INSTALLATION COMPANIES SHOULD BEWARE OF INNOCENTLY FALLING FOUL OF THE LAW!

Making the news recently was Essex based The Bathroom Fitting Company, who’s Director was found guilty of a “waste duty of care offence” from April 2016.

According to Epping Forest District Council, the prosecution related to flytipped building waste found in Pick Hill, Waltham Abbey. The Director of the bathroom company pleaded guilty to the offence in court and was fined £1,250, as well as being ordered to pay prosecution costs of £965.75 and a victim surcharge of £120. According to the Council, employees at The Bathroom Fitting Company Ltd “gave their trade waste to an unlicensed man in a van, despite the company's usual practice of arranging removal with a skip company.” The bathroom company did not carry out the necessary checks or request a waste transfer note, resulting in the waste being fly-tipped “as a result of their negligence.” 

Under these circumstances it’s hard not to have a modicum of sympathy for the guy who was penalised, providing that he was unaware that the offence was being made of course, but it is a reminder to us all to be more vigilant and take waste disposal more seriously.
