The National Sale

It is with great pleasure I write this sale forward. Charolais semen became commercially available 55 years ago in 1969 starting a significant influence on Australian beef herds. For the first time Australian cattle breeders had access to genetics offering tremendous growth and muscle capabilities and less waste than the breeds then available. As the first European breed to enter Australia, Charolais had to forge their own destiny and I am happy to report, our breeders did a great job. Charolais today are the leading European breed based on registration and number of sires sold at auction data.

The breed had an insatiable demand in the early days with the first Australian Charolais sale held at Mandalong Park, St Marys on the 6th June 1970. More than 1,000 people attended this sale with the top price $6,000 for Centrewood Babiller (imp NZ), a half-bred female.

In 1993 the inaugural Charolais National Sale at Dubbo launched and this ran at Dubbo till 1997 when the sale relocated to Tamworth. The sale operated from several locations in Tamworth for many years, before ceasing due to the increasing number of on property sales in the breed. In 2014 the sale relaunched back at Dubbo and ran through to 2019 in a successful format. The pandemic in 2020 once again saw the National hibernate. The Covid era also confirmed that with the use of technology, successful sales can be conducted outside traditional frameworks.

Beef Australia was the logical location to relaunch a new National Sale format. Breeders now are no longer required to display sale cattle at the venue. This approach was twofold, one, that this truly allowed a National Sale with distanced members not required to transport prior to sale, and secondly to encourage herds that no longer show cattle to participate. This catalogue is a testament to this with many lots still on farm, but one of the most exciting genetic line ups we have seen in a Charolais catalogue. Our vendors have dup deep into their keeper pens and catalogued an outstanding selection of Charolais genetic opportunities. We thank the vendors for taking this new format on board with the depth on offer and look forward to continued success for the Charolais breed.

Sale Information

The Charolais Society of Australia is hosting a premier Charolais sale during Beef Australia on Wednesday 8th May 2024. The sale will be held in conjunction with a dinner in Rockhampton. The dinner will celebrate 55 years of Charolais genetics in Australia and the impact of the breed on the Australian beef industry. Beef Australia is the perfect venue to do this.

All lots are sold at the fall of the hammer when full payment is due and payable. If the lot involves a pick, the selection of the animal must be completed at the fall of the hammer.

Fertility Guarantee

a. Bulls are to be sold as fertile and capable of natural service. The Purchaser will have the right of cancelling the sale within six months of the date of the Sale if they can submit a Veterinary Report stating that the bull is infertile or incapable of natural service. The Veterinary Surgeon must state that, in their opinion, the bull has not suffered, since the delivery to the Purchaser, any injury or maltreatment which could have affected its breeding ability. The Vendor is liable to refund the purchase price of the animal in full.

b. All female animals are to be sold as guaranteed breeders. Females twenty-four (24) months and over are to be pregnancy tested in calf, or have a calf at foot. Vendors must supply a PTIC certificate for every female entered in the catalogues as PTIC. Females under 24 months may be entered as mated or unjoined.

c. Where the lot is a female between the age of twelve (12) to twenty four (24) months, and a Purchaser submits a Veterinary Certificate to a Vendor within twelve (12) months of the date of sale stating that a female is infertile, and in the Veterinary Surgeon’s opinion, she has not suffered since the delivery to the Purchaser, any injury or maltreatment which could have affected its breeding ability, the Vendor is liable to refund the purchase price of the animal in full. This will not apply where an attempt has been made to transfer embryos/IVF from the female.

d. Where the lot, is an unjoined heifer under twelve months (12) of age, the purchaser has up to the date the animal is twenty four (24) months to submit a Veterinary Certificate to a Vendor that the female of joinable age is infertile, and in the Veterinary Surgeon’s opinion, she has not suffered since the delivery to the Purchaser, any injury or maltreatment which could have affected its breeding ability, the Vendor is liable to refund the purchase price of the animal in full. e. In this sale, a bull or a female resulting from a pick is the same as a bull or female offered live and is subject to the above guarentees.

Inspection

Lots: 5, 6 and 8 will be present at Beef Australia for inspection

Lots: 1, 2, 3, 4,and 7 can be inspected prior to sale by contacting the vendor for pre sale inspection. No cattle will be on site at the sale venue.

Delivery

Cattle onsite at Beef Australia will be available for delivery at the conclusion of the cattle exhibition. Purchasers are encouraged to dicuss transport arrangements with vendors after the sale. Live lots not onsite at Beef Australia will be available for delivery from the vendors property. All delivery instructions are to be given to the the agents in writing.

Transfer Fees

Transfer fees will be the responsibility of the Vendor in accordance with Charolais Society of Australia Ltd Regulations.

BREEDPLAN

All published Breedplan performance traits shall be reported in the sale catalogue.

