This entirely member-led committee oversees our nominations process, reviewing applications, meeting with interested individuals, and finally announcing the slate of candidates at our Monthly Luncheon in September. Voting will then remain open until our October AGM, when the new Board for 2024 will be announced.

We have also started adding observers to Committees and Councils so that members can understand the duties of the co-chairs who operate these twenty-five working groups. In December the board will appoint the leadership for 2024.

It’s been a fantastic first half of 2023, with 53 in-person networking events, 45 online webinars and working Council meetings, as well as signature events like the AmChams of Asia Pacific Summit, the AMCHAM Academy, the Governor’s Gala, Independence Day Tree Planting and an abundance of visits to Royal Thai Government Ministries and Agencies. We can’t wait for the second half where we’ll host the ChariTee Golf Tournament, the 2023 Corporate Social Impact Awards and begin engaging with the new government after it forms.

Creating a Ripple Effect in Thai Education: Stories of Impact & Progress

Teach For Thailand works to develop a network of leaders to achieve educational equity for all Thai children through a two-year fellowship program. They recruit and develop top Thai graduates and young professionals to work alongside schools and communities in high-needs areas, providing access to great education as well as to learn about educational inequity. After the two-year fellowship, they join an alumni network that works collectively to affect change which benefit all Thai children. Here’s an excerpt of an interview with three of their alumni.

“Everyone can change the education system.”

While this sentence presents an intriguing concept in theory, its practical implementation may not be as effortless as it suggests. Particularly when considering the experiences of individuals such as Sky, Fluke, and Phoom, who have spent two years working as school teachers.

Creating an impact on a larger scale may require more than individual effort. One impactful approach involves working at the policy level, where decisions and regulations have the power to influence the lives of people across the country.

Expanding Impact Through Policy to Achieve Dreams

For Sky, who works on proposing policies to drive the government, the driving force behind his policy-making career is his desire to expand the impact of his work. “When I was teaching in the school, the impact was limited only to the classroom, and I was not able to fully scale the impact. Even if I had a cool teaching method, it could not be scaled”.

Phoom joined the Equitable Education Fund (EEF) because he believed in investing in education. “I am an economist who has a passion for finance. “When I heard about the Fund, it immediately got my attention because I firmly believe in the significance of investing in education. I want to help educational organizations work more smoothly and effectively. I strive to ensure that when the Fund invests in various research projects, it invests in the right projects, yielding the desired results.”

Fluke, who is currently an education researcher at the Office of the Basic Education Commission (OBEC), wants to work on problems that teachers cannot solve.

“In the role of a teacher, we can only solve problems at the micro level, helping only a few people, perhaps 100-200 people. However, policies have a broader impact, enabling thousands of students to pursue their education. The magnitude of the impact is greater, and it aligns with my area of expertise.”

Positive Discovery that Ignites the Path Forward

When asked about what impressed them regarding policy work, Fluke’s response may serve as a noteworthy reflection of the comprehensive nature of their work.

“What surprised me was the immediate implementation of orders from the policymakers, without the need for lengthy procedures. For example, when a school faced water shortage, upon receiving instructions from the policy level, the school had water supply restored promptly. I’m happy to see the impact of my work”

Sky shared an impressive discovery about the work environment.

“When I participated in academic activities and met diverse stakeholders in the Ministry of Education, I encountered numerous positive aspects and interesting practices. I met individuals with exceptional ideas with a clear focus on achieving

tangible results, and diverse problem-solving approaches. These encounters made me let go of my ego and preconceptions.”

“For example, during a period, there were societal concerns about consolidating or closing small schools. However, upon delving into the policy process, I realized that the reason for consolidation or closure was due to the high cost of maintaining the schools, considering the limited benefits they provided. This eye-opening experience allowed me to adopt a more realistic way of thinking.”

Beginning With an Individual but With Government Support

When delving deeper into the idea that was popular in society at one point, which was ‘if we want to solve social problems, we need to start with ourselves,’ all three of them shared notable opinions:

Sky said that this idea is rational to some extent, but the government must also consider the public’s input. “I think this idea makes sense to some extent. Everything must begin with individuals, but it only becomes effective when everyone starts together. This is because policies rely on proposals, and the system itself is vital as it should allow public participation in policy development.”

Similarly, Phoom also shares a similar idea, which is focusing on starting with oneself and taking responsibility. “Starting with oneself is important as reflected in the saying ‘be the change you want

to see’. It would be wonderful if everyone had agency and could determine their own course, but that is not the whole picture. Systemic factors certainly play a role. For example, if the system is flawed, it becomes an obstacle, hindering the adoption of better approaches or impeding meaningful change.”

