The Law That Could Put Big Oil on Trial

This legal theory has sparked more than just headlines—it’s ignited a backlash.

FOR DECADES , fossil fuel companies have operated with near impunity, despite mounting evidence that their products drive climate change—and that their executives knew it.

Now, a little-known Pennsylvania criminal statute might change that.

Tucked into the state’s crimes code is a felony statute that prohibits causing or recklessly risking a catastrophe. But according to legal scholars, including Professor Rachel Rothschild of the University of Michigan Law School, this statute could be used to hold oil, gas, and coal companies criminally liable for knowingly fueling the climate crisis.

This legal theory has sparked more than just headlines—it’s ignited a backlash. A conservative group is now suing the University of Michigan to gain access to Professor Rothschild’s emails, accusing her of improper coordination with lawmakers and advocacy groups.

At the same time, fossil fuel companies face new lawsuits under state laws they never expected to encounter in court, and advocates say these efforts could fill the void left by years of inaction in Washington. And under the Trump administration, federal support for climate change research and accountability has all but vanished— crippling oversight and forcing states and local governments to pick up the slack.

How Pennsylvania’s Catastrophe Statute Could Become a Climate Prosecution Tool

Traditionally applied in cases involving industrial explosions, train derailments, or public health emergencies, this law is now being reexamined for a very different kind of disaster—climate catastrophe. The statute has been a staple in Pennsylvania criminal prosecutions where human action leads to large-scale harm. It’s not obscure, nor is it unused. The statute has been used in cases involving chemical spills, arson, and structural collapses.

While environmental litigation has traditionally focused on regulatory violations and civil liability, criminal charges remain rare, and largely reserved for acute, localized incidents. What makes this approach so significant is its attempt to reframe

climate change itself as a criminally reckless act when enabled by corporate behavior.

This argument is laid out in detail in a recent article published by the NYU Environmental Law Journal. It applies long-standing criminal principles to emerging climate realities, arguing that existing legal tools are already capable of addressing systemic environmental harm if prosecutors are willing to test them. The core idea is simple: fossil fuel companies didn’t just contribute to climate change—they did so knowingly and recklessly, meeting the statutory threshold for criminal liability in Pennsylvania.

The key legal concept here is recklessness . Unlike intentional crimes, reckless conduct doesn’t require that a defendant meant to cause a particular harm—only that they knew of a substantial and unjustifiable risk and disregarded it. For years, oil, gas, and coal companies have had access to internal research, independent studies, and government reports showing how burning fossil fuels contributes to rising temperatures, sea level rise and extreme weather. Yet many of these same companies actively lobbied against climate regulation, funded disinformation campaigns, and expanded production. According to the journal article, that history could satisfy the recklessness standard under Pennsylvania law.

Prosecutors could argue that internal industry documents warning of long-term climate risk—ignored in favor of expanded drilling and lobbying—demonstrate a clear pattern of knowing disregard. The question shifts from whether the companies understood the harm to whether they willfully dismissed it in pursuit of profit.

This distinction matters. A civil lawsuit seeks damages. A criminal prosecution seeks punishment. The potential use of Pennsylvania’s statute transforms the legal conversation from compensation to culpability.

Of course, bringing such a case would not be easy. Establishing causation between a company’s conduct and a specific climaterelated event in Pennsylvania would require expert testimony, detailed emissions data, and a judge willing to allow a theory that’s never been tested in this way. That hurdle alone could stall prosecution efforts, especially in politically conservative jurisdictions.

The Backlash Begins

Rachel Rothschild, a University of Michigan law professor, has helped design state-level legislation aimed at making fossil fuel companies financially liable for climate damage. She played a key role in developing New York’s and Vermont’s climate superfund laws, which force polluters to pay into state-managed funds to cover the cost of environmental harm caused by their products. That work has made her a target.

A conservative group known as Government Accountability & Oversight (GAO) is now suing the University of Michigan for access to Rothschild’s emails and pushing to depose her. GAO’s legal filing frames Rothschild’s academic work as part of a broader conspiracy to coordinate legal action against fossil fuel companies.

The goal isn’t just to harass a law professor. It’s to discredit the entire legal framework that climate accountability advocates are building. By dragging Rothschild into court, GAO hopes to cast doubt on the legitimacy of these legal strategies, discourage academic involvement in policy development, and chill future work from other scholars who might contribute to similar efforts. It’s a page straight from the industry playbook: when you can’t defeat the argument, attack the person making it.