Health.

To be eligible for entry, cattle must originate from:

a. A herd with a minimum J-BAS score of 6

b. Each animal must belong in a herd accredited free or confirmed free of both Brucellosis and TB.

Genomic Test Results

Genomic test results listed in this catalogue have been supplied by the vendor from results supplied by testing faciliites. Intending purchasers should consult with vendors to determine the test used and the suitability of the result for their own breeding program. The Charolais Society cannot bear direct liability or any consequential losses incurred by the purchaser should the test results supplied be deemed to be incorrect

Conditions of sale for Interstate Purchasers

a. Any animal, purchased for interstate movement, which requires further tests will be forwarded to an approved Quarantine area where appropriate tests will be carried out in compliance with the entry requirements into the destination state. The costs of agistment, transport and health tests are to be borne by the Purchaser of all cattle passing such tests, or by the Vendor should they fail to pass such tests. Payment for cattle to the Vendor will be made within the normal terms of sale whether or not the cattle have been tested for entry into the nominated state.

b. In the event of the cattle failing health tests and sale being cancelled, the Vendor will refund all monies, paid as settlement, for the Purchaser.

• We guarantee that there will be a minimum of 6 x A grade embryos.

• Semen from our inventory can be used free of charge with sires including SCX Jehu, Elder’s Blackjack, Johnny, JWX Silver Bullet or semen supplied by the purchaser.

• Purchaser will be responsible for programming, flushing and freezing costs.

• If the flush fails to make the minimum number of embryos the purchaser can choose from our entire inventory.

Graham and Katrina Blanch commenced Charnelle Charolais in 1992 with females from Trevlac and Tallegalla. Females have been added from Palgrove, Moongool, Fernvale and others have been added throughout the studs 32-year history. Embryo transfer and Artificial Insemination have always been a large part of our breeding program, successfully introducing new genetics into our herd. Charnelle has selected genetic globally and marketed semen from eight sires including JWX Silver Bullet and G Bros Thin Red Line from Canada in 2010. In 2013 we selected DÁngely and Gallway (both Polled Full French) from France and in 2016, Elder’s Blackjack and CML Distinction from Canada. Then in 2018, Johnny & Nougat (both polled Full French). We are very satisfied with the influence these bulls have had, not only in our breeding program but in herds right across Australia. It was very satisfying that Elder’s Blackjack from Canada, whom we selected for use in Australia, was voted World Champion Charolais Bull in 2020.

We have also imported embryos from the USA and France to enhance our breeding program. Embryos imported in 2008 from Camp Cooley USA resulted in two very influential females in our herd, Elle E10E & Emma E50E (both by RC Charlie). These females became donor dams in our herd with excellent EBV’s, temperament, structure and Homozygous Polled. Elle E10E produced Charnelle Panama P25E by Blackjack. One of our greatest achievements has been to market Charnelle Panama semen to Ireland, UK, New Zealand, South Africa, Norway and Germany, with calves by him already in Ireland, South Africa and New Zealand. Our herd comprises about 70 females and we sell about 25 bulls a year with our main bull sale being at the Coolabunia Classic Charolais Bull sale in August. The Annual Charnelle Charolais Invitational Female and Genetics sale has been held at Toowoomba on the first Saturday in March for the last 14 years.

We are very pleased to offer at this sale the right to flush the pick of our herd to the sire of your choice. Details of some of the options include.

A: Charnelle Elegance 6 GKA H45E: Elegance 6 is really from the pinnacle of our herd with terrific structure, length, udder, milk and volume with softness. She has plenty of French in her with Pinay featured in both sides of her pedigree. Sons have sold to $20,000 and a daughter to $14,000. BPA results pending.

B: Charnelle Elle 5 (P) GKA N12E: This Pinay daughter has already made her mark with her first son by Elder’s Blackjack selling for $20,000. Check out her Padra daughter at Beef Australia…. she is pretty special. N12E is a maternal half-sister to Panama & Louis out of Elle E10E imported from the USA as an embryo. N12E has really top figures for BW, GL, Growth, Milk, EMA, IMF% and top 6% for Domestic Index. Flushed twice for 19 x A, and 3 x B grade embryos. Available to flush this summer. BPA Free.

C: Charnelle Emma 4 (P) GKA R1E: Another Pinay daughter out of Emma E50E who was also imported from the USA as an embryo. Emma 4 has a tremendous set of figures with 11 traits in the top 11%, including top 5% rankings for Calving Ease (Dtr), short gestation length, 400 & 600 day-growth, EMA and Domestic Terminal index. Her only flush to Blackjack yielded 10 x A & 2 x B grade embryos. Open ready to flush and is BPA Free.

