Afewminutesbefore8 onthenightofhisdeath,thelarge hellofStEugene'sCathedralannounced tothecitizensthemournfultidings oftheBishop'sdeath.andimmediately onallsidesexpressionsofheartfelt sorrowwe;heard.
Hisgentledisposition,benevolent qualities,anddeepinterestintheir spiritualandsocialwell-beingendearedDr.O'Dohertytohisflockthroughoutthediocese.Ofaretiringnature hietooklittlepartinpublicaffairs, butallhisepiscopaldutiesweredealt withpersonally,withscrupulouscare andexactitude.

Thedeceasedprelatewastheeldest sonof1111r.EdwardO'Doherty,agentlemanhighlyesteemedinDerry,and onewhoduringtheearlierpartofhis lifewasextensivelyengagedinthe linentrade.TheyouthwhosubsequentlybecameBishopofDerrywas educatedatMolenaSchools,thenin theoldCatholicSeminary,Pumpstreet,Derry,andinMr.McQuilkin's ataidemy,passingontothetutorial careofMr.Campbell,Clonmany,at whoseprivateschoolmanyeminent ecclesiasticscompletedtheirclassical course.FromMr.Campbellthe YoungstudentproceededtoMaynooth. in1855: herehisgentledemeanor andconspicuousardourasastudent madehimextremelypopularwith classmatesandprofessors.Throughouthisentirecollegiatecareer,Dr. O'DohertywasoneofthemostdistinguishedstudentsatMaynooth, manifestingaspecialpredilectionfor thestudyofEnglish.HealsoworkedstrenuouslyatthestudyofthesacredScripturesandFrench,andhis knowledgeofboththesesubjectswas profound.
Fewecclesiasticspossessedgreater acquaintanceWithChurchhistorythan thelateBishop,whowasordainedat LongTowerChurch,Derry,in1861, by.thelateMostRev.Dr.Kelly.He wasimmediatelyappointedtothecuracyofCarndonagh.andthefollowing yearhewastransferredtoMilan. ehereheministeredthreeyears,and thenwascalledtotheadministration the-extensiveparishofArdstraw, Newtownstewart,where,fornearlya quarterofacentury.helaboredwith extraordinaryactivityandsuccessin buildingnewschools,repairingexistingone,andinpersistentadvocacyof thecauseoftemperance.Ilealso foundtimetowritereviewsandessaysofhighliteraryworth.HisexhaustiveessayontherenownedConventionatDrunikeat,nearLimavady in590,whichwasattendedbySaint Columcille.isconsideredamasterpieceofitskind.havingwontheunstintedadmirationofstudentsofhistoricalsubjects.
Dr.O'DohertywasconsecratedBishopofDerryinSt.Eugene'sCathy-
- IlisLordshipwasbornin1833,and hadhelivedanotherweekhewould havebeenBishopofDerryforseventeenyears. Duringhisepiscopate manysplendidprojectsfortheadvancementofreligionandeducation witnessedfulfilmentunderthelateprelate'sfosteringguidance.Inadditiontomanynewchurchesandschools erectedthroughoutthediocesehis LordshiphasleftenmiteringmonumenttohiszealinthefinalcompletionoftheCathedral,whichheinteriorlyadornedinbeautifulstyleand exteriorlyequippedwithaloftyspire andmagnificentchimeofbellsata costofseveralthousandpounds.The lateBishopalsolaidthefoundationstoneofthespaciouswingofSt.Ca lumb'sCollege.intheprosperityof whichhemanifestedthewarmestinterest,andlivedtoseeitholdinga proudplaceamongthePeelingeducationalestablishmentsofIreland. HisLordshipnevermissedattendanceattheannualprizedistribution inthecollege,andontheseoccasions tiedeliveredseveralmagnificientaddressesoneducation.Duringhis occupancyoftheSeeofSt.Eugene.

Bythesaintlyprelatewhopassed peacefullytohiseternalrewardon Monday.February25.theweightyobligationsoftheguardianshiphavebeen everdischargedwithacharitaleconsideration,unswervingfidelity,anda uniformmagnaminitythatmakeall themorepoignantandsincerethe sorrowuniversallyfeltbyhispriests andpeopleattheirbelovedPrelate's demise.

