THE Duterte administration has supported three out of the last four United Nations resolutions to ensure the safety of journalists amid heightened risks members of the media are facing globally, including the Philippines. A report of Article 19, a British human rights organization with a specific mandate and focus on the defense and promotion of freedom of expression and freedom of information worldwide, titled “Ending Impunity: Acting on UN Standards on the Safety of Journalists,” showed the countries that expressed intent to support or co-sponsor UN resolutions that set out commitments for states to ensure the safety of journalists. The Philippines was a party to the United Nations Human Rights Council (UNHRC) Resolutions in 2018 and 2016 and UN General Assembly Resolutions in 2017 and 2015. The 2018 UNHRC Resolution called on political leaders to stop denigrating journalists and undermining trust in independent media, and urges states to bolster digital security, and cease the abuse of defamation laws against journalists. The 2016 Resolution, meanwhile, spotlights impunity, urges the release of arbitrarily detained journalists, the reform of laws that obstruct journalists’ work, and calls on states not to interfere with tools for encryption and on-

THE Sandiganbayan has allowed government lawyers to appeal the dismissal of a forfeiture case against the family of former President Ferdinand Marcos and their cronies. In a November 6-resolution penned by Second Division’s Associate Justice Lorifel Pahimna, the motion for reconsideration – which was previously filed but denied for not complying with certain rules – was approved citing a Supreme Court provision, which states that exceptions may be made if only to ensure the right to due process. (OSG), sought for the relaxation of the rules citing the importance of the case. “It is undisputed that the Motion for Reconsideration was laden with procedural defects for failure to comply with the requirements of Rule 15. Although the inadvertence of the plaintiff’s counsel is not a compelling or sufficient reason to relax the rule, the Court is of the view that the defendant’s right to due process will not be impinged should the Court act on the earlier motion,” the court said. DEFENSE Secretary Delfin Lorenzana on Monday, November 11, said he would no longer support any proposal to extend martial law in Mindanao. But he added that the final decision would be based on the recommendation of the Armed Forces of the Philippines and the Philippine National Police (PNP). “We are waiting for the recommendation of the Armed Forces and the PNP, it will depend on u PAGE A2 them. not recommend anymore the extension [of martial law],” he told reporters in an interview at Camp Aguinaldo, Quezon City. Mindanao was placed under martial law in 2017 following clashes between government troops and militants affiliated with the Islamic State. Congress extended the implementation of martial law three times. If it will not be extended again, military rule will be lifted at the end of the year.
