matured market, with a clear legislation, strongly adapted to the realities of the industries, international operators, as well as the Romanian ones, benefit of the presence of well-known and highly-appreciated suppliers, to which the access is granted in a facile and transparent manner, as the list of the Class II licensed suppliers is public, available on the webpage of the authority.

There are not to be neglected the very good internet connection, available throughout the territory, which is wellknown worldwide, the Romanian professionals, ready to support the activity of international companies, as well as the appetite of the Romanian customers for on-line and retail products and the resonable level of taxation.

Please tell us couple of words about Rombet and the approach of the association.

După doi ani de absență din cauza pandemiei de coronavirus, Central European Gambling Summit (CEGS) revine în programul de evenimente in-person ale anului 2022.

CEGS22, sau ediția a Xa a tradiționalului eveniment anual Conferința Română de Gambling, va avea loc sub forma unui eveniment complex în perioada 24-25 Mai în București la complexul Grand din Crângași.

Desfășurat sub forma unui eveniment internațional cu participare fizică, CEGS22 va avea un program pe perioada a două zile, program ce va cuprinde 4 paneluri cu tematici deosebit de arzătoare din industria autohtonă a jocurilor de noroc și nu numai, paneluri susținute atât de speakeri români cât și străini.

Evenimentul va fi completat cu o petrecere în prima seară, dar și de o expoziție de aparatură strict B2B, boutique-style, pe toată durata celor două zile.

Petrecerea din seara zilei de 24 Mai va fi găzduită de Palace Casino Casa Vernescu.

Reprezentanții ONJN și-au anunțat, deja, participarea în cadrul primului panel, cel de dezbateri despre noutățile legislative din domeniu, dar și prezența la celelalte puncte ale evenimentului.

After a two-year absence due to the coronavirus pandemic, the Central European Gambling Summit (CEGS) returns to the 2022 inperson events program.

CEGS22, or the 10th edition of the traditional annual Romanian Conference on Gambling event, will take place in the form of a complex event on May 24-25 in Bucharest at the Grand Event Center Crângași.

Held in the form of an international event with physical participation, CEGS22 will have a program on two days, a program that will include 4 panels with very hot themes from the local gaming industry and not only, panels supported by both Romanian speakers and foreigners.

The event will be completed with a party on the first evening, but also by a strictly B2B boutique-style exhibition of equipment, throughout the two days.

Inițiativa legislativă pe care o vom analiza în cuprinsul prezentului articol, înregistrată pentru dezbatere la Camera Deputaților sub nr. PL-x 54/01.02.2021, are ca obiect de reglementare modificarea și completarea Ordonanței de Urgență a Guvernului nr. 77/2009 privind organizarea și exploatarea jocurilor de noroc, în sensul instituirii în sarcina tuturor organizatorilor de jocuri de noroc a obligației de a întocmi baze de date, în format electronic centralizat, care să cuprindă toate persoanele autoexcluse și indezirabile de la nivelul organizatorului.

Astfel, potrivit Proiectului de Lege, se propune modificarea și completarea Ordonanței de Urgență 77/2009 privind organizarea și exploatarea jocurilor de noroc după cum urmează: Art. I pct. 1 ”La articolul 15 aliniatul (2), după litera c) se introduce o nouă literă, litera c1), cu următorul cuprins: c1) dețin mijloacele tehnice pentru întocmirea bazelor de date referitoare la persoanele autoexcluse și indezirabile.”

Art. I pct. 2 ”Litera d) a aliniatului (6) al articolului 15 se modifică și va avea următorul cuprins: d) organizatorii de jocuri de noroc vor identifica persoanele care intră în incinta locațiilor în care se organizează și se exploatează jocuri de noroc și vor ține evidența, în format electronic, a datelor de identificare ale acestora. Bazele de date constituite la nivelul organizatorului se arhivează prin grija acestuia și se păstrează pentru un interval de minimum 5 ani de la constituire.”

Art. I pct. 3 ”După articolul 15 se introduce un nou articol, art.

151 cu următorul cuprins: Art. 15. Organizatorii de jocuri de noroc întocmesc, în format electronic, bazele de date referitoare la persoanele autoexcluse și indezirabile. Bazele de date constituite la nivelul organizatorului se arhivează prin grija acestuia și se păstrează pentru un interval de minimum 5 ani de la constituire.” În ceea ce privește modificările propuse la art. I pct. 1 din Proiect (vizând completarea dispozițiilor art. 15 alin. (2) din OUG 77/2009, referitoare la

Article I, point 2 “Article 15 paragraph 6, letter d is amended to read as follows: d) the organizers of the games of chance will identify the persons who enter the premises where the games of chance are organized and operated and will keep records, in electronic format, of their identification data. The databases set up at the level of the organizer are archived by his care and are kept for a minimum interval of 5 years from the establishment.”

Article I, point 3 “After Article 15, a new article is introduced, art. 151 with the following content: Art. 15. the organizers of the games of chance draw up, in electronic format, the databases referring to the self-excluded and undesirable persons.

I point 1 of the Project (concerning the completion of the provisions of art. 15 paragraph (2) of GEO 77/2009, regarding the conditions that economic operators must meet in order to obtain the authorization to operate gambling), we are of the opinion that, an additional period stipulating a transitional period for existing / ongoing legal situations (in this case determined by the existence of valid gambling licenses already issued), these unduly affect both the organization and operation of games of chance and the overall legal certainty in this field, representing for the recipients, contrary to the principle of legal accuracy and predictability, a danger which may arise from the law itself.

Apart from the other issues raised by the proposed regulation (which we will discuss below), we believe that in order for this proposed amendment

I pct. 2 din inițiativa legislativă, potrivit cărora organizatorii de jocuri de noroc au obligația de a identifica persoanele care intră în incinta locațiilor în care se organizează și exploatează jocuri de noroc și de a ține evidența, în format electronic, a datelor de identificare ale acestora, suntem de părere că, acestea sunt lipsite de claritate, întrucât, din cuprinsul acestor prevederi, nu rezultă ce anume implică noțiunea de ”identificare a persoanelor”, ce date vor fi prelucrate de către organizatori în vederea identificării și nici în baza căror documente se va realiza operațiunea de identificare.

