Dr.Burtongoesontoclaimthatconservative governmentsfearsocialismbecauseithasbecome arealthreattocapitalismwhichislosinggroundtechnically.Hencecapitalismhasbeendrivento confoundthepublicmindbyidentifyingsocialism withcommunism.That,ofcourse,issimplyuntrue, becausesocialiststhemselvesopenlyconfessthatthe onlypointofdeparturebetweenthetwosystems isonthequestionofmethod-revolutionversus gradualism.So,saysDr.Burton,Labour'sproblem istoprogresstowardsocialismbyparliamentary means-"bywinningelectionsandbybringingaboutchangebylegislation."
Thesnagaboutthispropositionisthatthepresi- dentoftheFederalA.L.P.executivewenttothe troubleofproducingastatementinwhichhesaid Labourwasjustnotinterestedinwinningelections. Andwhatismoreominoushisinterventioninthe domesticpoliticalaffairsoftwoStateshasshown conclusivelythatMr.F.E.Chamberlainhasno patiencewhateverwithdemocraticprocesses.So farasheisconcernedtheLabourPartyisnotgo- ingtogetwhatitwantsbutwhatheconsidersgood forit.PerhapsthatmajordivergenceofviewsexplainsthesomewhatpatronisingforewordMr. ChamberlainwroteforDr.Burton.
Inthisrespecttherearisesaratherhumorous contretemps,becauseafterdismissingverylightly the"absenceofsomefreedomsandtheexistence ofrepressioninRussiaandinChina,"Dr.Burton quoteshisoldfriendColeinsupportof"freedom fortheexpressionofdivergentopinions"and"free- domtoorganiseforthefurtheranceofsuchopin- ions."Allthismustmakeuncomfortablereading forMr.Chamberlainaftertherecentsummaryex- pulsionsofleadingA.L.P.personalitiesandhissup- pressionoftheIndustrialLabourOrganisationsin N.S.W.
But,ofcourse,allthissuppressionischangingin communistcountries,accordingtotheeagleeye ofDr.Burton.Theyareheadingintotherarefiedatmosphereofdemocracy.Evenifthatwere trueitwouldstillbeperplexingtoexplainhow itisthatLabour,sofarfromfollowingitsprototype, isheadingstraightintothearmsoftotalitarianism. ItwouldreallyseemfromDr.Burton'simaginative narrativethatthepoliticalsystemsarelikecontagiousdiseases.CommunismhascontracteddemocracyfromcontactwiththeWest,whileatleast sectionsofthedemocracieshavebecomeinfected withcommunismoranalmostundistinguishable virus.FormypartIfearthatthelatterthesis isalltoohorriblytrue.
Inviewofhisfriendlyandmutualexchange ofmorbiditiesDr.Burtonbreezilyproposesfurther contagionatleastonourside.Socialistsoughtto make"co sible"-existencepracticalandco-operationpos(honestly,ofcourse).Nowifoneisnot drivingametaphorintotheground,thelearned doctoroughttobewarnedthatsmalldosesofmorbidinfectiontendtobuildupanimmunity(Ifancy thatistheprincipleofagoodmanypreventiveinnoculationsinmodernmedicine).Butafulldose doesn'tleadtothefriendlyintercourseofviruses andantibodiesbuttoachangeinthephysicalmakeupofthepatienttoyieldtotheinvadingvirus.Socialismandcommunismarenotintherelationship ofvirusandantibody,butofavirulentgermagainst averysicklyonewhichhaslongceasedtoinfectoraffectthebodypolitic.

Apleasuredeferredhasbeenaconsiderationof ofDr.JohnBurton'sbooklet:"TheLightGlows Brighter."Inthesectionsinwhichhediscusses"democraticsocialism"anditsrelationshiptocom- munismthegenuinekidneyoftheman(perhaps unknowingly)isdisclosed."Theworldsituation,"he writes,"demandssocialismofus,whetherwelike itornot.Wecannotsurviveunlessweeffectively meetthegrowingcompetitionofthesocialistand plannedeconomies."InmysimplicityIcastabout forexamplesoftheseplannedsocialisteconomies andforthelifeofmeIcanfindnothingwhich fitsthebillunlessitbetheSoviet.Andifthat bethetruth,IdonotnoticetheAmericansquail- ingunderthethreat,althoughitmustbeade- cidedadvantageinsocialistcompetitiontohave somuchslavelabourfromtheoppositionandsweat- ingfromyourown.Forallthatthedemocracies appeartobesurviving.
