RASL Leadership Nomination Information REQUEST FOR NOMINATIONS

On June 17, 2011 the request for nominations form for the RASL Board of Directors was mailed to all Realtor members. Realtor members are invited to nominate themself or a fellow Realtor®, with their consent, as a candidate for one of our leadership positions for the 2012 term of office. The “2012 Nominations Form” is located under the information tab on www.rasl.com as well as on page 2 of the July Jazz Newsletter. The leadership of RASL requires enthusiastic, capable leaders to continue to achieve the goals of the membership and to enhance the real estate industry. If you are not interested in serving a position, but you know someone who you feel would be exceptionally well qualified to represent us, please encourage him/her to complete the nomination form. The deadline for nominations will be 5:00pm on July 8, 2011. Once nominated, you will receive a letter, election procedures, policy and application. Deadline for the completed application will be 5:00pm on July 15, 2011. The Nominating Committee will conduct candidate interviews on July 22, 2011 at the RASL office. All qualified applicants will be notified of the time for their interview. A candidate forum will be held on July 28th from 4:00-6:00 at the Ken and Aileen Education Center at RASL. Please mark your calendars for this important date and come hear the candidates speak about themselves and their desire to run for this elected office. July Ludie Article: Remember when I was complaining about how cold it was back in the winter months? Well, I don’t know what possessed me. I sure would like a little of the cold air outside now. I don’t want it all, just enough for a good breeze every now and then. I went shopping the other day and ran into my old friend, Gail Seward. Gail was talking about retiring and selling all her investment properties. She said she was just getting too old and it wasn’t as much fun as it used to be, when her husband was around. Gail’s husband passed away 4 years ago, and she has now decided to move up north closer to her children. Gail stated that she had found a buyer for her apartment complex and she was still negotiating the price. Gail and the buyer, Hugo Peabody, couldn’t agree on the price for the complex. Finally, they agreed that each would engage an appraiser and they would accept the average of the two appraisals as a fair price. Gail engaged Vern Story as her appraiser, and Hugo engaged Lucy Westenra as his appraiser. Both Realtors®, Vern and Lucy, were informed of the agreement of the principals. The two appraisal reports were submitted. The principals averaged the two valuations and made the transaction at the price determined. Six months later, it came to the attention of Gail that Vern was managing the building that he had appraised. Upon making further inquiries, she learned that Vern, for several years, had managed five other buildings owned by Hugo, and that he had been Hugo’s property manager at the time he accepted the appraisal assignment from her. At this point, Gail engaged Realtor® Kyle Cook to make an appraisal of the building she had sold to Hugo Peabody. Kyle’s valuation was approximately 30% higher than that arrived at six months earlier by Vern. Gail filed a complaint at the Association of REALTORS®, charging that when she hired Vern to appraise her property, she was unaware that he had a connection to her buyer, Hugo Peabody. Vern did not disclose his connection with Hugo and intentionally withheld the fact that he manages all of Hugo’s properties. Gail went on to state that Vern is currently managing the property that he had appraised for her in connection with the sale of her property to Hugo, and since he had not disclosed his relationship to Hugo he had acted unethically, and in the interest of his major client, had placed an excessively low valuation on the property he had appraised for her. At the hearing, Gail brought in a witness who stated that they had heard Hugo say that he had made a good buy in purchasing Gail’s apartment complex because her appraiser was his property manager. Hugo, appearing as a witness for Vern, disputed this and protested that he had paid a fair price. He substantiated Vern’s statement that management of the building formerly owned by Gail was never discussed between them until after Hugo had purchased the property. Well, do you think Vern is just making sure he has a continual revenue stream, or do you buy that he was doing the best job for his client? Maybe this is just selective memory on Vern’s part, but nevertheless, he didn’t tell the seller, Ms. Seward, that he managed the properties owned by the buyer. I don’t think that Ms. Seward would have hired him if she had known that he worked for the buyer, do you? It was concluded by the Hearing Panel that whether or not management of the complex was discussed between the buyer, Hugo Peabody, and the seller, Gail Seward’s Realtor®, Vern Story, prior to his purchase, Vern had a logically contemplated interest in it as a property manager in view of the fact that he had served as property manager for all other properties owned by Hugo Peabody. The Respondent, Vern Story was bound by the terms of Article 5 to disclose the interest he had with this property to his client, Gail Seward. He had failed to do this, so the panel found Vern in violation of Article 5 of the Code of Ethics. The Respondent, Vern Story, was directed to attend a Code of Ethics class within 180 days from the date the hearing decision became final. The proof of attendance must be furnished to the Association office upon completion.

Washington, DC, June 14, 2011 Althea Garner of Get Me A Home, Inc and Women’s Council of Realtors 2011 President Saint Lucie Chapter and Susan Hutchinson of Keller Williams Realty and 2011 President Elect Stuart-Martin County Chapter, have been awarded the Performance Management Network Designation by the Women’s Council of REALTORS®. The Performance Management Network is a next-generation REALTOR® designation designed from the ground up to deliver the real-world skills, know-how and tools to keep an agent’s business out front and on top of an evolving real estate market. PMN curriculum is driven by the following topics: Negotiating Strategies and Tactics, Networking and Referrals, Business Planning and Systems, Personal Performance Management and Cultural Differences in Buying and Selling. These classes are offered exclusively by Women’s Council and taught by instructors well versed in their subjects. Althea and Susan were presented with their awards while attending Women’s Council of Realtors® Mid Year Meetings held in conjunction with National Association of Realtors® in Washington, DC. The three day event was packed with education, breakout sessions, special speakers and programs all designed to further the attendee’s knowledge of the real estate industry. Women’s Council of REALTORS® is a nationwide community of more than 19,000 real estate professionals who include many of the best and brightest in the business.
