Salary surveys are conducted with numerous employers to determine pay levels for specific job categories and are generally conducted either by region, sector or job classification for the purposes of comparability. In conjunction with other tools, salary surveys can provide useful information to attract, support and retain employees within the context of an overall HR and organizational plan. When designed and used properly, salary surveys can provide useful benchmarking information for comparing salaries and benefits. Many organizations want to use salary surveys to set the compensation levels for their organizations. Turning Up the Heat on Fair Housing Education How to Prevent Discrimination Claims at your Community By Sondrah Laden, Grace Hill, Inc.

The Federal Fair Housing Act (FHA), as most multifamily professionals understand, serves to protect the rights of all individuals and prohibit discrimination when seeking, securing and residing in housing. The Americans with Disabilities Act (ADA) protects people with disabilities in a similar manner. Multifamily professionals whose employers provide consistent and thorough training also understand that fair housing laws go beyond federal laws and often include

throughout our industry – in 2011, there were more than 27,000 complaints of fair housing discrimination according to multiple federal authorities – most multifamily professionals do not intentionally discriminate. Rather, discrimination lawsuits happen, in many cases, because people make honest mistakes.

First, everyone who interacts with customers must be trained on the importance of these laws and the impact violations can have on a community. That means education is crucial for all client-facing employees, including leasing, management, and maintenance personnel. If they talk to the public, they need to be trained. Furthermore, if your company is involved in construction and development, anyone working on that side of the business should become intimately familiar with ADA requirements to ensure the housing you build is accessible to people with disabilities.

It’s not just small businesses who goof; even big companies are known to falter when it comes to these laws. In fact, despite spending millions of dollars on the Fair Housing Accessibility FIRST program to train architects and builders about fair housing responsibilities, the National Fair Housing Alliance recently reported that “developers continue to design and construct obviously inaccessible apartment buildings that do not meet the Fair Housing Act’s standards.”

Second, increase your awareness of discrimination cases occurring both in your area and throughout the country. It’s important to keep your eyes and ears open and tune in to current events and developments that are unfolding around you. Fair housing testers sometimes conduct a similar type of test at multiple communities. For example, the Nation Fair Housing Alliance filed charges against the owners of three apartment communities in South Carolina alleging discrimination against prospective residents who are deaf or hard of hearing. The January 2014 charges were filed as a result of a national undercover investigation involving apartment communities in cities including Charleston, SC, Savannah, GA, Atlanta, GA, and Austin, TX. The charges cited instances involving repeated call hang-ups and contradictory information when the undercover investigators called numerous apartment properties using relay service to speak. Is it logical that a developer would spend tens of millions of dollars to knowingly build a community that violates ADA requirements, especially considering violations not only damage reputations but also require a significant amount of time and money to repair? No, of course not. Construction design flaws, such as incorrect thresholds, inaccessible outlets, narrow doorways or lack of reinforcement in bathroom walls to support bars, are most often recognized as unfortunate errors, not intentional attempts to prohibit people with disabilities from enjoying an apartment home. They’re mistakes – plain and simple. In another way, instances exist where good sales skills can be misinterpreted as discrimination and result in another form of claim. An example of this may occur in relation to a simple rent premium on an apartment for features or upgrades that are not clearly communicated to prospective residents or testers. For instance, if a consultant shows a tester an apartment with new grey carpet to complement the furniture the tester described and the rent is $10 more per month than another apartment without new carpet, issues can surface if the cost difference is not clearly communicated. While the leasing consultant was simply trying to help the prospective resident find an apartment that would best meet their wants, the increased rent may be misinterpreted if the tester is a member of a protected class. In this instance, it would be important to fully explain why the premium was applied. Otherwise, it could seem as if the protected class tester was quoted higher rent. Documentation and awareness are the keys to avoiding these types of mistakes.

