Cape Coral Museum of History to celebrate city’s 55th anniversary

The Cape Coral Museum of History is hosting a free Open House Saturday, Aug. 16, from 10 a.m. to 2 p.m., in honor of the 55th anniversary of the incorporation of the city of Cape Coral.

There will be free admission to the museum and Master Gardeners will be on site for garden tours.

Guests can visit with some of the museum’s community partners, including the Cape Coral Fire Department (a fire truck will be on display from 10-11 a.m.), the Cape Coral Police Department, the Cape Coral Sun, the Chamber of Commerce of Cape Coral, Lee County Master Gardeners, Maddie’s Artisinal Bakery, Raso Realty and WinTrust Bank.

County Commission approves Cape Coral Bridge projects

voted to approve two measures advancing the project to expand and improve the Cape Coral Bridge.

Commissioners approved a resolution to formally adopt the planned bridge and roadway improvements, as well as a resolution to acquire additional right of way for the project.

“The Cape Coral Bridge improvement project is vital for our community’s future,” said Cape Coral Mayor John Gunter. “By increasing capacity and reducing congestion, we’re making daily travel safer and more efficient for Cape Coral residents.”

The Cape Coral Bridge connects Cape Coral Parkway in the city of Cape Coral to College Parkway in south Fort Myers. The planned improvements are designed to increase roadway

study for the Cape Coral Bridge in April 2022. Throughout the study, Lee County staff, the Florida Department of Transportation and the project consultant team worked closely to develop a final PD&E document.

On July 1, Lee County received Location and Design Concept Acceptance from FDOT, providing the necessary approvals for Lee County to continue project design and begin the rightof-way phase.

Construction is expected to begin in 2028.

Cape Police Department’s midyear report shows crime numbers down

According to recently released statistics from the Cape Coral Police Department, crime is down significantly over the first six months of 2025 compared to last year.

The CCPD report details “a remarkable 28% overall reduction in crime” year-over-year for the first half of 2025.

“This achievement reflects more than just numbers — it is a clear testament to the hard work and unwavering commitment of our dedicated officers, the support and vigilance of our community, and our department’s ongoing investment in innovative, data-driven policing,” CCPD officials said in a release issued Friday.

Between Jan. 1 and June 30, 2025, CCPD officials state the city experienced “significant declines in nearly every major crime category.”

Overall reported crime dropped from 2,076 cases in the first half of 2024 to 1,487 this year, “showcasing a substantial improvement in community safety.”

Robbery figures followed the positive trend, decreasing by 20%. The city reported zero homicides for the first half of 2025, compared to three in the same period of 2024.

The report shows motor vehicle thefts also declined by 4%, with 68 offenses this year versus 71 previously. CCPD officials state narcotics offenses fell from 194 cases in 2024 to 127 in 2025, representing a 35% reduction. Thefts saw a significant drop of 28%, down from 850 incidents to 612.

“These results reflect the commitment and collaboration of the department and the entire Cape Coral community in pushing back against crime at every level,” officials said.

Of the report, District 3 Councilmember Derrick Donnell said, “Our city ranks in the top 10% of being the safest city in the United States. This is a result of many factors that include but are not limited to; a professional department that is both dedicated and proactive, and a strong partnership with both our residential and business communities. This also gives our residents confidence in our city and is one of the major reasons why we continue to grow.”

CCPD officials said the reduction in crime is a testament to the “dedication and professionalism of the department’s officers, as well as the active participation of Cape Coral’s residents and business partners, Chief Anthony Sizemore

said, adding that by working proactively together, adopting cutting-edge technology, and embracing data-driven strategies, the city continues to set a high standard for public safety.”

“Our success is the result of several important strategies working together,” the release states. “First, strong partnerships with the community have created a culture of awareness, making it more difficult for crime to go unnoticed. We have also focused our patrols on areas with higher risk, and put extra effort into stopping repeat offenders, which has helped reduce crime directly. By investing in new technology — like advanced crime analysis and better investigative tools—we have been able to respond faster and solve cases more efficiently. Finally, our prevention and outreach efforts, such as public education and fraud awareness campaigns, have played a big role in the major declines seen in several types of crime.”

“We are proud to have an outstanding police department, and as our chief has said, our success is rooted in collaboration,” Cape Coral District 4 Councilmember Jennifer Nelson-Lastra said. “Public safety remains a top priority in our city, demonstrated by our continued commitment to equipping our officers with the tools and resources they need to do their jobs effectively and safely.”

The Cape Coral Police Department also extended its deepest gratitude to its officers, staff and all citizens who have played a part in this shared achievement.

FDLE breaks ground for new operations center in south Fort Myers

The Florida Department of Law Enforcement broke ground Thursday for a new operations center in Fort Myers.

The 64,000-square-foot complex to be built on 8.28acres at 16595 Oriole Road will act as the hub for the FDLE Fort Myers region, officials said.