In response to this question, Fluke expresses disagreement with the statement “if you want to solve social problems, start with yourself.” “I think that focusing only on the individual inhibits the ability to address the structure or dismantle it because people’s behaviors and thoughts depend on the structure itself. The truth is that change cannot be achieved by one person alone. It can only occur when many people come together.”

The Superpower of Those Striving for Education

When asked about what they were most proud of in their work, the faces of the three individualsFluke, Sky, and Phoom – immediately lit up.

Sky took a moment to reflect before answering, “What I am most proud about is developing proposals based on the real needs of people in the community and creating policies at the local level.” “For instance, in Rayong, there was an issue where schools were unaware of their student’s academic performance. We assisted them in developing tools to measure student performance. Although this tool may not have yielded immediate success, it provided a direction for future problem-solving.”

Fluke shared two sources of pride. Firstly, his involvement as a follow-up committee member for policies in the Bangkok education system. His work enabled more than 5,000-6,000 students to access the fund of EEF. Secondly, he organized a field trip to Bangkok from various provinces including Nan, Satun, Kalasin, and Sakon Nakhon. The field trip inspired these students to pursue their education at universities in Bangkok.”

As for Phoom, he spoke about his pride in developing international cooperation in his organization. “I initiated the cooperation between EEF and the Organisation for Economic Cooperation and Development (OECD, resulting in active teacher development. In addition, my contributions in communications and data preparation helped us gather valuable resources,

including the ability to raise billions of baht in funding.”

These are just a few of the Alumni who are driving change with real aspirations.

Phoom (Phoom) Pentrakul is an analyst and coordinator of the teacher development project at the Education Equality Fund (EEF) and a Harvard Kennedy School candidate (Masters in Public Administration, class of 2025). He aims to expand his impact on a national level by working in collaboration with the government.

Thunhavich (Sky) Thitiratsakul is a researcher in Education Reform Policy at the Thailand Development Research Institute (TDRI). He is interested in policy-level change. This has led him to work as a researcher under the innovation area project.

Jirawut (Fluke) Jitjak is an Educator at the Basic Education Commission Office at the Ministry of Education. He has been appointed to move to the Bangkok Educational Office at Bangkok Metropolitan Administration (BMA). He is interested in promoting equal and quality education at the policy level.

Bolstering Blue-Collar Financial Health: A Strategic Imperative for Employers

The rise of the digital economy, coupled with the ongoing challenges of a global pandemic, has brought about a significant shift in the world of work. Amidst these changes, a critical segment of the workforce often overlooked in the financial health conversation is blue-collar workers, particularly in Thailand. It is time we changed this narrative.

As a society, we must acknowledge the indispensable value blue-collar workers bring to the table. Their work is the lifeblood of the Thai economy, and their financial well-being is not just a moral responsibility but also a strategic imperative for businesses. Financial health can be the catalyst for happier employees, higher productivity, and increased employee loyalty and retention. To underscore the point, we refer to results from an employee survey conducted by Salary Hero in Thailand’s manufacturing industry. The survey represented companies from eleven Thai provinces and over 150,000 employees.

Leveraging HR for Financial Wellness: An Area of Focus

The role of Human Resources (HR) is pivotal in shaping and implementing policies that directly

affect workers’ financial health. This importance is even more pronounced for blue-collar workers, who often lack access to comprehensive financial resources and education.

The results from the survey paint a stark picture: about 70% of workers surveyed admitted to using loan sharks, and 83% reported experiencing financial stress. These alarming figures highlight a vital opportunity for HR to step in and create a significant positive impact by championing financial wellness.

Financial Wellness and Productivity: The Unmissable Link

Financial stress can have a detrimental effect on the overall productivity of the workforce. Employees struggling with financial worries are more likely to be distracted and less engaged, directly impacting their performance and, in turn, the company’s output.

By investing in financial wellness programs, companies can help their employees better manage their finances, leading to a more focused and productive workforce. Moreover, 82% of the surveyed employees noted they would view their employers more favorably if they facilitated access to financial health tools like Salary on Demand, financial education, and other wellness tools.

Enhancing the Employer Value Proposition with Financial Health

The Employer Value Proposition (EVP) is a unique set of benefits an employee receives in return for their skills and capabilities. A strong EVP is critical to attracting and retaining a high-quality workforce, particularly in Thailand’s tight labor market.