Dr.Burtongoesontoclaimthatconservative governmentsfearsocialismbecauseithasbecome arealthreattocapitalismwhichislosingground technically.Hencecapitalismhasbeendrivento confoundthepublicmindbyidentifyingsocialism withcommunism.That,ofcourse,issimplyuntrue, becausesocialiststhemselvesopenlyconfessthatthe onlypointofdeparturebetweenthetwosystems isonthequestionofmethod-revolutionversus gradualism.So,saysDr.Burton,Labour'sproblem istoprogresstowardsocialismbyparliamentary means-"bywinningelectionsandbybringing aboutchangebylegislation."
Thesnagaboutthispropositionisthatthepresi- dentoftheFederalA.L.P.executivewenttothe troubleofproducingastatementinwhichhesaid Labourwasjustnotinterestedinwinningelections. Andwhatismoreominoushisinterventioninthe domesticpoliticalaffairsoftwoStateshasshown conclusivelythatMr.F.E.Chamberlainhasno patiencewhateverwithdemocraticprocesses.So farasheisconcernedtheLabourPartyisnotgo- ingtogetwhatitwantsbutwhatheconsidersgood forit.Perhapsthatmajordivergenceofviews explainsthesomewhatpatronisingforewordMr. ChamberlainwroteforDr.Burton.
Inthisrespecttherearisesaratherhumorous contretemps,becauseafterdismissingverylightly the"absenceofsomefreedomsandtheexistence ofrepressioninRussiaandinChina,"Dr.Burton 'quoteshisoldfriendColeinsupportof"freedom fortheexpressionofdivergentopinions"and"free- domtoorganiseforthefurtheranceofsuchopin- ions."Allthismustmakeuncomfortablereading forMr.Chamberlainaftertherecentsummaryex- pulsionsofleadingA.L.P.personalitiesandhissup- pressionoftheIndustrialLabourOrganisationsin N.S.W.
But,ofcourse,allthissuppressionischangingin communistcountries,accordingtotheeagleeye ofDr.Burton.Theyareheadingintotherarefiedatmosphereofdemocracy.Evenifthatwere trueitwouldstillbeperplexingtoexplainhow itisthatLabour,sofarfromfollowingitsprototype, isheadingstraightintothearmsoftotalitarianism.
ItwouldreallyseemfromDr.Burton'simaginative narrativethatthepoliticalsystemsarelikecontagiousdiseases.CommunismhascontracteddemocracyfromcontactwiththeWest,whileatleast sectionsofthedemocracieshavebecomeinfected withcommunismoranalmostundistinguishable virus.FormypartIfearthatthelatterthesis isalltoohorriblytrue.
Inviewofhisfriendlyandmutualexchange ofmorbiditiesDr.Burtonbreezilyproposesfurther contagionatleastonourside.Socialistsoughtto make"co-existencepracticalandco-operationpossible"(honestly,ofcourse).Nowifoneisnot drivingametaphorintotheground,thelearned doctoroughttobewarnedthatsmalldosesofmorbidinfectiontendtobuildupanimmunity(Ifancy thatistheprincipleofagoodmanypreventivein- noculationsinmodernmedicine).Butafulldose doesn'tleadtothefriendlyintercourseofviruses andantibodiesbuttoachangeinthephysicalmakeupofthepatienttoyieldtotheinvadingvirus. Socialismandcommunismarenotintherelationship ofvirusandantibody,butofavirulentgermagainst averysicklyonewhichhaslongceasedtoinfectoraffectthebodypolitic.

ThesimplicityoftheearlyagesoftheChurch seemedtocometolifeagaininthepromptitude withwhichthefaithfulobeyedthebehestsofthe ministersofJesusChrist;andthelatterhadthe indescribablesatisfactionofbeingwitnessesofa visiblechangeintheconductandmannersoftheir flock.Fornotonlythepriestsbutalsothepublic functionariesrealisedarealreform,inthatpublic tranquilityhadceasedtobedisturbedinthecolony, andinthattherewasaremarkablediminutioninthe numbersofcrimes.