The construction project is anticipated to take 13 months with FDLE to then move its Fort Myers Regional Operations Center from Page Field airport to the property close to I-75 and Alico Road.

The new center will include office space, laboratory areas for FDLE’s Forensic Services including the Biology, Chemistry, Crime Scene, Friction Ridge and Evidence disciplines, a training center built to host trainings, events and meetings, and a warehouse facility.

Officials said it will be an asset to law enforcement and the community alike.

“As the former Special Agent in Charge for Fort Myers, it’s an honor to be here as we lay the foundation for this region’s future,” said FDLE Deputy Commissioner Vaden Pollard. “This new regional operations center is more than bricks and mortar, it’s a reflection of FDLE’s growth, our commitment to southwest Florida and our investment in the people who serve and protect it every day.”

Three years ago, Hurricane Ian swept through Southwest Florida, leaving a trail of destruction in Collier, Lee, Charlotte, and DeSoto counties. The storm left structural damage to the Fort Myers Regional Operations Center.

During its recent session, the Florida Legislature approved the project that local law enforcement said will be of great benefit.

“This new facility means faster results, better evidence handling and ultimately more justice for victims,” said Punta Gorda Police Chief Pam Smith. “FDLE brings their expertise, knowledge and manpower to scenes that other

small agencies sometimes can’t provide. That dependable support is invaluable when every second counts.”

FDLE Fort Myers Special Agent in Charge Eli Lawson took a similar view.

“As with the investigations our agents and analysts conduct, the disciplines that our forensic scientists practice, and the support that all members provide to accomplish FDLE’s mission, FDLE extends the same level of excellence and innovation through this project,” Lawson said.. “FDLE is growing, and the department has nurtured that growth with top-of-the-line facilities, equipment and people.”

The estimated completion date is October 2026.

Tennis players from across Southwest Florida will be “Fighting Alzheimer’s With Every Serve” to honor a Cape Coral tennis pioneer while also continuing to bring awareness to those with Alzheimer’s disease.

The U.S. Coast Guard Auxiliary, Flotilla 91 Fort Myers Beach, will hold a comprehensive “Boat America” safe boating class on Saturday, Aug. 16. This essential course aims to equip local boaters with the knowledge and skills to navigate safely, underscoring the critical fact from the 2024 Florida FWC accident statistic report that most boating accidents are preventable.

Far too often, boating incidents result from a lack of education or awareness. This “Boat America” course directly addresses these common pitfalls by covering fundamental topics crucial for responsible boating. Participants will learn about boating laws, safety equipment requirements, navigation rules, emergency procedures, and how to handle various on-water situations.

“We believe that an educated boater is a safe boater,” said Robert Guenthner, Flotilla Commander, Flotilla 91 Fort Myers Beach. “The vast majority of boating accidents, injuries, and even fatalities could be avoided with proper training. This class is an investment in your safety, your passengers’ safety, and the safety of everyone on the water.”

Upon successful completion of the course, participants will receive an FWC (Florida Fish and Wildlife Conservation Commission) Boaters Card, which is often required for certain age groups to operate a vessel in Florida waters.

The Boat America Safe Boating Class will be held from 9 a.m. to 5 p.m., Aug. 16, at the Pine Ridge Community Center, 15660 Pine Ridge Road, Fort Myers.

The Courts Cape Coral will host the inaugural Joe Winslett Summer Classic Tennis Tournament on Aug. 16.

The benefit tournament will feature ladies doubles (3.0, 3.5 and 4.0) and men’s doubles (3.0, 3.5 and 4.0) in a round robin format with an elimination format depending on the draw.

Winslett, who fought a courageous battle against Alzheimer’s, was instrumental in establishing a tennis community at the Cape Coral Yacht Club. His love of tennis, and his legacy, continues to thrive now at The Courts Cape Coral.

Lisa Zuk, general manager, The Courts Cape Coral, met Joe after his wife Venita began attending tennis clinics at the Yacht Club, where her progress was immediate.

“Venita was one, I honestly felt her progress, she is like a 4.0 now, her advancement was very quick. So I got pretty close with Venita with lessons and clinics and through that she introduced me to Joe.”

“Joe was always just a really cool guy,” Zuk said. “He was always very laid back, at the club a lot, he played most mornings. I got to know Joe a bit more because he was such a handyman, always willing to help out of the goodness of his heart. Everyone loved him.””

Venita said her husband was always active but his love of tennis came about because he missed her.

“He never really played tennis much but he started playing because I got so heavily into it,” she said. “He said to me ‘I guess if I’m ever going to see you I better learn how to play, at least I’ll see you on the court!

“Then when he started playing he fell in love with the game, he was as obsessed as I was, if not more,” she said. “He’d go out at 6 in the morning with the guys, he’d get there early, make sure there was no trash, help clean the courts, he just loved, loved playing and being around all the people.”

