You’ve finally found your dream property with the help of your Realtor®, and you're ready to make an offer! What are the important next steps to consider?
Here are 5 key things to keep in mind after your offer is accepted and you enter the Due Diligence phase.
Once your offer is accepted, your attorney will take over and draft the SPA (Sales and Purchase Agreement). Once this document is signed by both parties, two things happen:
◦ You will have 10 days to deposit the initial payment (typically 10% of the agreed price) into an escrow account.
◦ The property will be officially under contract and taken off the market.
What costs are involved in Due Diligence? Opening an escrow account is one of the initial expenses, with an estimated cost of around $1,000. This account will play a crucial role in the transaction, as it safely handles your funds and as they are transfered from your country to Costa Rica.
The specific studies required during Due Diligence will depend on your property, and your Blue Zone Realty International agent will guide you through these details.
◦ For land: If you’re planning to build, a soil test is essential to assess the land's stability and determine foundation requirements. An infiltration test is also necessary to evaluate how water is absorbed into the soil, which impacts the design of septic systems. Soil tests generally cost around $900, though this may vary depending on the number of samples required.
◦ For all properties: A survey study ensures the legal boundaries and dimensions of the property align with what was advertised. For a property up to 2 acres, the cost is typically under $1,000, but larger parcels may incur additional fees depending on the need to document features like rivers or water bodies that may affect building locations.
◦ For homes: It’s suggested to have a home inspection to identify any potential maintenance issues. This is necessary even for new construction. A home inspection typically costs around $1,000 for homes under 3,000 sq. ft., though prices can vary based on the size and condition of the home.
Your attorney will conduct a title search to ensure there are no liens on the property and confirm that water and electricity services are available. They will also verify that all taxes and utility bills are up-to-date before transferring the title to your name or a corporation.
Closing costs are typically 4% of the final sales price, and it is paid by the buyer.
From making an offer to closing on a property in Costa Rica usually takes about 45 days, though this can vary. You might offer a quicker closing to strengthen your offer, depending on your attorney's availability. Delays may also occur around holidays such as Holy Week and Christmas when many offices, including the National Registry, escrow services, and law firms, close for up to 20 days.
Upon signing the SPA, you have 10 DAYS to make the initial deposit, and the Due Diligence period typically lasts 30 DAYS. After accepting the Due Diligence findings, the deposit becomes non-refundable, and the closing date is set for approximately 10 days later. This gives you enough time to transfer the balance of funds required for closing.

If you established a corporation for the property, it is very easy for your local attorney to register a limited Power of Attorney for the specific act of signing the closing documents. If you are purchasing a property in your physical name, it is important to speak with an attorney when you are in Costa Rica to register the POA ahead of time.