De asemenea, obligarea organizatorilor de jocuri de noroc să creeze și să păstreze baze de date conținând toți participanții (înregistrați la fiecare intrare în locațiile de jocuri de noroc) pe perioade determinate este, pe de o parte, disproporționată și nejustificată, iar pe de altă parte, nu poate servi per se la atingerea scopului declarat în expunerea de motive a inițiativei legislative (și anume acela de a combate dependența de jocuri de noroc).

Dat fiind acest considerent, înregistrarea datelor persoanelor care intră în locațiile de jocuri de noroc nu va avea decât efectul îngreunării activității organizatorilor licențiați și participanților de bunăcredință deopotrivă, creând premisele pentru transferul jucătorilor către piața neagră, ceea ce reprezintă tocmai contrariul obiectivelor propunerii analizate. În ceea ce privește modificările propuse la art. I pct. 3 din inițiativa legislativă, potrivit cărora organizatorii de jocuri de noroc trebuie să întocmească, în format electronic, baze de date referitoare la persoanele autoexcluse și indezirabile, suntem de părere că acestea necesită clarificări atât

în ceea ce privește semnificația noțiunilor de ”jucători indezirabili” și ”autoexcluși”, cât și în ceea ce privește criteriile în baza cărora ar urma să fie determinate aceste categorii de persoane.

Also, forcing gambling organizers to create and maintain databases containing all participants (registered at each entry to gambling locations) for certain periods is, on the one hand, disproportionate and unjustified, and on the other hand on the other hand, it cannot per se serve the purpose stated in the explanatory memorandum to the legislative initiative (namely to combat gambling addiction).

In view of this, the entry of gambling sites will only have the effect of hampering the work of licensed organizers and bona fide participants alike, creating the conditions for the transfer of players to the black market, which is contrary to the objectives of the proposal.

Regarding the proposed amendments to art. I point 3 of the legislative initiative, according to which gambling organizers must compile, in electronic format, databases on self-excluded and undesirable persons, we believe that these require clarification both as to the meaning of the terms “undesirable players” and “self-excluded” and as to the criteria by which these categories of persons would be determined.

These clarifications are necessary, from our point of view, so that the obligation can be respected by all the recipients of the law in a uniform way, according to precise and rigorous rules.

Also, as the legislative initiative proposes to transpose into the area of exploitation of traditional gambling the provisions already existing and currently applicable to the operation of remote gambling, which concern the category of selfexcluded players, we consider that additional minimum provisions are needed regarding the effective self-exclusion of players, given the typological variety of traditional gambling.

Prin raportare la expunerea de motive a Proiectului de lege, prin care se justifică necesitatea reglementărilor invocându-se presupusa protecție pe care o oferă măsurile persoanelor care suferă de afecțiunea dependenței de jocuri de noroc, rezultă în mod clar că datele care ar urma să fie prelucrate cu privire la jucătorii autoexcluși includ date cu privire la starea de sănătate a acestora, calificate prin GDPR drept ”categorii speciale de date” (art. 9 alin. (1) GDPR), a căror prelucrare, în considerarea art. 9 din GDPR, este interzisă, cu excepția cazului în care se aplică una dintre situațiile reglementate în mod limitativ de alin. (2) al aceluiași articol.

Dintre acestea, față de modalitatea de reglementare a Proiectului de lege, în opinia noastră, ar putea fi incidentă doar situația în care ”prelucrarea este necesară din motive de interes public major, în baza dreptului Uniunii sau a dreptului intern, care este proporțional cu obiectivul urmărit, respectă esența dreptului la protecția datelor și prevede măsuri corespunzătoare și specifice pentru protejarea drepturilor fundamentale și a intereselor persoanei vizate” (lit. g).

Identificarea tuturor persoanelor care intră în incinta locațiilor specializate de jocuri de noroc poate conduce la prelucrarea pe scară largă a unor astfel de categorii speciale de date, motiv pentru care prelucrarea e necesar să fie, potrivit art. 35 din GDPR, supusă în mod obligatoriu unor proceduri prealabile pentru a se constata impactul prelucrărilor preconizate asupra protecției datelor. În acest sens, potrivit art.

35 din GDPR, se impune ca o evaluare a impactului asupra protecției datelor persoanelor vizate să fie efectuată, înainte de prelucrare, în special în ca-

Of these, in the opinion of the way of regulating the Bill, in our opinion, only the situation in which „processing is required for reasons of major public interest, based on Union or national law, which is proportionate to the aim pursued, respects the essence of the right to data protection and provides for appropriate and specific measures for the protection of the fundamental rights and interests of the data subject ”(letter g).

The identification of all persons entering the premises of specialized gambling locations may lead to the large-scale processing of such special categories of data, which is why the processing is necessary to be, according to art. 35 of the GDPR, which must be subject to prior procedures in order to ascertain the impact of the expected processing on data protection.

In this sense, according to art. 35 of the GDPR, an assessment of the impact on data protection of data subjects is required, before processing, especially in the case “largescale processing of special categories of data referred to in Article 9 (1)”. In this case, the processing is presumed to pose a high risk to the rights and freedoms of individuals.

Thus, we appreciate that, prior to the adoption of such regulations which may lead to the large-scale processing of special categories of data of data subjects, it is necessary to carry out an impact assessment on data protection in the context of the adoption of the normative act.

In view of all these considerations, although the initiative is welcome and additional measures to protect vulnerable consumers are needed, we believe that the Project needs to be revised and amended so that its provisions are easy to understand and implement, and the new provisions comply with all the rules governing the activity of gambling.

e have reached the last part of the study1 presentation “Responsible Gaming Message Personalization Strategies”, with the hope that it could be useful for regulators, operators and those directly involved in the creation and transmission of Responsible Gaming messages.