Itisafactthatachangeinthemoralsofonethirdofthepopulation(suchwasthenumberof Catholicsatthetime)couldnothavebeeneffected withouthavingasalutaryreactionontherestof thepeople.Deathsentencesandothercrimes graduallydiminishedeachyear,sothatifin1835, say,twenty-twocrimesmeritedsupremepunishment,inthefollowingyearthereweretwelve,in 1837sevenandsoonprogressively.
AsIhavesaidelsewhere,thecolonyofN.S.W. beingchosenbytheBritishGovernmentforthe transportofconvictseachoftheconvictships broughttwoorthreehundredoftheseunfortunate people,sothatfrom1835to1841,theycounted asmanyas18,000.Andyetinspiteofsuchnewcomers,theBishopsandhispriestsdidnotlose courage.However,seeingthattheharvestwasgreat andtheworkmenfew,hesenttoEuropehisworthy Vicar-General,DomB.Ullathornetoseekforrecruits.Atthistimetherecametojointheranks oftheclergyinthecolonytwopriests,Gooldand Brady,andsixmonthslaterFr.Murphywithfive priestsandtwostudents.Soonafterthesealso arrivedtheSistersofMercy.
ThejoyofthegoodBishopknewnobounds whenhesawthecrownofthedesiresofhisheart inthisreinforcementofzealousworkers.Hethen dividedhisdioceseintotendistricts,toeachof whichhesentanumberofpriestsinproportionto theimportanceofthepopulation,andtheSisters ofMercywereestablishednearthetownofParamatta,toattendtotheneedsofthelargeinstitutiontowhichtwelvethousandwomenhadbeen relegated.
TheCatholicreligion,thankstotheuntiring zealandcareofthepriestsblossomedagain,andwas propagatedinamannertobringgreatconsolation totheirhearts;andthemoralstateofthissociety keptpacewiththeadmirablechange.TheGovernor,SirR.Bourke,ongivingupofficedidnot failtobeartestimonyofficiallytothepersevering effortsoftheCatholicclergyinreformingadepravedpopulation,andalsotostatetheadvantages resultingfromthemtosocietyingeneral.
In1840theBishophadalreadynineteenpriests, ninechurchescompletedandsixunderconstruction, manychapelsandoratories,aseminarydirectedby sixpriests,withtwentyinternstudentsandmany extern;thirty-oneschoolsandtheconventofthe Sisterl4ofMercy.Therewere23,000communions and 0confirmations.
AnUrgentAppealFromTheSwanRiver
TheincreaseinthenumberofCatholics.the greatdistancebetweenthedifferentpartsofhis dioceseaswellasthefoundationofnewcolonies madetheadministrationofMgr.Poldingofsovast adioceseverydifficultifnotimpossible.Consequently,towardstheendof1840hesetsailfor RomeinordertorepresenttotheHolySeetheneeds ofhisVicariate-Apostolic. TheHolyFatheraccededtothewishesofhisgoodprelate,andforthe greatergoodofreligionhedividedthejurisdiction ofhisVicar-Apostolicintoseveralepiscopalsees; heerectedtheSeeofSydneyintothemetropolitan, andmadeMgr.PoldingArchbishopin1842.
intheneighbourhood,thereareProtestantministers whowithoutletorhindrancedisplaythereimportanceandtheirarrogance.InPerththerearetwo, inFremantleandinGuildfordone.Eachtowncan boastofoneortwoofthesegentlemenwhotake itonthemselvestoconvertthenatives,andeven tocauseCatholicstoapostatise.
HereitisdifficultforagoodCatholictokeep hisfaith,andsomehavealreadyfallenintothe netsetforthembytheProtestants.Buttheywill return,Iamsure,tothebosomoftheChurchifa favourableopportunityisgiventhem.Forallof usCatholicsourgreatest,orratherouronlyjoywill betohavethepowertobuildachurch,andtosupportincompetenceaministerofthetruereligion.
Meanwhile,VeryReverendFather,Ibegyou toconsiderthestateofourcountryandhavethe goodnesstomakeprovisionforthesalvationofour souls.

TheretheVicar-Generalwasintroducedtothe Governor,SirJohnHutt.Fr.Bradybeggedhim toassignedtohimasmallportionoflandonwhich tobuildachurch.TheGovernornotonlygranted hisrequest,butgaveittohiminthevicinityofthe Capital.Healsomadeagrantoflandforthesame purposeinothertownsinthecolony,promising moreovertocontributetotheconstructionofthe saidchurchesbypecuniaryhelpassoonaspublic fundsallowed.
