Ellie received her first COVID-19 vaccine dose a few weeks ago and had no adverse reaction. In fact, she cried for about 30 seconds, and we carried on with the rest of our day. She also received immunity when I got my first dose while pregnant, a decision I made after looking at data and consulting with my doctor. As the Senior Advisor for the California Department of Public Health’s vaccine task force, I see COVID-19 infection trends, research, and data every day. I’m keenly aware that hospitalizations for kids under age 4 were five times higher during the Omicron surge than when the Delta variant was circulating. I also know that one in five kids who were hospitalized with the virus also were admitted to the ICU. During COVID surges, my husband shared horror stories from the hospital where he works, telling me about young patients in the ICU fighting for their lives. As is true for all parents, my child is the light of my life. Before she was eligible for vaccination, I worried about Ellie getting COVID and the potential for serious outcomes. That is why I was eager to get her vaccinated as soon as possible. Not to mention, we live with my parents in a multigenerational household. As a lung cancer survivor, my father is at risk for serious consequences from COVID-19. To keep him as safe as possible, it was critically important that all of us, including Ellie, have the protection of vaccination. We are also careful to wear masks, limit interactions with non-family members and isolate when we don’t feel well, but we know our vaccination status is a critical component of our family’s COVID-safety plan. A Quinnipiac poll released the day before Biden’s address found a majority of Americans agree with the president that American democracy is on the ropes, though they are divided as to the reasons. EMS: Should kids keep masks on throughout the day, even when they are outside on the playground? What about lunchtime and PE?

EMS: What safety measures would you recommend for parents of school-aged children?
Dr. Priya Soni: I do agree with their position to focus on the fact that COVID-19 is here to stay and that we should focus on higher yield strategies that keep us all safe – strategies that no longer severely disrupt our daily lives. Some of the guidance that was particularly helpful was to end quarantine recommendations for exposures. We know this virus has taken a significant toll on our children and their ability to attend school without disruption. One of the other measures they have eased is the weekly screening tests – these are no longer necessary as routine practice in school settings in asymptomatic children. The CDC does mention that these screening tests can be helpful at times of high-risk activities in school including close contact sports, band, choir, and theatre. As well as in certain times of the year when we see increased transmission. Overall, these new recommendations help support optimizing in-person classroom time and minimize attendance disruptions that were so prevalent over the last few years.
EMS: The majority of preschool and K-6 children will return to school this fall unvaccinated. Are you concerned about surges at school sites? Dr. Priya Soni: We hope that this is not the case. But looking at all the vaccination rates, it is concerning to see that as of August 3rd the CDC reported that only 900,000 of children ages 6 months through 4 years have received at least one dose of COVID-19 vaccine. This represents only 5 percent of young children – ages 6-months through 4-years old. About 16.5 million children have yet to receive their first COVID vaccination. This number of course varies from state to state, however, I hope that by the time all schools re-start in the fall, we see higher numbers of vaccination.Iwillbeconcerned about small surges at school sites if these numbers are not improved. We know that vaccinations remain the mainstay of protecting ourselves. Vaccines continue to prevent against severe complications, including MIS-C and long-COVID, hospitalizations and deaths even in children. Parents need to realize that COVID-19 was a leading cause of death among children ages 0 to 4 years during the pandemic from March 1, 2020 – April 30, 2022 and it is continuing to impact children significantly. EMS: Do you agree with the CDC’s newest recommendations, including ending quarantines for exposures as long as people are asymptomatic?

