TWOWOMENLAWYERSdiscusstheprogressof women'srightsoverthelasthundredyears.

THELAW andthe STATUSOFWOMEN

"INTHENINETEENTHCENTURY,theprevailingviewofwoman, theviewwhichwasreflectedinherlegalposition,wasthatshewas mentallyinferiortoman,weak,foolish,susceptibletoinfluence, andconstantlyinneedofprotection,"saidRoseHeilbron,Q.C., oneofBritain'sleadingwomenbarristers,inadiscussionbroadcastintheB.B.C.GeneralOverseasServiceabouttheimportanceof lawindifferentpartsoftheworldinestablishingthestatusofwomen.

INBRITAIN.Miss Heilbronsaid,atthe beginningoftheVictorianeraawoman-particularlyamarried woman-wasconsidered inlawtobelittlebetter thanachattel..

"Herhusbandhadthe righttodemandabsolute obedience,andifsherefusedtolivewithhimin theplaceofhischoicehe couldadministerforce.

"Herproperty,witha fewunimportantexceptions,andevenherearnings,becamehis;his rightsoverthechildrenof themarriagewereabsolute,andhersnonexistent."

Ifsheventuredtoleave acruelhusband,notonly didherpropertyremaininhispossession,butshe hadnorighttoseeher children.

MissHeilbronthought thatthepositionhadbeen neatlysummedupina 19thcenturywillinwhich thegeneroushusband wrote:leavetoJoanna Smythe, mydearlybelovedwife, thesilver candlesticksgiventoher byhermotheronour weddingday."

In1839,MissHeilbron said,themotherhadobtainedtherightofaccess toherinfantchildren,and therightofcustodyto thosounderseven,and thusoneofthemainreasonswhichhadforceda wifetolivewithaviolent husbandhadbeenremoved.

Women'srightsingen- eralhadbeguntoimprove inaboutthemiddleofthe century,andin1882had comefullrecognitionof marriedwomen'sproperty right.

In1891ithadbeenlaid saw

Andin1935thelast remnantsoftheoldlegal fictionthatawomanon marriagebecamemerged inthepersonalityofher husbandhadbeenswept away, whenthemarried womanhadbeengiven fullcapacitytosuefor civil minorwrong(except, with herexceptions, tosue husband).

Withlegalequalityhad comeachangeofheart duringthelasthundred years,MissHeilbronsaid, butonlyasaresultofa longandverybitter strugglebypioneers, both menandwomen.

Inherview,women's positiontodaywastheresultoftheattainmentof legal theequality,education, franchiseandtheemploymentofwomen;and legalequalitywasthe basicfactor.

MissKamilaTyabji, whohasmadeaclose studyofMohammedan Lawandwasthefirst womantopleadasalawyerbeforethePrivy Councilwhenitwasthe SupremeCourtofthe Commonwealth, agreed aboutthecontributing factors, butcouldnotattachleadingimportance tolegalequality.

IntheEast,shesaid,ithadbeenfoundthatthe womenwhogotintodifficultieswerethosewho didnotknowtheirrights,andshewouldtherefore placefirstsocialawareness-aself-confidence thatenabledthemtoenforcetheirrightswhere necessary.

MissTyabjifeltthatthe traditonalsystemofseclusionofwomeninthe East,sadasithadbeen inmanyways,hadhad somegreatadvantage's.

Womenhadbeencalled upontoexercisemany rightsandresponsibilities; theyhadalwayshadto for ModernHairStyling byMastersoftheArt/ Representativesof \ NTERNATIONALE DECOIFFURE \--,?CURDAMES-

Thishadfittedthem particularlyforsocial welfarework, andinthe Eastitwasamatterofthe rncndraggingwomen forwardforsuchwork, ratherthanofholdingthembackashadbeen thecaseintheWest.

Theideaofworkingfor pleasurewas,MissTyabji thought,afairlyrecent growth.Intheolddays menhadhadtoworkfor food,andwomentokeepthehomegoing;she thoughtitinaccurateto viewwomenashavingbeenundersubjectionfor thousandsofyears.
