a"TONTINUED pressure exerted by v the federal government to force compliance with the Occupational Safety and Health Act is a real thorn in the side for the retail building material dealer.**

The time has come, however, when we must all recognize that we can't hide .from the enforcement of this act. On February 15, the personal safety sections of the act became effective. At this time each lumber yard should have safety shoes, hard hats, and safety glasses, for employees exposed to the dangers in the yard.

We cannot over-emphasize the need for you to comply. This is not a case where you assume the law applies to the other guy. OSHA inspectors have been hard at work in the logging camps and the mills. They are now beginning to broaden their field of inspection to the retail lumber and building material yard. You have no choice. You are required to provide the safety equipment or insure that your employees have it. The employee has no choice either. He is required to wear the equipment.

Recent court cases ruled against the employee and in favor of the employer. In these cases the employee was provided with the equipment but chose to ignore wearing it. OSHA inspectors cited the employer and levied a fine. The court ruled that the employer was required to provide the employee with a safe and healthy place of employment which he did in these cases, The disregard by the employee was ruled not to*be a violation by the employer.

All employers are urged to keep their OSHA Forms 100, 101, and 102, up to date. The OSHA poster must be prominently displayed for the employees' If you don't have these simple tasks performed you can be certain of a citation and fine should you be inspected.