This was observed both in the wording of the message (for example tone) and in the response to the action (ie the RG tool) which they were asked to consider.

Young adults were drawn to tips to help them become “better” players, messages that could be used to offer suggestions for losing less money (for example, not tracking losses).

This is in line with research that suggests that young people are more prone to misconceptions about gambling, such as the idea that gambling can be controlled. The focus group argued that participants would find the information in the questionnaire and the list “beneficial” and that they would use the tools to “better understand what they were looking at” when placing bets.

Instead, older adults looked for easier messages that focused on keeping gambling fun.

Older adults were also attracted to boundary-setting functions that were not as popular among other groups. Older adults, many of whom have a fixed income, can benefit from tools that help them to be aware of how much money they spend on gambling.

The gambling self-assessment test and limiting tools were viewed more positively by Frequent Players. Frequency

It has been found that messages are more likely to be persuasive if they promote positive attitudes toward the desired behavior. Motivation can be improved by reducing the “cost” of compliance, increasing the perceived ability to perform a certain action, using a positive framed message and appealing to the individual’s sense of value. Gamblers may be more likely to get involved with responsible gaming resources if they feel that these resources are being used regularly by their peers and the people they respect. Focus group participants constantly discussed the importance of not being supportive or critical.

Messages based on education and awareness are a tool that the field of gambling has adopted in the field of public health more widely, with mixed success. Customizing responsible gaming messages and adapting responsible gaming tools based on age, gambling frequency, and the

Cu această concluzie se încheie prezentarea acestui interesant studiu academic2. În fine, revin cu îndemnul de a merge întotdeauna ”la sursă” și a parcurge studiul în original3, atât pentru a avea acces la toate referințele, dar mai ales pentru a nu fi inluențați de eventuale omisiuni, comentarii personale sau de o traducere infidelă.

Limitations and future research “While focus groups are very useful for in-depth exploration of topics, attitudes and concerns, the findings may not be generalizable due to the limited sample. (…) The results are also limited by the fact that they took into account only four segments, each with a certain degree of overlap. Gambling operators may be able to segment their player databases in more sophisticated ways.

Further research should aim at analyzing gambler databases to identify at-risk players using more complex segmentation, connected to a theoretical understanding of persuasive messages and experimental design. Such an approach could include qualitative research more specific to the given jurisdiction, followed by field experiments testing more message options. Future work should also consider the transmission of messages in terms of transmission, frequency and duration. Each of these factors is important for effective communication.

Finally, it is important to note that gambler preferences are not the only consideration in designing public health strategies. While players may prefer one responsible gaming tool to another, this does not mean that it is the most effective tool.

Potrivit art.2 din Regulamentul UE 2021/953, definiția de „certificat digital al UE privind COVID” înseamnă un certificat interoperabil care conține informații referitoare la situația titularului, din punctul de vedere al vaccinării, al rezultatului testării sau al vindecării, eliberat în contextul pandemiei de COVID-19.

Astfel, sub definiția Certificatului digital al UE privind COVID, se regăsesc trei certificate specializate, privind vaccinarea, testarea sau vindecarea, conform art 3 alin.

(1) din Regulamentul nr.2021/953, acestea fiind precizate și reglementate în detaliu în art.5 - Certficatul de vaccinare, art.6 - Certificatul de testare și art.7 - Certificatul de vindecare.

Autoritățile de protecția datelor europene, au emis un Aviz comun CEPD3-AEPD4 1/2022 privind extinderea Regulamentului privind certificatul Covid-195, fiind efectuate atât comentarii generale, cât și specifice, referitoare la Lipsa unei baze de probă pentru evaluarea necesității și proporționalității propunerii6 și la Modificările câmpurilor curente.

Datele de interes privind numărul detaliat de Certificate digitale UE privind COVID emise până la 01.03.2022, au fost publicate în Anexa raportului Comisiei, fiind menționat un număr total de 1.718.430.857 de Certificate.

Dintre acestea se remarcă Franța cu un număr total de Certificate digitale UE privind COVID de 313.366.916, Italia cu 252.073.788, Olanda cu 220.841.972, Danemarca cu 220.501.966, Germania cu 216.483.636, Austria cu 126.955.404, România fiind menționată cu un număr de 12.405.997.

Money laundering has become or should have become, since this year, a topic of discussion for any company manager whose business is to provide gambling services, whether large or small. The reason is the entry into force of Order no. 370/2021 of the President of the National Office for Gambling for the application of instructions on preventing and combating money laundering and terrorist financing in the field of gambling in Romania. The legal requirement in this field of activity were established by Law no. 129/2019 for preventing and combating money laundering and terrorist financing, and by Order no.

370/2021 outlines exactly the obligations incumbent on the organizers of gambling services.

Thus, gambling service organizers need to develop internal anti-money laundering rules and procedures in compliance with certain key elements.

The money laundering prevention procedure sets the framework, principles and rules for protecting the company from possible money laundering and terrorist financing actions through the services provided to its customers. Therefore, it

Pentru relația cu clienții, ca parte esențială a unei gestionări prudente a riscului de expunere la spălarea banilor, trebuie create proceduri de acceptare a clienților. Acestea reglementează desfășurarea procesului de identificare, acceptare și monitorizare a clientelei. Scopul aici este de a reduce riscul reputațional, îmbunătățirea calității portofoliului de clienți și reglementarea managementului datelor solicitate de Oficiul Național de Prevenire și Combatere a Spălării Banilor (ONPCSB), conform prevederilor legale.

Cunoașterea și aplicarea corespunzătoare a procedurilor privind combaterea spălării banilor constituie un proces în care este implicat întregul personal al companiilor.

Legislația privind prevenirea și combaterea spălării banilor și finanțării terorismului are implicații și asupra personalului, în sensul că trebuie desemnată o persoană în relația cu ONJN și cu Oficiul pentru Spălarea Banilor. Restul angajaților care au relații cu clienții trebuie instruiți periodic cu privire la prevenirea și combaterea spălării banilor și finanțării terorismului.