Pat Monaghan, a close friend of Winslett and his wife, echoed Venita’s comments about Joe and his love of the game and the type of man he was.

Monaghan met Winslett years ago while watching him play tennis at the Yacht Club. In typical Winslett fashion, he asked him to play and they became fast friends.

“Joe is one of those guys who just always ‘showed up,’” said Monaghan. “He was always the first guy there, he’d ride his bike to the Yacht Club from his home on Skyline, in the dark, to get the court prepared, umbrellas up so it was ready. He was a self-made player, never took a lesson, just taught himself. He and Venita were just iconic there.”

Burnt Store Road Boat Ramp to close Aug. 13-15

The Burnt Store Boat Ramp, located at 230 Burnt Store Road South, will be closed from Wednesday through Friday, Aug. 13-15, due to an asphalt resurfacing project. Barring unforeseen circumstances, the ramp is expected to reopen Saturday, Aug. 16.

During this period, residents and boaters are encouraged to utilize other City-owned boat ramps:

n BMX Boat Ramp—1509 S.W. 7th Court (just north of Trafalgar Boulevard). This facility offers a double boat launching ramp, access

to an extensive freshwater canal system south of Pine Island Road, and restrooms.

n Horton Park Boat Ramp—2628

S.E. 26 Place. This ramp offers access to the Caloosahatchee River and the Gulf of Mexico, with ample parking and facilities.

n Rosen Park Boat Ramp—2414

S.E. 15 Terrace. Facility has multiple ramps, trailer parking, and restrooms.

Monaghan said Winslett was always active, whether it was mountain biking, riding motorcycles or boating.

“He was much more mechanically inclined than I was, I still have the TV on my boat he installed,” said Monaghan. “He was just a no nonsense type of guy, a hard-working dude. I really enjoyed our time together.”

However Joe and Venita’s life changed when he began to show signs of Alzheimer’s.

“In the beginning, we were completely shocked. As it progressed he said he was going to go as fast and as long and hard as he could,” Venita said. “Then we got into some drug trials. His thing was ‘I know they’re never going to help me but if I can do anything to help progress knowledge of Alzheimer’s or to save other people that’s what I’ll do.’”

Venita said the condition began a few years before it was diagnosed.

“Little things that he would forget were happening,” she said. “Like he was impeccable with directions. You could blindfold him in the forest, spin him around and ask him to point north and he would. And he started not being good at directions which was an odd thing. I would say things to him and he would say I never told him that. I put a note in his wallet with my name and number in case of an emergency. He asked me who Venita was. He finally realized it was not good and said there is something wrong.”

They visited Lee Memory Health where preliminary tests were conducted which led to more detailed MRIs and further indepth testing.

However it was a comment coldly delivered from a healthcare specialist that said “today is the best day of the rest of your life” that made them realize the magnitude of his condition.

CRA’s $7.45 million budget approved for Fiscal Year 2026

Cape Coral City Council, sitting as the South Cape Redevelopment Agency Commission, approved the CRA’s Fiscal Year 2026 budget of $7,455,201 Wednesday.

The budget includes an updated tax increment revenue of $453,254 from the July 1 property values. The revenue comes from Lee County tax increment based on 3.7623 millage rate and the

general fund transfer based on 5.2188 millage rate.

City Manager Mike Ilczyszyn, who also acts as the CRA’s executive director, said the benefit of having a CRA, versus drawing a geographic square and setting aside revenue, is receiving $3.1 million from Lee County.

“The CRA is one of the only direct benefits we get from the county,” he said. “The benefit is right there, $3.1 million directly coming from the county. A direct

financial investment in our trust fund to reinvest in the community.”

The budget includes four full-time positions, a code compliance officer removed and budgeted for the services in operating.

The operating budget includes Economic Development Incentives of $545,000, enhanced code enforcement and policing services and central services for $631,086 and project manager services of $150,000.

The transfers out include Palm Tree Median Beautification for $1,210,922, loan payment for The Cove parking garage for $1,122,294 and the annual debt for Southeast 47th Terrace Landscape for $460,741 and Bimini Basin for $2,600,000.

Budget Administrator Nicole Reitler said the existing capital project budget has $14.3 million allocated to CRA capital improvements with a $9.2 million available for existing projects.

Mussels drop series finale 7-1 to Blue Jays in 11 innings

FORT MYERS — The Fort Myers Mighty Mussels fell 7-1 in 11 innings to the Dunedin Blue Jays in the series finale at Hammond Stadium Sunday.

Sam Rochard made his Florida State League debut, getting the start on the mound for Fort Myers (45-55, 18-18).

Dunedin (48-49, 14-18) got on the board against Rochard in the top of the second inning. Brock Tibbitts led off the inning with a single and later scored on a two-out double by Austin Smith to give the Blue Jays an early 1-0 lead.