D: Challambi Estella (PP)(R/F) CHA S42E: Estella S42 is the latest to be added to our donor group and gives you a Homozygous Polled Red Factor option. She is a very neat and correct young female that took our eye as the pick female from the 2023 Charnelle Female sale. She is currently doing a great job rearing twins with perfect udder and teat structure. We visited the Challambi herd in 2022 and were very impressed with Nigel’s cattle & the Estella females are always a standout. She has been flushed once for 9 x A & 2 x B grade embryos. We’re extremely excited and proud to be a part of the National Charolais Sale, offering what we believe is an extremely unique package of embryos. In 2011 we founded our stud ‘Warilla Charolais’ off our long-term passion of breeding quality commercial Charolais cattle. We purchased our founding females from the Boongatti Dispersal Sale as well as Palgrove, from those initial purchases we further seeked to source quality females from leading studs here in Australia & New Zealand to further bolster our studs genetic pool. In recent years we have sourced some outstanding donor females, ultimately increasing our embryo transfer programs.

The embryo’s that we are proud to offer in the Charolais National Sale are out of what we consider, our best donor female. We purchased Charnelle Elegance 16 out of the 2020 Charnelle Invitation Female Sale for $14,000.

Elegance 16 has already given us some outstanding progeny, sired by LT Wyoming Wind, Elder’s Blackjack & Silverstream National. This female is an incredibly broody Charolais female, with great hip, udder, structure and a very docile temperament. Paired with the extremely impressive homozygous polled $100,000 sire in Palgrove Rockerfella, we believe this will be a mating that will result in outstanding progeny.

When we successfully secured the five straw package in the Charolais Youth Sale later last year we immediately knew we’d flush Elegance 16 to Rockerfella. With the flush a success, we implanted ten embryos ourselves, which has resulted in ten successful pregnancies. We now offer other breeders the opportunity to use these genetics. We thank the Charolais Society for organising such a prestigious sale, that allows us to showcase these leading genetics to the wider Charolais community.

Homozygous Polled Heifers from the Heart of the Herd

Bauhinia Park Charolais stud was founded by Jeff and Raelea Holzwart in the mid 90’s commencing with around 40 cows. Since then with some more industry relevant female purchases and the careful selection of high class Charolais sires, the stud has grown to where we are now joining 200 top quality females with the resulting young sires sold each year at our Annual Bull Sale and in the paddock.

Located just 30km East of Emerald in Central Queensland, the majority of the Charolais herd are run on our property ‘Kensington’. Ryan & Rachel Holzwart are now based at ‘Kensington’ and have taken the reigns of the Charolais stud herd. Jeff and Raelea are still involved & love their cattle. They live nearby on ‘Grandridge’ where they enjoy the running of their Angus stud herd.

Bauhinia Park has earnt a strong foothold supplying bulls throughout Central and Western Queensland. It is our commitment to breeding functional Charolais cattle with plenty of bone, natural muscle, constitution, fertility, and ability to finish easily, which we feel helps keep us in good stead against our peers.

The past few years has seen the purchase of some more very exciting sires that are performing extremely well for us. Bulls like Lastovski, Mario, Q-Pac and then more recent Spalding & Start the Party just to name a few. We also have semen interest in some modern, high selling AI sires in Ascot Recharge and Namesake. We feel all of these sire’s have contributed significantly to the stud herd and we’re very confident in where they will take us in the coming years.

What a wonderful opportunity to purchase your pick of the pair in these two high performing, homo polled females selected right from the top shelf. T22E has been a standout since birth, she is extremely long bodied, clean made and has always been one of the first to catch your eye in the paddock. We purchased a few straws in Namesake after watching him sell in 2019, we were totally in awe of his powerful phenotype and loved how he moved around the ring. The combination of Namesake crossed over two of our proven sire lines in Koshi and Black Adder has really worked a treat here. Her dam has a great track record with 4 calves in 4 breeding years, a son sold privately for $20,000 and she has another stunning heifer calf at foot again now.

T22E is PTIC due early August to highly anticipated calving ease sire Bauhinia Park Revolver (P). Our first Revolver calves look outstanding. The potential of this mating is beyond exciting!

A beautiful young homo polled, BPA free, Q Pac daughter who displays a tremendous amount of style and depth of body. She is full of carcass merit and very wedge shaped, yet still offers a nice refined front end with great head carriage and overall appeal. Her sire Q Pac was purchased as the top priced bull from the ANC sale in 2021 and has been breeding the house down for us ever since. On the dam’s side she stems from the original donor cow Charnelle Katrina H65E, who we also purchased as the high selling female from the Blanch family in 2019.

T100E was a bit young to join in the Spring so we have chosen to leave her open, allowing the opportunity for the purchaser to join to the bull or their choice, or slot her straight into an ET program.