La un mod foarte cuprinzător spus, cerințele cu privire la prevenirea și combatere a spălării banilor și finanțarea terorismului se pot aplica corect doar printr-o abordare și cunoaștere corectă a riscurilor potențiale de spălare a banilor și deci o bună cunoaștere a clienților. Iar pentru aceste cerințe există obligația elaborării de norme și proceduri interne de lucru, care au rolul de a proteja compania față de încercările de spălare a banilor.

Desigur, confidențialitatea trebuie să facă parte integrantă din politicile furnizorului de servicii de jocuri de noroc. Numele clienților și tranzacțiile efectuate de aceștia sunt considerate informații confidențiale, iar dezvăluirea lor către terțe persoane poate fi făcută numai în anumite situații specifice, în conformitate

cu prevederile legale în vigoare.

Casa Vernescu care găzduiește Palace Casino este o clădire plină de surprize. O clădire unde s-au format istorie și amintiri încă de prin anii 1820 și ca oricare edificiu emană un aer misterios ca o legendă cu un trecut bogat și multă pasiune adăugată de la generație la generație.

Casa Vernescu a fost construită în 1821 de către boierul valah Filip Lens, fiu al unui nobil de origine franceză. Palatul a fost ridicat pentru a fi oferit ca dar de nuntă miresei sale, Lisaveta Balotescu-Carpinisanu. Un an mai târziu, în 1822, clădirea cade pradă unui incendiu devastator. Cu toate acestea, proprietarul reface

imobilul, transformându-l în cel mai frumos palat al acelor vremuri din București pentru mai bine de un sfert de secol. Tot aici au fost pe rând o unitate militară, apoi Ministerul de război. În 1886 edificiul a devenit proprietatea lui Guță Vernescu care cu ajutorului arhitectului Ion Mincu a efectuat o restaurare, iar pictorul George Demetrescu Mirea i-a împodopit interioarele. Tema centrală a clădirii este centrul său ocupat de un vast hol de formă eliptică.

For us, lifting all restrictions is like a necessary breath of fresh air, which gives us confidence that we can evolve on a natural course to overcome this period.

Pentru noi, ridicarea tuturor restricțiilor este ca o gură de oxigen necesară, ce ne dă încredere că putem evolua pe un curs firesc pentru a depăși această perioadă. ➤ Cum se reflectă războiul din Ucraina în activitatea voastră? Au apărut în săli jucători din rândul refugiaților?

Un conflict nu aduce niciodată ceva bun, cu atât mai puțin după această perioadă dificilă a pandemiei. Efectele economice ale acestui conflict vor fi resimțite pe termen lung și nu doar de industria noastră. În acest moment sigura interacțiune cu persoane din rândul refugiaților au existat doar în campaniile de ajutorare.

➤ How is the war in Ukraine reflected in your work? Did refugee players appear in the halls?

A conflict never brings anything good, especially after this difficult period of the pandemic. The economic effects of this conflict will be felt in the long run and not just by our industry.

At this time, safe interaction with refugees only existed in relief campaigns.

➤ Care crezi că sunt cele mai arzătoare probleme ale industriei în acest moment? În acest moment, toate probleme sunt importante. Vorbim despre o industrie a cărei activitate a fost restricționată timp de 2 ani de zile, dar care a plătit taxe integral deși, restricțiile impuse ne-au limitat capacitatea și programul de funcționare. At this point, all issues are important. We are talking about an industry whose activity has been restricted for 2 years, but which has paid taxes in full, although the restrictions imposed have limited our capacity and operating hours. As I said, we are already referring to the new realities of the gambling market. It’s very difficult to make predictions. For now, the important thing is that I survived. About 250 employees returned to work trying to overcome all the shortcomings created by this pandemic.

So do our guests, after a long time we can see our smiles again. We hope that the coming months will bring us a boost of confidence in the first place. I think the economic and psychological effects of the pandemic will be felt for a while. The most important goal at the moment is to be present and carry on the Palace Casino tradition.

➤ Ce înseamnă pentru voi ridicarea restricțiilor?

Cum spuneam, ne raportăm deja la noile realități de pe piața jocurilor de noroc. E foarte greu să facem previziuni. Deocamdată important este că am supraviețuit. Aproximativ 250 de angajați s-au întors la serviciu încercând să trecem cu toții peste neajunsurile create de această pandemie.

La fel și invitații noștri, după mult timp ne putem vedea din nou zâmbetele. Sperăm ca lunile care vor urma ne vor aduce un boost de încredere în primul rând. Efectele economice și psihice ale pandemiei cred că vor mai fi resimțite o perioadă. Industriile de servicii orientate către consumatori au fost cele mai afectate de efortul de combatere a virusului. Consecințele sunt acum greu de calculat. Avem mai multe scenarii pentru viitor, rămâne de văzut ce alegeri vom face și ce ne va oferi noua normalitate.

➤D oes the military conflict in Ukraine affect you? Have there been any casino players among the refugees?

You are referring to an extremely unfortunate situation. Our casino does not target refugee players and we have no visitors, neither Russians nor Ukrainians, but we have refugee employees. Palace Casino is ready to lend a helping hand to those who have been evicted from their homes, from their daily routine, from their families. We thus offer a small helping hand to desperate people. The activity of the Casino was not directly affected by the war but rather indirectly by the economic fluctuations produced by this unfortunate event. ➤ Does the new normal change your marketing strategy?

Obvious! Marketing plans were abruptly discontinued in March 2020 with the onset of pandemic restrictions in our country. We are working on resuming and adapting the marketing plan. Consumeroriented service industries have been hardest hit by the fight against the virus. The consequences are now difficult to calculate. We have several scenarios for the future, it remains to be seen what choices we will make and what will give us new normalcy.

➤ Cum a trecut Game World peste pandemie?