Aremarkableinstanceoftheinjusticethatisatthebottomofthe wholepersecutionisfurnishedina caseofpeculiarinteresttoIreland justreportedinconnectionwiththe sequestrationproceedingsunderthe SeparationLawofFrance.Two IrishFoundations,onemadebyRev. JamesBurke,a-Killaloepriestin1821 whenhewasinFrance,andtheother bytheVeryRev.J.B.Walsh,D.D., formerlyRectoroftheltishCollege inParis,madein1825,havebeen sequestrated,althoughtheyarequite distinctfromtheCollegeproperty. Theywereworth£257sterlingtothe students,butatpresentthereseems nowayofrecoveringthem,boththe ArchbishopofParisandtheIrishCollegehavingbeendeprivedoftheir officialrightsunderthelaw.The caseisoneofparticularinjustice,affectingasitdoestheinterestsof youngmentowhomtheI3iirsesmust havebeenalargeconsideration:and itwilladdgreatlytotheindignation oftheIrishpeopleatFrance'scoldbloodedspoliationofthepropertyof theChurch.

Thewarescomprisealmosteverything 'fromaneedletoananchor,"but artisticgoodspredominate, and amongstthemarerarespecimensof plainandfancyneedlework,which showthatbenevolentheartshaveinspireddeftlingersthroughmanyhours ofwork.Forbeitrememberedthat thegoadswhichmaresobrillianta showing,andoffersuchtemptationstothre,..noneofthesevenGovernorswas thevisitor,areforthemostpartgiftsworthanything,sofarasthatinstiinaidofthebazaar.tobesoldfortuitionwasconcerned.Atthepresent thebenefitoftheOrphanage.Fivetimetherewere150girlsintheOrphanage.andMr.Longmorewould hearhimoutinsayingthattherewas nothalfenoughaccommodationforthe presentnumberofinmates.Thepeopleofthepresentdayhadmeans,and hewasaskingthemtogiveoftheir abundance.andraiseupaninstitutionthatwouldhaveaccommodation sufficientforthenextfortyyears.He askedthemnowtoassistthisobject, asitwasthechildrenofthepeople theinstitutioncaredfor.Hehad startedabazaar-heheardsomeone callingitacarnival-bazaarorcarnival,orwhateveritwas,itwasa money-collectingconcernanyhow.He hopedthatthebazaarwouldmeet withagenerousresponse.Hewas pleasedtoseethewaythestalls werearranged.andheunderstoodthat goodofficerswereinchargeofthem. OnThursday,January31,theIrishmenofBrooklyn,N.Y.,madeanother vigorousefforttokillforeverthe 'StageIrishman."TheRussellBrothers,whoare,strangetosay,themSelvesCatholic,havebeenplayinga piececalled"IrishServantGirls,"for sometimeinAmerica.Thepieceis notmerelyacaricatureandagross libelonIrishwomanhood,butanimmoralandobsceneplayaswell.The playhadbeenseverelycondemnedbeforeandaweekormorepreviously totheBrooklyndemonstration,the IrishSocietiesofN.Y.Cityhadthe playershootedoffthestage.The BrooklynirishminpetitionedthemanagerofRussellBrotherstodropor ohang,ethepiece,butinvain. The playwastogoonasusual.
Itwas10.15o'clockwhentheRussellBrothers,allunsuspecting,pirouettedonthestageoftheOrpheum Theatre,Brooklyn,J.Russellworethe familiarredwigandwasfantastically decoratedwithribbonsofgreen.John. thebrother,carriedtheold-time broom.Theysprinkledalittlesand Onthefloorandbegantoexecutethe preliminarydance.Thereweretwo Orthreeshuffles,andawhistlescreechedshrillysomewhereupinthegallery.Instantlyahundredmenwere MItheirfeet.Theyrosefromthe Orchestrachairs,fromtheboxesand fromthegallery.Thrustingtheir handsintotheirpockets,theyjerked outtheirammunition-andthebombardmentbegan.
Fromeverynookandcrannyinthe houseahailstormofeggsandlemons descendedonthestage.Theeggsand lemonswereaimeddirectly.attheactorsandspedstraighttothemars. Itseemedasifthebrigademusthave beenselectedwith,a,viewtosecuring menofunerringaim.Inlesstime thanthetellingofittakestheRussell Brotherswereconvertedintoarealisticlikenessofalemonandeggsouffle. Theyraneggsfromheadtofoot, whiletheirwigstookontheaspectof aheadbentunderafaucetinabarber shopafteravigorousshatnpoo.Presentlytheyolksandwhitesbeganto penetratetheirears,eyes,andmouth, andfinallytheywereforcedtorun chokingfromthestage.