Watch local and national news sources, set up Google alerts to funnel relevant news directly to you, and address events like this with your team so that everyone in your workplace is informed and prepared. Third, talk with your teams about discrimination prevention. Fair housing awareness shouldn’t be just an annual event. It should be an ongoing topic of conversation around your workplace. This type of ongoing dialogue can ensure that these issues remain at the forefront of all team members’ minds which, in turn, will help your

company keep its commitment to upholding the Fair Housing Act and Americans with Disabilities Act and providing equal housing opportunities for all residents and prospective residents who meet your qualifications and choose to live in your community. If you hold recurring staff meetings, for instance, make anti-discrimination one of your regular discussion points. Share fair housing news items. Remind associates of your commitment to serving all residents in a fair, equal, and consistent manner. You could also use these meetings as an opportunity for a Question and Answer session on tricky or confusing customer service situations that could arise, and help prepare your teams to respond appropriately. Here are some examples of such discussion questions:

Property management is tough enough on a daily basis; don’t let the fear of a discrimination lawsuit weigh you down even further. Empower yourself and your co-workers with the information you need to deliver great service without discrimination. Ensure that all associates receive the appropriate formal training, both at the time of hire and on an ongoing basis. Tune in to fair housing and ADA cases around the country and learn from those situations. And, keep the conversation going with your teams throughout the year. It isn’t enough to be able to recite the seven federally protected classes: turn up the heat on your fair housing education to protect your teams, to mitigate the risk of an unusual situation becoming a claim of discrimination, and to offer fair, equal, and consistent service to all residents who desire to live in your community.

Q: When should you discuss the pet policies with a prospective resident who has stated that they will be bringing a service animal when they move in? A: Never, because a service animal is not a pet and therefore is not subject to your pet policies. Your pet policies would warrant discussion only if this customer has additional animals that are pets. Q: A couple inquires about renting at your community. The woman is visibly pregnant. When considering your occupancy guidelines, how many people do you consider this household to consist of? A: The ‘familial status’ protected class of the Fair Housing Act dictates that you do not take a woman’s pregnancy into consideration when determining household size. Therefore, this household consists of two people. Do not ask questions regarding when the baby is due or whether the child will reside with them. Q: A prospective resident who uses a wheelchair has asked about your available two-bedroom apartment homes. All of your available homes are on the second floor. What do you tell them? A: Provide the same leasing information for this customer as you would for any prospect, regardless of disability. Tell them the location of all available apartment homes and let them decide if any meet their needs.

INDUSTRY ADVISORY: Installation of Fire Alarm Systems By Doug Sartain, President of Certified Fire Protection

less than 17 units within the same building, when fire resistive floors, walls and ceilings are provided, minimum fire resistance rating of 0.75 hours (a one hour fire resistive assembly is one layer of 5/8” Type X drywall installed on both sides of a 2”X4” framed wall). The separation between units can be evaluated by a licensed architect utilizing the criteria contained in Chapter 7 of the 2009 International Fire Code.

Please be aware that the Las Vegas Fire Department is retroactively requiring the installation of a fire alarm system in existing apartment complexes. Section 4603.6.6 of the adopted City of Las Vegas Fire Code provides language which allows enforcement of a retroactively installed fire alarm system. Specifically the code states the following: “An automatic or manual fire alarm system that activates the occupant notification system in accordance with Section 907.6 shall be installed in existing Group R-2 occupancies more than three stories in height or with more than 16 dwelling or sleeping units.” Exceptions: 1. Where each living unit is separated from other contiguous living units by fire barriers having fire-resistance rating of not less than 0.75 hour, and where each living unit has either its own independent exit or its own independent stairway or ramp discharging at grade. 2. A separate fire alarm system is not required in buildings that are equipped throughout with an approved supervised automatic sprinkler system installed in accordance with Section 903.3.1.1 or 903.3.1.2 and having a local alarm to notify all occupants. 3. A fire alarm system is not required in buildings that do not have interior corridors serving dwelling units and are protected by an approved automatic sprinkler system installed in accordance with Section 903.3.1.1 or 903.3.1.2, provided that dwelling units either have a means of egress door opening directly to an exterior exit access that leads directly to the exits or are served by open-ended corridors designed in accordance with Section 1023.6, Exception 4. 4. In essence this code requires all apartment buildings over 3 stories in height or any building containing more than 16 dwelling units to install a fire alarm system. The exceptions to the code allow the fire alarm system to be omitted when there are

