ALLLAWSADEADLETTERWITHOUTMORALITY

TherejectionoftheFrenchpeopleofthenewConstitutionforthe FourthRepublic,sponsoredbytheCommunists,maywellmarkthe burningofthetide,accordingtocertaincommentators,againstRed dictatorshipinEurope.TheReferendumwasmorethanadecision onconstitutionaltechnicalities.Itinvolvedatrootastruggleover thenatureofsocietyandtheroleoftheStateinthelifeofmanaquestionthatmustsoonerorlaterbedecidedinalldemocracies, includingAustralia.AstatementbytheFrenchBishopsundoubtedlyhadaprofoundeffectontherecentreferendum.ItwaspublishedonNovember13,1945,andentitled"DeclarationontheHumanPerson,theFamily,andSociety."

"AtthetimewhenthenewConstitutionisabouttobedrawnup," wrotetheFrenchBishops,"we havethedutyofmakingthe voiceoftheChurchheard.Not, certainly,tointerveneinafield whichisnotours;ontheproblemsofpurepoliticaltechnique, concerningtheinstitutions,the parliamentaryassemblies,therelationsofthevariouspowers amongthemselves,theChurchhas nothingtosay.Shehastoo muchrespectfortheliberty whicheachnationhastochoose thepoliticalformsandeconomic structureswhichseemtoitbest suitedtothepeculiargeniusofits peopleandtotheevolutionofits civilisation.Butinthepresent circumstanceswemustspeak,for twoprincipalreasons:-

TwelveRightsoftheFamily.

TheBishopsdividethestatementthatfollowsintothreeparts: orthehumanperson,onthefamily.andoncivilsocietyandthe State.Inthefirstofthesethey distinguish"theerrorsofliberal individualism,whichsacrificessocietytotheindividual,andtotalitarianism,whichsacrificestheindividualtosociety,"andpropound insteadthetraditionalteachingof theChurch.Theyrecapitulate therightsofthehumanperson,as citedbythePopesfromLeoXIII onwards,andespeciallyinthe Encyclical"DiviniRedernptoris" (ifPiusXI,andenumeratenine basicrightsbroughtoutinthe war-timemessagesofPiusXII.

True, theChurchisfarfromconsideringthisdivisionofbeliefsas theoreticallyideal, forwewho loveChristdesirethatallshall knowHimandloveHimandshall findinHimandHisChurchtheir enlightenmentandtheirstrength.

ButtheChurch,whichdesiresthat theactoffaithshallbemadefreely,withoutbeingimposedbyany externalconstraint,takesaccount ofthefactofthedivisionofbeliefs;shedemands,therefore,simplyherfreedomtofulfilthespiritualandsocialmissionwhichher DivineFounderhasentrustedto her.
