Council to discuss revisions to city’s incentive programs

City, Kearns Restaurant Group reach agreement on rebuilding the Boathouse

The city of Cape Coral and the Kearns Restaurant Group have reached an agreement that will allow for the rebuilding of the Boathouse.

City Manager Michael Ilczyszyn notified Cape Coral City Council late Friday that the city and the Kearns Restaurant Group have reached an agreement.

“Good evening Mayor Gunter and City Council, We (City Administration and the City Attorney’s Office) have successfully concluded our negotiations for the rebuilding of the Boathouse restaurant in Cape Coral.

“The signed Settlement Agreement and Concessionaire Agreement were delivered to City Hall this afternoon. I have attached a Term Sheet which summarizes the business terms contained within the agreement which will be presented to you at the next regular city council meeting. Have a great weekend.”

The agreements signed by the Boathouse Tiki Bar & Grill LLC, which allow for the termination of the existing lease agreement for the restaurant’s location on the Cape Coral Yacht Club acreage, the demolition of the existing fire-damaged structure and a new concessionaire agreement, still need council approval. Terms of the Concessionaire Agreement include a 30-year term and grants the Boathouse Tiki Bar & Grill LLC exclusive rights to food/ beverage, retail, fuel and beach equipment concessions within the Concession Area as well as first right of refusal if the city engages with another freestanding restaurant at the Yacht Club

will increase the award potential of 10% of total project cost, and not just infrastructure; expand eligibility to allow speculative projects, not just targeted industries or job creating employees; and allow retail unless it is the principal component.

Other items on the agenda include a mobility fee ordinance discussion, a financial policy update, watershed management plan and Del Prado landscape.

The meeting will take place at 9:30 a.m. today, Sept. 10, in Council Chambers at City Hall, 1015 Cultural Park Blvd.

The meeting is open to the public.

Cape Coral City Council will hold the first of two public hearings on the property tax rate and next year’s budget Thursday. Council set a not-to-exceed rate of 5.5188 mills on July 23.

One mill is equal to $1 for every $1,000 of taxable assessed property valuation.

Council considered four options: included a proposed rate of 5.2188 mills; the rolled back rate of 5.1471 mills, which would have generated $2,200,734 less than the city manager’s proposed rate; the not-to-exceed 5.5188 mills or $9,208,099 more than at the city manager’s proposed rate; or any millage rate greater than the roll-back rate, but less than the not-to-exceed rate.

The 2026 budget as proposed is $1,437,048,387, which includes a total general fund revenue and operating expenditures of $264,702,131.

The budget includes 19 positions added to the fire department, 16 positions to the police department, four code compliance officers and one code compliance supervisor, playground replacements at Burton Park and Giuffrida Park, fitness station replacements at Del Prado Linear Park, Lake Kennedy Parking lot construction, city hall roof replacement, bridge maintenance and rehabilitation and flood prevention improvements.

The meeting will begin at 5:05 p.m., Thursday, Sept. 11, in City Council chambers, 1015 Cultural Park Blvd.

The final public hearing will be held on Sept. 25.

City, former manager settle lawsuit

A former city manager who filed a lawsuit against the city alleging discriminatory and other labor violations has dismissed his suit.

In a settlement agreement signed by Roberto Hernandez and Cape Coral City Attorney Aleksandr Boksner on Aug. 18 and 19, respectively, Hernandez agreed to dismiss the suit against the city and the city agreed it would waive any claim for costs. The parties agreed to pay their respective attorney fees.

Mayor John Gunter said the settlement vindicates the city’s position that the allegations were false.

“I am pleased that Mr. Hernandez has withdrawn his lawsuit filed against the city. The allegations that were made were utterly false, and during this process, they were found not to have any merit,” Gunter said in response to a Breeze email requesting comment. “This was simply a disgruntled employee who was terminated and made false accusations as a result of his termination. Throughout this time, we have remained focused on serving our residents, strengthening our community, and building a brighter future for our city. We will continue to do so while moving forward.”