Incorporating financial wellness into the EVP can significantly enhance a company’s appeal. It sends

a strong message to current and prospective employees that the company genuinely values their people. This commitment can boost employee loyalty, reduce turnover, and cultivate a positive company culture.

The Compelling Business Case for Investing in Financial Health

Investing in the financial health of blue-collar workers is not just a moral obligation - but also makes sound business sense. The results from the survey further strengthen this assertion. Companies that prioritize their employees’ financial health stand to benefit from increased productivity, improved morale, decreased absenteeism and lower turnover and recruitment costs.

Moreover, demonstrating a commitment to employees’ financial health can significantly enhance a company’s reputation and branding. In a world where companies’ social footprints are closely scrutinized, businesses that invest in the financial wellness of their employees distinguish themselves as responsible employers and thought leaders.

By adopting the right HR tools and technologies, companies have a unique opportunity to make a tangible impact on the lives of their people and with the availability of tools and quality technology in 2023 – this has never been easier to execute.

Conclusion

The financial health of blue-collar workers is an issue of crucial importance that requires urgent attention and action. By leveraging data and new

technologies, companies can implement effective financial wellness programs that are easy to implement with seamless integration to their existing systems.

Investing in the financial wellness of employees is a win-win strategy that yields happier employees, a more productive workforce, a stronger employer brand and a tangible boost to the company’s bottom line - making it not just the right thing to do but also smart business.

Terminating Employment for Poor Work

Most employers know that terminating employees for poor job performance is not easy. However, it is actually legally possible if employers have the right approach and take specific precautionary measures. Failing to take these precautions can mean that an employer is either stuck with an incompetent employee or on the losing end of a lawsuit for unfair termination.

This article will lay out some essential considerations for employers in Thailand regarding termination of employment for poor performance.

First, understand that “poor work performance” refers to a lack of performance or ability, or an inability to work with other employees. It does not constitute a violation of work rules or regulations. However, in some cases an employee’s failure to act in accordance with lawful instructions or commands from the employer, resulting in poor work performance, could also be considered a violation of work rules or regulations. This may occur if the work rules or regulations state that employees must strictly comply with the employer’s instructions or commands.

Second, it is indeed possible for an employer to terminate an employee due to poor work performance. For example, this may be possible in the following scenarios:

• Records indicate that an employee’s work performance has fallen below the employer’s required standards, and the employee has made no effort to improve his or her work performance for three consecutive years. Furthermore, there is no evidence of bias on the employer’s part when assessing an employee’s work performance.

• The employee’s job description includes the responsibility of coordinating with employees in other departments, but the employee has been unable to do so. As a result, the employee was reassigned a new job role, but their performance still did not improve. This pattern suggests a significant lack of interpersonal skills and an inability to collaborate with others. The employee’s behavior has had a detrimental impact on the efficiency of the employer’s business operations and has caused significant damage to the employer.

• An employee in senior management had a duty to strictly work in accordance with the employer’s policy and comply with the employer’s orders, and effectively perform the job to set a good example for other employees. However, the employee neither worked in accordance with the employer’s policy nor complied with the employer’s orders. The

employee also failed to improve performance even after receiving a notice from the employer requesting improvement. Continuing to employ this senior manager would disrupt the employer’s chain of command and future business operations. Therefore, the employer has the right to protect its interests by terminating the employee according to the relevant section of Thailand’s Civil and Commercial Code.

Third, there are several steps an employer should take regarding termination due to poor work performance to reduce the risk of committing an unfair termination:

• The employer should regularly assess the employee’s work performance so that if a problem arises, there are assessments covering multiple years, not only the latest one.

• The assessment of work performance should be conducted by both the employer and the employee, without any bias.

• The employer should identify causes, implement remedies. and establish measures to improve the employee’s work performance (such as setting a performance improvement plan) if it is unsatisfactory.

• It is crucial to give the employee time and opportunity to improve before considering termination of employment. The more time and opportunities given to the employee, the fairer the termination of employment.

• If the employment agreement specifies that the employee’s work performance will be used as a criterion for evaluating the employee’s

abilities, the employer has the right to terminate the employment agreement if the assessment of work performance falls below the required standard set by the employer. If the employer then exercises this right as specified in the agreement, it would not be considered unfair termination.

Fourth, if an employer terminates an employee due to poor work performance, the employer is still required to make statutory payments, such as severance pay and wages in lieu of advance notice. However, if the employee neither adhered to the employer’s policy nor complied with their orders, the employee can be terminated immediately, and the employer is not required to pay wages in lieu of advance notice.

