Chair’s Report

As we look ahead to a new year the economic outlook for 2023 remains equally uncertain. Inflationary pressures have hit businesses and customers expect the same high level of service that you provide despite these evolving impacts on your bottom line. Add skill shortages and rising energy costs to this and businesses are presented with challenges on multiple fronts. From the MTA’s perspective this means members require the latest advice and advocacy to ensure they remain robust and viable.

Retail across 2022 recorded similar new and used vehicle sales, indicating that consumer demand remains strong. This also extended to agricultural machinery. Global

supply chains are hoped to ease in the coming months as China re-opens following its pursuit of a COVID suppression strategy which choked international markets. This presents an opportunity for local sales to continue resurging, in addition to parts becoming more readily available.

At the other end of the industry, skill shortages are persisting and service and repair businesses continue to have backlogs simply due to not having enough employees to complete work. It is not uncommon for business owners to be on the tools themselves, with less time to actually manage workplaces and associated red tape. This is particularly the case for regional businesses and another ongoing focus of the MTA this year will be skilled migration where positions cannot be filled locally to assist alleviate labour shortages. Equally, we need to have the right initiatives in place to attract people to an apprenticeship.

Like all sectors of our economy, skill shortages remain a significant issue for automotive. We must demonstrate to young people, as well as their parents, schools and influencers that there is a bright future in completing an apprenticeship. Our industry is full of opportunity but unless we convince young people of it they will not be rewarded with the exciting and rewarding career which we know it to be.

The MTA is committed to addressing this. Our own words must be matched by actions and this is why the association is working with students through our NT Mentoring Program. It complements further

initiatives such the additional work our Automotive Apprentice Mentor role is undertaking through school visits and open days to educate young people about the possibilities within our industry.

It was exciting to see this on display first-hand at the 2022 TIO Automotive Apprentice Awards in late November. 300 people joined the MTA to celebrate young Northern Territorians and the passion and drive of the apprentices was evident to everybody in the room.

On an operational level Darrell Jacobs has succeeded Paul Unerkov in the role of MTA SA/NT CEO, following unanimous endorsement by the Board. I have every confidence that he will rise to the occasion and he has already hit the ground running. Darrell has two decades of automotive experience and will provide the MTA with a strong knowledge base and connection to industry.

As part of this renewal, we have also turned our attention to implementing our new three-year strategic plan. We want the MTA to be recognised as the automotive trainer and apprentice employer of choice by the industry, government and public alike. As part of our long-term planning, the MTA must also stay at the forefront of automotive innovation. This includes electric vehicles where we eagerly await the Federal Government developing the inaugural National Electric Vehicle Strategy.

2023 will be another big year for our industry and as the only NT employer-based organisation dedicated to automotive, the MTA will continue delivering the same level of service members have come to expect.

CEO’s Message

As a new year begins, the extraordinary privilege of being appointed to the role of CEO of the Motor Trade Association SA/ NT is not lost on me. I have a clear vision for the MTA – to be the best automotive skills, careers and service provider. Building on Paul Unerkov’s tremendous work, I am committed to delivering this to ensure members can ultimately remain doing what they do best –running their business.

Coming into the role I bring sheer enthusiasm in representing one of the most important industries to the local economy and Northern Territorians at large. Classified as an essential service throughout the COVID-induced lockdowns,

automotive keeps the territory moving. This is where getting the public policy settings right for automotive businesses is critical across retail, service and repair. Equally still, the MTA must be fit for purpose to deliver the key services to our members.

To meet this goal, the MTA is revitalising our internal organisational structure. As part of our vision for the association to be the best automotive skills, career and service provider we are synergising our resources in 2023 and beyond.

On a practical level for members and MTA customers, we are integrating our field operations across training, employment and divisions. Our goal is to support your business better by having more representatives in industry, understanding the key issues and helping solve them as quickly as we can.

Moving forward, I look forward to leaning on the guidance of members as we navigate ongoing policy priorities, including skills shortages. The transition to zero and low emission vehicles will also present new opportunities for the industry but we must ensure that this transition does not adversely affect local businesses. The MTA will stand shoulder to shoulder with industry in this regard, whether it’s advocating to all levels of government on your behalf or helping your business prepare to sell, service and repair new vehicles.