They say those who are unvaccinated are at greater risk for COVID-19. As back-to-school season commences, vaccines are especially important tools for safely sending children to day care, preschool and school environments.Accordingto Aug. 11 data from the California Department of Public Health, just about one third of children ages 5-11 are vaccinated and less than 25 percent of Black and Latino children in this age group have received their primary series. In the two months since the vaccine became available for children under 5, only 1.6 percent of children under 5 years old statewide have received their primary series. The pandemic is not over but we must acknowledge that we are not in the same place that we were over two years ago. None of us have a crystal ball –but as we head into the later fall and winter, we may be faced with another cycle of high COVID-19 transmission – something we have been seeing now consistently every four to six months. Tourism planning should re ect market realities

First of all, any current assumptions about overseas visitor numbers, even returning overseas Filipino workers, are probably too optimistic; tourism planners should scale back those expectations. That does not mean ignoring the international market, of course, but it should perhaps be given less priority than domestic tourism, which appears to offer better prospects for faster recovery for the tourism sector. In one respect that may actually prove to be an Editorial advantage, as domestic tourism reaches areas that foreign visitors do not, or at least not in significant numbers. In order to make the most of the advantage, however, the Tourism department will have to expand its coordination with other departments and levels of government. The DOT can, for example, provide valuable input to the Department of Transportation and Department of Public Works and Highways on the development of transportation infrastructure serving potential tourist locations. Likewise, the DOT should expand its outreach to local governments in areas such as support and oversight of tourismrelated businesses — obvious ones, such as hotels and restaurants, but other potential attractions such as local markets, stores and farms as well — and managing the preservation and access to local historic and scenic areas. In short, while the DOT should certainly keep up efforts to market the country to overseas visitors, it should keep in mind that for at least the next couple of years, the results are likely to be diminished. The time between now and 2024 or 2025 can be used to boost the domestic tourism base, which will pay dividends in both the short and long term; if done right, the work to create exciting destinations for domestic tourists will appeal to and be accessible to foreign visitors as well, once they return in the hoped-for millions. (ManilaTimes.net) ON a rock in Scarborough Shoal is a Philippine territorial marker. The concrete cylinder is 20 cm in diameter and a meter long, but only 15 cm protrudes. On the brass cap is embossed “USAMSFE.” The US Army Map Service-Far East embedded it there before the 1946 birth of the Philippine Republic. That marker proves that the Shoal, also called Panatag and Bajo de Masinloc, 123 miles off Zambales, is Philippine boundary. By a series of Spanish and American official acts and documentation, jurisdiction transferred to Manila. Filipino geodetic engineerastronomer Dante Yglopaz, 84, knows the marker well. He is the only surviving member of the Scarborough survey 61 years ago by USAMSFE and the Bureau of Coast and Geodetic Survey. That week-long research pinpointed the exact longitude and latitude of the Philippine border. Yglopaz likens the marker to a “mohon” (stone boundary) of a lot. Marked “BL” (Bureau of Lands) it denotes the State’s demarcation authority. Yglopaz was 23 when he served as the survey’s assistant astronomer in March 1961. The venerable engineer Felipe F. Cruz, whose firm the USAMSFE contracted, acted as documenter. Felipe Caddauan of Ilocos was main astronomer; Victor Henry Baledia of Negros Oriental, radioman.Theysailed two days and one night from the BCGS headquarters in North Harbor, Binondo, Manila. Captain Frisbitero skippered the tenman crew of the steel vessel “Pathfinder.” Anchoring a distance from the treacherous reefs, they rowed boats to unload equipment on an old steelframed shed beside the marker, as USAMSFE instructed. Wall-less, only a GI sheet roof shielded them from sun and wood-planks from water, with latrine at the far end. Gear consisted of a book charting the position of 55,000 stars, electric chronograph, chronometer, radio, mechanical adding machine, heavy-duty truck batteries, kerosene stove and Petromax lamps. No calculators or GPS then. At night they timed the moon’s occultation of 30 to 50 stars; at day they computed and logged their findings. They worked, ate and slept on the small