Barossa Live Auction will take place on Thursday 20 April 2023 at The Barossa Cellar in Barossa.
Potential buyers can register and view Barossa Live auction items from 12.00pm on Thursday 20 April 2023 at The Barossa Cellar.
BIDDING
Please note a valid credit card saved against your confirmed bidding registration is necessary in order to bid at auction. Credit card details must be registered with Barossa Australia on arrival at The Barossa Cellar prior to the commencement of the live auction.
All bidding is on a per lot basis unless otherwise advised by the auctioneer. The auctioneer will be in charge of the bidding and any disputes will be decided at their discretion. All items are at the risk and expense of the buyer at the fall of the hammer. All sales are final and there will be no refund or exchange on items.
People not attending the live auction and wish to bid please register on the enclosed absentee bidding form.
PAYMENT
All lots are sold GST exclusive, all applicable taxes will be added and detailed on the buyer’s invoice.
Barossa Australia accepts all major credit cards including American Express, Mastercard and Visa.
Bank transfer is accepted on lots that are greater than $10,000.
DELIVERY
Live Auction items paid in full can be collected on the day of the auction.
Live Auction items not collected on the day remain the responsibility of the buyer and delivery will need to be arranged with Barossa Australia. Shipping charges are not included in the final bid price and will apply at the discretion of the Barossa Australia.
Wine purchased from the online auction is held securely in The Barossa Cellar’s temperature controlled warehouse.
TERMS & CONDITIONS
Buyers are requested to read carefully the explanation of cataloguing practice and the conditions set out below which contains the terms on which Barossa Australia conducts sales and handles other matters.
2) An auction
An auction is the process of selling “lots under the hammer”, whether it is “live” in an auction room, or an “online auction”.
3) The buyer
A) the highest bidder acceptable to the auctioneer shall be the buyer but if any dispute arises as to the last or best bidder, the lot in dispute shall be put up again and resold, provided that the auctioneer cannot decide who was the last or best bidder.
B) the purchase price payable by the buyer shall be the final bid, together with any impost chargeable on this final bid. The final bid means the price at which a lot is knocked down to the buyer.
C) the auctioneer has the right at his/her absolute discretion to refuse any bid and to advance the bidding as he/she may decide.
D) The auctioneer reserves the right to withdraw any lot the sale or to combine any two or more lots at any time.
4)
Vendor
The vendor, at the auctioneer’s absolute discretion, shall be entitled to place a reserve on any lot and the auctioneer shall have a right to bid on behalf of the vendor for any lot offered.

5) Catalogue descriptions
All statements in the catalogue, advertisements or brochures are statements of opinion and are not, nor are they to be relied upon as statements of fact. Each lot is sold by the vendor thereof with all faults and defects (if any) and with all errors of description and shall be at the buyer’s risk on the fall of the hammer and the auctioneer, Barossa Australia nor vendor shall not be accountable for any deficiency, damage or loss which may arise thereafter.
6) Responsibility for purchased lots
a) Barossa Australia’s decision will be final and binding on the buyer and vendor in all matters and no action shall be brought in connection with any claim except on and in accordance with Barossa Australia’s decision.
B) Wine will be released to the buyer only after full payment is received.
7) Penalties for non-pay ment or failure to collect purchases
If a buyer fails either to pay for or to take away any lot, Barossa Australia shall, without further notice to the buyer and at its absolute discretion and without prejudice to any other rights or remedies it may have, be entitled to exercise one or more of the following rights or remedies:
a) To issue proceedings against the buyer for damages for breach of contract.
B) Charge the buyer interest on the total purchase price at the rate of 2% above the 90 day bank bill swap rate published by the reserve bank of Australia for each day that it remains unpaid for more than 30 days from date of the close of auction.
8) Guarantee
a) Subject to the obligation accepted by Barossa Australia under this condition, none of the seller, Barossa Australia, its employees or agents are responsible for the correctness of any statement as to authorship, origin, date, age, attribution or provenance of any lot, for any other errors of description or for any faults or defects in any lot and no warranty whatsoever is given by the seller, Barossa Australia, its employees or agents in respect of
any lot and any express or implied conditions or warranties are hereby excluded.
9) Commission bids
a) Prospective buyers are advised to attend the auction. Barossa Australia will however, if so instructed execute bids on their behalf, but neither Barossa Australia nor its employees nor agents shall be liable for any neglect or default in so doing or for failure to do so.
10) General conditions
1) Barossa Australia as agents for the seller is not responsible for any default by the seller or the buyer.
2) Barossa Australia has the right at its absolute discretion to refuse any bid, to advance the bidding as it may decide, to withdraw any lot, or combine any two or more lots.
3) The following words and expressions shall have the following meaning:
“Lot” any item deposited with Barossa Australia, with a view to its sale at auction, in particular, the items or items described against any lot number in any catalogue.
“Bought in” Those lots which fail to reach their reserves.
“Purchase Price” The hammer price plus GST.
These conditions of business shall be governed by and construed in accordance with the law of the state of Australia in which the auction takes place and all parties concerned hereby submit to the non-executive jurisdiction of the States Court.