This tactic is familiar to anyone who’s followed climate politics over the last decade. But it’s important to recognize that the legal harassment of Rothschild doesn’t exist in a vacuum. It’s part of a broader, sustained effort to dismantle the institutional infrastructure needed to confront climate change—and that effort has accelerated under the Trump administration.

This is a moment of real consequence for the legal profession. The backlash against climate accountability is no longer abstract. It’s personal, and it’s professional. It doesn’t just aim to chill academic debate—it aims to disarm the very people developing the legal tools we may all need in the years ahead.

If universities and public interest law shops become battlegrounds, the entire legal community loses something foundational: the freedom to test theories, build frameworks, and pursue justice without fear of political retaliation. Lawyers who care about accountability— whether environmental, financial, or institutional—should see this clearly for what it is: an effort to undermine the architecture of legal innovation before it ever gets to court.

For practicing attorneys—especially those in environmental law, state prosecution, or policy litigation—this moment invites a strategic shift. Understanding how existing criminal statutes can be leveraged for climate harm opens up an entirely new branch of liability.

It also suggests that attorneys working in academia or public policy roles should prepare for increased scrutiny. The use of public records laws to extract internal documents from researchers and government consultants isn’t just a political tactic—it could become a legal strategy that shapes how future cases are built or undermined.

The Trump White House has systematically gutted federal climate programs, including defunding the U.S. Global Change Research Program. These aren’t budgetary accidents—they are deliberate acts meant to strip away the scientific and legal scaffolding required to build public accountability.

The goal isn’t just to eliminate support for climate adaptation—it’s to weaken the institutional frameworks that make climate litigation possible. When the government defunds the science that underpins climate models or axes grants that help track emissions, it’s not just cutting budgets—it’s cutting the legs out from under future prosecutions and lawsuits.

TODAY’S WORLD OF MEDICAL MALPRACTICE

“We’re experiencing an era in medicine that’s a world apart from the scribbled doctors’ notes and floppy x-rays that were ‘the medical record’ when I began trying these cases,” noted Victor Pribanic.

“Computers, electronic medical records, and now artificial intelligence, have transformed medical care. These are helpful aids for practicing medicine, but are never a substitute for the interaction between patient and physician.

“In theory, no child should ever suffer a hypoxic brain injury before being born, but it continues to happen. While we revere the work health care providers do, we also recognize that patients bear the brunt of medical errors, and we evaluate potential claims in a way that respects the health care community, but always puts our clients’ rights and interests foremost.

“Clients often come to us with grave injuries or after the death of a loved one, with explanations from health care providers which are, at best, wrong, and at worst, false. Equally often, completely unlookedfor injuries or deaths during routine procedures leave patients confused and troubled about the loss of a child, spouse, or other loved one. Our investigations provide answers.”

Recent examples of cases concluded by Pribanic & Pribanic include wholly preventable spinal cord injuries leading to paralysis, unnecessary brain surgeries negligently performed leading to catastrophic injury to children, intraoperative injuries to veins and arteries causing brain damage without diagnosis, and the list goes on and on and on.

In each scenario, patients, parents, and injured children were kept in the dark and never told why or how these injuries occurred—these failures to honestly acknowledge mistakes that lead to tragically bad outcomes have become commonplace.

“Without accountability for this conduct, the immense and largely faceless institutions that supply most of the medical care in Pennsylvania will never change or improve,” Pribanic added.

“We strive with each case to alter this trend for our clients and all health care patients. There is nothing more gratifying as a lawyer than to know we have secured a resolution that will provide a better future for our clients.”

Recent medical malpractice case results range from $1 million to $22 million.

SPINAL CORD INJURIES AND PARALYSIS

In 2024, Pribanic noted an increase in injuries stemming from spinal fusions and surgeries. This trend has continued as one of the leading types of the firm’s caseload, resulting in several significant confidential resolutions.

In one such case, a patient suffered life-altering injuries from a botched spinal fusion, resulting in partial paralysis and a need for long-term care.

During discovery, Pribanic & Pribanic identified inconsistencies in the surgeon’s timeline. Combined with their knowledge of proper medical protocols, the team secured a favorable outcome for the client.

Pribanic, a careerlongmember of the American Association for Justiceand the Pennsylvania Association of Trial Lawyers further commented, “As of April 2025, we have several ongoing similarcases where there was a failure to diagnose problemsaffecting the spinal cord. They were not corrected ortreated in time and the patients suffered paralysis asa consequence.”