Keeping these four key factors in mind and seeking expert assistance when complications arise, can help protect employers from costly penalties and unfavorable rulings in the event of legal disputes arising from termination of employment for poor performance. While it is not easy to terminate employees for poor performance, it is entirely possible if employers exercise prudence and adhere to the law.

Meet the Embassy @ the U.S. Ambassador’s Residence

On May 11, His Excellency Robert F. Godec, the U.S. ambassador to Thailand hosted a “Meet the Embassy” event for members of the American Chamber of Commerce (AMCHAM) in Thailand. The event was attended by key department and section heads within the U.S. Embassy, including the Consular, Economic Section, Foreign Agriculture Service, Foreign Commercial Service, Public Affairs, United States Customs and Border Protection (under Homeland Security), United States Patent and Trademark Office, and United States Trade and Development Agency.

During the event, AMCHAM members gained insight into the day-to-day work of the U.S. Embassy and their efforts to promote US-Thailand relations. Ambassador Godec reaffirmed the U.S. Embassy’s commitment to helping American businesses achieve their goals in Thailand and strengthening the partnership and relations between the two countries for the long-term benefit of both.

Independence Day Celebration: 190 Trees for 190 Years of U.S. - Thai Diplomacy

AMCHAM Commemorates Independence Day and Celebrates 190 Years of Diplomatic Relations between the U.S. and Thailand

On June 2, the American Chamber of Commerce in Thailand (AMCHAM), led by AMCHAM Vice President Deborah Seifert of Pfizer, commemorated Independence Day and celebrated the fruitful 190th anniversary of diplomatic ties between the U.S.-Thailand. The event took place at the U.S. Ambassador’s Residence, with the gracious host U.S. Ambassador to Thailand, Robert Godec, and the distinguished guest of honor Bangkok Governor Chadchart Sittipunt.

During the event, the AMCHAM business community demonstrated unwavering dedication to the local community by planting five ceremonial trees, contributing to Governor Chadchart’s one million tree initiative. This initiative aims to combat

air pollution, add more green space, and promote environmental diversity. The five trees include the national flower of Thailand, the Golden Shower Flower or Ratchaphruek, Mayodendron Igneum or Peep Thong for strength and progress, Thai Bangor or Salhao for luck and status, and Horse Cassia or Chaiyaphruek for success and victory.

AMCHAM members reaffirmed their enduring commitment to Thai society and the million-tree policy. AMCHAM aims to plant 185 more trees at a public park later this year. “We are excited to foster long-term relationships and actively contribute to the progress and prosperity of the local community”, emphasized AMCHAM Vice President Deborah Seifert.

AMCHAM’s Governors’ Gala Dinner Raises Over 700,000 Baht to Fund Scholarships for Thai Students in Need

On May 27, 2023, at the Shangri-La Hotel Bangkok, the American Chamber of Commerce in Thailand (AMCHAM) hosted the Governors’ Gala. The Gala is one of AMCHAM’s signature social events, bringing together the international business community to celebrate the service and commitment of the 2023 AMCHAM Board of Governors. Throughout the joyous evening, members contributed funds and increased awareness for the longstanding AMCHAM Thailand Foundation (ATF) scholarship program.

This year guests got a taste of the big top with a Circus Circus theme, and they embraced the occasion by adorning themselves in their preferred circus-themed attire. AMCHAM Vice President, Arpaporn (Gift) Samabhandhu, Vice President & Area Managing Director at KENVUE warmly welcomed the attendees-”AMCHAM remains committed to fostering a robust international business community. AMCHAM Empowers Next Generation of Business Leaders at Exclusive Residential Program

The American Chamber of Commerce in Thailand (AMCHAM) recently concluded its AMCHAM Academy Residential Program from May 15 to 17. This exclusive two-and-a-half-day event aimed to empower mid to senior tier management professionals from AMCHAM member companies by providing them with a unique platform to enhance their leadership skills, forge valuable business connections, and network with likeminded peers. AMCHAM Executive Director Heidi Gallant highlighted the program’s objectives,

stating, “The AMCHAM Academy Residential Program is designed to equip rising professionals from our member companies with the tools they need to excel in their careers. Additionally, the program offers exclusive access to industry experts for direct learning opportunities and the chance to build a long-lasting business network. We had an exceptional turnout in the program’s inaugural year in a residential format and are thrilled to announce we will host it again next year.”

The program featured a dynamic format of speakerled presentations, engaging panel discussions,

and dedicated networking sessions. Participants were immersed in a wealth of industry-specific insights, gaining valuable knowledge on topics such as responsible business practices, effective networking strategies, cultivating meaningful relationships, sustainability, diversity and inclusion, and emerging economic and geopolitical trends.