Hernandez, who served as Cape Coral’s top administrator from August 2020 to February 2023 accused the city of discriminatory labor violations and alleged that the Cape Coral City Council did not renew his contract in retaliation after he objected to a series of civil rights violations concerning minority and LGBT employees.

Council then voted to terminate his contract without cause.

Hernandez subsequently filed a complaint with the U.S. Equal Employment Opportunity Commission in March 2023. The federal agency opened an investigation, giving the city 30 days to respond.

The city denied both the allegations related to discriminatory labor practices and the accusation of retaliation.

It hired GrayRobinson, a Tampa-based law firm, to conduct an independent investigation.

The report, received by the city on May 12, 2023, concluded that the claims were unsubstantiated.

Sacha Dyson of GrayRobinson found that the non-renewal of Hernandez’s contract and his subsequent termination did not violate protections under state and federal law and that “no action has been taken or recommended to be taken against any employee because of his or her race or any other protected characteristic or protected activity.”

As April 29 of this year, the last time The Breeze made a followup query, the EEOC said it had no information to share on the matter. The agency told The Breeze shortly after the complaint was filed that such matters are confidential and that information is provided “Only when and if the EEOC files a lawsuit are we allowed to furnish any information.”

Individual council evaluations: city attorney rated ‘standard’ or above in all performance categories

Cape Coral’s city attorney’s overall “above standard” evaluation score of 3.3 on a scale of 1 to 4 from the Cape Coral City Council late last month included two overall “excellents” and a trio of “standard”-pluses from members of the eight-member board.

Mayor John Gunter and Councilmember Joe Kilraine evaluated City Attorney Aleksandr Boksner with the highest average scores of “4” among 10 categories with Councilmember Rachel Kaduk’s overall average coming in at 2.5, Councilmember Laurie Lehmann’s at 2.6 and Councilmember Jennifer Nelson-Lastra at 2.7. Councilmember Derrick’s Donnell’s overall evaluation averaged to 3.8, Councilmember Keith Long’s,

an attorney, at 3.5, and Councilmember Bill Steinke at 3.

A 4 represents “excellent”; a 3 “above standard,” a 2 “standard” and a 1 “below standard.” Boksner received no “below standard” scores.

The evaluation took place on Aug. 27 with council approving a new, longer contract with additional compensation and better benefits on Sept. 3.

The new contract, extended for three years until Aug. 13, 2029, includes a 7.25% raise, pushing his annual base salary to $320,609.69. It also includes additional leave time and deferred compensation of $10,000, minimum, “within 14 days following his employment date anniversary of Aug. 13, 2025, and every anniversary employment date during the initial term.

Grant awards, programs on CRA agenda

The South Cape Community Redevelopment Agency is expected to vote on grant award resolutions today.

Each resolution is for a Breaking Barriers to Business Grant Program grant.

The first resolution, 14-25, is for Palace Pub & Wine Bar, for $34,480.

Resolution 15-25 is for a $28,520 grant for Nice Guys Pizza and a $7,817 grant for Lady Cakes Bakery.

Cape Coral City Council, sitting as the CRA commission, also will discuss the Demolition Grant Program. The existing funding structure “favors” small parcels over the larger properties. A revision in the gap would “promote equity” across the property sizes and “incentivize larger-scale redevelopment projects.”

There are three options for the commissioners.

The first would provide greater funding for larger

projects is $200,000 or more. According to city documents posted online with the agenda, for every additional $100,000 spent over $100,000 the grant increases by $75,000. An example provided was for a $200,000 project receiving a $150,000 grant.

The second proposal includes removing the cap on the second tier. The first $50,000 of eligible costs is 100% reimbursed up to $50,000 and costs above $50,000 is 50% reimbursed with no upper limit. There is no ceiling for the total grant for higher-cost demolitions, which currently sits at a $75,000 cap.

The third option is a flat 75% grant coverage of total eligible demolition costs.

The Cape Coral Community Redevelopment Agency meeting will be held at 9 a.m., today, Sept. 10, in Council Chambers at City Hall, 1015 Cultural Park Blvd. The meeting is open to the public.

