The case pitted the very best of Florida’s trial lawyers against the previously unbeaten tobacco industry in a landmark, multi-year war of litigation. The case was resolved during the third week of trial when Big Tobacco packed it in and settled with the State of Florida for a historic $17 billion. Dramatic advertising concessions were also extracted. “Joe Camel was eliminated, the Marlboro men were retired, the Virginia Slims girls were gone,” Yerrid explains. “Billboards and cigarette vending machines were removed from around the country, sponsorship of sporting events ended and pandering to children was halted.”

RECENT AND LANDMARK COURTROOM BATTLES
Yerrid recently ushered in his half-century of advocacy with another notable verdict. Yerrid, acting alongside partner David Dickey, represented the parents of a 23-year-old woman whose death was caused by the negligence of two hospitalists. Their erroneous diagnosis and lack of appropriate care resulted in their only daughter losing her life, and her parents losing their dreams. Discharged from a large trauma one hospital and transferred to a long-term acute care facility in order to continue her recovery, she was to be treated and followed for severe erosive gastritis in the duodenum. That was not done, the erosion continued, and her GI wall was ultimately perforated. Tragically, she went into septic shock and lost her life.
“The defendants did not offer a penny in settlement, and the case proceeded to trial,” Yerrid noted. The jury awarded $15 million in damages to each parent for mental anguish, plus burial expenses of $7,502.00, resulting in a total verdict of $30,007,502.00. In 2025, the case was affirmed on appeal, resulting in an even larger monetary award by the addition of attorneys’ fees and costs.

Florida Rewrites the Rules on Housing

NOT LONG AGO, a developer in Tampa or Miami or any other Florida community could stare at an aging strip mall or empty warehouse and see nothing but red tape—years of zoning battles, neighborhood opposition and planning commission meetings that could put an end to their ambitions long before a project even got off the ground.
Now, with the stroke of a pen and a 30 year affordability commitment, that same property can be transformed into a high-rise apartment building—no rezoning required, no public hearing necessary.
This is the vision of a new Florida, reimagined under the “Live Local Act”—a sweeping state law that gives developers unprecedented power to build affordable and workforce housing in places once off-limits. Pitched as a bold solution to Florida’s housing crisis, the law sidesteps local zoning restrictions, potentially overrides some historic preservation rules and even lets churches build apartments in their parking lots.
Supporters call it a lifeline for working families and a long-overdue correction to exclusionary zoning. Critics see it as a power grab that steamrolls local control, fast-tracks gentrification and leaves communities with little say in how—or where—development happens.
One thing is certain: The “Live Local Act” is reshaping the Florida real estate landscape, perhaps faster than anyone expected.
For years, wages have lagged while rents soared, pricing out teachers, nurses and service workers across the state.
According to the University of Florida’s Shimberg Center, more than 900,000 low-income households now spend more than 40% of their income on rent. The situation is especially dire in metro areas like Miami, Tampa and Orlando, where new housing supply hasn’t kept up with population growth.
The Live Local Act, passed in 2023 and significantly expanded in 2025, is the state’s boldest attempt to tackle the crisis. It allows developers to bypass zoning restrictions on properties zoned commercial or industrial—as long as at least 40% of the units are reserved for affordable or workforce housing. In return, projects receive administrative approval. Local officials can’t require rezoning, public hearings or planning board votes.
Density and height are dictated not by the parcel’s zoning but by whatever is allowed within a one-mile radius. Local development codes are essentially sidelined if they conflict
with the state’s pro-housing mandates.
The Live Local Act also provides tax incentives, including property tax exemptions, for developers who create affordable housing.
Flashpoint on the Coast
Nowhere is the law’s potential impact more obvious than along Florida’s coast, where aging condo buildings are quickly becoming targets for demolition and redevelopment. In the wake of the catastrophic Surfside collapse in June 2024, Florida introduced stricter inspection and reserve requirements for older buildings, which caused many coastal condominium communities to become financially unsustainable.
Enter the Live Local Act, which provides developers with a streamlined process to buy out condo owners, demolish the buildings and replace them with taller, denser structures. These new developments must also include a portion of affordable housing units. But here’s the catch: The affordable housing doesn’t have to be on-site or even serve the immediate neighborhood.
In June, the cities of Hollywood and Bal Harbour filed lawsuits challenging key provisions of the Live Local Act, the first to test the state’s broad preemption of local zoning regulations.
According to Hollywood’s filing in Broward County Circuit Court, the Live Local Act “violates the principle of home rule” by allowing the state to override zoning restrictions without offering cities a meaningful opportunity to regulate development. City leaders further claim the law enables developers to pursue projects inconsistent with local comprehensive plans, height limits and neighborhood character.
Bal Harbour’s challenge takes a slightly different angle. In a petition for declaratory relief filed in Miami-Dade County, the village asserts that the Live Local Act’s definition of “administrative approval” is vague and violates due process. Officials argue the law removes public hearings and neighborhood input from the development process without providing clear standards for approval, leaving cities vulnerable to legal and political uncertainty.
While both lawsuits are in early stages, if successful, they could trigger a cascade of similar challenges from other Florida towns and cities reluctant to enforce the law as written.
With Florida’s population projected to swell by three million by 2030, the stakes could not be higher.
The Fight Over Florida’s District 16 Could Reshape State Voting Rights