The cohort represented diverse backgrounds and industries, including automotive, technology, fashion, legal, and more. All participants shared

a common goal of enhancing their leadership capabilities, expanding their networks, and actively engaging in AMCHAM activities. Zach Heinecke, an Executive Trainee at Minor International, expressed his appreciation for the program’s networking opportunities, stating, “I have gained new insights on the importance of cultivating a strong network, and I made numerous valuable connections during the program. I am also eager to contribute meaningfully and make a significant impact by participating in one of AMCHAM’s 25 Committees.”

Describe your journey as an AMCHAM Board of Governor

I first joined the AMCHAM Board of Governors around mid- 2022 when I took over the position of Chevron Thailand’s Managing Director from my predecessor, who was a retiring board member. I felt that I had been given an opportunity to step out of my comfort zone and take on a role that I had never done before. It allowed me to create a new network and represent Chevron while serving the Thai community and American businesses. As the election for new board members approached in the last quarter of 2022, I decided to apply and was ultimately elected as one of the board members for 2023-2024

term. In addition to serving on the AMCHAM Board of Governors, I also serve as a board liaison for both the Environmental Social and Governance (ESG) and the Government Affairs Councils.

What leadership principles have been the most effective for you in your career?

I grew up believing that we all live to create value for others, especially those surrounding us. My motto is, “When you lie down at night knowing in your heart that you have made someone’s life just a little bit better, you know you had a good day”. Leaders are the ones who make others successful. They create inspiring visions that people want to follow. Leaders not only lead, but they also support their followers and remove barriers. As I look back on my career, the leaders who cared about other people the most were the ones who were most effective.

Which AMCHAM membership benefit is most valuable to you?

I enjoy connecting with other people and learning about other companies’ businesses. I believe by leveraging each other’s strengths, we can make our own business stronger. There’s a saying “If you want to go fast, go alone. If you want to go far, go together”. I do not believe we need to have all the capabilities within our own organization or excel in every aspect. In fact, that may not even be possible. What’s important is knowing where to acquire those capabilities when we need them. As I have learned more about other businesses, I have found that we often face similar challenges and can learn from each other. The various councils and committees provided by AMCHAM offer opportunities for learning and addressing common business challengesand the US-Thai business community. I look forward to building more terrific friendships!

Rockwell Automation Thailand Creates Education Oasis

Multi-Chamber Eastern Seaboard Networking hosted by AMCHAM – May 19

On May 19, 2023, the American Chamber of Commerce in Thailand (AMCHAM) held the Multi-Chamber Eastern Seaboard Networking event at Holiday Inn Pattaya. The event was organized by AMCHAM in collaboration with the Australian, British, Canadian, Belgian, German, Irish, Netherlands, South African, Singapore Thai Chambers of Commerce, and the Thai-Taiwan Business Association. It offered members from Bangkok and the Eastern Seaboard a valuable opportunity to network and establish business connections.

AMCHAM Executive Director Heidi Gallant stated, “the Multi-Chamber Eastern Seaboard Networking serves as an excellent platform for AMCHAM members and participants from other chambers to explore new business opportunities and foster ongoing business connections.”

Prior to the networking event, AMCHAM’s Legal, Human Resources, and Manufacturing Committees hosted a business briefing on the topic of “From Hiring to Firing - Important Considerations and Updates for Employers in Thailand.” The briefing featured Parada Saibua, Senior Associate of DLA Piper, and Suruswadee Jaimsuwan, Counsel of Tilleke & Gibbins, who shared valuable insights and tips for manufacturers on attracting skilled candidates, retaining valuable employees, and fostering employee loyalty and engagement within manufacturing operations.

The hotel’s outdoor space overlooks the beach at sunset and was the perfect spot for chamber members to enjoy themselves, network, and delight in fine food and drink. With great service and hospitality from the venue, everyone had a fantastic time.

The speaker delivered a comprehensive update and forecast on the auto industry across Southeast Asia, with a primary focus on Thailand, Indonesia, and Vietnam. He presented statistics and numbers, highlighting the upward trajectory of the auto industry in Thailand and the ASEAN region. The manufacturing of battery vehicles (BEVs) is expected to significantly increase as a result of the government’s tax scheme and subsidies for BEVs. It is expected that Thailand will continue to be known as the “Detroit of Asia” in the coming decade.

To reflect this evolution, AMCHAM has renamed our signature awards program the AMCHAM Corporate Social Impact Awards.