Rochard allowed one run on four hits, and struck out three across three-plus innings of work.

Like Rochard, Will Armbruester made

his Mussel debut Sunday. Armbruester entered out of the Mussels’ bullpen in the top of the fourth, and recorded all three outs in the inning.

Armbruester faced the minimum in the fifth, before recording the first out of the sixth and seeing his outing come to an end. He tossed 2.1 scoreless innings and picked up a pair of strikeouts.

Anthony Narvaez took over with one out in the top of the sixth and induced a ground ball double play to end the frame. His outing ended with two outs in the top of the seventh inning, after striking out one across 1.1 innings of work.

Zander Sechrist was the fourth Mussel pitcher of the afternoon, and needed just

one pitch to retire the final batter of the 7th.

In the home half of the frame, Bryan Acuna reached on a one-out single. Later in the inning, Luis Hernandez’s first professional hit was a single to center, which scored Acuna and tied the game 1-1.

Sechrist went seven up and seven down before exiting in the top of the 10th. Julio Bonilla took over on the mound and retired all three men he faced.

The Mussels got two on with one out in the bottom of the inning but couldn’t score, which sent the game to the 11th.

Tyler Stasiowski (2-1) was the sixth pitcher of the day for Fort Myers and didn’t record an out in the top of the 11th.

Dunedin took a 2-1 lead on an RBI double

by Kendry Chirinos off Stasiowski, who then issued back-to-back walks before giving way to Jakob Hall.

Hall issued a third consecutive walk by Fort Myers pitching, as the Blue Jays extended their margin to 3-1. After a sacrifice fly from Tucker Toman, Tibbetts lashed a double to left center to add to the tally and push the lead to 6-1.

Dunedin added an RBI groundout to make it six runs in the inning and take a 7-1 lead to the bottom of the 11th.

“I still struggle, it’s hard for me. I miss him greatly, we were together for more than 40 years,” she said. “So I’m trying to do things that I know he would want me to do. We both loved tennis, it was such a connection for us, so getting back into it gives me that connection.”

Zuk, who lost her grandfather to Alzheimer’s, hopes to make the Winslett Summer Classic an annual event. The idea for the tournament came about when Zuk met with Venita hoping to plan a way to bring awareness to Alzheimer’s in Joe’s memory.

“If it’s a success, yes I would like it to be an annual event, I feel as we get along with the amount of people we have so far, it will be. This event is special because it’s

Venita and Joe,” she said. “He was such a big part of the Yacht Club that I’d say about 90% of the people that play at The Courts came from the Yacht Club and most knew Joe. After the Yacht Club was destroyed in the hurricane people could have gone to play anywhere, But we had such a tight-nit community, and Joe was such a huge part of that, which is amazing, to have so many go from public courts to here.”

The cost to take part in the tournament is $45 per person, which includes lunch.

A portion of the proceeds will be going to fight Alzheimer’s, with 100% of a raffle also going to battle the disease.

In addition to hosting the Summer Classic for tennis enthusiasts, the raffle will offer an opportunity to win prizes including weekend getaways, restaurant gift cards, golf packages, and much more.

You do not need to participate in the tennis tournament to take part in the raffle.

Tickets can be purchased up to Aug.16 at The Courts at Cape Coral pro shop adjacent to the Sun Splash Family Waterpark on Santa Barbara. Raffle tickets will go for

$5 for items valued at less than $200 and $20 for those $200 and above.

Saturday, Aug. 13, is the cut off date to register to participate in the tennis tournament. Zuk hopes to have 70 players take part.

Proceeds from the tournament and the raffle donations, will go to the “Walk to End Alzheimer’s” organization. A walk is scheduled for Saturday, Nov. 8, in Fort Myers at Florida Southwest College.

Cape Coral Bridge: Plans to replace the existing structure move ahead

Four lanes of traffic will remain open throughout construction. A new eastbound bridge will first be built south of the current

eastbound bridge and will temporarily provide two lanes in each direction to maintain current travel conditions. Once traffic shifts to the new eastbound bridge, both existing bridges will be demolished.

A new westbound bridge will then be built to the north of the existing bridges. Each new bridge will accommodate three lanes of traffic and include a shared-use path.