space as wind splashed seawater on them. Their study was submitted to USASMFE headquarters in Tokyo, later moved to Honolulu. Sadly, Yglopaz’s personal journals and photos of the expedition were ruined by storm Ondoy’s mud and floods in his Marikina home, 2009. Yglopaz joined other USASMFE surveys, 1959-1965, with Caddauan, Baledia and alternate astronomer Ernesto Calpo of the Weather Bureau. They survived poisonous snakes and blood leeches in Sulu, Palawan and Babuyan Island mountaintops. Then, on to South Vietnam to plot the coordinates of the southernmost tip to the demarcation line with the North. Onto Kwajalein, Saipan, Guam, Sydney, Auckland, Christchurch and Dunedin. Also the U.S. mainland: Sacramento, Reno, San Francisco, where they and Cruz were locked down at The Presidio base during the 1962 Cuban Missile Crisis.Yglopaz wonders if China, which grabbed Scarborough in 2012, has destroyed the USASMFE marker. “In 1961 we didn’t see any navigation lights” in the 15,000-hectare lagoon, he recounted in Sapol-dwIZ last Aug. 27 and a follow-up interview Aug. 29. “No fishermen, and U.S. or Philippine patrols either. And certainly no Chinese ships.” About China’s nine-dash line claim encompassing the Shoal, he said: “Ngayon lang ‘yan. Wala ‘yan noon. Narinig ko lang ‘yan nu’ng presidente na si Noynoy Aquino.”“ Kung ipaglalaban sa court, tapos may witness na pupuntahan yung shoal, at kung hindi pa nila giniba ‘yong corals du’n, sigurado nandoon pa ‘yong concrete monument,” he stressed. “That would physically locate the boundary of the Philippines. Ex-president” Rody Duterte’s defeatism saddened Yglopaz: “He shouldn’t have publicized that we can’t fight China because it is strong and we are weak. TIME is supersonic. On October 8 or 40 days from now, this administration, the most popular and biggest landslide winner in history, will be crossing its 100-day Rubicon of public opinion. Are the public getting what they expected from President Bongbong and his chosen alter egos in the Cabinet in the past 60 days? Maybe, it is too early and quite unfair to judge him in just two months, but in this country, the President presence must be felt with impact. I remember former Pres. Duterte making explosive moves within his first 60 days. He named local officials, court judges and police generals involved in the illegal drug trade. Also in September, he declared a state of lawlessness in the whole country that took effect for one year. His first 100 days was bloody and fearsome that more than 732,000 addicts and drug dealers nationwide voluntarily surrendered. A large-scale display of presidential bravado that led to record-low crime incidence and widespread public appreciation.Today,we hear Senators naming smugglers of white onion, garlic, fish, and rich sugar hoarders who connive with multiconnected syndicates inside the Dept of Agriculture, Customs that conspire to manipulate the supply situation and jack up prices. There was public outcry, but will Malacañang allow these people to continue their ways in the coming 40 days? Looking back, the biggest news event of BBM’s administration to this day would only be his economic road map on both the June 30 inaugural speech and July 25 SONA. Everything was aspirational, hopeful but takes time and needs congressional approval. Yes, those speeches were spectacular and much awaited, but remember they were never thoroughly discussed during the campaign. Now that 60 days passed, PBBM would rather work silently, meets his Cabinet twice or thrice a week, gain consensus from stake holders and veer away from Duterte’s bombastic style. In the meantime, people are suffering from high prices. Inflation rose 6.4 percent in July from 6.1 percent in June and still going up. BSP governor Felipe Medalla says these price increases are 80 percent imported, consistent with worldwide supply of oil, and food aggravated by the war in Ukraine. But we cannot forget PBBM’s own admission of the nation’s shortages of rice, corn, pork, poultry, or fish and of fertilizers. This was even prior to the brouhaha at the Sugar Regulatory Authority (SRA) and now there are shortages in white onions, garlic, salt, and many other products, that are obviously the handiwork of unscrupulous traders. Yes, there were much publicized raids of warehouses and the discovered contraband. But were appropriate cases filed or about to be filed? Was anti-hoarding, anti-price control or economic sabotage cases charged against these traders? None that we know of. Quite honestly, BBM’s past sixty days, to many Filipinos who voted for him, is a big hohum. We acknowledge that he would never be like Duterte but, many are awaiting to see his decisiveness on serious public issues.Ifirmly believe though, that in time, BBM will get his acts together and show to the people the kind of real leadership and succeed for greater benefit of our country in the next six years.