Duringthetimethechurchwasincourseof construction,Fr.Bradysetoutfromthecapitaltowardstheeastofthecolonywiththeobjectof visitingtheCatholicsinthoseparts,assuringhimselfoftheirnumbersandawakeninginthemfervour inpractisingtheirreligiousduties.
InthemonthofJanuaryinthefollowingyear, 1844.withthesameobject,hetravelledthrough thedistrictssituatedtothesouthofhecapital.After thesevisitsthezealousmissionerthoughtitnecessarytogotoEuropetoinformtheHolySeeofthe needsofthisCatholicpeople.
Atadistanceofmorethan3,000milesfrom Sydney,andcommunicationwiththemetropolis beingofsuchverygreatdifficulty,itwasimpossible thatspiritualhelpcouldbegiventotheminproportiontotheirneeds.Soattheendoftwelve weekssojourninthecolony,Dr.Brady,leavingto histwofellow-workersthecareofthemission,set outon14thFebruary,1844,forBataviaandfrom thencetoRomewherehearrivedinNovemberof thesameyear.
Beforetheperiodunderconsideration,theBenedictineFatherD.JosephSerraandmyself,thecompilerofthesememoirs,hadbothgonefromSpain tothemonasteryofLaCava,situatedabouttwentyfivemilesfromNaples,bothofushavingtheintentionofdevotingourselvesentirelytomissionary workamongthesavages.

Afteralongconversationweproposedtooffer ourselvesferventlytoGod,askingHimtoenlighten USinamatterofsuchmoment.Thatnightnosleep cametous,somuchwereourthoughtstakenupwith themissiontotheblacks,withthedangersofthe enterpriseandwiththeconsolationwhichshould follow.Onthefollowingeveningwespokeagainof theresolutionswehadtakenonthenightbefore, andhavingfoundtheywerenotonlyfixedinthe affirmative,butstillstronger,andmoredetermined thanbefore,itwasdecidedamonstusthatweshould devoteourselvesforlifeandfordeathtothemissions amongstthesavages.
Withtheobjectofopeningourmindsonlytothe SacredCongregationofthePropagationoftheFaith, weaskedforamonth'sleavetovisitthecapitalof theChristianworld.Havingobtainedthepermission, wesetoutforRomeon26thDecember.Onthat day,wellbeforedawn,welightedtwocandlesin frontofthebeautifulanddevotionalpictureofOur LadyofPerpetualSuccourwhichIhadbroughtwith mefromSpain,andthere,onourknees,weardently recommendedourselvestothemercifulMother, SpouseandDaughteroftheAllMightyGod.Our prayersover,andalmosttrembling,wedeparted fromourcell.Finally,havingleftthecandlesburningbeforeOurLady'simage,earlyinthemorning wewereonourwayfromNoceraandonthefollowingdaywearrivedbyseaatCivitaVecchia.
TwodaysafterourarrivalinRome,ourmindsa preytoanxietyastowhetherweshouldknowfor certainthatwewouldbeacceptedforthemissions, wepresentedourselvestoMgr.Brunelli,thenSecretarytotheSacredCongregationofPropaganda,who havingwelcomeduswiththegreatestcordiality, askedustowhatparticularmissionwewouldlike todevoteourselves.Wetoldhimthatourvocation wasfortheconversionofthesavageracesinanypart oftheworldassignedtous.
WhiletheChurchintheEastwasprogressing underArchbishopPoldingandhisfellowworkers, theCatholicsofSwanRiverwhosincethefoundation in1829weredeprivedofchurch,altarandpriest, addressedthemselvestotheBishopofSydney, thinking,erroneously,thatMgr.Ullathornewassuch. WhoeveremergesastheinitialvictorofanotherwarbetweentheArabsandtheIsraelis,theSovietUnionwouldbe theultimatewinner.IftheIsraeliswhippedtheArabs,the NasserGovernmentwouldbereplacedbyapro-Communist, ifnotCommunist,governmentwhichwouldbefarmoreantiWestandanti-UnitedStates.
