BARBERING SCHOOL OF WALES COURSE AGREEMENT 12 WEEK NVQ LEVEL 2 BARBER COURSE

This Course Agreement (the “Agreement”), effective between [ ] (the “Effective Date”) & [ ] (“End Date”), is entered into by Barbering School Wales LTD (“Company”), and [ ] . Company and Student [ ] agree as follows: 1. Engagement. The course will begin effective and end on . The Student will be provided with access to the course curriculum, course resources, online resources supplied by both the Company & the specific Awarding Body (if applicable).

The Student will also have access to the use of academy premises & equipment.

2. Student Requirements. Student agrees to the following terms for delivery and review of materials.

A. Provide any required information as needed for maximum effectiveness in receiving the Services.

B. Complete the training course in full & by course standards and guidelines.

C. Perform any “Actions” assigned at any time by Educators, Assessor’s, IQAs or Senior Staff.

D. A deposit or initial instalment payment is required for enrolment onto any course at BSW. In the event of no deposit, initial payment or instalment paid by the Student the space available on the course will be open to any other prospective students.

3. Services.a. Teaching and services provided is for the following course NVQ Level 2 Barbering and will include information, methodologies and content included in the specific course curriculum provided to the student - See Course Curriculum.

This course is accredited by VTCT and provides students with the following qualifications NVQ Level 2 Barbering. b. Equipment provided by Company to Student will remain the property of the Company throughout the duration of the course and after. These items are; (i) Razor Blades (ii) Neck Rolls (iii) Health 7 Safety Equipment (iv) Gowns (v) Barber Chairs (vi) other communal items & resources. c. Students are required to supply their own barbering/shaving equipment suitable to perform the course unless they have purchased a barbering kit from Company. Items must be to industry & health & Safety standards.

d. If enrolled on an Accredited course, Students will be awarded qualification within a maximum 2 months of graduating their course. c. Barber School Wales have the rights to withhold any qualification from students who they don’t seem fit for practice, professional or have breached terms of their induction & student agreement.

4. Facilities & Provisions. The BSW facilities; (i) Academy; cutting floor, presentation areas, waiting areas, staff rooms, toilet facilities and other aspects considered as ‘facilities’ are provided to The Student throughout the duration of their course.

Facilities offered to Students do not include the following; (i) food, beverages, clothing or any other consumable or consumer item.

5. Fees, Expenses & Deposits a. The agreed upon fee for Engagement is [

Right to cancel: The Student has the right to cancel this contract until midnight of the third (3rd) business day after it is signed and executed. Company has a zero-refund policy and Company reserves the right to keep the initial payment if cancellation is activated by the Client. Clients may cancel this agreement by mailing a written notice to Barbering School Wales LTD before midnight of the third business day. Notice of cancellation sent after this deadline may be deemed invalid at the sole discretion of Barbering School Wales LTD. c. Missing payments: The Student is 100% liable for any missed payments or payment dates. If payments aren’t made on the due dates, the Student will be removed from the course and not awarded any certification. In the event of the Student not making payments or cancelling after the agreed dates, full deposits will be retained by the Company.

d. Deposits: Deposits are non-refundable and will be retained fully by the Company. e. Refunds: Fees for courses are fully refundable (minus deposit) if cancelled within 14 days of an initial deposit payment or signing of the Student Contract. For example, student pays deposit on 1st Jan, they have until 15th Jan for their cooling off period. In the event of the Student not making payments or cancelling after the agreed dates, full course fees will be retained by the Company.

6. Confidentiality. Company agrees that all information received from Student in the course of Services will remain confidential, except when disclosure to a third party is compelled by

law or deemed necessary by Company to avoid harm to Student or others. Barbering School Wales LTD complies with GDPR regulations in The United Kingdom.

7. Release of Liability. Student releases Company from any liability for injury or loss resulting directly or indirectly from the Services. Student acknowledges that he or she is partaking in the Services at his or her own risk. Furthermore, the Student agrees that he or she bears complete responsibility for the consequences of any action, or failure to act, whether or not suggested by the Company in the course of providing the Services.

8. No Guarantee. Barbering School Wales LTD does not warrant or guarantee any specific level of performance, results from the student or employment for the student. Examples of results obtained for other students of Barbering School Wales LTD may be used as a marketing tool and shown to Students for demonstrative purposes only and should not be construed by Student as indicating any promised results or level of results or employment.

The student acknowledges that the results will come from collaborative work with Barbering School Wales LTD and the Student therefore Barbering School Wales LTD cannot guarantee that the Student will fulfil the necessary action steps and therefore cannot be held liable in this instance. Barbering School Wales LTD does not warrant or guarantee any specific amount of live customers for its student’s. It operates as a live barbershop and does everything necessary to provide as many live clients for students as possible, however due to the nature of the barbering industry, it is not fully protected from cancellations or no shows.

9. Illness, Absence & Lateness.. In the event of illness and absence from the course, the Company is not liable to refund or reimburse the student. This includes financial payment and also space on an alternate date. Any teaching days or course content that is missed by The Student which may affect their final qualification are not the responsibility of the Company. ‘Illness’ includes contracting COVID19 and having to self isolate. Should ‘illness’ affect your ability to undertake assessments, then you will be invited at a later date to complete your assessments only with a fixed end date. No additional training will be provided. You are required to provide your own models for these assessments.

Barbering School Wales Ltd have an attendance policy - if the Student is non-compliant within the attendance policy, Barbering School Wales Ltd have the right to withhold certification.

10. Photo Consent. The Student [ ] gives consent to being filmed and that the content can be used for advertising and marketing purposes.

11. Testimonial. The Student [ ] agrees their experience including photographs, comments and feedback during their time at BSW can be used for advertising and marketing purposes.

14. Feedback. The Student [ ] agrees to partake in feedback activities with staff of BSW during their course which can be used for advertising and marketing purposes.

15. Entire Agreement. This Agreement is the final, complete and exclusive Agreement of the Parties. No modification of or amendment to this Agreement shall be effective unless in writing and signed by each of the Parties.

16. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of The United Kingdom & Ireland without regard to its conflicts of law provisions. Exclusive jurisdiction and venue for any action arising under this Agreement is in the national court in The United Kingdom, and both parties consent to the jurisdiction of, and irrevocably waive any objection to the venue in courts for this purpose. In any action or proceeding to enforce this Agreement, the prevailing party will be entitled to recover from the other party its costs and expenses (including reasonable attorneys' fees) incurred in connection with that action or proceeding and enforcing any judgement or order obtained.

17. Throughout the candidate's time at Barber School Wales Ltd or partner company Capello Barbers Ltd, they must not engage in any activity (physical or verbal) with any competitive barber academy or barbershop in Wales, England and the rest of the UK. In doing so, the candidate will be removed from the course and be required to settle payment within 14 days.

19. The Student & Guarantor agree that this is a lawful abiding contract and if any term is breached at any time, Barber School Wales Ltd & Capello Barbers Ltd will take relevant legal action.