This is why the MTA will continue delivering local electric vehicle training in the NT. Industry demand is accelerating for hybrid and battery electric vehicle training and we will continue offering a range of short courses in Hybrid and Electric Vehicle Technology for technicians to upskill.

For members, I am committed to making sure you have access to the very best workplace relations services. Most MTA members have been with us for more than ten years and may not have called upon our expertise to assist them, but they know that the MTA will always be there should an issue arise. In my view having this confidence and peace of mind remains essential.

Over the coming months I look forward to engaging with as many members as I can. As an association we are only as strong as our membership. This includes our Chair, MTA Board, Industry Advisory Council and Chairs of each Divisions and Zones. My door is always open as we strive together to develop the MTA to be the best automotive skills, careers and service provider.

This will complement working with all levels of the Northern Territory Government and members of parliament to ensure continual engagement and open and honest conversations that can strengthen both the Automotive Industry and the NT.

Shocking MTA Survey Reveals Rampant Theft and Crime Faced by NT Automotive Businesses

Following strong feedback from members and the automotive industry more broadly, the MTA has advocated for deterrents such as harsher penalties and sentencing to stop the cycle of local violence and crime in the Northern Territory.

Local crime is a significant issue and the MTA conducted a survey to identify major concerns. While frustration with a lack of police follow-up was a common theme, a majority of respondents said harsher penalties and sentencing was required, in addition to greater education.

More than half of survey respondents reported property damage or vandalism in the past 12 months, with 47 per cent also reporting being a victim of theft. Only a quarter of survey respondents said they were either satisfied or very satisfied with the Northern Territory Police’s response to crime in their area. Commonly stolen items from automotive businesses have included utes such as Toyota Landcruiser Troopcarriers. Territorians work hard to make a livelihood and putting up with these challenges is an unnecessary cost to doing business. At what point do we say enough is enough and that businesses do not deserve to put up with this?

In recent months, MTA members have detailed an increased spate of thefts and property damage. There isn’t going to be a quick or easy solution but we have to start somewhere.

The MTA will continue to call out crime and work with the Northern Territory Government to adequately address member concerns. Authorities should urgently address business concerns by identifying reforms to criminal punishments and offender rehabilitation.

As part of its advocacy, the MTA’s demand for action by authorities was reported by local radio and television news.

Automotive Apprentices Recognised for their Contributions to Employers and Our Industry

Organised by the Motor Trade Association, close to 300 people attended the 2022 TIO Automotive Apprentice Awards at Mindil Beach Casino Resort in November to celebrate apprentices and to recognise the immense support provided by their employers.

The event was held to recognise local Northern Territorians who have excelled in our industry and personified what it means to be an apprentice. The passion and drive of the students were evident to everybody in the room and highlighted how the industry is full of diverse and exciting career opportunities.

Congratulations to all the nominees and recipients, including the 2022 TIO Automotive Apprentice of the Year, Panormitis Ampelas from MY AUTOCare - Automotive Solutions, in Winnellie.

After becoming interested in cars from a very young age, Panormitis has viewed being a mechanic as a job for life and was recognised for

this passion. Like most Territorians, his hobbies include hunting, fishing and camping but it was his love of all things automotive which saw him impress during his trade with MY AUTOCare – Automotive Solutions. The Indigenous Award category was presented by Paul Kirby, the Northern Territory Minister for Business, Jobs and Training, and awarded to Trey Patullo from Gebie Civil and Construction, Groote Island. Trey has been outstanding in all aspects of his training and is well deserving of the title.

The MTA saw a significant increase in the number of nominees across all award categories, but in particular within the Light Vehicle Mechanical Technology, Heavy Commercial Vehicle Technology, Mobile Plant

Technology and Automotive Electrical Technology categories. “Our industry is full of opportunity and we thank the employers for their ongoing contribution towards promoting the continuation and completion of automotive apprenticeships in the Northern Territory,” MTA CEO Darrell Jacobs said. “The strong turnout reflected the importance of the automotive industry to the Northern Territory and with the breadth of recipients at this year’s awards its future is strong.”