Eggsofallsizes,shapes,andage wenthurlingovertheheedsofthe audiencetocrashagainsttheyellow andwhitestripedsceneryattheback ofthestage.Lemons-ripeandjuicy lemons-flew,too,untilthefloorof thestagebegantolook,likeagroceryshopaftertheinvasionofabull. Oneofthereasonsaccordingtothe UnionistpatriotsinEngland.whyitis necessarytopackjuriesandtochange venuesinIrelandisthattheIrishCa- tholicorNationalistjurordoesnot mindperjuringhimself.InErigland itisdifferent.At'leastthatiswhat wehavealwaysbeentold.Strange tosay,however,Mr.JusticeGrant- hamhasjuststatedattheWinchester Assizesthatperjuryissuchacommon thinginEnglishCourtsofJustice "thatthelivesofjudgeswouldbe tooshorttotryallthe)casesoflying whichtakeplace."Commentingon this,anEnglishpapersaysthat, "consideringhowvitalitistoim- partialjusticethatwitnessesandall concernedshouldspeakthetruth,it isveryalarmingthatsoexperienceda judgeasWilliamGranthamshould refertoperjuryasaneviltowhich wemustberesignedowingtothe utterhopelessnessofpreventingit." D.J.O'Donoghue,whodiedrecentlyinTorontoattheageofsixtythree,wasthefatherofthelabour movementinCanada.Forfortyyears hehadbeenaconspicuousandaggressiveadvocateofthelabourcause.His funeralwasattendedbyMinistersof theCrown,membersofParliament, Akerepresentatives-oftheCanadianJudiciaodelegates,fromlabourorganisationsandprominentcitizensfromall partsoftheDominion.Thegatheringwasastrikingtestimonyofthe respectinwhichthememoryofthis remarkablemanwasheldbyall classesoftheCanadiancommunity.
PerhapsthisistruerofAmerican workingmenthanitisoftheworkingmenofEurope.Butitistrue,at anyrate,ofthosewhocomposethe membershipofthegreatlabourorganisations,anditisparticularlytrue ofmanyoftheirnotableleaders.
Inthesedays,whenthepathtofame ismoreoftentravelledbytheunprincipled'politicianorthesuccessfulorganiserofastupendoustrust,itisarelieftoturntothecareerofonewho caredfornoneofthethingsesteemed bythepoliticianortheorganiserof trusts.whoputthemasideimpatientlyasiftheywereofnovalue,who preferredtoemployhispowersIna persistentefforttobettertheconditionofthepeopleabouthim. The virile,uncompromisingCatholicityof Mr.O'Donoghuewasasdistinctivea featureofhischaracteraswastheintelligentsympathyhebestowedon thosewho.beartheheatandtheburdenofmanuallabourwhileenjoying butasmallshareofitsfruits. .He hadnopatiencewiththosewhoaccusedthe('hurchoffailingadequately tosupportthecauseoflabour.His successfulleadershipoffortyyearswas inspiredbyarealtlevoliontoCatholicprinciples. liesawtheinherent fallacyofSocialisticideas,andnever swervedinhisoppositiontosocialism asaremedyforthegrievancesofthe workingclasses.Ilefrequentlysaid thatsachcriticismofthe('hurch washornofadesiretoexcitemistrustinthemindsofthosewhosereal interestshavebeenherchiefconcern. The('hurch.inhisopinion,wasthe mostdemocraticinstitutionknownto men.Hewouldreverentlysaythat herFounderchosethesimpleenvironmentandcommonplaceconditionsof oneoftheworld'stoilersasthestartingpointofHisDivinemission.And thenhewouldlayemphasisonthe factthatthefirstPopewasaplain fishermansprungfromaclassatthe lowestroundofthesocialscale.

Whenhewastoldbyaradicalworkmanthatthe('hurchwastheenemy ofthemasses.herosetohisfeetand publiclysaid
TheunderlyingCatholicspiritofthe KnightsofLabourinthedaysofits vigorhasoftenbeencommentedon, anditwastheconsequenceinnosmall degreeoftheferventCatholicspirit exhibitedbyitsfounder,TerenceV. Powderly.OneofPowderly'sablest lieutenantsin'thatmovementisthe subjectofthissketch',and,luckier thanhisformercolleague,heretained hisinfluencetotheendofhislife.