From a family of Champions

4 Ways Charolais was registered with the society in 2004 after breeding commercial Charolais cattle since 1985. Originally, we were located at Young, South West New South Wales operating a broadacre cropping program and purchasing a few registered females as the budget allowed. After a few years the opportunity to purchase the majority of females from another breeder turned our hobby into a viable stud operation. The stud has pursued the best genetics available including the record priced sires, Moongool Lunar Rise (P) $83,000 and Moongool Revolution (P) $265,000.

Refine’s pedigree is the most influential in the 4 Ways herd. Amongst her pedigree, two full natural siblings having won at BEEF Australia and the Brisbane Royal show. In 2021, 4 Ways Quantum was awarded Grand Champion Charolais Male at Beef Australia and then sold to Mac and Gayle Shann of Cantaur Park for $40,000. In 2023, 4 Ways Refine R32E was appointed Grand Champion Charolais Female at the EKKA. She was then entered into the Charolais International Vitual Show and was granted Grand Champion Female.

In 2008 the stud was relocated to Guyra in the New England region of NSW to concentrate on our stud operation. The following year we were given the opportunity to sell bulls at Clermont Central QLD with another breeder for which we are so grateful to those breeders for that. Following this bulls were sold at Emerald Aggrow and a small sale we had at Armidale NSW.

Moving on 5 years, David got itchy feet again and we made the move to Inverell where our stud operation is currently run while also conducting a small cropping enterprise. Bulls are offered at Emerald Aggrow and our own sale in September each year.

Refine is the first registered female to be offered by her sire Moongool Lunar Rise who was purchased by 4 Ways in 2017 for $83,000 which at the time was the Australian record for a Charolais Bull. Lunar Rise’s pedigree consists of leading Charolais sires such as Silverstream Evolution, Minnie-vale Sundance and Moongool Simon. We admired Lunar for his smooth muscle pattern and great skin type with his progeny being sort after by stud and commercial cattlemen. Amongst Lunar’s son’s is 4 Ways Revolution our top price bull selling to Kelly and Barry Shann in 2022 for $65,000.

Refines dam also has plenty to impress in her pedigree, tracing back to the impressive Palgrove Refine family with Platinum Windfall, Palgrove Viagra and Moongool Fairfax, who was the junior champion Charolais bull at EKKA 2012. At BEEF AUSTRALIA 2009 we sold 4 Ways Refine D45E to Ascot Charolais who was also a special individual and has breed well in their herd.

From a family of Champions, Refine T94E has all the great attributes of a superior Charolais female. Veejay downs was started in 1987 by Henry and Verona Pisaturo in 2008 it was passed to James Pisaturo and with the purchase of some heifers from Mandalong it was reestablished, these females were closely linked to Nandillyan Peugeot and created a strong base. Bulls from Rosedale and DSK were utilized. In 2015 the herd was moved to ‘Inga Downs’ southeast of Middlemount in Central Queensland. Since then, all Veejay Downs progeny have been bred at ‘Inga Downs’. It is currently owned and operated by James, Aleisha, Olivia and George Pisaturo.

Our operation focuses on breeding bulls for our own commercial program and has given us the ability to ensure our bulls thrive in the central Queensland environment. As all commercial bulls prepared for our own use are in the same management group as our sale teams we ensure our bulls are prepared to survive. The CQ Premier Charolais Sale is the only place we offer bulls for auction. We have recently expanded the operation to provide a line of paddock bulls to our clients.

Our program is a control mated with all cows calving from late spring to early summer in one management group to suit our wet season. All cows that fail to rebreed are culled to ensure selection pressure with our cows run under the same management as our commercial herd. We are BREEDPLAN recorded with all progeny remaining in the herd until 400 Day scans and the Charolais Bundle are done on all calves to include genomics and are very close to full parent verification to ensure the accuracy of the information provided.

Our Cattle have been validated by our success in the Clermont Cattleman’s Challenge with our home bred Charolais sired steers winning 3 years in a row. This competition starts with steers being backgrounded for 250 days in the same paddock then fed for 100 days on grain. There is a weight gain, carcase and taste test aspects to this competition making it a very comprehensive paddock to plate.

Our offering in this sale, “The pick of our two most elite young females” is a celebration in our 50th year of the Legacy of Robert and Georgina Binny and the quality of stud females they built from modest resources and land base With limited data available to all breeders in those times, with only a vision and simple commonsense selection, planned mating’s, strict culling and strategic purchasing to produces females that takes any breeding program forward. Nolana 153rd and Charol 147th are two individuals with all that knowledge gained over 50 years and 2 generations behind them.