TOURISM is an important economic driver for the Philippines, and with each change of administration, the new tourism secretary and the Department of Tourism (DOT) launch an enthusiastically ambitious plan to attract more visitors to the country and expand the tourism sector. ManilaTimes.net photo The current DOT under Secretary Ma. Esperanza Christina Garcia Frasco is no different, but faces much tougher challenges than its predecessors. In order for its tourism strategy to be successful, the DoT and tourism stakeholders will need to be keenly aware of market conditions and adjust their plans to match. Some of those challenges were revealed in a webinar on Thursday, September 1 presented by the economic analysis and advisory group Oxford Economics and the International Air Transport Association. The current reality and medium-term prospects for the air travel industry were laid out in detail and they are somewhat discouraging. Global economic conditions are not conducive to air travel growth, Oxford Economics analyst explained. Although the global economy actually contracted in the second quarter, it does not seem to be getting worse; inflation and commodity prices, except for a few exceptions (the Philippines may be one of them), peaked around April and are slowly declining. However, the world economy does not yet seem to be getting better. Consumer sentiment continues to decline, and with it, consumer discretionary spending; as a result of this and other factors, forecasts for economic growth over the next two years are modest. As far as the air transport sector is concerned specifically, an initial spike in passenger demand following the lifting of most restrictions around the world has flattened out, with demand overall still at least 20 percent below the pre-pandemic 2019 levels. Domestic demand is recovering slightly more quickly than international demand, but both are lagging, and the Asia-Pacific region is experiencing the slowest recovery in the world. Much of this is due to the cooling economy in China, which has been affected by general economic conditions, a series of localized pandemic lockdowns and a severe drought across much of the country. Globally, the long-range forecast for growth is about 2.4 percent, but air travel demand is not expected to return to 2019 levels until sometime in 2024; domestic demand might recover by mid2023, with international demand getting back to prepandemic levels by late 2024. Here in the Asia-Pacific region, the full recovery is not expected until 2025, with domestic demand returning to its previous level a bit sooner than international demand. So, what does all this mean for tourism planning?

Commuters avail of QC hall’s LIBRENG SAKAY going around its business districts.Inprevious columns, I noted that elementary, high school , senior high and college students of public schools in Makati, Pasay, Paranaque, Taguig and and Manila receive monthly allowances.Iammentioning all of these because they are laudable and selfless initiatives of government leaders to fully serve people in these hardest times. DOT o ers incentives to OFWs who bring guests
This is aside from the plan to open 10 “tourist service rest areas” across the country, which should make it easier for differently abled persons to enjoy their stay in the Philippines. Tourism Secretary Christina Garcia-Frasco, who presented the agency’s proposed budget for 2023 during deliberation at the House of Representatives last Wednesday, said the incentive program for OFWs, dubbed as Bisita Be My (BBM) Guest Program, would be launched this year.Under the program, OFWs who bring guests to the Philippines will get a chance at the raffle prizes offered by the agency. “We will be providing them with a travel passport they can use to go across key destinations, get stamps, and claim a prize at the airport; this will also give them a privilege card that would provide them with discounts in accredited establishments across the country,” Frasco said. The DOT will partner with other agencies, including the Department of Migrant Workers, in implementing the BBM Guest Program.Frasco disclosed the DOT’s plan to develop the Tourist Lifecycle App, which would also show data like how long a tourist could stay in a particular tourist spot and how much to spend. DOT plans to open 10 “tourist service rest areas” across the country, which will feature tourist information centers and pasalubong centers as well as facilities for disabled persons. “These areas will serve the travelers in need of accommodation, information, safety and security,” Frasco pointed out. The programs, she added, include plans to improve land and sea tourist facilities and prioritize the health and safety of tourists.During the budget hearing, Frasco asked for P3.573 billion to fund the DOT, Intramuros Administration, National Parks Development Committee and the Philippine Commission on Sports Scuba Diving, which is currently transitioning as a DOT-attached agency.

It will also launch this year a mobile application to make it easier for tourists to connect with accredited “tourism establishments for accommodation, food, shopping, rides to accredited transportation, tour operators, and tour guides.”