Thefinestfruitofhisincessantlabour,thoughotherssharethehonour wastheestablishmentoftradescouncilsinalltheimportantcitiesof Canada. Lateronthisledtothe establishmentoftheDominionTrades andLabourCongress,whoseannual meetingsareeventsofconspicuousnationalimportancetoCanada.AnunnoticedresultofthelabourmovementinCanada,and-yetoneforwhich Mr.O'Donoghueearnestlystrove,was thegradualextinctionoftheintensely bitterfeelingthatformerlyexistedbetweenCatholicandProtestant.and, inasmallerdegree,betweenthe FrenchandEnglish-speakingworkingmen.Thiswasthenaturaloutcome oftheirnewassociation,buttheold feelingthreatenedattimestowreck thefortunesofthelabourmovement Anditwasnotaccomplishedbypal' teringintheleastwithCatholicprinciples,butbyavowingthemboldly anduncompromisingly,andappealing totheintelligenceandsenseoffair playontheoppositeside.
Thelifeofagoodmanisthetree plantedbytheriversofwaterswhich bringsforthitsfruitinseason,aiigurenotinappropriateindescribing thecareerofI).J.O'Donoghue.For himselfhedidnothingmaterially,and yetspirituallyfewmenhavelefta nobler'legacybehindthem.TheprogressachievedbytheWorkmenof ('anadainthelastfortyyearsisdue toaconsiderableextenttohispersistentlabours.Iito-daytheworkmenoftheDominionenjoybenefitsunknowntothe'workmenofothercountries,itisbecausethisdistinguished manunwrarietilytoiledfortheirinterests.Whenhebeganhiscareer Parliamentwasindifferenttothe Inuresofthemasses,Theideaof legislatingforthemwasrepugnantto themajorityofitsmembers.When heclosedhiscareerconditionshadentirelychanged.Parliamenthadadoptedthemajorityofthereformsheadvocated,andhadestablishedaMinisterofLabourtoseethatthelabour lawswereproperlyenforced.Helived leseetheestablishmentofarbitration bo'rdstosettlelabourdisputes.and hehimselfbecametheprincipalofficer whosedutyitwastoseethatthe wor',ersengagedeitherdirectlyorby contractinfievernmentworkrelieved fairwagesandwerenotcompelledto labourforunreasonablehours.
Astheeditorofaladingpaperhe hadmanyoniortunitiesoffurthering thelabourcause.andwithunflinching zealbefoughtthebattleoflabourin itscolumns.HispositionalsoenabledhinttopromotetheIrishmovementinthecapitalofCanada,andhe wasinstrumentalinsecuringforit thepowerfulsupportofCanada'schief politicalleadersonmanyamomentousoccasion. Therewerefewmovements,however, forthebettermentofthehumanrace inwhichMr.O'Donoghuedidnottake adelightedandenthusiasticpart.By nomeansanorator,hewasyeta shrewd,straightforwardspeaker,who wentstraighttotheheartofhissubject,illuminatingitashewentwith touchesofsprightlyIrishhumour.

TheChurchisandalwayshashem thefriendofthepeople.lerinfluence issteadilyemployedtoimprovetheir moralandmaterialcondition.Withinherranksclassfeelingisanimpossibility. Beforeheraltarsallmen aree.oial.'lermosthonorednames andherhighestdignitarieshavebeen thewIsprinz.oflabourersandmechanics. Itwasthe('hurchwhich first%flightthetruedirnilyoflabor. anditwasthe('hutchwhicheinatilii,,sipaledtheserfandstrucktheshack fromthelimbsoftheslave."
ThenhepointedoutthatthepresentconditionoflabourwasnotcausedbyanyartoftheChurch.forat notimewaslabuurmorer:spected thanduringtheMiddleAges,when workmenwereorsanisedintoguilds.
-TheChurch,"headded.significantly,"isevennowendeavouringtobeing bac!:totheworkerstheprivileges theyenjoyedbeforetheReformation intreducedthecommercialsystem whichhasdegradedlabourtothe levelofacommodityandinperformingthistaskshehastheother taseofcombatingthesocialismwhich offersthelaborereconomicfreedomat thepriceofhisspiritualmanhood."