INA CASE THAT COULD TRANSFORM how state racial gerrymandering claims are evaluated, a federal three-judge panel is weighing whether Florida’s Senate District 16 was drawn with race as the predominant factor without sufficient justification.
What’s at stake in the case, Nord Hodges v. Albritton, reaches far beyond Tampa and St. Petersburg.
The plaintiffs, represented by the ACLU of Florida and NYU’s Civil Rights and Racial Justice Clinic, allege that Black voters were intentionally packed into a sprawling district that leaps across Tampa Bay, diminishing their influence in neighboring District 18. If the court agrees, it would mark a rare judicial rebuke under the Equal Protection Clause and Florida’s Fair Districts Amendment.
The outcome in Nord Hodges v. Albritton will deliver more than a legal resolution—it will signal how courts intend to respond when race and political power collide under modern redistricting regimes. It will also test the durability of constitutional protections in an era where mapmakers have grown increasingly adept at disguising racial sorting as procedural necessity.
District 16 is just one district. But the ruling will reverberate wherever voters are segmented along racial lines to entrench political outcomes. In that sense, the court’s opinion may not just interpret doctrine. It may shape the boundaries of accountability moving forward.

The Legal and Constitutional Backdrop
The legal theory underpinning the challenge to Florida Senate District 16 rests on two intersecting frameworks: the Equal Protection Clause of the Fourteenth Amendment and Article III, Section 21 of the Florida Constitution, known as the Fair Districts Amendment. Both restrict how race can be used in redistricting, though they operate in distinct legal lanes.
Under federal law, race may be considered when necessary to comply with the Voting Rights Act, but it cannot predominate in the drawing of district lines unless narrowly tailored to achieve a compelling interest. Meanwhile, Florida’s Fair Districts Amendment explicitly prohibits districts drawn with the intent to favor or disfavor a political party or incumbent and
requires that districts do not diminish minority voting power. It also mandates contiguity, compactness, and adherence to existing political and geographic boundaries.
The plaintiffs argue the legislature violated both. Not only does District 16 unnecessarily aggregate Black voters from St. Petersburg and East Tampa into a single, geographically fragmented district, diluting Black voting strength in neighboring District 18, but it also constructed a district that lacks shared community interests or contiguity, the plaintiffs claim.
By linking two dense Black communities across Tampa Bay—without a physical bridge—the plaintiffs contend the legislature packed minority voters in a way that was neither required nor justified by state or federal law.
The Fair Districts language is especially relevant here. Plaintiffs maintain that the state could have drawn a map preserving Black voters’ ability to elect candidates of choice without crossing the bay. The state counters that the configuration was necessary to avoid diminishing minority voting strength in Pinellas County, invoking compliance with Tier 1 standards.
That claim, if accepted, would shield the legislature under both constitutional frameworks. If rejected, it would signal that courts are willing to scrutinize legislative motives more aggressively.
What the Court’s Decision Could Transform
While the geographic impact of the ruling will be limited, the implications could extend statewide. If the court finds that race impermissibly predominated the redistricting process, it could require a remedial map before the 2026 election cycle and establish a clearer line between permissible consideration of race and unconstitutional racial gerrymandering under both federal and state law.
Should the court uphold the district, it could embolden legislatures to rely more heavily on justifications rooted in compliance with minority protections, even when maps fracture communities or obscure representational coherence. That would reinforce a deferential standard, effectively narrowing the reach of both federal and state protections unless race is explicitly prioritized and clearly unjustified.
A ruling striking down District 16 could bolster plaintiffs in other jurisdictions who argue that race has been used strategically to pack or crack minority voters. It could also add weight to claims that state constitutional amendments like Fair Districts are enforceable tools, not just aspirational language.
More broadly, the outcome could influence litigation strategies in states with similar constitutional or statutory language. A strong ruling on the impermissibility of unjustified racial predominance could help clarify how far legislatures can go when balancing compliance with racial fairness provisions against broader principles of contiguity, compactness, and community coherence.