Glenlea Charolais was established in 1973 by Robert and Georgina Binny in Tasmania with first progeny registered in 1974, 50 years of continuous registered Charolais seedstock production in 2024! In 2005 the stud herd was taken control of by Roderick Binny and the journey to become Glenlea Beef began. Our policy is to take our bulls to our Qld clients, either at our sales or from the paddock direct, adaptability is excellent with repeat buyers from across Northern and central QLD. We sell bulls all year round out of the paddock and offer free delivery to all major centers with our paddock bull sales. We will offer for sale close to 300 bulls in 2024.

In the 1850s Moongool consolidated holding was composed of the runs of several blocks. In 1884 the “Runs” were consolidated but were not divided until April 1888. Moongool, which is only 16 km South of Yuleba, was purchased by the Price family in 1954 for 2/6 an acre. It consisted of Brigalow, Belah, Box and Sandlewood scrub country.

Moongool is a Commercial breeding and fattening enterprise, along with a Charolais stud which was founded in 1985.

The stud operation is based on a number of properties in Maranoa and Western Qld area and the annual on property Bull Sale is conducted in September at Moongool. This year being our 31st annual on property sale. Over the years we’ve had some tremendous results- one being an Australian record price for a bull sold at auction( $265,000).

(a) The following words have the following meanings: Fees means all levies, charges, fees, costs and other expenses incurred or relating to these terms and conditions and the sale and purchase of livestock including, without limitation, transaction levies, yard and weigh dues, cartage, advertising and rebates, and whether paid for, or incurred, by the agent; Livestock means animals auctioned pursuant to these terms and conditions; and Price means the amount at which the lot has been sold to the buyer referred to in clause 7 of these terms and conditions (i) plus any Fees

23.5. The vendor acknowledges that the agent may take enforcement, repossession or other action to recover any livestock for which the buyer has not paid in full, or the Price of such livestock, owing by the buyer under these terms and conditions:

(a) when this clause does not apply, as agent of the vendor (including by reselling the livestock); and

(b) when this clause applies, on the agent’s own behalf exercising the rights of the vendor by subrogation or assignment under these terms and conditions (whether in the vendor’s name or not) and, where title to the livestock has not passed to the agent, by selling the livestock as agent of the vendor without the agent having to account to the vendor for the proceeds of sale.

23.6. The agent may at any time, assign, transfer, securitise or otherwise dispose of all or any of its rights under these terms and conditions and any debts created pursuant to it (including, without limitation, the rights assigned to it under clause 23.3).

23.7. The vendor hereby irrevocably appoints the agent as the vendor’s attorney to:

(a) do at any time

35. A buyer with the benefit of owners risk protection is not liable to pay the Price of that animal to the vendor. The buyer remains nevertheless liable for all costs incurred after the fall of the hammer in transport, slaughter, testing and disposal of the animal.

36. Owners risk protection is available to the buyer of cattle to which this chapter applies if all of the following are satisfied:

(a) a certificate is issued by AQIS which states the relevant NLIS RFID tag number and PIC, the date of the certificate, the reason for condemnation and that the reason for condemnation existed prior to the fall of the hammer;

(b) the certificate is received by the selling agent either in its original form or by fax by 5:00pm on the 7th day after the fall of the hammer; and

(c) if the condemnation is due to chemical residue the certificate follows testing in an AQIS approved laboratory which establishes maximum residue limits in excess of the Australian limit.