MTA Chair Frank Agostino agreed. “It is always rewarding to see young adults excelling in their chosen profession and this sits behind what we aspire to achieve at the MTA,” he added.

Culture is Central for New MTA Member

Harmonious working relationships are a priority for Central Diesel Services, and it’s largely why they have recently joined the MTA.

“To find the right people to be on your team is key,” said owner Jackie Mabasa.

“The conversations that I’ve had with the MTA’s NT Automotive Business Specialist have been great and it gives you the feeling that you have a real team behind you.”

Central Diesel Services was bought by owner Jackie and her husband Peter, affectionately known as ‘PJ, in December 2020.

“The previous owners were retiring and moving to Queensland and we didn’t want to see another business in Alice Springs close down. There was definitely a need for it,” Jackie said.

Central Diesel Services, located in the Northside of Alice Springs, is a heavy diesel servicing and parts provider, and has mechanics skilled and experienced in work from routine

maintenance to complex issues.

It is a service that is met with a lot of demand, aiding transport vehicles that need to be back on the road swiftly.

“I never realised how important it is,” said Jackie.

“We service transport vehicles that need to be on the road for freight and road trains that need to be on the road for carting,

“There are a lot of rural communities around us that need all of these vehicles, it’s all part of a larger picture.”

Central Diesel Services has nine employees, however finding workers to meet demand is a challenge in the automotive industry, with a skills shortage reaching unprecedented levels. This is exacerbated in remote areas such as Alice Springs.

“It is not easy to find heavy equipment diesel mechanics,” said Jackie.

“We are competing with mines and

larger companies that have a bigger capacity than small businesses.”

“There’s a skills shortage in many places around Australia but in the Northern Territory we have a few more obstacles thrown at us being so isolated and with social issues.

“Getting people into Alice Springs is not easy, but not impossible.”

Despite the challenges surrounding attracting mechanics to Alice Springs, Jackie believes things will only get better for local businesses.

“My husband and I love Alice Springs to its core,” she said.

“It has such amazing facilities, sports and lifestyle, there is such a promising future here for people, the schools are wonderful for kids, we try very hard to get people to see that.”

The automotive industry has a strong presence in the town, and Jackie believes that makes it a suitable destination for aspiring mechanics.

“My husband has always been passionate about the industry and

my kids are motor car mad. It’s in the Territorian blood to be around it.

“We’ve got the speedway, Finke desert race, drag racing – everywhere you turn there is something to do with motorcars and motorbikes.”

At the heart of Central Diesel Services is a strong focus on culture and creating a team that works cohesively together, which is also why a move to the join the MTA was logical.

“We have previously been with another employee relations company and it didn’t have that personal touch the MTA provided,” Jackie said.

“When you’re running a business it’s not just about running a business, you have to have many avenues of

team behind you to make things work, it’s like a revolving door of working together.

“We were finding a lack of personal touch and helpfulness with the other company, but we found it with MTA. Joining up with them was a no brainer.

“It was like dealing with a local business and having that sense of personal connection.”

Retaining mechanics amidst a skills shortage crisis is a challenge but one that Jackie has confronted by ensuring that the environment at Central Diesel Services is as comfortable as possible for her employees.

“I always thought we were big on culture, but then I learnt that we could be doing this better,” Jackie said.

“We have done a lot of work on it in the last two years, it was and always has been important, but it’s at the top of the list now.

“People spend the majority of their lives at work, you want to give them a place where they feel inclusive, heard and appreciated, that’s something we work really hard towards.”

Heavy diesel maintenance is the bread and butter of Central Diesel Services, but they also have a strong hand in the community and sponsor local sport.

“We love to sponsor the local sporting clubs, and up and coming go-cart kids. Our kids play basketball and we sponsor that,” Jackie said.

“We like to share the love around and help out in the community.”

As for the future, Jackie is optimistic about the new partnership with MTA, and for what’s to come.

“The future plans are exciting and we are always working to be better,” she said.

“We are very excited to be working with the MTA and can’t wait to see where that relationship takes us.”

MTA Leadership Meets with Local Businesses and NT Decision Makers

For the first time, the MTA held a full Board Meeting in Darwin recently, underscoring the importance the association places on local members.