Trial Lawyer Steve Yerrid Celebrates Five Decades in the Courtroom and a Half-Century at the Top of His Legendary Career

aised by a single mother in a humble environment, Steve Yerrid learned quickly that hard work, determination and helping others were keys to a better life. Even as a youngster he felt the urge to become a trial lawyer and possess an ability to make a difference. After graduating from Georgetown University Law Center, he returned to Tampa and, over the next five decades, became one of the country’s top trial lawyers. Under his leadership, The Yerrid Law Firm has amassed an amazing track record of over 330 individual verdicts and settlements of $1 million or more in catastrophic injury, wrongful death, product liability, construction defects, medical malpractice, premises liability, vehicular accidents, commercial disputes and a broad range of civil cases. A number of these verdicts were eight- and nine-figure results. Yerrid was inducted into the National Trial Lawyer’s Hall of Fame in 2016.

A Landmark Result, by the Grace of ‘God’
Many Americans became aware of Yerrid as a rising star of the legal profession in 1980 when he received widespread recognition for his critical defense strategy in one of the world’s largest maritime tragedies, when a mammoth bridge was hit by a ship and collapsed. Despite a virtually unanimous consensus the case could not be won, Yerrid utilized an “Act of God” defense at trial to secure the complete exoneration of the accused, Captain John Lerro. Lerro was in command of a large 608-foot bulk freighter when an unpredicted storm packing hurricane force winds blew the ship off course. The freighter struck the huge, but unprotected, anchor pier of the Sunshine Skyway Bridge spanning Tampa Bay. The impact collapsed more than 1,200 feet of its center span and tragically claimed 35 innocent lives.
“Lerro needed a fighter in the courtroom to protect him, as well as bring out the truth of what transpired on May 9, 1980,” says Yerrid, who has been continuously included in Best Lawyers® over the last five decades. The outcome inspired the construction of the Bob Graham Sunshine Skyway Bridge, which opened in 1987 boasting a modern, state-ofthe-art design that featured protective piers and elaborate fendering. In 2019, a 60-minute documentary “The Skyway Bridge Disaster” about the case, aired on numerous satellite and cable television networks.
“It was the honor of a lifetime to represent Captain Lerro” Yerrid says. “His courage and heart continue to inspire me.”
Big Tobacco Goes Up in Smoke
Yerrid’s successful defense of Captain Lerro garnered international acclaim, and he channeled that momentum, as well as a string of courtroom victories, to form The Yerrid Law Firm, a plaintiff’s injury law firm that has earned a national reputation for consumer advocacy and precedent setting results. By the 1990s, he had emerged as a forceful trial lawyer whose impact had been noted by lawmakers. Yerrid was an early selection by the late Gov. Lawton Chiles as the youngest member of the 11-member “Dream Team”, the most skilled private trial lawyers the Governor could assemble . The case pitted the State of Florida against the previously unbeaten tobacco industry in a landmark, multi-year war of litigation. The odds weren’t in their favor. Through more than four decades of litigation and more than 800 cases, no one had been able to beat the cigarette cartel. Florida’s case
was resolved during the third week of trial when Big Tobacco finally folded and chose to settle rather than go to verdict.
“The case resulted in the biggest monetary settlement in the nation’s history at the time,” notes Yerrid, “ultimately topping $17 billion.”