North Fort Myers runners had a big day at Saturday’s Seahawks Invitational, winning the girls race and taking third in the boys team results.

Cape Coral was second in the boys race.

Despite the absence of star runner Jazlyn Forbes, the Oasis girls took second overall with Lilliana Sipe and Madison Boyko finishing 1-2. Sipe’s winning time was 20:46.2 to Boyko’s 20:57.5.

Aurelia Sciandra (21:34.5) led the Red Knights with a third-place finish, with teammate Isabella Hull ninth.

Briana Watson of Island Coast came in sixth.

On the boys side, Cape Coral finished second to Fort Myers in the team scoring, just ahead of North Fort Myers. Oasis was sixth and Ida Baker seventh.

The Seahawks’ Ruben Viera De Lemos finished third in 17:14.0. North’s Brody Hilt was seventh and Cape’s Joshua Warren came in eighth. Adiran Sosa of Oasis was 10th.

Mariner’s Angel Cruz, the area’s top boys runner so far this season, did not compete Saturday. Dylan MaciasBuenrostro of Mariner, finishing second to Cruz a week ago at the DDD Sommer Invitational, also skipped Saturday’s race.

Big second half leads North Red Knights to 37-14 win over Mariner’s Tritons

The North Fort Myers Red Knights football team picked up its first win of the season Friday night and, in-turn, new head coach Ira Riggins scored his first win as a head coach.

The Red Knights (1-2) defeated Mariner (1-2) at home 37-14 on senior night, backed by a 30-point second half following a long weather delay prior to the contest.

A sluggish first half for both offenses saw North take a 7-0 lead into half when Caedon Conn connected with A.J. Phillips for a 42-yard touchdown strike over the middle in the second quarter.

It was all Red Knights in the second half, especially on the ground, as running backs Christian Weber and J.D. Irons both found paydirt.

North rushed for more than 200 yards on the ground in the contest, with Weber

totaling 108 yards.

“We just got way too comfortable,” said Tritons head coach Tyran Jones. “We got out of ourselves in the second half. We let them gain momentum and we just couldn’t get it back.”

Conn threw for his second touchdown of the night in the third when he found Charles Lonbardo for a 23-yard score.

“We just couldn’t get anything going offensively,” Jones said, noting two of Mariner’s receivers were out of Friday’s contest. “That slowed down a lot of our game plan for the week.”

As far as what happened defensively, Jones said, “By the time we were getting some things going, we would jump offsides or have a mental issue. The small things that we work on, we let North really just gain momentum. We lost confidence.”

Mussels, Mets season finale Sunday canceled

FORT MYERS - Due to inclement weather and unplayable field conditions, the season finale between the Fort Myers Mighty Mussels and St. Lucie Mets has been canceled and will not be made up.

After taking the Thursday and Friday night games at Hammond Stadium by the scores of 6-3 and 4-1, respectively, the Mussels dropped the Saturday game with the Mets winning 14-3.

St. Lucie finished the regular season with a record of 77-53, winning both the first and second halves of the season in the Eastern Division of the

Florida State League.

The FSL playoffs were set to begin Tuesday, with St. Lucie, Daytona, Lakeland and Clearwater competing for the league title.

The Fort Myers Mighty Mussels finish the season with a record of 5273, last in the FSL.

Cape Coral police charge Naples man with grand theft

A Naples man has been charged by Cape Coral police after investigators said he was identified by his tattoos.

John Joseph Adams, 41, has been charged with two counts of grand theft, a third-degree felony.

Cape Coral Police Department officials state that on Aug. 27 around 8:45 a.m., officers were called to a reported theft at the Walmart located at 1619 Del Prado Blvd., South.

Officers met with Walmart’s loss pre-

vention investigator, according to police, who stated they observed a man attempting to push a cart full of unpaid merchandise past all points of sale.

CCPD officials said when confronted, the suspect abandoned the cart and fled on foot.

“The stolen merchandise, which was fully recovered, totaled $1,140.64 before tax,” CCPD officials stated in a release.