This was complemented by the Northern Territory Zone Annual General Meeting and a Members Night. A presentation on electric vehicles was provided before discussions turned to major advocacy issues, including local crime amongst others.

Ahead of the TIO 2022 Automotive Apprentice Awards, CEO Darrell Jacobs, his predecessor Paul Unerkov, MTA SA/NT Chair Frank Agostino and members of the Board heard directly from local businesses about issues of concern and set out 2023 priorities.

Whilst in the Territory, it was also an important opportunity to introduce Darrell to key Government Ministers and departments to progress ongoing initiatives in local skills and training development and address further issues of importance. This included repairable write offs, backyard dealers, skilled migration, electric vehicle concessions, registration data and towing rosters.

Federal Industrial Relations to Lift Wages, Improve Job Security and Close the Gender Pay Gap

As 2023 came to an end, the Federal Government enacted extensive reforms to industrial relations by way of the Secure Jobs, Better Pay Bill. These changes are some of the most significant amendments to the Fair Work Act (“the Act”) since its commencement in 2009. Different areas of reform will commence on different dates, with the first changes having already commenced on 7 December 2022.

The most significant changes to be aware of are listed below, together with their commencement date:

Prohibiting Pay Secrecy

Many current employment contracts contain clauses requiring employees to keep their remuneration confidential. Such clauses are now prohibited.

Employees now have a workplace right to share information about their pay and their employment terms and conditions that would be needed to work out their pay (i.e. their hours of work) if they choose to. Employees are also free to ask other employees about that information, but an employee is not forced to disclose

the information if they do not want to. An employer can’t take adverse action against an employee for exercising their right to tell someone their salary.

From 7 December 2022, any terms in existing contracts concerning pay secrecy will have no effect. Further, any new contract entered into that contains a pay secrecy clause will contravene the Act.

Job Advertisements

Penalties will be applied to employers who advertise employment opportunities listing a rate of pay that would contravene the Act or an award. From 7 January 2023, if you plan on advertising a rate of pay with a job listing, be sure to seek advice on the applicable salary rate.

‘Zombie’ Agreements

Currently, enterprise agreements made prior to the introduction of the Fair Work Act continue in operation after their nominal expiry date until they are terminated by the Fair Work Commission or replaced with a new enterprise agreement. Such agreements are commonly referred

to as ‘zombie’ agreements.

If your workplace has such an agreement, employees must be advised in writing (before 7 June 2023) that the agreement will be terminating. The new laws provide for the automatic termination of these ‘zombie’ agreements on 7 December 2023.

New Protected Attributes

From 7 December 2022, an employer must not take adverse action against an employee, or prospective employee, because of the employee’s gender identity, intersex status, or because the employee is breastfeeding. Adverse action includes refusing to employ the person, dismissing the employee, altering an employee’s position, or discriminating between the employee and other employees.

This makes the Act consistent with other Commonwealth antidiscrimination laws that already outlaw such behaviour.

Sexual Harassment

To complement other legislative amendments that already ban sexual

harassment, a new provision has been inserted into the Act making it unlawful for a person to sexually harass another in the workplace. This includes circumstances where the harassment involves a PCBU, an employee, or a prospective employee.

Where a person alleges they have been sexually harassed, they may apply to the Fair Work Commission to deal with the dispute. Also, a vicarious liability provision means that a business owner may be liable for the acts of sexual harassment committed by their employees.

Businesses should ensure they have adequate policies regarding sexual harassment and that they conduct training with their employees on expected standards of behaviour before these provisions come into effect on 6 March 2023.

Flexible Working Arrangements

Currently an employee in certain circumstances can request in writing to have changes to their working arrangements. The employer then

has 21 days in which to respond to the request, which may be refused on reasonable business grounds.

The new laws, which commence 6 June 2023, expand the types of employees that can request flexible working arrangements to now include pregnant employees and employees experiencing domestic violence. An employer will now also be required to discuss the request with the employee. Finally, if the issue cannot be resolved in the workplace, the Fair Work Commission will have jurisdiction to hear any disputes.