H.believedthatthelongcenturies ofChristianbeliefhadsothoroughly permeatedthemassesthathewasaccustomedtosay"TheCatholicworkman - istherest,effectiveFarrier againstsocialism."
Wemightaddwithtruththatifit werenotfortheconsistentCbristianiteoftheCatholicmassesthebeliefs ofsocialismwouldhethebeliefs ofthevastmajorityofworkingmen.
Thesegreatreforms,wemayimagine,werenotgainedexceptbyyears ofdifficultlabour,unrenumerativefor themostpart,butcheerfullyencount.ridforthesakeofthecausethat laynearesthisheart.Whenthehistoryofthelabourmovenkntcomesto bewrittenthelistofIrishmenwho ha,e:oughtitstattleswillbeno meagreone.And.whileengagedin thisuphillcontest.thosemen.obscure forlifemostpart.wereneverwithout apatheticinterestinthewelfareof themotherlandwhichhadcradled them.llr.0'Donoghuewasoneofa bandofIrishmeninwhomthepassion forso:'ialhope..cr.,litwitwoigtod everyotherconsideration.
liewasborninIrelandin1811,a periodofsadimportanceinthehistoryofIreland.Eightyearslater hisparentsemigratedto('anada,and settledinBytown.nowOttawa,the capitaloftheDominion.Whenalad scarcelyout.ofhisteensheentereda newspaperofficetolearnthebusiness oftype-setting.Illswanderjahrwas spentintheUnitedStates,wherehe becameinterestedintheTypographicalUnion.Onhisreturnhomehe establishedtheTypographicalUnionof Ottawa.thefirstofitskindinCanada.Intheyearsthatfollowedhe wasactiveinpromotingthelabour movement.andhisworkattracted widespreadattention.sothatwhenhe wasnominatedfortheOntarioParliamentin1874onthelabourplatform-hewaselectedbyaelaegemajority.HewasthefirstlabourrepresentativethateversatinaCanadian LegislativeAssembly,andoneofthe firsttoenjoythatdistinctionanywhereintheEnglish-speakingworld. HisworkinParliamenthasalready beenreferredto.hutitwasinthe generalorganisationoflabourbodies thathereallyexcelled.Fertileinresources,brimmineoverwithideasand suggestions,hispresencestimulated mentoaction.andvethenever thrusthimselfforwardandassumed thepositionofleader..nreferringtoallowthehonourandemolumentsto gotoothermen.providedtheprincipleshecontendedforwereaccepted.

Theenvelopeofairsurroundingthe earth,andinwhichwebreatheand haveourbeing,isaworldofgermlife,inmanyformsdeadlyanddangeroustohumanlife;andespecially thosetoilinginthecentresoftrade aremoreexposedtothem.
BeyondhisparticularinterestinlabourandIreland,hewasdeeplyconcernedinthesubjectoftechnical schools.Alongwithothers,hesecuredtheestablishmentofatechnical schoolinTorontoandbecameoneof itsfirstdirectors.Thiswasanother instanceofhisgenuineinterestinthe welfareoftheworkers.Hevalued improvementsintheirmaterialcondition,buthevaluedstillmoreeverythingthattendedtoelevatethemto ahighermoralandspiritualplane. Thetechnicalschoolevokedthesympathetic.kindlyIrishsideofhisnature.forhehadthefuelingthatindividualsaremorethanacause.and thatnomancouldthinkthathehad donehisfulldutyunlessheactually conferredadirectbenefitonsomeparticularperson.Buthefeltstillmore thatitwasincumbentonhimasa Catholictotakepartinthesocial movementsofhistime.Hiswasa vigorousandoutspokenCatholicity, yetwithalgenerousandfreefromthe slightesttingeof-bitterness.ItdelightedhinttoshowthatthebestsocialinfluencesofthedayareofCatholicorigin,andthatnowheredoes the('hurchexhibithermissionto greateradvantagethanwherepolitical institutionsarefreest.Howwell O'DonoghuepreservedtherespectofailclassesoftheCanadian communityisshownbytheremarkable eulozypasseduponh'imbyChiefJusticeMuleck,oftheCanadianSupreme Bench.whosaid '1haveknownMr.O'Donoghuefor manyyears,andduringmetenureof officeasMinisterofLabourwas broughtintocloseassociationwith hintandhadopportunitiesofknowing