Education, health and wellness and employment were the next-ranked concerns that came out in the survey. The poll likewise indicated that 79 percent of the respondents are satisfied with the action plans of the government regarding the coronavirus pandemic, while 56 percent are still worried about the resumption of face-to-face classes.Italso revealed that at least eight out 10 Filipinos agree on continuing the platforms of the previous Duterte administration, such as the Build, Build, Build program (including the underground subway project), independent foreign policy, and the war on drugs. The mobile-based survey was conducted with a confidence level of ninety-five percent with a 2.829 percent margin of error. The survey respondents proportionately represent the following areas nationwide: 12 percent from Metro Manila, 23 percent from North & Central Luzon, 22 percent from Southern Luzon, 20 percent from Visayas and 23 percent from Mindanao. EMS: If a parent tests positive for COVID-19, should they isolate themselves as well as their children? How often should parents test their children for infection? Dr. Priya Soni: If a parent tests positive for COVID-19, they should try to wear a mask and do their best to practice good hygiene measures at home in efforts to prevent spread. At minimum, you should try to use separate bathrooms, if possible, and try to stay at least more than 6 feet apart, as much as possible. It’s wise to avoid sharing personal items such as eating utensils, drinking cups and pillows. When a parent who is positive is caring for a younger child who cannot be left alone, I recommend wearing a well-fitted surgical mask and regularly sanitizing surfaces and washing your hands when interacting with your child. If you are breastfeeding, you can continue to do so, just make sure you’re wearing a mask when interacting with your baby. Quarantine is no longer recommended for children that are exposed to COVID-19. Parents should follow CDPH recommendations to self-isolate and test as soon as possible to determine infection status. EMS: If there is an outbreak at a school site, would you recommend that children stay home for a few days, even if they themselves test negative? If your child is positive, when can they safely return to school? Dr. Priya Soni: If there is an outbreak in your child’s classroom, but your child is vaccinated and asymptomatic, they may still be able to stay in school and attend with a mask in place. Follow the school’s guidance on this. If your child develops symptoms, while on campus, while wearing a mask, there may be on-site testing available at the school. If the school is unable to provide onsite testing right away, the child should be sent home right away. If your child does test positive after a school related outbreak or classroom exposure, they should stay at home and be excused from school until at least five days from symptom onset or test positivity. If your child has no symptoms or symptoms are resolving, they may end isolation after day 5. If they had symptoms including fever and cough, they should return after day 5 when fever-free for at least 24-hours (without the use of fever reducing medication) and their symptoms are improving. Once your child has ended isolation after at least day 5, they should continue to wear their mask at school through day 10. If parents have access to antigen tests, they may consider testing their child towards the end of their illness. According to the two companies’ reports, the market action index (MAI) in cities/ towns like Las Vegas, North Las Vegas, Pahrump, Boulder and Henderson, while still slightly in a seller’s market, have been on a downtrend.InPahrump, which is located 67 miles west of Las Vegas, the MAI stood at 31 as of August 31, which is still just about in the seller’s market, and dropped by a point off the previous month’s index. The median list price in Pahrump stood at $432,00, with the median price of new listings pegged at $387,000. The price per square foot stood at $218. On the average, properties stood in the market around 73 days, and inventory stood at a 7-day average of 236, a slight increase over the previous’ period’s average of 232. In Las Vegas, considered as one of the entertainment and gambling hotspots in the world, the MAI decreased by six points, from 44 to 38, in the September 1 report. While still slightly in seller’s market territory, there have been more homes available and less demand from buyers resulting in lower prices. The median list price of homes has gone down to $510,000, with the median price of new listings pegged at $475,000. Price per square foot is at $263. Properties on the market sat an average of 65 days, with the inventory having a 7-day average of 5,219 (as compared to 4,964 in the previous month). The same story has unfolded

in the North Las Vegas area. While still in a seller’s zone, the MAI has fallen about eight points month-to-month, from 51 to 43. According to the report, prices have plateaued for a while, with the median list price hovering around $448,495 and new listings having a median price of $429,950. Per square foot price is at $236, with inventory increasing to a 7-day average of 962, over the previous month’s average of 851. On average, listings stayed in the market around 54 days. For Henderson, the MAI fell down to 37, from the previous month’s figure of 42. Similar to Las Vegas, the market has been in a cooling off period in the last several weeks, with more homes becoming available and less demand from buyers. The area is still slightly in a seller’s market. The median list price went down slightly to $598,000, with new listings having a median price of $574,950. Price per square foot is pegged at $280. Inventory in the area was at a 7-day average of 1,453, slightly up from last month’s average of 1,353. Finally, in the Boulder City area, there is a dip of 6 points in the MAI, from 36 to 30 monthto-month. The median list price is pegged