Fixed Term Contracts

From 6 December 2023, employers will no longer be able to employ a person on a fixed term contract that:

• Is for 2 or more years (including extensions)

• May be extended more than once, or

• Is a new contract:

• That is for the same or a substantially similar role as previous contracts

• With substantial continuity of

the employment relationship between the end of the previous contract and the new contract, and either:

• The total period of the contracts is 2 or more years,

• The new contract can be renewed or extended, or

• A previous contract was extended.

Some exceptions apply, including where the fixed term contract is for a training arrangement (i.e. apprenticeship). Finally, from 6 December 2023, employers will have to give employees they’re engaging on new fixed term contracts a Fixed Term Contract Information Statement.

New Member Regenerates Industry Service

A unique business has recently opened in Darwin offering the first service of its kind in the NT.

Regen NT specialises in commercial cleaning of diesel particulate filters (DPFs) and other ignition control exhaust components – a service that is not offered anywhere else in the Territory.

“The reason we are doing it is that there is no one up here that is dedicated to commercial cleaning for DPFs,” said owner Jason Stoddart.

Jason and wife Kristie have operated vehicle repair shop Stoddy’s Mechanical for almost ten years.

They saw the demand for a specialist DPF cleaner after an increase in customers experiencing issues.

“We started getting quite a lot of DPF faults at our

mechanical workshop and we were having to send them down south, which is a week turnaround,” he said.

“People aren’t happy waiting that long. We thought we would look at doing it ourselves as there is no one else doing it up here.

“With our new equipment we can provide a one hour turnaround on most cleans.”

Located in Pinelands, southeast of Darwin, Regen NT currently shares premises with Stoddy’s Mechanical however separating the two businesses formally was important, as it allowed Regen NT to cooperate with other mechanics, rather than compete.

due to a lack of tooling, or just struggling to wrap their heads around the new technology,” said Jason.

“The issue was they were bringing their car to us for that, but some of their customers became our customers, and that wasn’t the idea.

“The last thing I want to do is start a war between workshops because we stole one of their customers.

“We decided we will get this machine and then create a separate business.”

Jason believes this approach will enable Regen NT to be part of the solution rather than the solution.

“This will allow workshops to retain their customers,” said Jason.

“I want Regen NT to support NT Workshops.”

The target audience for the service is other workshops, with the idea that they can send the necessary parts to Regen NT opposed to the whole vehicle itself.

Jason acknowledges that it will be difficult getting people on board with the service due to the negative stigma around DPFs in the industry.

“Early on I don’t expect massive buy in, maybe one DPF a week, until it slowly builds up,” he said.

“Once the public realises that their car will no longer be roadworthy after a DPF is removed, I think they will be less inclined to ignore it.”

Marketing

Regen NT has set up Facebook and Instagram pages, and created business cards and flyers, with signage next on the agenda.

The venture has required considerable investment, the cleaner costing approximately $25,000. It is capable of cleaning all DPFs.

While vehicles feature an emission control unit, diesel vehicles have the most issues with the component.

“Easily 40% of vehicles in the territory have the potential for a fault,” said Jason, who has been working in motor repairs since the age of sixteen.

Despite the problems owners experience with DPFs, there is a reason why Regen NT is the sole commercial cleaner,

“We are now fully up and running. We have had three customers in the first ten days since opening in early January,” said Jason.

“We have done up to a light truck so far with ease.”

Jason is hopeful that, with the support of the MTA, his business can continue to grow.

Warranties and guarantees - A promise is a promise

“I warrantee you that this vehicle will last for five years!” is not an expression that a motor vehicle dealer would use when making assurances about the quality of a motor vehicle, whether it be brand new or second-hand. Instead, they would say: “I guarantee you that this vehicle will last for five years!”

And yet, when a dealer guarantees something, they usually give a warranty, not a guarantee. Then there are express warranties, warranties against defects, and statutory warranties for used cars. Confusing semantics?

Let’s break it down.

Consumer guarantees are embedded in the Australian Consumer Law. They are a set of statutory rights, which are the same everywhere in Australia. They state that goods must be fit for purpose and last for a reasonable amount of time. There is no set time limit when these consumer guarantees expire. They can exceed dealer or manufacturer warranties, taking into account circumstances such as the price that was paid for the vehicle. A car that sold for $500 cannot be expected to

be as durable and reliable as a car that sold for $50,000.

