What is Amendment 4? Amendment 4 is a constitutional amendment on Florida’s ballot this year. This proposal will lower property taxes for new homebuyers and spur muchneeded economic growth in the housing market by offering a healthy new exemption for first-time homebuyers. Amendment 4 will also protect working families, small businesses and homeowners from unfair and unexpected tax increases by helping to stop “recapture,” a tax gimmick that increases property taxes even when property values decline. Finally, Amendment 4 will lower assessment increases on non-homestead properties from a burdensome 10 percent to a more reasonable 5 percent.

Bottom Line  Amendment 4 creates an additional homestead exemption for first-time homebuyers for 5 years.  Amendment 4 protects Floridians from increased property taxes when their property values have declined.  Amendment 4 lowers the maximum yearly assessment increase on non-homestead properties from 10 percent to 5 percent.

Potential Questions Q: Does this new homestead exemption replace the exemption in current law? A: No. The new homestead exemption in Amendment 4 is applied in addition to your current homestead exemption. Q: Won’t creating an additional homestead exemption affect the funding of police officers and firefighters? A: Amendment 4 is not retroactive and does nothing to affect the current budgets of local governments. Q: Does Amendment 4 change or reduce “Save Our Homes”, which caps assessment increases at 3% per year for homestead property, at all? A: No. Q: If local governments are not able to raise the assessed value of a property that has gone down in market value, won’t they just raise millage rates? A: It is the local government’s decision whether to raise taxes on Florida homeowners or not. Amendment 4 simply gives the Legislature the authority to protect homeowners from burdensome, unfair tax increases if the value of their home goes down. Q: Exactly how much is this new homestead exemption? A: The additional homestead exemption that Amendment 4 creates is equal to half of the home’s value, up to half the median home value in the county. Learn more: http://www.taxyourassetsoff.com

RECOMMENDATIONS ON SUPPORT OF AMENDMENTS: ******************************************************************************************** The Florida Realtors Executive Committee and members of the Public Policy Committee have reviewed the Amendments on the ballot for November 2012 and have recommended support for the following Amendments: Florida Realtors support Amendment 2 regarding property tax exemptions for disabled veterans on the November 2012 ballot. Rationale: Amendment 2 would expand the exemption for disabled veterans to include those not residing in Florida when their injury occurred. This has a relatively small fiscal impact (less than 2.5 million for 2013-2014; will encourage veterans to move to Florida and expands a worthy exemption already supported by Florida Realtors. Florida Realtors support Amendment 3 regarding the state revenue limitation on the November 2012 ballot. Rationale: Amendment 3 would replace the current state revenue cap, which has been in place since 1994 and has never been used, with a new cap that would limit state revenue growth based on growth in population and inflation. If in place since 1980, the new cap would have been used once, in 2006. It requires excess revenues to be deposited into the state’s Budget Stabilization Fund, used to support public schools by reducing property taxes used to fund education, or returned to the taxpayers. Florida Realtors support Amendment 4 regarding property tax limitations on first time homebuyers, on Homesteaded property whose value has decline, as well as a reduction for nonhomestead assessment increases. This amendment will appear on the November 2012 ballot. Rationale: Amendment 4 would lower property taxes for new homebuyers by creating an additional homestead exemption for first-time homebuyers for 5 years. It would protect Florida homeowners and small businesses from unfair and unexpected tax increases by helping to stop “recapture”, which increases property taxes on homesteaded properties even when property values decline. Additionally, this amendment will lower assessment increases on non-homesteaded properties from a burdensome 10 percent to 5 percent. Florida Realtors support Amendment 9, regarding a new property tax exemption for surviving spouses of military veterans or first responders killed during active duty. The amendment will appear on the November 2012 ballot. Rationale: This amendment has a relatively low fiscal impact ($660,000 for the first year) and is a worthy exemption for the families of fallen heroes. Florida Realtors support Amendment 10, regarding expansion of the tangible personal property tax exemption, on the November 2012 ballot. Rationale: This amendment expands the tangible personal tax exemption from $25,000 to $50,000 and allows local governments to further expand the exemption by local ordinance; Florida Realtors supported the increase in the exemption four years ago from $5,000 to $25,000; this amendment will exempt more individual entrepreneurs from paying the tangible personal property tax. Florida Realtors support Amendment 11, which allows local governments to establish a new lowincome, long time resident, senior exemption. This amendment will appear on the November 2012 ballot. Rationale: This amendment would allow local governments to enact an exemption for lowincome seniors who have lived in their homes for at least 25 years. It has no impact to schools, and a relatively low fiscal impact to local governments.