TheArabsbelievethattheycansurviveasablocof neutralistnations,alooffromtheEast-Weststruggledbspite theRussianwooing.Theyareapparentlyequallyconvinced theycancontinuetoliveinastateofneitherwarnorpeace withIsrael.TheIsraelisknowtheycannotliveindefinitely underthesecontinuingtensions,besetbyaboycottandsurroundedbyanArabworldcuttingthemofffromcommerce, whichforcesthemtorelyonfinancialsupportfromabroad andtobuildapermanentarmedcampoftheirsmallcountry.
TheWesternpositionhasseriouslydeterioratedthrough. outtheMiddleEast,France,pushedoutofMoroccoand Tunisia,desperatelyhangsontoAlgeria.Britain,humiliated inJordanbytheousterofGlubbPasha,isharassedin Cyprus,squeezedinBuraimi,andthreatenedinthePersian Gulfarea.TheUnitedStates,thehatedallyoftheimperialist powers,isthechampionofIsrael.AndRussia,thefoeof colonialism,hasemergedastheonlyfriendandsupporter oftheArabpeoples.
ThelossofMiddleEastoilwouldspellindustrialchaos forWesternEuropeandcripplethemilitaryforcesofNATO. AndwithouttherevenuefromherPersianGulfholdings, Britainfacesbankruptcy.TheusuallyreservedBritishhave becomefrightened,angry,andincreasinglydesperate.Britain seemstohavelosttheartofdiplomacyinwhichherinternationalservantscustomarilyexcel.Instead,theonceproud Empireblustersloudlyandfutilelywithtalkoffighting,if necessary,toholdtheoil.
ThetimeisripeforthePresidentandSecretaryofState toenunciateaconstructivesolution,spellingoutthespecifics suchashavebeenhereoutlined.WerethePresidenttomake atelevisionappealtothenationinbehalfofsucha"peace withjustice"settlement,hewouldbesurprisedatthesupport hewouldreceivefromJewandChristianalike.IfIsraelior

Theconflictbetweenlegal menandpsychiatristsin lawcourtsoverthequestion ofcriminalresponsibility arisesinpartfromthe limitedoutlookofbothprofessions.
Psychiatristsareinclined toadoptanattitudeofomniscienceandtotheorise ratherwildlyonsometimes slenderpremises.
Legalmentendtoignore theeffectofemotionsand unconsciousmotivesonone's actionsandtoassumethat wearemorerationalcreaturesthanwereallyare.
Conditionssuchasabnormalstatesofdepressionor epilepsycanabolishresponsibilityforone'sactions. Legaldefenceof"blackout"mustbescrutinised withgreatscepticismasit isaltogethertooconvenient andthegreatmajorityof suchdefencesarespurious.
ShockTreatment
Unfortunately psychoanlysishasprovedmore usefulinstudyinghow psychiatricsymptomsmight havearisenthaninhelping patientsgetridofthose symptoms.Thefactthata patientmayunderstandhow hissymptomshaveoriginateddoesnothelphimget ridofthem.
Physicalmethodsoftreatmentsuchastheso-called "shock"treatment(electric convulsanttreatment)have ingeneralprovedmoreeffective,particularlywith abnormalstatesofdepression.
Itshouldbemorewidely knownthat,thankstothe useofmodernanaesthetics, theterm"shock"treatment isamisnomer.Many patientsareterrifiedatthe thoughtofsuchtreatment butitcannowbegiven withmuchlessdiscomfort thantheaveragevisittoa dentist.
Psychiatristshavetended tomakeexaggeratedclaims fortheirabilitytocuresex offenders,claimswhich havenotbeenborneoutby practicalexperience.
Thereisneedforaninstitutionmidwaybetween thementalhospitalandthe prisonwheresuchoffenders canbekeptuntiltheyare regardedasnolongera menacetothecommunity. Suchaninstitutionhasbeen establishedinDenmarkand seemsthemostrationalapproachtotheproblem.
Mr.Toohey,indiscussing criminalresponsibility,said thatthereweretwoelements ofcriminaloffence-physicalandmental.
IntentionAndAct
Anactmustbeaccompaniedbyknowledgeofthe consequencestogetherwith theintentiontobringthem aboutorrecklessnessof consequences.
Aguiltymindalonewas insufficient-thenearest approachwasseditionbut anovertactwasrequired.
Thelawwasnotequally consistent,however,inrequiringthementalelement. Themoralists'problemwas thedemandfortheextensionofirresponsibility. Lawyerswereconcernedin thattoo,butalsowiththe tendencytoimposeliability, irrespectiveofmoralresponsibility.