There are further statutory warranties which apply only to used cars. While they are called warranties, they are also a set of statutory rights. They vary between the Australian States and Territories, but are effective for a set time period. Statutory warranties mandate a dealer’s obligation to repair certain defects that appear during that period. Some defects mainly associated with wear and tear can be expected in used cars. They are not covered under statutory warranties.

Warranties against defects are voluntary promises made by the dealer or manufacturer, stating that the vehicle will operate free from faults for a certain period. For example, it comes with a 5-yearwarranty which can be subject to Terms and Conditions that require regular servicing and prohibit misuse. These warranties are not extended beyond their validity period, even if parts are exchanged under this warranty. It is merely a promise that the customer will have a working vehicle for the duration of the warranty period, regardless of how

often it needs to be repaired or exchanged.

Dealers or manufacturers can make additional promises about the condition, quality or other characteristics and standards, as well as the availability of spare parts and servicing. These extra promises are called express warranties.

If a dealer gives a warranty, there is a consumer guarantee that the dealer will comply with the warranty they have given.

Therefore, if the vehicle does not meet either the consumer guarantees or warranties made by the dealer, consumers are entitled to remedies of either a repair, replacement, or refund. In summing up, consumer guarantees and statutory warranties are mandated by law and must not be evaded. Additional protections such as warranties can be created through voluntary promises made by the dealer or manufacturer, who can promise whatever they like.

But remember: A promise is a promise.

Q&A with Darrell Jacobs, MTA’s new Chief Executive Officer

After his first month in the role, new Motor Trade Association CEO Darrell Jacobs has hit the ground running. Despite perhaps being new to some members, Darrell’s experience in the industry extends multiple decades and his interest in all things automotive began at a young age. In this question and answer, he reveals his commitment to the association and where he views his priorities for 2023 and beyond.

You might be new to the role of CEO but you’re not unfamiliar with the industry and its members are you?

Succeeding somebody like Paul Unerkov will always be difficult due to his long-term service to our industry, but I am looking forward to this invaluable opportunity. I believe we must continue supporting our members, address critical issues such as skill shortages and drive the sector as a vital part of our local economy. To do this, I will be leveraging my own experience in our industry over two decades. This includes as the Head of Marketing at Mitsubishi Motors and more recently across a number of General Manager positions at the MTA. Paul and I worked closely together at the MTA

for the past three years, so having this internal transition will provide continuity as we move forward.

After your first month in the top job, what has surprised you about the MTA?

The thing that has probably not surprised me, but has been reinforced, is the range of expertise MTA members and our MTA staff possess. Automotive runs through the blood of our 1300 members and almost 100 employees. The old saying goes that you are only as good as the team around you and harnessing this passion and immense amount of knowledge will be imperative in our ongoing training, advocacy and workplace relations.

More broadly in my day-to-day role, I have also been impressed with the willingness of government and other key stakeholders to work closely with us. I look forward to building these relationships and working together to strengthen our industry.

What are your priorities for this year and beyond?

Helping attract the skilled technicians of tomorrow is a priority of mine. Time and time again Northern

Territory businesses have contacted the MTA asking whether we know of anybody available for work. We are at the cutting edge of technology in our industry and we must capture the attention of prospective apprentices to complete their career in our rewarding industry. This is why I am also excited to be leading the MTA through the innovation revolution that is sweeping our sector. From infrastructure to propulsion systems and policies there is a lot to consider as the industry transitions over the foreseeable future.

In recent months, crime has also been a frequently raised concern of members. Dealing with theft and vandalism is an unacceptable cost of doing business and the MTA will continue working closely with authorities. At what point do we say enough is enough and that businesses do not deserve to put up with it?

What is something MTA members might not know about you?

I am a son of a publican, a golf tragic and have a sizeable matchbox car collection!

Using Migration Programs to Help Ease Workforce Shortages

As we enter into another year in the post-pandemic era, workforce shortages continue to be the number one issue facing Territory businesses. While border restrictions and mandates may be a thing of the past, businesses are still unable to rely on Working Holiday Makers and other temporary visa holders to the same extent. This has seen an increased demand for regional migration programs such as the General Skilled Migration (GSM) program and the NT Designated Area Migration Agreement (NT DAMA), which enable overseas skilled workers to live and work in the NT with a pathway to permanent residency.