at $699,000, with new listings having a median of $517,500. Inventory slightly increased to 71 (7-day average) in the area, with square footage price pegged at $318. Prices have remained relativelys table in the area, according to the reports, but it is likely that there will be downward pressure on home prices if the MAI continues to stumble and there’s a growth in inventory. As of now, the area’s MAI is almost at the border between seller’s and buyer’s markets, but still said to be slightly in seller’s market territory.Although the areas mentioned are still in said to be in seller’s market, the increase in inventory has allowed many buyers to find more properties to their liking and they are able to negotiate more with sellers, unlike last year and even early this year when some buyers had to be put on a waitlist just to take a look at a property.However, real estate prices in the state are still at lower levels when compared to some areas in the country, which is why more and more people are looking at living in Nevada due to more reasonable home and land prices. Unemployment has also been trending downward in the state, which may mean more money or income for people to put into a home if they intend to purchase one.A look at all the projects being planned in Las Vegas and neighboring communities shows continued interest in the area. But before her retirement, Melette Lampino’s public service experience includes 42 years of California State service as a Public Health Chemist and Environmental Scientist; member of the Cerritos City Economic Development Commission, where she also served as a former Chair and Vice Chair; and the City of Cerritos “Let Freedom Ring” Committee for four years. Melette has called the City of Cerritos home since 1975. Another significant turning point in Melette’s life was when she was “born again” in 1985. But debtors with too much debt, in reality, are the modern-day Sisyphus. ‘Busting out of debt’ To break out of the debt cycle, or in bankruptcy slang, the Chapter 7 “bust out” of debt allows debtors to petition the court to grant relief from debt by “discharge” of debt by court order. The discharge order prohibits the creditor from collecting the debt, in effect wiping it out. But what debts are discharged and what debts are not discharged? Dischargeable debts The bankruptcy code states that a debt is dischargeable, unless it is excepted from discharge. §523 of the bankruptcy code contains a list of debts, which are not discharged. Generally speaking, most debts are discharged. For example, credit card balances up to any amount, medical bills, unpaid rents, payday loans, any kind of unsecured or secured loans or credit lines, bank loans, utility bills, car loans, and even home mortgages are discharged in Chapter 7. Even hundreds of millions of court judgments for the collection of debt are wiped out. Non-dischargeable debts What kinds of debts are not discharged? Child support, alimony, student loans (unless 3 prong test of hardship is proven in an adversary proceeding), HOA for the house where you live (not HOA for your rental property which is dischargeable), damages caused by intentional torts (willful intent to cause damage to the person or property is proven, income taxes owed where the requirements for discharge are not met (income taxes are dischargeable if specific requirements for discharge are met.)Therefore, if you have too much credit card debt — for instance, you owe $40,000 of credit cards, a judgment for unpaid rent of $200,000, owe $1 million to the casino in Pechanga, owe a $2 million in a civil lawsuit, say for breach of contract — a Chapter 7 discharge will wipe all of your debts away. But if you owe $300,000 of student loans, unless you can prove hardship under the three-prong test in an adversary proceeding, you are stuck with the student loans until you die, unless Uncle Biden gives you a way out of it. * * * Disclaimer: None of the foregoing is considered legal advice for anyone. The Petitioner’s attorney gets paid a statutory rate for attorney’s fees commencing with 4% of the gross estate. The probate referee will have to be paid for appraising the assets of the estate. If it is necessary to post bond, the premium on the bond would have to be paid as well. A PERSON who obtains his/ her green card via marriage to a U.S. citizen spouse, and who is married for less than 2 years has conditional permanent resident status. A conditional permanent resident has a green card that is valid for 2 years.Inorder to continue to have permanent resident status after 2 years, the conditional permanent resident and his/ her US citizen spouse must file an I-751 Petition to Remove Conditions on Residence during the 90 days before the expiration of the green card. 8 CFRBut216.4(a)(1)whatif things don’t work out with the U.S. citizen spouse after getting married, and the conditional permanent resident can no longer get the participation of his/her US citizen spouse in filing the I-751 petition? In such a case, the conditional permanent resident may seek an I-751 waiver of the joint filing requirement. In order to qualify for an I-751 waiver of the joint filing requirement, the conditional permanent resident must show that the marriage upon which his/her status was based was: 1) entered into in good faith, and 2) terminated. 8 CFR With216.5(a)(1)(ii)respecttothe required showing that the marriage was entered into in good faith, the conditional permanent resident must show that his/her marriage was not a “sham.” A marriage is considered a “sham” if, when they married, the couple did not intend to establish a life together. An intent to obtain something other than or in addition to love and companionship (such as a green card) from that life does not make a marriage a sham. Matter of Soltan, A76 888 125 (BIA 2001). Documents such as joint bank and credit card statements, and photos that demonstrate that the marriage was entered in good faith should be presented.

