ABSTRACT This research presents a conceptual theoretical approach to access to justice, pointing out the role of the Superior Courts (STF and STJ) who must become the courts that have analyzed the most important causes for the country, changing its current stance, namely, function as Appellate courts, hindering the reasonable duration of the process, making it impossible to access to justice since they function as a third or fourth instances.