The settlement also imposed drastic advertising restrictions as well as severe prohibitions designed to halt pandering to America’s youth by eliminating mascots, such as Joe Camel, the Marlboro Man, as well as the removal of all billboards and cigarette vending machines. Additionally, the settlement required funding of The Truth Campaign and the launch of model programs across the nation targeting nicotine addiction and treatment. The resultant sea-charge in curbing and reducing cigarette smoking has saved millions of lives.
“It was truly a career highlight to be a member of the ‘Dream Team,’ and be counted among Florida’s best,” says Yerrid, who detailed the matter and several of his high-profile cases in his acclaimed non-fiction legal memoir, When Justice Prevails. “That settlement initiated a trend against Big Tobacco and corporate wrongdoers – in and out of the courtroom. Victims and their families felt, and continue to feel, empowered to take a stand against industries that are profiting off the harm their products cause.”
A Historic Medical Malpractice Verdict
Yerrid’s advocacy has made national headlines through the years, particularly notable was a case in 2006, when he won a historic verdict for Allan Navarro, a former professional basketball player born and raised in the Philippines.
In 2000, Navarro visited a Florida emergency room for an excruciating headache, double vision and some dizziness. While the symptoms suggested a stroke, a non-physician misdiagnosed the condition as sinusitis and sent him home. The actual problem was left untreated, and by the next day, the ongoing stroke caused Navarro to become a quadriplegic. Yerrid teamed up with Tampa veteran lawyer Rich Gilbert, in taking the case to trial to get justice for Navarro. As a result, a $217 million verdict was obtained. It remains the largest medical malpractice verdict in Florida’s history, and the top national jury verdict of its kind in 2006.
“Allan’s verdict was extremely gratifying for Allan and his family” Yerrid recalls. “We were also able to succeed in our goal to help prevent other patients and health care consumers from suffering the same fate. Since that result, many
hospitals across the country have instituted new policies explicitly require ER medical doctors to thoroughly diagnose and treat patients before anyone can be discharged.”
Helping to Prevent Mass Shootings
Steve Yerrid, and partner Jeff Murphy, were the only attorneys east of the Mississippi included in the group of plaintiffs’ lawyers representing clients in the horrific Las Vegas shooting tragedy. Fifty-eight men and women were killed and over 500 were injured when enjoyment at an outside concert turned into a mass shooting spree and the massacre of many innocent people. The shooter had managed to bring numerous assault weapons and sniper rifles into his Mandalay Bay hotel room undetected. The wrongful death and personal injury cases resulting from this tragic event were recently settled, and an $800 million payment was made by MGM to the victims and families. Just as importantly, the hotel industry took notice and implemented vastly improved security measures.
“From those types of horrific cases, we can effectuate changes so the next generation does not have to pay the huge price of preventable tragedies,” Yerrid says. “We’ve got to take action not just for ourselves but for those who follow us.”
Looking Ahead
Yerrid and his firm remain selective in the cases that are accepted, and the caseload of the firm is intentionally kept small in order to ensure each client has a close and personal relationship with its lawyers and staff. New legal risks are always emerging, he noted – from social media’s influence on America’s youth, to the rise of profit seeking over safety, social unrest, and, the maltreatment of people. But through the ethical use and navigation of the law, The Yerrid Law Firm is a sure bet to continue to protect the public and carry on the tradition of success it has achieved for decades.