Pentru toți operatorii land-based ultimii doi ani au fost foarte dificili. La Game World ne-am concentrat să organizăm cele mai sigure condiții atât pentru clienți cât și pentru angajați. Am păstrat totodată ambianța și vibe-ul specific sălilor noastre, în perioadele când ni s-a permis să funcționăm, chiar și cu restricții de program și condiții legate de numărul de clienți sau certificatul verde. În acest sens reamintesc că Game World a fost prima rețea de săli de jocuri din România care a primit certificarea Dekra pentru locații de încredere, în februarie 2021 și care deține această certificare și în prezent.

➤ How did Game World get over the pandemic?

The last two years have been very difficult for all land-based operators. At Game World we have focused on organizing the safest conditions for both customers and employees. We also kept the ambiance and vibe specific to our rooms, during the periods when we were allowed to operate, even with program restrictions and conditions related to the number of customers or the green certificate. Ridicarea restricțiilor reprezintă un semn de revenire la normalitate mult așteptat. Putem începe să reluăm cu toții ceea ce știm să facem cel mai bine iar la Game World aceasta înseamnă în primul rând distracție, socializare, divertisment. Ne bucurăm că putem să repornim spectacolele și petrecerile și să răspundem astfel din nou preferințelor de entertainment ale clienților noștri. Mai mult decat atât, este importantă și schimbarea din starea de spirit a oamenilor. Zâmbetele largi de pe fețele colegilor și ale clienților comunică speranță și optimism mult mai bine decât atunci când puteam să zâmbim doar în spatele măștilor. ➤ Vă afectează conflictul militar din Ucraina?

Desigur, războiul atât de aproape de granițele noastre este o preocupare foarte mare. Suntem cu toții îngrijorați, atât de ceea ce se întâmplă acum cât și de ceea ce se poate întampla în continuare. Impactul economic se simte deja și este foarte probabil să se acutizeze și să dureze mult timp de acum înainte. Din punct de vedere emoțional, drama refugiaților din țara vecină are un efect și mai puternic asupra stării de spirit generală iar incertitudinea pentru perioada care urmează este un factor de îngrijorare major. ➤ Î n ce fel schimbă noua normalitate strategia voastră de marketing?

Așa cum spuneam, schimbările sunt mai mult în plan tactic decât strategic. Și în perioada de pandemie ne-am păstrat strategia de a oferi clienților noștri o experiență cât mai plăcută, într-o ambianță elegantă, cu servicii atente și de foarte bună calitate. Ne-am adaptat și am găsit soluții să trecem peste perioada aceasta dificilă iar acum revenim la un calendar de evenimente consistent, atrăgător și generos. În sălile Game World avem atât spațiul necesar cât și toate facilitățile pentru a oferi clienților o mare diversitate de opțiuni de entertainment. Fie că vorbim despre spectacole artistice, petreceri sau promoții cu premii fie că ne referim la restaurantele, barurile sau terasele pentru clienți, putem acum să oferim din nou experiența completă de divertisment care a consacrat sălile Game World.

➤W hat does lifting restrictions mean to you?

Lifting restrictions is a long-awaited sign of a return to normalcy. We can all start to repeat what we know how to do best and at Game World this means first of all fun, socializing, entertainment. We’re glad we can restart shows and parties and respond to our customers’ entertainment preferences. Moreover, it is important to change the mood of the people. The wide smiles on the faces of colleagues and customers communicate hope and optimism much better than when we could only smile behind masks. ➤D oes the military conflict in Ukraine affect you?

Of course, the war so close to our borders is a very big concern. We are all concerned about what is happening now and what may happen next. The economic impact is already being felt and is very likely to worsen and last a long time from now. Emotionally, the drama of refugees in the neighboring country has an even stronger effect on the general mood and uncertainty for the period ahead is a major concern. ➤ How does the new normal change your marketing strategy?

As I said, the changes are more tactical than strategic. Even during the pandemic, we kept our strategy of offering our customers a pleasant experience, in an elegant environment, with attentive services and very good quality. We have adapted and found solutions to get through this difficult period and now we return to a consistent, attractive and generous calendar of events. In Game World halls we have both the necessary space and all the facilities to offer customers a wide variety of entertainment options. Whether we are talking about art shows, parties or awards promotions or we are referring to restaurants, bars or terraces for customers, we can now offer again the complete entertainment experience that has consecrated the Game World halls.

The problems were related to the logistics and delivery of parts from China and Taiwan, as well as the fact that components and consumables became very expensive. This has led to rising equipment prices. ➤W hat does the current situation mean when the restrictions were lifted?

Producers came to the aid of operators and increased prices less than they should have been, ie in proportion to the increase in the prices of components, logistics or energy.

The market continues to grow so that operators have started ordering better equipment that complies with the new legal requirements. ➤ Is the armed conflict in Ukraine a problem for equipment suppliers?

The biggest problem is that three markets have been lost - Ukraine, Belarus and Russia, and we don’t know when they will reopen.

In Romania, at the moment, the conflict does not affect us, but it is possible that it will affect us later through its consequences.

At the moment, however, we can observe and talk about logistical and transport problems in Poland and Ukraine.

➤ Este conflictul armat din Ucraina o problemă pentru furnizorii de echipamente?

Cea mai mare problemă este că sau pierdut trei piețe – Ucraina, Belarus și Rusia și nu știm când se vor redeschide. În România, momentan, conflictul nu ne afectează, dar este posibil să ne afecteze mai târziu prin consecințele sale.

Momentan, totuși putem să observăm și să vorbim de probleme logistice și de transport în Polonia și Ucraina. ➤C um este resimțită problema refugiaților ucraineni?

La această etapă nu putem spune că problema refugiaților ar fi avut careva schimbări asupra domeniul în care activăm, însă, având ca exemplu experiența statelor care s-au confruntat anterior cu acest fenomen cred că pe termen scurt va avea efecte mici pozitive asupra economiei în general, iar pe termen lung depinde de cum va gestiona statul integrarea refugiaților în câmpul muncii. La rândul nostru vom fi dispuși să sprijinim inițiativele îndreptate spre ajutorul refugiaților de a se integra. ➤ Care sunt cele mai arzătoare probleme ale industriei jocurilor de noroc în România?