ConflictingPressures
In"statutoryoffences" whereitwasdifficultto provethementalelement thepenaltywaslightand thedamagetothepublic greatbycomparison.
Itwasgenerallytrueto saythatwithseriousoffencesknowledgeandintentionwererequired.
Someexemptionsfrom responsibilitywerenotcommontoboththepsychiatrist andthemoralistandwould notbediscussed,forexample,mistake,infancy,compulsion.Thegreatestdifficultywasinthesphereof mentaldisorder.
Conflictingpressuresarose -ashumanitarianstheydid notwishtopunishascriminalsthosewhoseactswere
productsofaninsanemind; aslawyers,theydidnot wishtowithdrawthedeterrentforceofcriminallaw fromthosewhomightbe influencedbyitssanctions; ascitizenstheywereaware ofthestrongpublicdesire forretributionparticularly wheredeathwasinvolved.
Increasingknowledgeof psychiatryhadnotgreatly lessenedthatconflict.
Inpracticeadefencebasedonmentaldisorderwas onlyrelevanttohomicide wheretheissuewasincarcerationversusdeath.In theabsenceofthedeath penaltytheproblemwas notsogreat.
SanityPresumed
Theverdictof"Notguilty onthegroundofunsoundnessofmind"hadoriginatedinVictoriantimes.
"Insanity"wasthelegal termtodenoteirresponsibilityorincompetenceat laworliabilitytocommittal toaninstitution.Itshould notbeusedbypsychiatrists whoclassifiedsubjectsin termsofvariousclassificationsofmentalillness.
Thebasisoflawregarding insanityweretheMcNaghtenrules,i.e.,thepresumptionofsanityunlesstheaccusedwerelabouringunder adefectofreason,from diseaseofthemindsoas nottoknowthenatureand qualityoftheactorifhe didknowithedidnotknow hewasdoingwhatwas wrong.
PossibleChanges
Thoseruleswererepeated intheCriminalCodewith ratherdifferentwordingand extensiontocoverirresistibleimpulse.
Theaccusedwasnotresponsibleifatthetimeof theacthewasinsucha stateofmentaldiseaseor naturalmentalinfirmityas todeprivehimofthecapacitytounderstandwhathe wasdoingorofthecapa- citytoknowthatheought nottodotheact.
"Ought"asinterpretedby theHighCourtmeantmorallywrong.
Theoperationoflawevenwiththeinclusionof irresistibleimpulserulesleftmuchtobedesired.In itsformulationitwastoo narrow,initsoperationtoo elastic.
Whilejuriesweredirectedintermsofthelaw,their verdictwasreachedonthe
basisofmanyotherfactors, forinstance(asinaparticularlyatrociouscrime), e.g.,Haig,Heath,Griffiths. Juriesdidstretchthe rulesandinthatwayarrivedatsubstantialjustice.
Discussingwhatchanges mightbemade,Mr.Toohey saidthattheRoyalCommission,1953,suggesteditbe lefttothejury"todeterminewhetheratthetimeof theacttheaccusedwassufferingfromdiseaseofthe mind(ormentaldeficiency) tosuchadegreethathe oughtnottobeheldresponsible."
Suchadirectionwouldallowmorepsychiatricevidencetobepresentedand wouldnotputpsychiatrists intheimpossiblepositionof accommodatingtheirviews toalegalformula.

Moralist'sViews
Suchfactorswere,for example,inculpableignorance,abadenvironment, disordersofconstitutionor temperament,strongemotion,mentaldiseaseorderangement.
Itwasimportant,however,tobearinmindthat althoughstronglyinfluenced byvariousfactors,and thereforenotperfectlyresponsible,peoplecouldoften retainenoughself-controlto besufficientlyresponsible fortheiractions,and,moreover,theycouldberesponsibleforexposingthemselveswithoutexcusetothe influenceofthosefactors.

Psychologyhadcontributed,forexample,toour knowledgeofthechild,and psychiatrytoknowledgeof theabnormalpersonality.It seemedonlyrightandreasonablethatthecivillaw shouldtakethosefindingsintoaccount.
At altiesleastwheremajorpenwereinvolved,legal responsibilityshouldbear someproportiontomoralresponsibility.Discussionsof thatkindbetweenlawyers, psychologists,psychiatrists, andmoralistswerehighly desirablesincetherewere manymodernproblemsinvolvingpublicorder,the humanpersonalityandthe morallaw.