welllothhisworthandcharacter. Hewasamanofpurelifeandhigh ideals.andwasdevotedtotheupliftingofhisfellow-workingmen.Heexertedonalloccasionsamoderatinginfluenceagainstextremeviews,believingthatinmoderationandfairnessa causewasbestadvanced.Hewas justandimpartialinallhisdealings andintheadjustmentofconflictinginterestsbetweenemployerandemployee wasguidedbyasingleeyetowhat hebelievedwasequitableandright. In 1848acommissioncameouttoGovernorFitzroymakinghimGovernorGeneralintheAustralianColonies accompanyingthatcommissionwere fourdistinctcommissionsforSouth Australia,Victoria,Tasmania,and NewSouthWales,fourStateswith fourdistinctGovernors,whowasone andthesameperson,andhewasalso Governor-GeneralofAustralia.He justwantedtomentionthatinpassitrightbeforedealingwiththeCon-fug,becausehethoughtourchildren stitution,tosaythatFederationwasoughttoknowmoreaboutAustralian history.Thereisoneotherperson hecouldnotpassbywithoutreferring to,becausehehadagreatdealtodo withadvocatingAustralianunity.In 1854,intheSydney"MorningHerald,"thereappearedaseries,ofeloquentlywrittenlettersadvocatingthe Federal,Union.Theyappearedover thesignatureof"JohnAdams,"but werewrittenbytheRev.JohnWest, ofTasmania.Theproprietorsofthe paper,beingimpressedbytheliterary abilitydisplayedinthewritingof thosearticles,offeredWesttheeditorHedidnotwish-togooveranyshipofthatjournal,whichheacceptgroundinthatspeech,buttherewereed.Andwhileashorttimewasaloneortwopointshewantedtotouchlowedtoelapsebetweenhislettersin upontoleaduptothesubjecthe1855.Westagaincametothefront hadundertakenthisevening.InthatwithleadingarticlesintheSydney 'speechwearetoldthatintheyear"MorningHerald"ofaverystrong 1781acertainActpassedintheBri-Federalnature.BythistimeVenttish'Parliament-24thGeorgeIII-en-worthhadgonehometoEngland.and titled"enletfortheeffectualtrans-thespeakerwouldrendhisfarewell portationoffelonsandotheroffenderswordstothetropicofAustralia:beandtoauthorisetheremovalofpri-cause,ifthereisonemantowhom sonersincertaincasesandforotherthepresentraceofAustralianshould purposesmentionedtherein."Twobethan'.1111.itistoW.C.Wentworth yearsafter,in1786,byorder-in-coun-(cheers.)Wentworth,inleaving NewSouthWaleswasappointedaney.madeuseofthesewords:placeforthereceptionofpersons nhatevermayliemydestiny.bewithinthemeaningoftheAct. Inthissameyearthementionofthe separationofVictoriafirstcameup fromNewSouthWales,and,asitwas necessarythat,anamendmentofthe NewSouthWalesConstitutionshould takeplacebeforethatseparation, EarlGreysentouttotheGovernor fortheconsiderationoftheLegislativeCouncilacertaindespatch.His amendmentswereonjectionablein everyformofthepeopleofNewSouth Wales:butthatdespatchcontaineda veryremarkablesentenceasregards Federation.whichreadasfollows:Therearemanyquestionswhich, thoughlocal.respectingtheAustralian Colonies,collectively,arenotmerely localinrespecttoanyoneofthese colonies,thougheachmayhaveapart inacommoninterest,andinregard towhichitmayheessentialtothe welfareofalltohaveasinglecentralauthoritywhichcanhemoreproperlyandmoreeffectually'decidedby someauthorityinAustraliaitself thanbythemoreremote,lessaccessible,andintruth,lesscompetentauthorityofourBritishParliament, In1852,Dr.LangproducedawonderfulworkasregardsConstitutional constructionhecalledit"TheFreedomandIndependenceoftheGolden LandsofAustralia:"andthereisno questionthatDr.Lang'sideaswould haveobtainedfargreaterinfluence andpower,butthathebasedhis wholeschemeonseparationfromthe Mother'Country.Therewasone OtherspeakerMr.'Murphywouldlike toreferto-thatidealAustraliannative,Mr.J.J.Simons,whose thoughtswhenhegetsupinthemorningareaboutAustraliaandwhenhe goestobedareaboutthesame:and thatissomethingMr.Simonsshould bevery,veryproudofindeed. He hadheardthisgentlemancomplainat theneglectofteachingAustralianhistoryinourStateschools.Ifyou