A RESOLUTION OF THE HERONS GLEN RECREATION DISTRICT

APPROVING A PRELIMINARY BUDGET RELATING TO SPECIAL ASSESSMENTS TO BE LEVIED IN THE DISTRICT TO OPERATE AND MAINTAIN THE RECREATIONAL FACILITIES; STATING THE INTENTION TO USE CHAPTER 170 AND CHAPTER 197, FLORIDA STATUTES AS METHODS OF COLLECTING SUCH ASSESSMENTS; CALLING FOR A PUBLIC HEARING TO BE HELD AT WHICH THE DISTRICT SHALL CONSIDER THE ADOPTION OF A NON AD VALOREM ASSESSMENT ROLL IN CONNECTION WITH SUCH ASSESSMENTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE HERONS GLEN RECREATION DISTRICT:

SECTION 1. AUTHORITY FOR THIS RESOLUTION. The Board of Supervisors (the "Board") of the Herons Glen Recreation District (the "District") is authorized to adopt this Resolution under the authority granted by the provisions of Chapter 418, Florida Statutes, as amended, its Charter (Ordinance No. 98-08 adopted by Lee County, Florida on April 25, 1998, as amended), Chapter 189, Florida Statutes, Chapter 170, Florida Statutes and Chapter 197, Florida Statutes and other applicable provisions of law (collectively, the "Act").

SECTION 2. FINDINGS. The Board of Supervisors expressly finds as follows:

A. The District is a local unit of special purpose government organized and existing under and pursuant to Chapter 418 Florida Statutes. The District was established for the purpose of acquiring and operating the Recreational Facilities (hereinafter defined).

B. "Recreational Facilities" shall collectively refer to the land and any and all buildings and other improvements that are owned, or acquired subsequently, by the District including, without limitation, clubhouse, maintenance buildings, cart storage area, outbuildings, supports, foundations, structures, golf course, practice facilities, ranges, pitching and putting greens, tennis courts, shuffleboard courts, swimming pools, bocce courts, pickle ball courts, fitness center, storage areas and storage buildings, lakes, landscaping, signs, paths, sidewalks, curbs, driveways, parking lots, bridges, lighting, open or vacant lands, water systems, drainage systems, waste water facilities, maintenance facilities and irrigation water storage and distribution facilities (CLIS), machinery, fixtures and equipment, including all substitutions for, replacements of and additions to the same located within or without the Herons Glen Development of Regional Impact in North Fort Myers, Lee County, Florida, and any such other facilities as the District may acquire from time to time. The Recreational Facilities are also sometimes referred to herein as the “Improvements.”

C. The Board has annually since their acquisition, and has again, this date, considered and does now determine that the operation, maintenance and improvement of said Recreational Facilities serves a proper, essential and valid public purpose which specially benefits each lot in the District.

D. The District is empowered by the Act to provide facilities such as the Recreational Facilities to the residents of the District and others.

E. Management has submitted a Preliminary Budget Report ("Preliminary Budget Report") for operation and management of the Recreational Facilities during the District's 2025-2026 Fiscal Year, which Preliminary Budget Report supports the special benefit to the properties in the District as a result of the operation, maintenance and improvement of the Recreational Facilities and allocates such benefit to the properties in the District. The Preliminary Budget Report provides a method, based upon the 1999 report of Financial & Associates, Ltd., entitled “Preliminary Special Assessment Methodology,” as amended, in 2006 and again in August 2020, by PFM Financial Advisors LLC (the “Financial Report”) for levying non ad valorem special assessments on the specially benefitted properties in the District in order to provide funds necessary to operate, maintain, replace, improve and manage the District and its Facilities, and which Financial Report anticipates no general tax revenue for the District. The Financial Report in conjunction with the Budget Report, is the basis for the methodology used for determining the District’s Preliminary Assessment Roll.

F. The District now desires to approve and adopt the Budget Report and the Preliminary Assessment Roll, evidence its intent to collect the Special Assessments (the "Special Assessments") by the Methods authorized by Chapter 170 and Chapter 197, Florida Statutes, and to call for a public hearing for the purpose of hearing evidence from assessed owners and for adopting a final non ad valorem assessment roll with respect to such Special Assessments, all as required by Florida Statutes.

G. The Board finds that all lots and parcels, developed and anticipated to be developed, as well as the residents, existing and anticipated, of the District will be specially

benefitted by the Special Assessments through fulfillment of the operation and management of the District and the operation, maintenance and replacement of its Recreational Facilities, because the Recreation Facilities were purchased or otherwise acquired on the basis that they are a special benefit to each property within the District, and the District having acquired them for the benefit of the property in the District, finds that those facilities must be properly operated, maintained, replaced, improved, increased and managed in order for them to continually provide the special benefit to such property, in accord with the original intent for creation of the District and as contemplated at the time of initial acquisition of the Recreational Facilities.

H. The Board finds that the Preliminary Budget Report provides a fair and equitable apportionment of the Special Assessments for the District’s next fiscal year, 20252026

SECTION 3. APPROVAL OF PRELIMINARY BUDGET REPORT AND PRELIMINARY ASSESSMENT ROLL. The Preliminary Budget Report, substantially in the form submitted at the July 18, 2025 Board meeting, including the preliminary special assessments included therein, i.e. the per lot annual operation and maintenance assessments, as shown in the attached Exhibit A, as well as that certain annual debt service assessment previously established for repayment of the District’s Bonds (the “Bond Debt Service Assessments”), are hereby approved and adopted. The proposed per lot assessments as stated therein will be imposed upon all existing lots located within the Herons Glen Recreation District’s jurisdictional boundaries.