It is most likely that your existing apartment building will not be constructed with the proper fire resistive construction. As such either the fire resistance rating of the structure must be upgraded or more likely a fire alarm system will need to be installed within your building. When reviewing bids and pricing from a fire alarm contractor it is important to consider and evaluate the following items: •

Is the fire alarm contractor reputable? Just because the fire alarm contractor provides the lowest bid, this does not necessarily make them the best choice.

You may wish to consider requiring the alarm contractor to supply you with a performance bond, this will ensure that the job is completed to your satisfaction.

Require the fire alarm contractor to provide to you a copy of their General Liability Certificate of Insurance which should also include Worker’s Comp. in the event a workman gets injured.

Make sure you have a good understanding of who is responsible for the containment of asbestos and lead based paint if some is found.

Careful scheduling of the fire alarm installation will be necessary to minimize the impact of the installation on your existing

tenants. Access to the units will probably need to be arranged in advance. •

If furniture needs to be moved and/or covered whose responsibility will this be?

Have a good understanding on where the electrical conduit and devices will be placed inside the units and outside on the buildings and who will be responsible for the fire caulking if this is to be done.

Who will be responsible for drilling the holes necessary for installation of wiring, conduit and other fire alarm equipment? Who will be responsible for patching, repairing and painting to return the unit to its original state? (Typically, fire alarm contractors do not patch, paint, drill or repair walls, floors or ceilings). What are the necessary power requirements for the fire alarm system? Does your existing electrical service contain the necessary spare power capacity to allow for connection of the fire alarm system or must a new or expanded service be provided? Is the fire alarm control panel to be located in a location where power is readily/easily available or must power be brought to the panel from a remote location?

Please consider purchasing only a fire alarm system that is nonproprietary in nature. Some fire alarm systems have only a single vendor in the Las Vegas Valley. Having only a single vendor does not allow your organization to obtain multiple bids for service or maintenance of the fire alarm system.

Obtain a separate bid for monitoring of the fire alarm system. All fire alarm systems must be supervised by a remote 24 hour central station. Obtaining separate bids for this service will also

help you to save money in the installation and routine servicing of this equipment. •

You may wish to consider hiring a licensed general contractor or life safety consultant to assist you in the installation of any retroactive fire alarm systems.

With all of this said, it is important that an adequate strategy be developed before signing any construction/installation contracts. There are numerous considerations to be fully explored before moving forward with the installation of a fire alarm system. This advisory was developed in an effort to educate the industry, given that the Las Vegas Fire Department is enforcing the installation of these retroactive fire alarm systems. It is not the intent of this advisory to document all possible considerations, but simply to provide increased awareness relative to elements that are routinely overlooked when the installation of fire and life safety equipment is required to be installed retroactively.

3 Tips for Starting (and Finishing) Pool Season Right By Doug Sartain, President of Certified Fire Protection

Memorial Day weekend marked the start of pool season and, if your community has an outdoor pool, you've no doubt spent the past few weeks readying the popular amenity. However, before your residents start diving in, here are a few practical tips to see you through the pool season, from beginning to end.

The pH, chlorine, total alkalinity and calcium hardness levels of the water all play in an important role in determining the water balance. Corrosion or scale on heater surfaces are both conditions that are commonly not covered by pool-heater warranties and can cause premature failure. Learn more about caring for your pool operator.