MISDIAGNOSIS AND UNNECESSARY SURGERY LEADS TO A LIFETIME OF SPECIAL NEEDS

Another heartbreaking case involves a teenage boy whose minor schoolyard injury was tragically mismanaged. After being hit during a dodgeball game, the teen developed persistent headaches. A CT scan revealed a small, benign blockage impeding the flow of cerebrospinal fluid to his brain.

“The boy was at risk for hydrocephalus, which is massive pressure to the skull that needs to be relieved,” Pribanic said.

The family was never told of lower-risk options, such as a shunt and a biopsy. A neurosurgeon strongly advised the family to remove the tumor through surgery to avoid the boy slipping into a coma. An artery was severed in the brain during surgery, causing paralysis of one half of his body and severely

impacting his pituitary and his hypothalamus glands.

“Those glands are vital to brain development and growth,” Pribanic said. “This child was just 14. Now, at 17, he’ll never fully experience puberty, and his mind functions at the level of a much younger child. This was entirely avoidable, and we intend to hold the health care providers accountable for such a tragic error.”

AUTOMOBILE AND PRODUCT LIABILITY LITIGATION

In addition to medical malpractice, Pribanic & Pribanic continues to prosecute cases on behalf of clients injured in automobile, commercial vehicles, tractor trailer, and all-terrain vehicle crashes involving catastrophic injuries.

Cracking Down or Falling Behind?

PENNSYLVANIA TOUGHENS UP CHILD LABOR PENALTIES AMID NATIONAL ROLLBACK

CHILD LABOR LAWS are at a national crossroads. In Pennsylvania, lawmakers are pushing to increase penalties for violations, while states like Florida are relaxing work restrictions for teens.

At the federal level, the Trump administration cut funding for international child labor enforcement, further straining an already tense system. This has sparked a legal and political divide: some regions are imposing stricter enforcement on violations, while others are dismantling protections that have been in place for decades.

This outcome creates a sense of uncertainty for businesses and compliance professionals alike. Navigating the patchwork of laws—especially across states or global supply chains—requires more proactive legal guidance than ever.

Pa. Looks to Strengthen Child Labor Enforcement

In March 2025, the Pennsylvania House passed House Bill 118 to double fines for employers violating the state’s Child Labor Act. The bill raises first-offense penalties from $500 to $1,000 and repeat violations from $1,500 to $3,000. It now moves to the Senate for consideration.

The bill doesn’t change youth employment restrictions but emphasizes enforcement. Low penalties have allowed some employers to treat violations as a cost of doing business. HB 118 aims to change this by increasing penalties, particularly for repeat offenders.

HB 118 aligns Pennsylvania with states strengthening child labor protections, amid reports of underage workers in hazardous jobs like meatpacking and manufacturing.

Fla.’s Push to Loosen Child Labor Protections

Florida is taking the opposite approach to child labor.

In March 2025, the state legislature advanced Senate Bill 918, a measure that would roll back protections for 16- and 17-year-old workers, removing restrictions on hours minors work during the school year and allowing them to take jobs that were previously off-limits due to safety concerns.

From a compliance perspective, this introduces new complexity. Federal law—specifically the Fair Labor Standards Act (FLSA)—still imposes limits on youth employment, including maximum work hours and bans on certain hazardous occupations. When state laws are weakened, the burden shifts to employers to ensure they’re still aligned with federal rules.

For attorneys representing employers in Florida, SB 918 introduces genuine legal uncertainty.

International Pullback

In March 2025, the Trump administration eliminated funding for international child labor enforcement programs— cutting roughly $50 million from the Department of Labor’s Bureau of International Labor Affairs. For two decades, these funds have supported global initiatives aimed at preventing child labor in agriculture, mining, manufacturing, and other high-risk sectors.

Companies importing goods or contracting labor abroad now face a higher burden of proving their supply chains are free of child labor. Without U.S. funding, much of the monitoring infrastructure disappears, increasing the risk of violating international trade rules, ESG standards, and shareholder disclosure requirements.

Attorneys will need to reevaluate how clients document supply chain practices.

The Cost of Complacency

Child labor law in the U.S. is no longer moving on a unified track. Pennsylvania is moving to strengthen enforcement. Florida is working to weaken it. And the federal government just walked away from global oversight altogether.

For businesses and attorneys, that means greater complexity, not less. The patchwork of laws, inconsistent enforcement, and political signaling leave plenty of room for liability—and very little for error.

Relying on outdated policies or assuming compliance will sort itself out is no longer an option. The message is the same across all jurisdictions: child labor risk is real, rising, and impossible to ignore.