(a) A vendor is bound by these terms and conditions by offering livestock for sale by auction (b) An agent (which includes an auctioneer) is bound by these terms and conditions by conducting an auction sale. (c) A buyer is bound by these terms and conditions by bidding at auction. 2. (a) In these terms the expression auctioneer, agent, buyer and vendor respectively includes the servants, contractors, agents of each of them. The auctioneer, agent, buyer and vendor shall be wholly responsible for the acts and omissions of their respective servants, contractors and agents. The term “auctioneer” includes, so far as the law and context permits, the vendor’s agent. (b) When used in these terms the expressions “companion animals” means all animals originating from a property on a particular day. Where lots are split and sent to multiple establishments, then all of these animals shall be regarded as companions. 3. The following applies in interpreting
and other expenses incurred in relation to the purchase of livestock
payable by the buyer; and (ii) plus any GST added in accordance with clause 12.
These terms and conditions are subject to legislation or regulation in the State in which the auction is conducted and in the event of any conflict then the legislation or regulation will prevail. The provisions of these terms and conditions are in addition to, and do not derogate from, the duties and rights of vendors, agents and buyers set out in legislation and regulation in the State in which the auction is conducted. CHAPTER TWO - STANDARD TERMS OF SALE 4. Subject to any reserve price, and to the right, prior to the fall of the hammer, of the vendor to withdraw any lot without declaring the reserve, the highest bidder shall be the buyer 5. The auctioneer has the right to bid on behalf of the vendor provided that right is notified prior to the commencement of the sale and is subject to State law 6. A bid cannot be made or accepted after the fall of the hammer unless, in accordance with clause 8, the auctioneer decides to put the lot up again 7. The last price called by the auctioneer at the fall of the hammer shall be the amount at which the lot has been sold. 8. In the event of a disputed bid, the auctioneer is the sole arbitrator of the successful bidder or the auctioneer may decide to put the lot up again. The auctioneer’s decision is final. 9. The auctioneer may refuse to accept any bid which, in the auctioneer’s opinion, is not in the best interests of the vendor and need not give reasons for doing so. The successful bidder at a livestock auction sale must give to the auctioneer at the fall of the hammer: (a) the purchaser’s name; or (b) the bid card number which identifies the purchaser; or (c) the name of the person on whose behalf the successful bid was made; and (d) the Property Identification Code (known as the “PIC”) of destination. 12. The auction shall be conducted on the basis that the bid price shall be exclusive of Goods and Services Tax (GST). GST shall be added after the fall of the hammer for those sales subject to GST.
As soon as practicable after the fall of the hammer, the buyer shall if requested by the agent, sign the agreement for sale 14. If a buyer does not comply with any of these terms and conditions, which includes the requirements of State law, any livestock knocked down to that buyer may be re-sold by public auction or private contract in whatever lots and manner the auctioneer decides. The re-sale may be with or without notice and shall be at the buyer’s risk. The buyer is responsible for all loss and expense arising out of a re-sale and is not entitled to any resulting profit. 15. The buyer of livestock must pay the agent the full amount of the purchase price in immediate funds on receipt of a tax invoice Payment is required prior to delivery unless some other time for payment is specified in a written agreement between the buyer and the auctioneer that was made before the fall of the hammer. 16. No person may bid unless, prior to the commencement of the sale, that person has made arrangements satisfactory to the auctioneer for payment for livestock purchased. If bids in breach of this condition are inadvertently accepted, delivery shall not be given until the purchase money is paid and any law, rule or practice to the contrary is accordingly negatived as far as possible. 17. (a) Cattle sold on a liveweight basis that are weighed pre-sale are at the risk and expense of the buyer upon the fall of the hammer. (b) Cattle sold on a liveweight basis that are weighed post-sale are at the risk and expense of the buyer immediately after weighing (c) All livestock other than cattle sold on a liveweight basis are at the risk and expense of the buyer upon the fall of the hammer. 18. (a) Subject to this clause the sale is complete on the fall of the hammer. (b) The time for rejection is the time commencing at the fall of the hammer and ending at the first of: (i) delivery is taken by a representative of the buyer; (ii) departure of the animal from the purchaser’s delivery pen; or (iii) one hour after the last animal is: a. in the case of pre-sale weighing, sold; or b. in the case of post-sale weighing, weighed. (c) During the time for rejection the buyer may reject any animal which is lame, blind or diseased where that condition existed prior to the fall of the hammer but could not be reasonably observed when the animal was in the selling pen. (d) If the purchaser rejects an animal during the time for rejection then the sale of that animal is cancelled and the animal is returned to the vendor or sold at such price as the purchaser and the agent may agree. (e) This sub-clause applies only to cattle which are sold in Queensland at auction for slaughter. The agent has responsibility for the prevention of loss or escape (but not death, sickness or injury) of those cattle from the time of the fall of the hammer, through delivery to and from the scales, to the buyer’s delivery pen and on to the buyer’s nominated transport. This responsibility ends at the earlier of those cattle boarding the buyer’s nominated transport or sunset on the day after the sale. This sub-clause does not apply if the agent makes an announcement to that effect prior to sale. 19. (a) Subject to the right of rejection in Clause 18, all conditions and warranties expressed or implied by law are hereby excluded from the sale to the extent that the law allows. All lots are open for inspection prior to the commencement of the sale and are sold with all faults, if any. No compensation shall be given for any faults, imperfections, errors of description, number in or of any lots sold or otherwise. (b) Any claim or objection arising out of an error or misdescription in the provision of relevant information in terms of legislation or regulation concerning the National Livestock Identification Scheme (NLIS) must be made by 5:00pm on the seventh day after the fall of the hammer. No objection, requisition or claim against the vendor or agent in respect of such error or misdescription can be made after that time. (c) Any statements made by the vendor or the auctioneer whether in writing or orally to the effect that any female has been pregnancy tested or scanned positive shall mean and require only that a certificate in writing shall be supplied to the buyer signed by a qualified veterinary surgeon or certified scanner certifying that the said female has been tested or scanned on the date specified in the certificate and that in the opinion of the surgeon or scanner the female was pregnant on that date. (d) For cattle, the agent undertakes to make every reasonable effort to ensure that any NLIS cattle device number is transferred from the saleyard account to the purchaser’s account on the NL IS database no later than midnight on the day of the sale. (e) Where livestock have a food safety or market eligibility status derived from the NVD and/or the NLIS/ERP database, the agent will inform the buyers by presale catalogue in conjunction with vendor branding and/or announce the status prior to the offering of those lots. 20. If delivery is made to, or possession obtained by, the buyer or its representative before full payment of the Price, then until full payment is received, the buyer:
does not acquire title to the livestock;
holds the livestock as bailee only for the vendor;
must act in a fiduciary capacity in its relationship with the vendor; (d) must store the stock separately or so that they are readily distinguishable from other livestock owned by the buyer; (e) is responsible for the safety and well being of the livestock; (f) may make a bona fide sale for market value of any or all of the livestock. As