OntheirarrivalinPerth(viaAlbanyport)thepioneers weretakentotheirtemporaryresidenceinAdelaide-terrace. TheretheSistersofMercyofVictoria-square,havingeverythinginreadinessfortheirreception,werewaitingtogive themawarmwelcomeandanassuranceofhelpinevery need.Howthatkindlinessandencouragementcheeredthe new-cornersontheirfirstdayinAustraliacanwellbe imagined.
ItwasduringtheirstayintheTerracethattheterrible typhoidepidemicbrokeoutonthegoldfields,attheheight ofthegoldrush.AtarequestfromtheGovernortheBishop enlistedthehelpoffouroftheSisterswhowentinhaste totheaidofthestrickenminers.Theywerefollowedlater byothers,whenIrelandansweredthecallformorehelp.
Thehardshipsimposedbyconditionsexistinginthose earlygoldfielddaysaretoowellknowntoberepeated.But inthecanvas"hospital"runbytheSisters,nearmiraclesof healingwerewroughtbytheiradaptabilitytocircumstances. Inthefightforthelivesoftheirpatients,twoofthose devotednursespaidthesupremesacrifice.Asecondaryand primaryschoolwasalsoopenedatthisperiod-thefirst CatholicschoolontheEasternGoldfields.
Duringthepioneers'nearlytwoyearsresidenceinthe TerracethepresentsiteinSubiacowasgiventhembyBishop Gibney,andoniterectedaneighteen-bedhospitalofwood andironconstructionandasmallconventbuiltofwood. Thetwomodestbuildingsweresetinthickvirgingrowth andprovidedahappyhuntinggroundforsnakesandother reptilesfromwhichtheSisterswerealwaysonthealertto keepacivildistance.Theyhadneverseensuchthingsin theEmeraldIsle!
Contrastswereinevitable.Theyhadenvisagedbuildings andagarden-onamodifiedscale,ofcourse-ofapattern withthose"athome."AndtheywonderedwhattheBishop couldhavebeenthinkingofwhenhegavethemsomuch land(Someofthemlivedlongenoughtoappreciatehis Lordship'sforesight). Theseweresomeofthepioneers' reflectionsastheytookpossessionoftheirpropertyonthe hillbesidetherailwaylineinSubiaco.
However,these"NewAustralians"settleddownhappily andsoonfounddelightintheirsurroundings.Thescentof thegumtrees,thelaughofthekookaburra,andtheother joysofnaturewithwhichtheirhomeinthebushprovided themcompensatedformuchthatwasmissingintheirnew life.Theywerenowfullofzestfortheworkahead.
Theopeningofthelittlehospital,thefirstintheStateto berunbyreligiousSisters,wasquiteaneventand-for thosedays--drewalargecrowd.TheSisterswerethrilled andheartenedbythewarmexpressionsofwelcometheir presenceevoked,andlookedhopefullytothefuture.Their hopes,wererealised:Thelittlehospitalwaskeptbusyand, asti wenton,moreSistersfromIrelandcametotheir

NeverdidtheyfalterinthebeliefthatGodwouldprosper theworkHecalledthemtoaccomplish.
FortherewardoftheirtrustinDivineProvidencewehave to-daytheachievementsthathavedevelopedfromthefoundptiontheylaid.Thanks,too,totheProvidenceofGod,the increaseinpersonnelhaskeptpacewiththebuildingdevelopments-therearenownearly200SistersatSubiaco, manymorethantheoldchapelcouldaccommodate.
Buttheachievementsof60yearsarenotconfinedto Subiaco:BesidesthesixflourishinghospitalsinW.A.,there arethreeinVictoria,oneinNewSouthWales,andonein NewZealand,allfoundedfromtheparenthospitalin SubiacoandstaffedwithSistersimbuedwiththespiritof thepioneers.
NorweretheaboriginesoftheNor'-Westforgotten.As earlyas1907threevolunteerSistersfromSubiacofounded amissionatBeagleBay.TherearenowsevencentrescoveringavastareaintheNor'-Westwherethirty-nineSistersof St.JohnofGodconductorphanages,schools,hostels,hospitalsanda300-bedleprosarium-allforthepooroutcasts ofthecountry.
