Itshouldalsobeobserved atthebeginningthatthe threequestionsarenot,as hasbeensuggested,symptomaticofcriseswithinthe Church.

Bishops'Role
Thequestionoftheroleof bishopswastreatedfrequentlyandatlengthinmany ofthepastorallettersof thebishopsoftheworldin thethreeyearsbeforethe council. Ithaslikewise beentreatedinbookform: notablybyArchbishopEmile GuerryofCambray,France ("L'Eveque,"LibrarieArthemeFayard,Paris1954).

Religious
Exemption
ThequestionoftheexemptionofReligiousrefers tothatprovisionintheCode ofCanonLaw(art.251) whichplacesreligiouscommunitiesandsocietiesunderthejurisdictionofthe SacredCongregationofReligiousoftheChurch'scentraladministration, and thereforeremovesthemfrom thejurisdictionofthebishupsofdiocesesinwhichthey mayreside.
Whenthisitemappeared inthebulletinoftheCouncilPressOffice, reporting thepresentationoftheprojectforthecouncil'sagenda, suchphraseswereusedas "newrequirementsandsituations.'and"missioncountries."Thebulletindidnot givedetailsontheproject, butthephrasesusedpromptedonetoimaginevarious problemsthatmighthave arisen.
Inmissionterritories,for example,onemightimagine howasocietyofReligious hadworkedformanyyears andintimedevelopeda thrivingChristiancommunity.Induecourse,abishopmightbenamedinthe missionterritoryandmight findthatthegreatermajorityofhispriestsbelonged totheReligioussociety.The problemisobvious:hewould havenojurisdictionoverhis ownpriests.
Incarryingoutitsmission ofteachingandsanctifying, theChurchhasalwaysrequiredthecooperationofthe diocesanclergy,whoaresubjecttothebishopoftheir diocese,andtheregular clergy,whoaresubjectto thesuperioroftheirorder.
Ontheotherhand,the Religiousisboundtopursuethespiritualprogramme andthespecialworkswhich characterisehisorherparticularcommunity.
Thequestionarises, then, howtocoordinatethejurisdictionandauthorityofthe bishopinhisdiocese, the loyaltyoftheReligiousto theirownparticularideals andtheexerciseoftheir rightsinsuchamanneras toproducethebestcollaborationbetweendiocesanand regularclergy.
Manyoftheimportant questionsinvolvedarealreadytreatedingreatdetailincanonlaw.Butthe 'newrequirementsandsituations,"asindicatedbythe CouncilPressOfficebulletin, callforrevisionsandclarifications,bothforthewelfareoftheReligiousand forthegreatereffectiveness oftheapostolateofthedioceses.
ThefirstcaseofexemptionofReligiouswasinstitutedbyPopeGregorythe
1300YearsOld
Bythe12thcenturyall themonasterieshadobtainedexemptionandthenonmonasticreligiousorders followedtheirexample.But theprivilegewasusedabusivelyinsomeinstances. Restrictionswereincorporatedintothelaw,therefore.bytheCouncilofConstance(14141,bytheFifth LateranCouncil11512)anti bytheCouncilofTrent (1545).
Thelatterpromulgateda generallawwhichindicated thelimitsofexemptionso thatitwouldnotinfringe upontheauthorityofthe bishops.ThiswaslaterincorporatedintotheCodeof CanonLawtogetherwith variouspapaldecreesthat followedit.