“Notable items included a $419 sewing machine and a Cricut Maker 3 valued at $349.00. Surveillance footage showed the suspect, described as heavily tattooed and

wearing a teal hat, selecting the merchandise and attempting to leave the store.”

Officials state a follow-up investigation by the CCPD Property Crimes Unit revealed the same suspect had been involved in a prior theft at a Walmart in Estero.

Detectives noted distinctive tattoos, including:”Ridin’ Dirty” on the man’s neck, “Momma” on his hand and “Rachel” in red letters beneath his lower lip.

Review of surveillance video and facial recognition software confirmed the suspect’s identity, officials stated, as Adams. A photo lineup was conducted, and Adams

was positively identified.

CCPD officials said further investigation linked Adams to additional thefts at Target (1890 N.E. Pine Island Road), where he reportedly stole $809.97 worth of merchandise, including Ninja cookware and a KitchenAid mixer.

On Sept. 6, Adams was arrested by the Lee County Sheriff’s Office in connection with another theft in Estero.

As of Tuesday afternoon, Adams will still in custody at Lee County Jail, being held on $13,500 bond, with one charge still pending a bail amount.

Council-related records requests to go through city attorney’s office

Public records requests for documents involving Cape Coral City Council will now go through the city attorney’s office.

Cape Coral Michael Ilczyszyn sent an email to staff and members of the elected board on Aug. 22, notifying them that the “responsibility change” had been implemented.

The change is intended to streamline the process while also ensuring “consistency, accuracy, and compliance,” the email states.

“This adjustment was made as a matter of best practice,” Ilczyszyn said in response

to a Breeze email. “City Council members are not employees of the City’s administration, and their records—such as emails, social media accounts, and other communications—are distinctly separate from the day-to-day operations of administrative departments. It is also important to note since council members are not employees, administrative regulations and standard operating practices do not apply to them. Because of this, it is appropriate for the City Attorney’s Office, which serves as the legal counsel to the Council, to manage and coordinate responses to these requests.”

There are a number of benefits, he said.

“The change provides several benefits,”

Ilczyszyn said.

“1) Consistency and Accuracy: The City Attorney’s Office is best positioned to ensure records are collected, reviewed, and released in compliance with Florida’s public records laws, especially when requests involve multiple formats or personal accounts.

“2) Separation of Roles: This process avoids placing administrative staff in the position of handling records that do not fall within their official responsibilities.

“3) Legal Oversight: Since some Council records may involve privileged communications or sensitive materials, it is prudent for the City Attorney’s Office

to oversee production and ensure proper redaction when required by law.”

The City Clerk’s Office will continue to directly process requests that are not related to Council.

City Clerk Kimberly Bruns is the city’s designated custodian of public records, as is typical among municipalities throughout Florida. The city’s public records portal for those who choose to make public records requests electronically remains on the City Clerk’s Office Public Records webpage, https://www.capecoral.gov/department/ clerk/publicrecordsrequest.php.

Boathouse LLC to reimburse 50% of the cost over the agreement term. If Council opts not to approve the agreements, the existing lease, which has about nine years left to run, will be reinstated. Council had set a deadline of Sept. 6 for a signed concessionaire agreement with the original deadline for a settlement of the existing lease for the damaged building already past. According to the agreement signed by Zak Kearns, owner and partner of the Boathouse, the business will again be responsible for cost of demolition of the structure with the demolition to be completed within 30 days of receiving the permits to do so.

Notice is hereby provided that the South Florida Water Management District is issuing a Water Use Permit (permit) modification with conditions (Permit Number 36-00077-W; Application Number 250815-56045 to Cam7-Sub, LLC to transition the project from agricultural irrigation to landscape irrigation associated with the proposed Kingston residential community on Corkscrew Road. As a result, the annual allocation is decreasing from 1791.8 million gallons (MG) to 543.33 MG, whereas the maximum month allocation is decreasing from 346.86 MG to 68.31 MG. The project name is Kingstone Phase I Irrigation, located in Lee County ‘ s Section 24, Township 46 South, and Range 27 East.