SECTION 4. INTENT TO ASSESS AND COLLECT SPECIAL ASSESSMENTS.

The Findings have been considered by the Board and found to be true and correct. The District hereby states its intent to use the method of collecting the Special Assessments as permitted by Section 189.4065, Florida Statutes, and Chapters 197 and 170, Florida Statutes, for the assessable properties in the District. The District intends to use the methodology of Section 197.3632 for collection of its Bond Debt Service Assessments, and for collection of its annual operation and maintenance assessments on lots owned by owners who are or have been substantially delinquent in payment of prior District assessments. Otherwise, the District intends to use the methodology of Chapter 170 for collection of its annual operation and maintenance assessments.

The levy of the Special Assessments is required to provide funds for payment of debt service and to operate, maintain, replace, improve and manage the District and its Facilities during its fiscal year 2025-2026 in the amounts set forth in the Preliminary Budget Report. The Special Assessments shall be made on all lots and lands specially benefited, as further designated in the assessment roll hereinafter provided for. The assessments shall be made on a platted (developed and vacant) per lot basis; they shall be in the amount described in the Preliminary Budget Report per Lot, unless the amount is modified at the final hearing described herein; they shall be imposed on an annual basis, and collected either annually or quarterly, as determined by the Board at the final Public Hearing. For those lots whose Special Assessments the Board determines are eligible, the Special Assessments shall be paid by in quarterly installments to be billed by the District during the District's 2025-2026 Fiscal Year. Further, the Special Assessments shall be the personal obligation of each owner, whether collected by direct billing or by the uniform method of Section 197.3632, Florida Statutes, i.e. on the County tax bill.

The legal description of the lands within the District which shall be subject to the levy of the Special Assessments is attached hereto as Exhibit B.

SECTION 5. PUBLIC HEARING TO ADOPT SPECIAL ASSESSMENT ROLL.

The District hereby calls and sets a final public hearing for Friday, September 5, 2025 at 6:00 p.m. to be held in the Clubhouse of the Herons Glen Golf & Country Club, 2250 Herons Glen Boulevard, North Fort Myers, Lee County, Florida (the "Final Adoption Hearing") for the purpose of receiving testimony and objections from affected property owners, adopting a Final Budget Report, and a final non ad valorem Special Assessment roll (the "Final Special Assessment Roll") with respect to the Special Assessments. At the Final Adoption Hearing, the Board will sit as an equalizing board, will hear objections of all interested persons to the Final Assessment Roll and will finally confirm and adopt a Final Special Assessment Roll and allocate such assessments as appropriate among any property in the District, or take such action relative thereto as it deems just and right.

SECTION 6. NOTICE AND PUBLICATION. As required by Section 170.07, Florida Statutes and Section 197.3632, Florida Statutes, at least thirty (30) days prior to the Final Adoption Hearing, notice thereof shall be given by first-class United States mail. The notice shall be in substantially the form attached hereto as Exhibit C (the "Notice"). The Notice to be given by mail shall be sent to each person shown by the Lee County Property Appraiser as owning property subject to the Special Assessments on the effective date of this Resolution. The Notice shall include the

information required by Florida Statutes. This Resolution shall be published once a week for a period of two (2) weeks in a newspaper of general circulation published in Lee County. Further, the Notice of the time and place of the Final Adoption Hearing shall be published two times, one week apart in a newspaper of general circulation published in Lee County such that the final publication is at least one week prior to the Final Public Hearing.

SECTION 7. GOLF AND TENNIS ANNUAL FEES. The preliminary Golf Membership and Tennis Membership fees and charges, which are also shown on the attached Exhibit “A,” are hereby preliminarily approved for the 2025-2026 fiscal year, subject to any changes approved in the at the Final Adoption Hearing.

SECTION 8. MISCELLANEOUS. The Chairman, and other officers of the Board of Supervisors, the District Management and the District Legal Counsel are authorized and directed to execute and deliver all documents, contracts, instruments and certificates and to take all actions and steps on behalf of the District that are necessary or desirable in connection with the effectuation of this Resolution and which are not inconsistent with the terms and provisions herein.

SECTION 9. SEVERABILITY. Should any sentence, section, clause, part or provision of this Resolution be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of this Resolution as a whole, or any part thereof, other than the part declared invalid.

SECTION 10. EFFECTIVE DATE. This Resolution shall be effective immediately upon its adoption.