THE constitution of the United States of America allows bankruptcy to its citizens and residents to allow them to become productive again if they are saddled with accumulated debt. The Supreme Court calls Chapter 7 bankruptcy a “the fresh start.” You may have good income but debt repayment could be eating up all of your disposable income. In this case, you are compared to Sisyphus, the character in Greek mythology who is condemned to roll a rock up to the top of a mountain, only to have the rock roll back down to the bottom every time he reaches the top. The debtor with too much debt is the same as Sisyphus because no matter how much his income is, he pays his minimum required payments each month, left with no disposable income every month, only to have to pay out the same amount to his creditors next month and forever, leaving nothing for the debtor himself in savings. THINKING about one’s demise is not something people want to spend time thinking about. However reality is that we all have to face this one day. It is just a matter of whether you depart this world prepared or unprepared. If you pass away with at least $184,500 in gross assets and you do not have a living trust (even if you have a will), your beneficiaries would have to open up a probate case before title to the assets can pass to them. When I say gross assets, I mean regardless of how much debt you owe on them. For example if you own a house valued at $350,000 at the time of your death, it does not matter that your mortgage balance is $300,000, a probate case has to be opened in order to pass title to that property. The same is true with other types of assets such as owning a business, a professional practice, bonds,

People with little credit card debt had no other choice but to borrow, hoping that “when things get better”, they can just pay it all back slowly. Of course, this is nothing more than a temporary solution that could backfire if the additional debt is not paid back. At some point, the credit lines are exhausted, and they are in a deeper financial hole that is hard to get out of. I know this sounds discouraging when you’re clueless about where to turn once you have exhausted your resources. But there is hope. If you are currently facing a financial crisis, it may be tempting to just throw in the towel and give up all hope for a better financial future. But let me tell you that instead of getting frustrated and angry about things that you cannot control or change, your energy will be better spent focusing on finding a solution. On the other hand if you have a living trust, your estate can avoid the entire court system and court supervision. In certain situations, the process may also save you estate taxes which may be substantial if your assets exceed a certain threshold. Basically, you and/or your spouse can be named as the initial trustee of the trust while you are alive. The trustee is the person who manages the trust. This means you retain control of all your assets the same way as if you never had a trust. For revocable trusts, you can later on, at any time during your lifetime, revoke the entire trust if you change yourThemind.assets held in your living trust will be managed by the trustee and distributed according to your directions without court supervision and involvement when you pass away. This can save your heirs time and money. Since the trust would not be under the direct management of the probate court, your assets and their value and your beneficiaries’ identities would not become a public record. Your heirs and beneficiaries would still have to be notified about the living trust and advised, among other things, of their right to obtain a copy of the trust. If you are contemplating setting up a trust or have an existing trust that needs to be updated because your family circumstances have changed over the years, you should set an appointment with an experienced attorney that understands and can competently advise you in the law.
Also, in order to qualify for an I-751 waiver of the joint filing requirement, the conditional permanent resident must show that the marriage was terminated. By “terminated,” the USCIS requires a valid, formal divorce judgment. An I-751 waiver of the joint filing requirement cannot be approved in cases where the conditional permanent resident is legally separated or in divorce proceedings that are still pending. Also, once the marriage is terminated, the conditional resident may file the I-751 petition immediately, and does not have to wait until the normal 90 days before the expiration of the conditional green equities,card.etc.