Mulți operatori care își cumpără 10-20 de aparate, unul sub licența altuia și, din păcate, nu cunosc domeniul. De exemplu cumpără echipamente neoriginale și desfășoară o activitate neconformă cu piața.

Toată această perioadă a fost foarte dificilă pentru industria de gambling tradițional. Operatorii economici licențiați în domeniul jocurilor de noroc au fost printre primii afectați de măsurile luate de către autorități în încercarea de a limita efectele pandemiei COVID-19.

La începutul acestei pandemii, activitatea a fost suspendată în totalitate, fapt din care a rezultat o nesiguranță constantă, dar am învățat să ne adaptăm la măsurile adoptate, la noile condiții impuse și, treptat, încercăm să revenim la situația de dinainte de pandemie.

This whole period has been very difficult for the traditional gambling industry. ➤ Ce înseamnă ridicarea tuturor restricțiilor din punctul vostru de vedere?

Ne bucurăm atât noi, cât și clienții Gets Bet că am ieșit din starea de alertă și că au fost ridicate restricțiile. Mai mult decât atât, ne bucurăm că numărul de persoane infectate cu virusul este în scădere și că putem reveni, treptat, la o viață normală.

Cea mai mare problemă considerăm că este reprezentată de inflație, creșterea galopantă a tuturor prețurilor, începând cu utilitațile și continuând cu bunurile de consum, combustibilul etc. Totodată, încă nu putem exclude complet o eventuală creștere a numărului zilnic de infecții cu virusul SAES-Cov-2, respectiv impunerea adoptării măsurilor restrictive pentru prevenirea și/sau limitarea pe cât posibil a efectelor pandemiei, restricționarea activității operatorilor economici licențiați în domeniul jocurilor de noroc, a programului de funcționare sau chiar suspendarea totală a activității cu publicul. ➤C ât credeți că va dura până va reveni la normal societatea întreagă? Dar industria?

Nu știm care va fi unitatea de timp, dar putem spune că tot acest drum pe care l-am parcurs fiecare dintre noi în timpul pandemiei fost anevoios, iar ieșirea din pandemie este cu atât mai puțin un automatism. Ne dorim să revenim la normal cât mai curând posibil, la viața de dinainte de restricții, atât noi, în calitate de organizatori de jocuri de noroc, precum și întreaga societate, însă trebuie să fim conștienți cu toții că va fi nevoie să redefinim noțiunea de “normal”.

We do not know what the unit of time will be, but we can say that this whole journey that each of us took during the pandemic was difficult, and getting out of the pandemic is even less automatic. We want to get back to normal as soon as possible, to the life before the restrictions, both we, as gambling organizers, and the whole society, but we must all be aware that we will need to redefine the notion of “normal”.

Obligațiile declarative și de plată pentru activitatea jocurilor de noroc din România

~n anul 2022, organizatorii de jocuri de noroc au o serie de obligații, de conformare practică declarativă și plată, ca urmare a prevederilor legale actualizate, respectiv OUG 77 din 2009, Codul Fiscal și Codul de Procedură Fiscală, iar o sinteză a acestora arată astfel: A) ~n cazul Oficiului Național pentru Jocuri de Noroc (ONJN), organizatorii jocurilor de noroc trebuie să depună o declarație lunară `n care să evidențieze veniturile din jocuri de noroc, sub forma unui formular-tip, cf. Ordinului 179 din 2018 al Președintelui ONJN, până la data de 10 a lunii următoare, pentru luna precedentă, `nsușită de administratorul societății, pentru jocurile de noroc tradiționale sau și de o persoană autorizată, pentru jocurile de noroc la distanță. ~n scopul debirocratizării și simplificării acestei cerințe, este imperios necesară introducerea unui sistem de transmitere online, cu semnătură electronică, prin completarea unui formular PDF inteligent.

B) ~n cazul Agenției Naționale de Admnistrare Fiscală (ANAF), organizatorii jocurilor de noroc sunt obligați să declare și să plătească, conform prevederilor OUG 77 din 2009, actualizată, taxe pentru obținerea dreptului de a organiza și exploata jocuri de noroc, astfel: 1. Taxa de licență – pentru organizarea jocurilor de noroc, (inclusiv taxa de licență pentru activități conexe jocurilor de noroc), iar declararea și plata taxei de licență se realizează anticipat, `n sumă fixă, pentru intrarea `n vigoare a licenței

Ce este frica și de ce apare?

rica, împreună cu tristețea, bucuria, dezgustul și furia este una dintre emoțiile fundamentale ale ființelor vii, ne avertizează asupra pericolelor și ne împinge spre supraviețuire.

Dacă, de exemplu, în parc observăm că o ramură de copac cade peste noi, vom găsi puterea să sărim brusc din fața acesteia. Fără acest tip de răspuns am fi zdrobiți de ramură. Sub presiunea fricii, suntem capabili să facem lucruri pe care nu credeam că vom fi capabili să le facem. Totuși, devine o problemă atunci când este trăită într-un mod exagerat sau în afara contextului. De fapt, atunci când se confruntă cu un pericol, corpul nostru produce un hormon - cunoscuta adrenalină - care induce schimbări fizice și psihice și care ne pregătește pentru acțiune: fugim sau rămânem nemișcați (fugă sau luptă). Dacă facem un pas înapoi către viața strămoșilor noștri, putem înțelege valoarea adaptativă a acestei emoții, frica i-a protejat de animalele sălbatice sau de vecinii ostili. Astăzi, stimulii care ne înspăimântă nu mai sunt aceeași, ci mai degrabă se leagă de pierderea unui loc de muncă, schimbări majore în viață sau acumularea de probleme zilnice. Cu toate acestea, reacțiile de gândire și comportamentale rămân aceleași cu cele ale strămoșilor noștri. Cele două reacții principale în fața unui stimul care arată pericolul sunt atacul sau fuga: prima ne permite să înfruntăm obstacolul, să luptăm; a doua ne determină să abandonăm situația înainte ca aceasta să devină excesiv de amenințătoare pentru supraviețuirea noastră. Pe lângă aceste reacții principale, mai sunt altele două, care pot apărea în fața unei situații periculoase: înghețarea

