Clinton Plan Devised lllegally
A federal judge has ruled that the Clinton Administration illegally developed ia Pacific Northwest forest management plan butrefused a timber industry request to block its implementation.
Ruling on a suit brought by the Northwest Forest Resource Council, the U.S. disrict judge said that the Administration repeatedly violated the Federal Advisory Committee Act's requirements for open proceedings in developing the Option 9 plan.
Yet, he wrote, an injunction would be "premature" since at this point the plan is merely a written prescription. Other courts could still find the violations serious enough to block decisions called for in the plan.
"The injunction is probably less important than the fact that the Administration's plan has been found to be legally flawed by the very first review that took a look at it," said Mark Rey, American Forest & Paper Association.