MigrationNT within the NT Government’s Department of Industry, Tourism and Trade has carriage of skilled and business migration programs in the NT and assists NT employers with information on accessing various visa pathways to fill vacancies with overseas workers. The team also conducts dedicated information sessions for employers across the NT and engages with industry throughout the year.

MigrationNT issues nominations for overseas skilled workers, which enable them to apply for permanent (subclass 190) or 5-year (subclass 491) visa under the GSM program. These visas do not tie the worker to an employer, but they are nominated on the basis of a demonstrated commitment to live and work in the NT on a long-term basis. MigrationNT opened for offshore applications in September 2023, targeting experienced overseas workers in high priority occupations, those who have job offers with NT employers and those who have family support in the NT. Motor Mechanic is a high priority occupation, and overseas skilled workers in this occupation are well positioned for a subclass 491 visa nomination.

The NT DAMA is an increasingly popular program that enables NT employers to sponsor overseas workers to fill vacancies where the demand cannot be met locally, and offers concessions to some of the standard visa requirements such as English language level, age and skills. Sponsored workers can access a temporary visa with pathway to permanent residency and are

bound by visa conditions to remain employed with their sponsoring employer for the visa duration of 4 or 5 years. Eligible occupations in the motor trades industry include Motor Mechanic, Diesel Motor Mechanic, Motor Vehicle Parts and Accessories Fitter, Motor Vehicle Parts Interpreter and Panelbeater. NT employers who wish to provide feedback on the occupations list are encouraged to engage with the Industry Skills Advisory Council NT to inform their labour market analysis which in turn influences the occupations list for the NT DAMA.

While it is pleasing to note that the Australian Government has made significant inroads into clearing the backlog of visa applications, MigrationNT continues to advocate for greater concessions to make it easier for NT employers to access overseas skilled workers to ease workforce shortages.

Part-Time Hours of Work

Understand what part-time work actually means and its implications for your business and employees.

Part-Time employment is defined in the Vehicle Repair, Services and Retail Award 2020 (the Award) as an employee who:

(a) is engaged to work less than 38 ordinary hours per week;

(b) has reasonably predictable hours of work; and

(c) receives, on a pro rata basis, equivalent pay and conditions to those of full-time employees who do the same kind of work.

At the time of engagement, the employer and the part-time employee will agree in writing on the following:

(a) the hours worked each day;

(b) which days of the week the employee will work;

(c) the actual starting and finishing times each day;

(d) that any variation must be in writing;

(e) all time worked in excess of agreed hours is paid at overtime rates; and

(f) the times of taking and the duration of meal breaks.

Once a Part-Time employee’s

roster is agreed and written in the employment contract, as required under the Award, all time worked in excess of the hours agreed are required to be paid as overtime.

For example:

Fiona works 22.8 hours per week as a Part-Time service receptionist, equating to 7.6 hours over 3 days in the week (Monday-Wednesday). If Fiona is asked to work a Thursday, technically the whole day would be paid as overtime. In this situation, Fiona would be paid 150% for the first 3 hours and 200% thereafter for her additional day of work.

This, of course, does not allow much room for flexibility for either party. The only way the agreed hours can be changed is for the employee to agree to a variation in rostered hours. Members are reminded that any agreement to vary the contracted hours of a Part-Time employee must be done so in writing. Generally, a true variation of agreed hours would be done for long term scenarios where the employee is required to cover another employee’s position due to long term sickness, parental leave, jury duty etc.

However, there may be circumstances where the employee agrees to work additional hours or days as required in order to obtain

extra hours. If they are aware that an agreement to vary the hours means that they will not be paid overtime rates for any agreed additional hours, both parties may agree in writing to this variation. An email or text message may suffice as a sensible option in some situations. Employers could also add a clause in the employment contract to reflect this ongoing agreement. For example:

“You and the Employer agree that your actual number of ordinary hours per week may vary between 20 and 37.5 and will be agreed in writing prior to the variation being made.”