In addition to clause 20, if payment is not made according to clause 15, but delivery has been made to, or possession obtained by, the buyer or its representative: (a) The vendor or its agent may repossess and resell the livestock and enter property owned or occupied by the buyer or its representative if necessary to do so; and (b) Interest may be charged at the rate usually charged by the agent for overdue accounts on any amounts which remain owing at any time. 22. The buyer may not make any claim against the vendor for actions by the vendor or its agent under clauses 20 or 21 and indemnifies the vendor and its agent against any loss, damage, costs, expenses, penalties, fines or claims suffered by the vendor, the agent or any person or entity arising from the vendor exercising its rights under clauses 20 or 21 23.1. Clause 23 applies whenever the agent pays the vendor before being paid by the buyer, which the agent is not bound to do. The agent is then the del credere agent of the vendor at law 23.2. The vendor hereby gives notice to the buyer of the assignments referred to in clause 23.3 23.3. When this clause applies, in addition to any rights of the agent that arise by operation of the law, the parties agree that, subject to clause 23.6 the agent is subrogated to

23.4. Title to the livestock does not pass to the agent or a nominee of the agent unless the agent, by written notice to the vendor, notifies the vendor that it is to be transferred to the agent or a nominee of the agent.
and in any manner as the agent thinks fit all acts necessary or desirable to perfect o r improve the rights and interests afforded, or intended to be afforded, to the agent u nder these terms and conditions; and (b) appoint one or more sub-attorneys to do anything that the agent may do as the vendor’s attorney. 23.8. These terms and conditions do not render the agent liable to the buyer as vendor nor entitle the buyer to set off against the agent any right the buyer may have against the vendor or otherwise. 23.9. The buyer acknowledges that the provisions of this clause 23 are intended solely for the benefit of the agent (and its assigns) and the vendor. The liabilities and obligations of the buyer will not be in any way affected: (a) by this clause 23, other than as it expressly provides; or (b) by the failure of the agent or the vendor or either of them to comply with the terms of this clause 23. 23.10.The buyer must pay all amounts payable to the vendor or the agent under these terms and conditions without any deduction, withholding, set off or counterclaim whatsoever, whether the benefit of a deduction, withho lding, set off or counterclaim is alleged to exist in favour of the buyer as against the vendor or the agent in any capacity whatsoever or any other person including any assignor of the vendor’s or the buyer’s interests under these terms and conditions. 24. (a) The agent agrees that he is liable to pay to the vendor the Price, less such commission as is agreed between the vendor and the agent, and in the absence of any agreement such amount as is reasonable, and less the Fees that are payable by the vendor that were incurred by the agent on behalf of the vendor in relation to the sale of the livestock. (b) In the event that the buyer pays the Price or part of it direct to the vendor then the agent has no liability to the vendor for the amount of such payment. Further, if the agent pays the vendor any amount which the buyer also pays direct to the vendor in respect of the same livestock, then the vendor must repay the agent that amount and the agent may debit that amount to an account held in the name of the vendor by the agent. (c) Regardless of whether or not a sale has occurred the agent may, but is not under obligation so to do, instead of deducting payments owed to it by the vendor, debit the amount of the commission and fees to an account held in the name of the vendor by the agent. 25. The auctioneer has been retained by the vendor as auctioneer for the purpose of selling the livestock comprised in the lots. The terms of engagement between the auctioneer and the vendor do not extend to the provision of advice by the auctioneer to the vendor in relation to the safety or otherwise of the sale ring, the saleyards and the surrounding environments CHAPTER THREE – VENDOR WARRANTY FOR CORRECT PRESENTATION AND DECLARATION 26. This chapter applies only in the case of livestock and their companion animals sold at auction for slaughter when the buyer is the slaughterer and the livestock are transported direct from the sale yard to the meatworks at which they are slaughtered. This chapter does not apply if the buyer is a trader w ho subsequently resells the livestock to a slaughterer. A slaughterer is any person who pays the AMPC Processor levy. 27. The warranty of a vendor is that livestock and their companion animals offered for sale at auction: (a) pass AQIS and other regulatory autho rity requirements and inspections at the time of slaughter; (b) are of merchantable quality; (c) carry an NLIS device in accordance with State law ; (d) in the case where a representation has been made in the pre-sale catalogue that the livestock have particular characteristics or are fit for a particular purpose or market, and such representations are based on information in the National Vendor Declaration, the livestock will have those characteristics or will be fit for the particular purpose or market; and (e) all information in any National Vendor Declaration provided by the vendor is true, complete and correct in all material respects. 28. In the event of a breach by the vendor of the vendor’s warranty and provided such breach is notified by the buyer to the agent by 5:00pm on the 7th day after the fall of the hammer then the buyer is not liable to pay the portion of the Price of such of the vendor’s livestock to which the breach applies. 29. However if the breach by the vendor is such that the livestock are not rejected outright but are instead downgraded then the buyer will pay the value of the livestock at their next highest and best use. 30. In the case of a breach by the vendor of the vendor’s warranty then the vendor will also be liable to the buyer for any further losses which the buyer might establish but the buyer will take all reasonable steps in co -operation with the agent and vendor to mitigate both the effect of the breach and the amount of any loss. 31. Where a sentinel animal of a lot tests positive for chemical residue, and provided such test is certified and notified as required by these vendor warranty terms, then: (a) the buyer will be entitled to delay payment for the price of all livestock in that lot; or (b) the vendor has the option, at the vendor’s cost, of collecting the companion animals and returning them to the vendor’s property; or of having the livestock slaughtered in which event the risk of further condemnations will be that of the vendor. Where product integrity is potentially jeopardised, the Processor has the right to refuse slaughter and send the livestock back to the consigning property at the vendor’s cost. 32. The auctioneer is liable to the buyer in respect of any breach of the vendor’s warranty arising out of: (a) any error, by the auctioneer, of transcription of information from the National Vendor Declaration completed by the vendor to the pre-sale catalogue or the buyers post-sale summary; (b) any failure by the auctioneer to notify the buyer, prior to b idding, of any breach by the vendor of the warranty of the vendor if the buyer establishes that the agent knew of such breach prior to the sale; and (c) any failure by the auctioneer to disclose prior to bidding, and in the presale catalogue, that the vendor has failed to provide a National Vendor Declaration that is complete in all material aspects. CHAPTER FOUR - OWNERS RISK FOR CONDITION OF CATTLE 33. This chapter applies only in the case of cattle and their companion animals sold at auction for slaughter when the buyer is the slaughterer and the cattle are transported direct from the sale yard to the meatworks at which they are slaughtered. This chapter does not apply if the buyer is a trader who subsequently resells cattle to a slaughterer A slaughterer is any person who pays the AMPC Processor levy. 34. Owners risk reflects the producer’s responsibility to provide slaughter cattle for sale that are fit for human consumption. Cattle are fit for human consumption if they are not condemned as unfit by AQIS. Owners