Tips for Pool Season

For instruction on the importance of water balance, consult the National Swimming Pool Foundation’s Certified Pool Operator program.

Consider chaining large flower pots to the pool fence to prevent plants from winding up in the pool, whether from heavy winds or vandals.

Paul Rhodes, CAMT, National Maintenance and Safety Instructor for the National Apartment Association Education Institute (NAAEI), once witnessed the damage to a community caused by its planters being tossed in the pool. Not only did the topsoil clog the sand filter, but plant root balls had to be vacuumed from the pool floor and the water needed to be “shocked” to remove the fertilizer.

3. As the end of pool season approaches, consider keeping the pool filled during the off-season. This will help prevent problems that can occur with an empty pool, such as plaster staining, pool deck and waterline tile cracking, hydrostatic pressure problems (where the pool “floats” up out of the ground), shortened life for the plaster and filter and the potential for vandalism.

However, realize that if the chain is visible, prospective and current residents may view this as an indicator that there is a crime problem at the community. If vandalism is a potential concern, communities should consider installing a built-in, raised flower bed instead of purchasing pots.

To keep the pool filled, the property must either monitor the pool chemicals or cover the pool. With the pool covered, staff realistically only need to check the pool about once per month.

Avoid the Fall of Brand Power Keep your community’s “brand” strong by not making these “all-to-common” mistakes By James Surowiecki of The New Yorker

About 18 months ago, Lululemon Athletica was one of the hottest brands in the world. Sales of its high-priced yoga gear were exploding; the company was expanding into new markets; experts were in awe of its “cultlike following.” As one observer put it, “They’re more than apparel. They’re a life style.” But then customers started complaining about pilling fabrics, bleeding dyes, and, most memorably, yoga pants so thin that they effectively became transparent when you bent over. Lululemon’s founder made things worse by suggesting that some women were too fat to wear the company’s clothes. And that was the end of Lululemon’s charmed existence: the founder stepped down from his management role, and, a few weeks ago, the company said that it had seen sales “decelerate meaningfully.” It’s a truism of business-book thinking that a company’s brand is its “most important asset,” more valuable than technology or patents or manufacturing prowess. But brands have never been more fragile. The reason is simple: consumers are supremely well informed and far more likely to investigate the real value of products than to rely on logos. “Absolute Value,” a new book by Itamar Simonson, a marketing professor at Stanford, and Emanuel Rosen, a former software executive, shows that, historically, the rise of brands was a response to an information-poor environment. When consumers had to rely on advertisements and their past experience with a company, brands served as proxies for quality; if a car was made by

G.M., or a ketchup by Heinz, you assumed that it was pretty good. It was hard to figure out if a new product from an unfamiliar company was reliable or not, so brand loyalty was a way of reducing risk. As recently as the nineteen-eighties, nearly four-fifths of American car buyers stayed loyal to a brand. Today, consumers can read reams of research about whatever they want to buy. This started back with Consumer Reports, which did objective studies of products, and with J. D. Power’s quality rankings, which revealed what ordinary customers thought of the cars they’d bought. But what’s really weakened the power of brands is the Internet, which has given ordinary consumers easy access to expert reviews, user reviews, and detailed product data, in an array of categories. A recent PricewaterhouseCoopers study found that eighty per cent of consumers look at online reviews before making major purchases, and a host of studies have logged the strong influence those reviews have on the decisions people make. The rise of social media has accelerated the trend to an astonishing degree: a dud product can become a laughingstock in a matter of hours. In the old days, you might buy a Sony television set because you’d owned one before, or because you trusted the brand. Today, such considerations matter much less than reviews on Amazon and Engadget and CNET. As Simonson told me, “each product now has to prove itself on its own.”