și leșinul. Înghețarea arată ca și cum persoana pare încremenită, este o imobilitate care permite să nu fie văzută de „prădător” în timp ce evaluează care strategie (atac sau fugă) este cea mai potrivită pentru situația specifică. Când niciuna dintre aceste strategii nu pare să aibă vreo șansă de succes, singurul răspuns extrem posibil este un fel de leșin (moarte falsă), adică reducerea bruscă a tonusului muscular însoțită de o deconectare profundă de la orice altceva, în afară de situația amenințătoare. Este o reacție foarte extremă, se manifestă ca o simulare a morții, evident automată și inconștientă, deoarece prădătorii preferă în general prada vie. În această situație se produce o detașare de ceea ce se întâmplă și este posibilă apariția unor simptome disociative. Toate aceste modificări corporale, cognitive și comportamentale fac parte din natura emoțiilor, în special a fricii, nu doar pentru a face față stresului, ci, în cele din urmă, pentru a ne asigura supraviețuirea. Problemele apar atunci când nu reușim să ne oprim reacțiile corporale și mentale în fața unei amenințări care nu mai este prezentă sau iminentă, astfel încât răspunsul la stres, de la adaptativ, se transformă în cronic sau excesiv.

Este nevoie să cunoaștem aceste reacții, astfel încât să le putem integra în ceea ce reprezintă un comportament normal, adaptativ în fața pericolului. Astfel, reacțiile corporale atunci când trăim o emoție de frică includ: gură uscată, creșterea frecvenței cardiace și respiratorii, motilitatea intestinului, tensiunea musculară, transpirația crescută.

Corpul nostru se pregătește pentru o reacție imediată, fără astfel de schimbări, de fapt, am fi total inadecvați în fața pericolului. În caz de frică excesivă, senzațiile corpu-

lui încep să devină mai accentuate. Tensiunea musculară, esențială pentru răspunsul de luptă sau fugă, se transformă în stare de rău, adică cefalee, dureri în piept, simptome gastrointestinale, slăbiciune a picioarelor, senzații de greață sau dificultăți de respirație, atenția concentrată pe bătăile inimii, care nu face altceva decât să crească tensiunea arterială și să ne facă să simțim leșin, vedere încețoșată și țiuit în urechi. Reacția psihologică la stimuli periculoși duce la o schimbare a modului în care gândim. De exemplu, atunci când suntem supuși unui stres deosebit, devenim mai concentrați pe problemă și ne creștem abilitățile de rezolvare a acesteia. În mod similar, vom simți și o schimbare, cum ar fi să fim mai iritabili sau tensionați.

Astfel, un răspuns excesiv de frică în numeroase situații începe să devină o obișnuință, ne concentrăm exclusiv pe ceea ce ne produce teamă, îngrijorându-ne în general că nu există soluții sau catastrofizând situația. În timp, se dezvoltă un tip de gândire negativistă despre sine și despre lumea înconjurătoare, percepută ca o sursă de amenințări întotdeauna posibile.

Asemenea forme de raționament negativ formează un cerc vicios cu modificări corporale, cum ar fi: „Am dureri în piept, trebuie să fie ceva în neregulă cu inima”, sau: „Acest sentiment/emoție este de nesuportat, nu pot face nimic”. În acest fel, stresul rămâne constant ridicat, ducând la o creștere a disconfortului și a îngrijorărilor, ceea ce determină oamenii să se concentreze mai degrabă pe evenimentele negative și insolubile decât pe cele pozitive.

ear, along with sadness, joy, disgust and anger is one of the fundamental emotions of living things, it warns us of dangers and pushes us to survive. If, for example, in the park we notice that a branch of a tree falls on us, we will find the strength to suddenly jump in front of it. Without this kind of response we would be crushed by the branch. Under the pressure of fear, we are able to do things we never thought we would be able to do. However, it becomes a problem when it is lived in an exaggerated way or out of context. In fact, when faced with a danger, our body produces a hormone - known as adrenaline - that induces physical and mental changes and prepares us for action: we run away or remain motionless (run or fight). If we take a step back to the lives of our ancestors, we can understand the

adaptive value of this emotion; fear has protected them from wild animals or hostile neighbors. Today, the stimuli that frighten us are no longer the same, but rather are related to job loss, major life changes or the accumulation of daily problems.

However, our thinking and behavioral reactions remain the same as those of our ancestors. The two main reactions to a stimulus that show danger are attack or flight: the first allows us to face the obstacle, to fight; the second causes us to abandon the situation before it becomes excessively threatening to our survival. In addition to these main reactions, there are two others that can occur in the face of a dangerous situation: freezing and fainting.

Freezing looks as if the person seems frozen, it is an immobility that allows not to be seen by the “predator” while assessing which strategy (attack or flight) is best for the spe-

cific situation. When none of these strategies seem to have any chance of success, the only extremely possible answer is a kind of fainting (false death), is a sudden reduction in muscle tone accompanied by a deep disconnection from anything but the threatening situation. It is a very extreme reaction, manifesting itself as a simulation of death, obviously automatic and unconscious, because predators generally prefer live prey. Fobia, așadar, este o frică, intensă, persistentă și de durată, resimțită pentru un anumit lucru. Dar cum o recunoaștem?

Este o manifestare emoțională disproporționată pentru ceva care nu reprezintă o amenințare reală. De altfel, cei care suferă de fobii sunt copleșiți de teroarea de a intra în contact cu obiectul fobiei: un păianjen, un ac, microbi, etc. Simptomele fiziologice sunt:​​ tahicardie, amețeli, tulburări gastrice și urinare, greață, diaree, sufocare, roșeață, transpirație excesivă și oboseală. Evident, aceste manifestări au loc doar la vederea lucrului de temut sau la gândul de a-l putea vedea. Fobicii sunt în esență anxioși și ca atare au tendința de a evita situațiile asociate cu frica, dar pe termen lung acest mecanism devine o adevărată capcană. If these behavioral changes are persistent, they lead to the addition of negative ones. For example, we can increase the amount of cigarettes we smoke, start eating unbalanced, stop exercising.