NOTICE IS HEREBY GIVEN that the Herons Glen Recreation District (the “District”) has called for a public hearing to be held on Friday, September 5, 2025 at 6:00 p.m in the Clubhouse of the Herons Glen Golf & Country Club, 2250 Herons Glen Boulevard, North Fort Myers, Lee County, Florida, for the purpose of adopting its Annual Budget and non-ad valorem assessment roll in the form of special assessments to defray the cost of bond debt service and operating and maintaining the District’s Recreational Facilities and to fund capital replacement and deferred maintenance reserve accounts during its upcoming fiscal year, 2025/2026. For lots owned by owners who are two or more quarters delinquent, the O&M amounts stated above are proposed to be collected either directly by the District, or by the County Tax Collector, as determined by the District from time to time. BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE HERONS GLEN RECREATION DISTRICT:

SECTION 1. AUTHORITY FOR THIS RESOLUTION. The Board of Supervisors (the "Board") of the Herons Glen Recreation District (the "District") is authorized to adopt this Resolution under the authority granted by the provisions of Chapter 418, Florida Statutes, as amended, its Charter (Ordinance No. 98-08 adopted by Lee County, Florida on April 25, 1998, as amended), Chapter 189, Florida Statutes, Chapter 170, Florida Statutes and Chapter 197, Florida Statutes and other applicable provisions of law (collectively, the "Act").

SECTION 2. FINDINGS. The Board of Supervisors expressly finds as follows:

A. The District is a local unit of special purpose government organized and existing under and pursuant to Chapter 418 Florida Statutes. The District was established for the purpose of acquiring and operating the Recreational Facilities (hereinafter defined).

B. "Recreational Facilities" shall collectively refer to the land and any and all buildings and other improvements that are owned, or acquired subsequently, by the District including, without limitation, clubhouse, maintenance buildings, cart storage area, outbuildings, supports, foundations, structures, golf course, practice facilities, ranges, pitching and putting greens, tennis courts, shuffleboard courts, swimming pools, bocce courts, pickle ball courts, fitness center, storage areas and storage buildings, lakes, landscaping, signs, paths, sidewalks, curbs, driveways, parking lots, bridges, lighting, open or vacant lands, water systems, drainage systems, waste water facilities, maintenance facilities and irrigation water storage and distribution facilities (CLIS), machinery, fixtures and equipment, including all substitutions for, replacements of and additions to the same located within or without the Herons Glen Development of Regional Impact in North Fort Myers, Lee County, Florida, and any such other facilities as the District may acquire from time to time. The Recreational Facilities are also sometimes referred to herein as the “Improvements.”

C. The Board has annually since their acquisition, and has again, this date, considered and does now determine that the operation, maintenance and improvement of said Recreational Facilities serves a proper, essential and valid public purpose which specially benefits each lot in the District.

D. The District is empowered by the Act to provide facilities such as the Recreational Facilities to the residents of the District and others.

E. Management has submitted a Preliminary Budget Report ("Preliminary Budget Report") for operation and management of the Recreational Facilities during the District's 2025-2026 Fiscal Year, which Preliminary Budget Report supports the special benefit to the properties in the District as a result of the operation, maintenance and improvement of the Recreational Facilities and allocates such benefit to the properties in the District. The Preliminary Budget Report provides a method, based upon the 1999 report of Financial & Associates, Ltd., entitled “Preliminary Special Assessment Methodology,” as amended, in 2006 and again in August 2020, by PFM Financial Advisors LLC (the “Financial Report”) for levying non ad valorem special assessments on the specially benefitted properties in the District in order to provide funds necessary to operate, maintain, replace, improve and manage the District and its Facilities, and which Financial Report anticipates no general tax revenue for the District. The Financial Report in conjunction with the Budget Report, is the basis for the methodology used for determining the District’s Preliminary Assessment Roll.

F. The District now desires to approve and adopt the Budget Report and the Preliminary Assessment Roll, evidence its intent to collect the Special Assessments (the "Special Assessments") by the Methods authorized by Chapter 170 and Chapter 197, Florida Statutes, and to call for a public hearing for the purpose of hearing evidence from assessed owners and for adopting a final non ad valorem assessment roll with respect to such Special Assessments, all as required by Florida Statutes.

G. The Board finds that all lots and parcels, developed and anticipated to be developed, as well as the residents, existing and anticipated, of the District will be specially

benefitted by the Special Assessments through fulfillment of the operation and management of the District and the operation, maintenance and replacement of its Recreational Facilities, because the Recreation Facilities were purchased or otherwise acquired on the basis that they are a special benefit to each property within the District, and the District having acquired them for the benefit of the property in the District, finds that those facilities must be properly operated, maintained, replaced, improved, increased and managed in order for them to continually provide the special benefit to such property, in accord with the original intent for creation of the District and as contemplated at the time of initial acquisition of the Recreational Facilities.