It’s been argued that the welter of information will actually make brands more valuable. As the influential consultancy Interbrand puts it, “In a world where consumers are oftentimes overwhelmed with information, the role a brand plays in people’s lives has become all the more important.” But information overload is largely a myth. “Most consumers learn very quickly how to get a great deal of information efficiently and effectively,” Simonson says. “Most of us figure out how to find what we’re looking for without spending huge amounts of time online.” And this has made customer loyalty pretty much a thing of the past. Only twenty-five per cent of American respondents in a recent Ernst & Young study said that brand loyalty affected how they shopped. For established brands, this is a nightmare. You can never coast on past performance — the percentage of brand-loyal car buyers has plummeted in the past twenty years — and the price premium that a recognized brand can charge has shrunk. If you’re making a better product, you can still charge more, but, if your product is much like that of your competitors, your price needs to be similar, too. That’s the clearest indication that the economic value of brands — traditionally assessed by the premium a company could charge — is waning. This isn’t true across the board: brands retain value where the brand association is integral to the experience of a product (Coca-Cola, say), or where they confer status, as with luxury goods. But even here the information deluge is transformative; luxury travel, for instance, has been profoundly affected by sites like TripAdvisor.

For consumers this is ideal: they’re making better choices, and heightened competition has raised quality and held down prices. And they’re not the only beneficiaries; upstarts now find it easier to compete with the big boys. If you build a better mousetrap, people will soon know about it. A decade ago, personal-computer companies like Asus and Acer had almost no brand identity outside Taiwan. Now they are major players. Roku, a maker of streaming entertainment devices, has thrived even though its products have to compete with similar ones made by Apple (which is usually cited as the world’s most valuable brand). And Hyundai has gone from being a joke to selling four million cars a year. For much of the twentieth century, consumer markets were stable. Today, they are tumultuous, and you’re only as good as your last product. For brands like Lululemon, there’s only one consolation: make something really great and your past sins will be forgotten.

Recently on The Accelerators, a blog on startups, entrepreneurs and investors discussed the best strategies for establishing valuable connections. For Gary Vaynerchuk, a serial entrepreneur and New York-based angel investor in more than three dozen startups, including Uber Technologies Inc. and Path Inc., it's about providing value first. An edited excerpt is below: Over the past seven years, I have thrown out a minimum of 100,000 business cards that I have received. I've been to a lot of networking events, conferences and other things of that nature, and to this day, I am completely baffled by the number of people who think "good networking" is predicated on the distribution of business cards; that giving a card to anybody

People will high-five their co-workers for running around a conference for four hours and handing out cards. Their key performance indicator is impressions, and it's wrong. Of course, I could give you plenty of tactics, such as: — Go to a conference, but don't even bother with the sessions. Stand out in the hallway, and say "hello" to everybody. — If you're staying behind after a conference, find others who are as well, invite eight of them out to dinner, and then pick up the check. I could tell you all those things from a tactical standpoint, but what I want to focus on is the why. Why are we networking in the first place? Why would someone want to network? Because at some point, you want something from this other person.

Networking is something that I take a lot of pride in. I'm good at it. I've learned the true secret to networking is gaining the first-mover's advantage: leverage. The right kind of leverage in a relationship allows you to extract value over time. How does one acquire that kind of leverage? Be the first person in the relationship to provide value. In my career there have been 500 to 1,000 times where I have approached someone, done something for him or her and then figuratively walked away. I expected nothing in return from those situations, and yet they have been, by far, the interactions that have driven my career (and my companies) forward. On the other side, the five to 10 times others have done this for me have been the beginning of great relationships. By giving first, you have established that the relationship will always be a minimum of 51:49 in your favor. You now have leverage for your counter-ask. This is something that is theoretically pretty easy, but the real trick is replicating it. Effective networking is about reversing the game everybody instinctively plays. It's about patience and buildup, not the close. We celebrate audacity and courage instead of patience and value. That's backward, and when you make an effort to buck the trend, not only will you be noticed, but you'll be appreciated and remembered. Take that laundry list for what you will, but I assure you that the real takeaway here is to pay it forward first.