Overtime will still be required when working beyond 10 ordinary hours in a day or more than 37.5 hours per week.

Another important factor to remember is that with any variation to the agreed hours of work, the ordinary hours of that employee will be adjusted and annual leave and sick leave will accrue on the new ordinary hours for the period of the variation.

Five Tips to Fight Inflation

Inflation is challenging to manage as the cost of parts, labour and other business inputs continue to rise. At worst, these pressures can bankrupt a company or employer, as seen recently in the building sector with its rapidly rising costs. However, looking back at past inflationary periods, some businesses have actually reported increased profits. This should be your goal. Here are five tips to help you weather the storm and keep your business healthy and profitable.

Analyse the Impact of Inflation on Your Business

Inflation can impact your business in several ways. As mentioned previously, rising costs are the most obvious risk – but not the only one.

• Rising input costs may force you to advance purchase more stock to beat future price rises, which can hurt cashflow. As we all know, good cashflow management can keep a struggling business afloat, while poor cashflow management can sink a profitable business.

• If you have outstanding debt, it may become more difficult to repay as interest rates rise with inflation.

• Inflation can also cause sales

to decrease as prices rise and people have less discretionary income. If you don’t have access to historical data, speak with an MTA member who has been through the cycle previously. Adjust the numbers in your forward forecasts and see how you might be affected under different demand scenarios.

• Price increases will be one of the tools you can use to offset costs, but how price sensitive are your customers? This also needs to be factored into forward projections.

Monitor Your Expenses and Cut Costs Where Possible

Rising costs can sneak up on you, as they have a cumulative effect. They erode profits, but counter measures can be taken to retain your margins. Here are a few ideas:

• Get tough on waste and drive it down

• Look for ways to improve efficiency and be open to new ideas from your staff

• Consider changing suppliers

• Renegotiate your fixed expenses

• If your cash position is strong, seek discounts for early payments

• Streamline your business processes to reduce costs.

Adjust Your Pricing

As a general rule, customers are far more accepting of price rises during inflationary periods. They don’t like it – but they understand it.

If you haven’t reviewed your pricing for some time, now is the time. You may find that your margins have already been slipping and by carefully increasing prices, you actually become more profitable.

It can be a difficult balancing act; trying to remain competitive while also staying profitable.

If you have a fixed-price contract, you may want to consider renegotiating it to reflect new costs or pricing structure.

Streamline Your Business Processes

In the current post-Covid environment where there are still supply constraints throughout the economy, inflation may be coupled with longer wait times for deliveries, more expensive transportation, and other challenges. To avoid unnecessary delays and costs, it would be beneficial to streamline your business processes.

There is also merit in simplifying the business processes you can control. Done correctly, removing complexity can help improve efficiency and reduce costs without hurting quality. Optimise your supply chain and consider using more efficient transportation methods, such as consolidating shipments. You may also need to improve your inventory management system to reduce the cost of carrying inventory.

Take Advantage of Technology

As inflation increases, you should work smarter to take advantage of technology that will improve efficiency and save money. Tech projects are not without pain – but inflation provides the motivation to push them through. An example would be software to automate your billing and reconcilement process, or other areas, such as business intelligence tools to better forecast sales and manage inventory.

Finally, maximise the tech you already have. As an example, make the most of your Customer Relationship Management (CRM) system to improve customer engagement. CRM updates today are invariably focused on automating steps in the marketing and sales funnel, and automating communications across fragmented user groups. Back in the Day with MTA 1969

The filtration system employed by modern motor vehicles has largely countered the potential impacts of dirt on internal componentry of engines. However, it remains a risk that always needs to be managed.

Back in the day with older cars, people would gently pump the brakes to slow down or stop. Now, technology has been developed to do it better than most humans can.

In contemporary vehicles, sensors on each wheel provide feedback to a central computer in fractions of a second, enabling it to handle pulse braking far more quickly and effectively than a person can while preventing the wheels from locking. (When you skid, it’s considerably more difficult to steer effectively.)

In 1969, the two millionth Holden was manufactured and driven off the production line. Sadly, the iconic Australia brand would cease vehicle and engine production by the end of 2017 in South Australia. According to many in the car industry, this was the end of an era in car manufacturing in Australia.