H. The Board finds that the Preliminary Budget Report provides a fair and equitable apportionment of the Special Assessments for the District’s next fiscal year, 20252026

SECTION 3. APPROVAL OF PRELIMINARY BUDGET REPORT AND PRELIMINARY ASSESSMENT ROLL. The Preliminary Budget Report, substantially in the form submitted at the July 18, 2025 Board meeting, including the preliminary special assessments included therein, i.e. the per lot annual operation and maintenance assessments, as shown in the attached Exhibit A, as well as that certain annual debt service assessment previously established for repayment of the District’s Bonds (the “Bond Debt Service Assessments”), are hereby approved and adopted. The proposed per lot assessments as stated therein will be imposed upon all existing lots located within the Herons Glen Recreation District’s jurisdictional boundaries.

SECTION 4. INTENT TO ASSESS AND COLLECT SPECIAL ASSESSMENTS.

The Findings have been considered by the Board and found to be true and correct. The District hereby states its intent to use the method of collecting the Special Assessments as permitted by Section 189.4065, Florida Statutes, and Chapters 197 and 170, Florida Statutes, for the assessable properties in the District. The District intends to use the methodology of Section 197.3632 for collection of its Bond Debt Service Assessments, and for collection of its annual operation and maintenance assessments on lots owned by owners who are or have been substantially delinquent in payment of prior District assessments. Otherwise, the District intends to use the methodology of Chapter 170 for collection of its annual operation and maintenance assessments.

The levy of the Special Assessments is required to provide funds for payment of debt service and to operate, maintain, replace, improve and manage the District and its Facilities during its fiscal year 2025-2026 in the amounts set forth in the Preliminary Budget Report. The Special Assessments shall be made on all lots and lands specially benefited, as further designated in the assessment roll hereinafter provided for. The assessments shall be made on a platted (developed and vacant) per lot basis; they shall be in the amount described in the Preliminary Budget Report per Lot, unless the amount is modified at the final hearing described herein; they shall be imposed on an annual basis, and collected either annually or quarterly, as determined by the Board at the final Public Hearing. For those lots whose Special Assessments the Board determines are eligible, the Special Assessments shall be paid by in quarterly installments to be billed by the District during the District's 2025-2026 Fiscal Year. Further, the Special Assessments shall be the personal obligation of each owner, whether collected by direct billing or by the uniform method of Section 197.3632, Florida Statutes, i.e. on the County tax bill.

The legal description of the lands within the District which shall be subject to the levy of the Special Assessments is attached hereto as Exhibit B.

SECTION 5. PUBLIC HEARING TO ADOPT SPECIAL ASSESSMENT ROLL.

The District hereby calls and sets a final public hearing for Friday, September 5, 2025 at 6:00 p.m. to be held in the Clubhouse of the Herons Glen Golf & Country Club, 2250 Herons Glen Boulevard, North Fort Myers, Lee County, Florida (the "Final Adoption Hearing") for the purpose of receiving testimony and objections from affected property owners, adopting a Final Budget Report, and a final non ad valorem Special Assessment roll (the "Final Special Assessment Roll") with respect to the Special Assessments. At the Final Adoption Hearing, the Board will sit as an equalizing board, will hear objections of all interested persons to the Final Assessment Roll and will finally confirm and adopt a Final Special Assessment Roll and allocate such assessments as appropriate among any property in the District, or take such action relative thereto as it deems just and right.

SECTION 6. NOTICE AND PUBLICATION. As required by Section 170.07, Florida Statutes and Section 197.3632, Florida Statutes, at least thirty (30) days prior to the Final Adoption Hearing, notice thereof shall be given by first-class United States mail. The notice shall be in substantially the form attached hereto as Exhibit C (the "Notice"). The Notice to be given by mail shall be sent to each person shown by the Lee County Property Appraiser as owning property subject to the Special Assessments on the effective date of this Resolution. The Notice shall include the

information required by Florida Statutes. This Resolution shall be published once a week for a period of two (2) weeks in a newspaper of general circulation published in Lee County. Further, the Notice of the time and place of the Final Adoption Hearing shall be published two times, one week apart in a newspaper of general circulation published in Lee County such that the final publication is at least one week prior to the Final Public Hearing.

SECTION 7. GOLF AND TENNIS ANNUAL FEES. The preliminary Golf Membership and Tennis Membership fees and charges, which are also shown on the attached Exhibit “A,” are hereby preliminarily approved for the 2025-2026 fiscal year, subject to any changes approved in the at the Final Adoption Hearing.

SECTION 8. MISCELLANEOUS. The Chairman, and other officers of the Board of Supervisors, the District Management and the District Legal Counsel are authorized and directed to execute and deliver all documents, contracts, instruments and certificates and to take all actions and steps on behalf of the District that are necessary or desirable in connection with the effectuation of this Resolution and which are not inconsistent with the terms and provisions herein.

SECTION 9. SEVERABILITY. Should any sentence, section, clause, part or provision of this Resolution be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of this Resolution as a whole, or any part thereof, other than the part declared invalid.

SECTION 10. EFFECTIVE DATE. This Resolution shall be effective immediately upon its adoption.