theGovernmentprogramme,"although hadbeenpromisedthatthefirst measurethatshouldbedealtwith'in anyoftheParliamentswouldbethe DraftConstitutionBillof1891.His experienceoilthepeopleofN.S.W.in 1891wasthattheyslidnotrealisethe importanceofFederationandtheydid notseemtowanttohaveanythingto dowithit,andnoenthusiasmcould beworkedupinpublicmeetings.In November1891Parkeswentoutof officeandbytheeffortsofB.R.Wise, BeechamandMcMillian(towhoma greatdealofcreditonfinancialmattersisdue)wemanagedtoatlast kindlesomesortoffireamongstthe peopleoftheMotherState.In1893 therewasafunctionheldunderthe auspicesoftheA.N.A.atCorowa VictoriatoconsidertheFederalquestion,andin1896wehadtheBathurst Conventionwhichdidmoretoadvance FederationthananyotherConvention. Thedelegatestothisconventionwere electedsolelybythepeople.Hefound onlookingdownthelistthatonewho didagreatdealfortheFederalcause wasHisEminenceCardinalMoran (cheers).Thatbroughthimtothe subjectofhislecture-"TheAustralian Constitution."Wewouldhavetouse twootherConstitutionsforformof comparisonthatistheConstitution oftheDominionofCanadaandofthe UnitedStatesofAmerica.Inthefirst placetheconstitutionoftheDominionofCanadacouldhardlybecalled aconstitution,because,althoughacceptedbythepeopleofCanadathey theyhadnovoiceinitsframing. UndertheBritishNorthAmericanAct definitelegislatixemeasureshavebeen reservedforthevariousprovincesfor themtolegislateupon.,andwhatis notmentionedinthatActhasbeen handedovertotheCentralAuthority. In(fieConstitutionoftheU.S.A.and inourConstitutionwedefinitely mentionsertainsubjectsthatwehave givenovertotheCentralAuthority. andthosenotmentionedinthatConstitutaonremaintherightofthe Statetomakewhatlawsitthinks lit-thatistheimportantdifference. Thenthereisthisgreaterdifference, inconsideringaConstitutiontheques- tionwemustaskourselvesis,to whomdoestheSupremepowerofthe ConstitutionbelongorwhoissupreeundertheConstitution?Inthe BritishConstitutionitissupposedto betheBritishParliament-theKing, etheLords.andtheCommons.The ConstitutionoftheU.S.A.distinctly saysthatthepeopleshallhavesupreme power.thepeopleshallhesupreme. Buthewishedtoshowthatthepower giventothepeopleofteeU.S.under theirconstitutionislessthanthe powergiventothepeopleofAustraliatindertheCommonwealthConstitution.Havinggotaconstitution,of courseths..nextnecessarythingisto bringintoexistenceaParliamentto makelawsinkeepingwiththatconstitutionandtocarryoutthewillof thepeople.andjustinproportionas yougivethepeoplethepowertomake theParliamentwhattheylike,sothe peoplearesupreme;justasinpropor- tionyoutakeawaythepowersofthe Parliamentyoutakeawaysomepor- tionofthepeoples'powers.Thethree FederalParliamentsarecomprisedof twohouses,thelowerhouseinCanadaiscalledtheHouseofCommons andtheUpperHouseiscalledtheSenate,andinAustraliaandU.S.A.they arecalledtheHouseofRepresenta- tivesandtheSenate.thelowerhouse istheHouseofRepresentativesand theupperhousetheSenate.Mr. Murphywishedto'makereferenceto thequalificationsofthosewhoaspire tobeSenators.InCanadaaman beforehecanbeaSenatormustbe 30yearsofass.hemustbenineyears acitizenoftheDominion,beaBritish subjecteitherbybirthornaturalizationandmustpossespropertyabove alldebts'liabilitiesorchargesofthe clear.valorof4.000dollars-E800.In theUnitedStates,thesualificaitions are:-Age.30years(followineCanada veryclosely)nineyearsacitizenin theUnitedStatesandaresidentof theStateforwhichheisreturned.A manresidinginNewYork,forinstance,couldnotgotothepeopleof