bruising, (b) fever, (c) partial condemnation, or (d) emaciation. CHAPTER FIVE - NOTICES REQUIRED BY STATE LEGISLATION NSW Legislation Property, Stock and Business Agents Act 2002 Warnings Penalties for collusive practices. It is an offence against the Property, Stock and Business Agents Act 2002 for a person to do any of the following as a result of a collusive practice, or to induce or attempt to induce another person by a collusive practice to do any of the following: (i) to abstain from bidding; or (ii) to bid to a limited extent only; or (iii) to do any other act that might prevent free and open competition. Severe penalties may be imposed on persons convicted of collusive practices. The auctioneer has the right to make one bid on behalf of the vendor if the auctioneer clearly and precisely announces that fact prior to the sale. Tasmanian Legislation The auctioneer must not appear to acknowledge a dummy bid. A buyer must not give, agree to give or offer a gift or other consideration to a person for abstaining from bidding and a person must not accept any gift or consideration for abstaining from bidding. A person must not participate in collusive practices b y way of making or receiving an unlawful promise to abstain from bidding, not to bid except to a limited extent or do any other thing which may prevent free and open competition. Western Australian Legislation Auction Sales Act 1973 s31 NOTICE It is an offence to: (i) induce or attempt to induce another person to abstain from bidding by means of a promise, expressed or implied, that the other person will have the right to elect to take over as buyer or to toss or draw lots to establish who is to become the owner; (ii) abstain or agree to abstain from bidding as a result of such a promise; (iii) knowingly enter or permit or cause to be entered in the auctioneer’s record any name other than that of the actual successful bidder; (iv) enter in the auctioneer’s record the name of the buyer other than that of the actual successful bidder; or (v) in the case of successful bidder supply wrong information as to the name of the buyer to the auctioneer or to any person, firm or corporation on whose behalf the sale is conducted.
