Lasting Powers of Attorney

Lasting Powers of Attorney

Lasting Powers of Attorney (LPAs) are legal documents that enable you to choose people you trust to deal with your affairs in case you ever become unable to do so for yourself, either temporarily or permanently. There are two types of LPA: one covering your Property and Finances and one for your Health and Welfare.

Without a valid LPA in place, your loved ones may find it difficult to step-in and help you in the future should the need arise. For example, if someone needed to access your money, manage your property or deal with your income they would have to get an order from the Court. The process of obtaining a Court order is expensive and can take a long time. It can also be stressful for your family at what is already a difficult time. Ultimately the Court decides who manages your affairs, which could cause conflict between family members and might even result in someone you wouldn’t necessarily choose being in control. The person managing your affairs under such a Court order would be monitored on an ongoing basis, which of course has associated costs and stresses. Having a valid LPA in place would avoid all of these potential issues.