Massachusettstoseekelectionasa Senator.InAustraliatheettaliflcationsare:-Britishornatturalisedsubject,age21years(loudcheers)anda residentintheCommonwealththree years.Thespeakerdealtwiththe modeofelectingSenatorsinthethree constitutionsmentioned.IntheDominiontheGovernorGeneral,inthe nameofTheKingshallfromtimeto timeelectcertainpersonstofillthe positionofSenator.Thisisalife appointmentintheDominion.andonce theGovernorelectsapersonheis thereforlife,onlysuchthingsas death.crimes,orbankruptcy,removinghimfromthatposition.In
America,wherewearetoedthatthe peoplehavebut'averysmallvend inselectingSenatorsforthevarious States.ThemethodinAmericais forbothHousesoftheStateParliamenttocometogetherandvotefor certainnamesthathavebeensubmitted,andthosewhogetthemost votesareelectedasSenators.Mr. Murphywouldliketoaskhishearers whatchanceLynch,Needham,and Pearcewouldhavehadofbeingreturnedifsuchconditionsprevailedin Australia.WetakeoutownState, andwefindithasonesingleelectorate;wesaytothepeopleofthat State,"Wehaveconferreduponyou thefranchise,sodoyourbest,accondinetoyourability,toselectthe bestmenthatmaycomeforwardto representyouintheUpperHouseundertheCommonwealthConstitutionof Australia(applause).Wehaverecog- nisedinAustralia,andnota,daytoo soon-infact,twentyyearstoolatethatourwomankindareGod'screaturesjustasmuchasweare,and thattheyveryoftenwillmakeawiser choicegenerally-asregardspublic moralsanyhost-thantheordinary male.TheHouseofRepresentatives isverymuchthesanteinthethree places,exceptthattheyhavealonger residentialterminCanadaandAmerica,andhigheragelimitthanwehave here.Asitisapopularvotebyballotinbotbthesecountries,weneed notcomplainmuchhere.Haying createdaParliament,itiswellnext tolookwhatpowerswehaveconferreduponthem.because,itisina greatmeasurethepowersthatyou conferonParliamentthatmakesParliamentabletoworkoutaproperdestiny.Thefirst.greatpowerwe conferredupontheParliamentofAustraliawasthepowertodealwithall mattersrelatingtotradeandcommerce,andherealso,inthissubsectionthereleamarkeddifferencebetweenourselvesandtheConstitution ofCanadaundertheBritishNorth AmericanActandtheConstitutionof the1.S.A.TheCanadianActsays thattheDominionParliamentshall havepowertoregulatetradeandcommerce.Mr.Murphyaskedhishearers tomarktheword"regulate"which impliedthattheDominionParliament hadpowertoregulatetradeevenwhen thetradewasconfinedtothelimits ofoneprovincealone.aswhen'it spreadoitttotwoorthree.The U.S.ontheotherhand.saysthat theyshallhavepowertoregulate tradeandcommercewithforeigncoon triesandbetweentheStates.Our Constitutiongivesfarlargerandfar morebeneficialpowersto,theCommonwealthPatlianiene Wehave adroppedtheword"regulate."wesay theCommonwealtitParliamentshall havecompletecontrolinallmatters relatingtotradeandcommercewith othercountriesandamongstthe States,andthegreatdifferencebetween"regulate-and"relatingto" youcanseeforyourselves.The powertoregulatedoesnotconferon theDominionParliamentthepower toprohibitthatisconferredonour Parliament,whichcanabsolutely prohibitanytradetheymaythinkis detrimentaltothewelfareofAustralia.Mr.:Murphytool:thequestion ofopiumasanexample.whichisa prohibitedimportunderourCommonwealthTariffAct.Ifopiumwas growninWesternAustralia.the growthofitcouldnotbeinterfered withbyourFederalParliament.but, themomentitwasofferedforsale,a Federallawprohibitingthesaleof opiumthroughouttheCommonwealth wouldmakeit.acriminaloffenceto sellthisarticleinW.A.Thespeaker wantedtoshowthegreatpowers giventoourFederalParliamentin comparisonwiththepowersconferred oneithertheCongressinAmericaor theDomenionl'arnanent.(Cheers).