All this increases the feeling of not feeling well, of being chronically tired and of being less able to cope with stress. Let us remember that the most common response to stress is to avoid situations that scare us. However, the relief that comes from avoiding stressful stimuli is only temporary and increases the feeling of personal distrust. Whatever the trigger that induces anxiety (whether real or imaginary), what maintains the stress response even after the stimulus is exhausted is the activation of the vicious circle just mentioned and that unites all the problems of suffering, fear and anxiety.

Anxiety and fear are coded in the same area of the ​​ brain, but the reasons for their occurrence are different. In the first case, when we are afraid, we are afraid of something real. If we have to take an exam, it is normal to be afraid,

but when we want everything to go according to our plans, that is, to take the highest grade without any certainty that this will happen, we will talk about anxiety. and not about fear. In short, anxiety is triggered when we make negative and catastrophic predictions about events that are perceived as important or dangerous. In this case, there are a number of physiological changes similar to those of fear: dizziness, confusion, difficulty breathing, tightness or pain in the chest, blurred vision, feeling unreal, heartbeat, numbness or tingling in the fingers, hands and cold feet, sweating, muscle stiffness, headaches, muscle cramps, fear of going crazy or losing control. Anxiety is often generated by the assessments that are made about a certain event, or rather by thoughts, predictions most often, about what will happen in the future. Anxiety, however, could also occur for no apparent reason, manifesting itself excessively and without any control.

Phobia is another form of fear, a disproportionate feeling towards something that is not a real danger, but we perceive this state of anxiety as uncontrollable, even by implementing behavioral strategies that are useful to deal with the situation. Phobia, therefore, is a fear, intense, persistent and lasting, felt for a certain thing. But how do we recognize it? It is a disproportionate emotional manifestation for something that is not a real threat. In fact, those who suffer from phobias are overwhelmed by the terror of coming into contact with the object of the phobia: a spider, a needle, microbes, etc.

The physiological symptoms are: tachycardia, dizziness, gastric and urinary disorders, nausea, diarrhea, suffocation, redness, excessive sweating and fatigue. Obviously, these manifestations take place only at the sight of the dreaded thing or at the thought of being able to see it. Phobias are essentially anxious and as such tend to avoid situations associated with fear, but in the long run this mechanism becomes a real trap. In fact, avoidance only confirms the danger of the situation being avoided.

Povestea câștigătoare a lui Glowny amintește foarte mult de victoria compatriotului Piotr Nurzynski la Barcelona 2018, care s-a calificat online la PokerStars în timp ce călătorea în America de Sud. De asemenea, Glowny și-a câștigat intrarea în Main Event printr-un satelit de 530 de euro și a obținut cel mai mare câștig în bani din cariera sa. În drum spre victorie, el a fost susținut de o galerie zgomotoasă, inclusiv partenerul său și a devenit al cincilea campion EPT din Polonia.

Când a fost întrebat dacă poate exprima în cuvinte ceea ce tocmai s-a întâmplat, Glowny a fost destul de copleșit: “Absolut nu. Este prea mult.

Sunt prea obosit să mă gândesc altfel. Evident, este o victorie imensă”.

Glowny a remarcat că presiunea pe masa finală a fost foarte mare,

dar a reușit să rămână concentrat.

El a menționat, de asemenea, o perioadă dificilă când a pierdut mult și a devenit jucătorul cu cele mai mici șanse. Acesta nu a fost un teritoriu necunoscut pentru Glowny în ultimele zile, deoarece a fost un „stack short”foarte aproape să iasă din joc și chiar a scăzut până la patru blinduri mari în ziua 4.

Grzegorz Glowny won his way into the 2022 European Poker Tour Prague €5,300 buy-in no-limit hold’em main event via a €530 online satellite on PokerStars. The native of Poland was one of 1,190 total entries in this massive tournament. After seven full days of tournament action, Glowny managed to emerge victorious with the title and the top payout of €692,252 ($754,555 USD).

In addition to the money, Glowny also became the fifth Polish player to win an EPT main event title.

The return of the PokerStars European Poker Tour (EPT) to European soil has been a thorough success and the €5,300 Main Event in the King’s Casino at the Hilton Hotel in Prague has concluded. Out of a field of 1,190 entries, Grzegorz Glowny defeated Andrea Cortellazzi in headsup play to claim the biggest portion of the €5,771,500 prize pool.

For the victory, Glowny earned a payday of €692,252 and the maiden post-pandemic EPT Main Event title. The top four finishers all locked up career-best prizes and agreed to an deal in the second attempt after the first negotiations fell through.

Notably, it was Glowny who declined the deal and became the short stack only to stage a successful comeback thereafter.

Likewise, Glowny earned his entry in the Main Event via a €530 satellite and scored the biggest cash of his career. En route to victory, he was supported by a boisterous rail including his partner and became the fifth EPT champion from Poland.

When asked if he can put into words what had just happened, Glowny was quite overwhelmed: “Absolutely not. It’s too much.

I am too tired to think otherwise. It’s obviously a massive win.”

Glowny remarked that the pressure on the final table was very high but he was able to stay focused. He also mentioned a difficult spell when he went card dead and became the short stack.

This was not unknown territory for Glowny throughout the last few days as he was a short stack near the money bubble and even dropped to as little as four big blinds on Day 4.

After the first deal negotiations fell through, Glowny was on the ropes once more but scored a pivotal double through then chip leader Kim. “I ran ace-jack into ace-king.

I don’t know if this was even a decent move or not and I got lucky. After that, my confidence was back. So, yeah, for the most part, I think I was able to be focused”, Glowny said with a smile on his face.