Manyoldfriendscanrecallthehumblebeginnings-the littlehospital,thepoorincommodiousconventandtheold churchnearby,usedasaschoolbytheSistersofSt.Johnof God,whowerefirstinthefieldtogivethechildrenof Subiaco,andsurroundingdistricts,asolidChristianeducation.
ManyoftheSisterswhotaughtinthatoldschoolare, happily,stillwithus.Inpassingitmightbementionedthat noschooleverturnedoutmoreloyalpupils.Itisexpected thatmanyofthemwillbepresentonthisjoyousoccasion andlookuptheiroldteachers.
Fromsuchlowlybeginninghasrisen,inthedesignsof God,themanyfinebuildingsofwhichthememorialchapelis thecrowningglory.Thecrossandpinnaclessurmounting thechapelproclaimthatashrine,asnearworthyaspossible, hasatlastbeenprovidedfortheSacramentalpresence ChristOurLord.Itwassuchashrinethepioneersyearned toseeerectedasathankofferingforthesuccessthatblessed theirlabours.Noneofthemsurvivedtoseethedearestwish oftheirheartsrealised.Buttheplantheyleftusisoneon whichthechapeloftheirdreamsisbuilt:Inclosecollaborationwiththelastoftheirsurvivors,Mr.E.leB.Henderson producedtheplanofthemagnificentspecimenofGothicart.
Somuchwasaccomplished-onpaper.Forfinancial reasonsmanyyearsweretoelapsebeforetheplanscouldbe putintoexecution.Thecompletionofthehospitalbuildings duringthedepressionyears,withoutanyoutsidehelp,left ahugedebt.Thefinancialpositionwasdesperate.
InkeepingwithatraditionoftheOrder,thecareofthe sickmustgetfirstconsideration-andthattraditionalsoim pliestheprovisionofthebestinbuildingandequipment. Themaintenanceofthatpracticenowbecamethemajorproblem-aproblemsolvedonlyatthecostofgreatpersonal sacrificeonthepartoftheSisters.Plansforthechapelhad tobeputasideandtheovercrowdedlivingquartersand manyotherneedsoftheSistersenduredindefinitely.
Thelackofaccommodationinthechapelwasnotthe leastoftheSisters'hardships.Thechapelwasbuilttoaccommodateforty.Whenthatnumberwasexceededanadjoining roomwasannexedbytheremovalofawall;andasthe numberofSistersincreased,furthermakeshiftshadtobe resortedto,includingportionofanadjoiningverandah.For healthreasonsalone,thatconditioncouldnolongerbe tolerated.
Whenatlastdirenecessitycompelledabeginningtobe made,theSisterswere,financiallyspeaking,stillveryill preparedforanundertakingofsuchmagnitude,and,though determinedtherewastobenoalterationintheplan,they weresomewhatdownhearted.Buttheenthusiasmshownby somanyfriendsandwell-wishers,aswellasthegenerosity ofsomewhocouldaffordtogive,heartenedthemtolook forwardtothememorialchapelbeingclearedofdebtinour day.Somesubstantialmoneygiftscametohandasthe buildingwasabouttostart;othersfollowed,andtheSisters darehopethatthereareyetmoretocome.

Onthenorthendofthewestaisleisbuiltapermanent NativitycribandintheoppositeaisleaLadyofPerpetual Succourshrine.
Anorganandchoirgalleryinwhichistobeinstalleda pipeorganisprovidedabovethefrontporch.Thefront balustradeofthisgalleryisincarvedsyntheticstoneofrich tracery.
Asecondgallery,havingacarvedjarrahtraceriedbalustradefinishedinFrenchpolish,isbuiltintothewesttransept. Thisgalleryandtranseptunderitareconnectedwiththe hospitalbycloisterstoprovideapproacheitherway.
Thenaveandtranseptceilings,carriedoutinfibrous plasterinTudorvaulting,enrichedwithtracery,risetoa heightof37feet.
Theceilingsofsideaislesaregroined,vaultedtoaheight of18ft.6in.Theceilingsofthenave,transeptsandsanctuaryarefinishedinbluewithallcolumns,arches,etc.,in naturalstonecolour.
Thewallsofthesideaislesarepaintedaverylight heliotrope,whilethewallsofthesanctuary,naveandtransseptsarefinishedinivory.Thewallsofthesidechapelsare pinkandblue.
