Hi everyone, first of all, let me introduce myself first. My name is Clara Titania, usually called Caca, I'm from the Faculty of Law, Diponegoro University. This year, I was given the opportunity by ALSA LC UNDIP and the Public Relations Division to become Project officer of Thrive Magazine Volume III. In this year, Thrive Magazine took the theme of Investment Law. This theme was taken because there are many cases regarding illegal investments and many people who didn’t understand what investment law is.

Therefore, with the establishment of Thrive Magazine Volume III, every reader can increase their knowledge related to Investment Law. Investment law is a very hot topic to be discussed among the public. From Thrive Magazine Volume III, everyone can find out about law enforcement in accordance with illegal investments and can differentiate between legal investments and illegal investments, which is an important point to prevent the public from fraudulent illegal investments circulating. Thrive Magazine Volume III also not only provide knowledge about investment law in this country, that is Indonesia, but also provide knowledge about investment law outside Indonesia, that is Singapore. So that readers can broaden their knowledge about investment law on an international scale

Dear ALSA Local Chapter Universitas Diponegoro, June 21, 2022 From its humble roots in 2002, the Asian Law Students’ Associations (ALSA) has risen to become one of the largest law students’ associations in the world. Reaching over 9,000 members in over 16 jurisdictions, it has become the premier representative body of law students in Asia. As an organization, we uphold 4 main pillars, namely, internationally minded, legally skilled, academically committed and socially responsible, where we always strives to implement them in every event that we have.

Reflecting the Strategic Plan of ALSA, which encourages the Local Chapters and National Chapters to send in academic articles and publications for the enhancement of equipping the members with academic commitment, I truly appreciate LC Undip’s initiative of this Thrive Magazine. OJK'S LIMITED AUTHORITY : LIMITED SOLUTION ?

ndonesia is one of the countries that ensures the welfare of its people as it formulated in the fourth paragraph of the Opening of the 1945 of the Republic of opening of theConstitution 1945 Constitution of the Indonesia and Chapter XIV of the 1945 Constitution Republic of the Republic of Indonesia regarding state’s obligation to be responsible for the welfare of its people in every aspect, not least economic.

It's role in guaranteeing economic welfare is manifested in one of the state institutions, namely the Financial Services Institution (LJK). These institutions have the main function of providing other financial services for citizen’s daily life. Even with their very broad authority, LJK still have to be monitored and limited in exercising their authority, which is carried out by the Financial Services Authority (OJK).

Today, the development of technology has brought humans into an era of digitalization that is all practical. It is used by some cunning people to create an investment offer with a way to trick people into accepting it, even though it is illegal and fraudulent. One of the examples is fraudulent investment’s issues done by Indra Kenz that was captured on February,24th related to scam using Binomo app. To overcome these problems, OJK can certainly step in to speed up the process of finding the solution.

It must first be known that in Law No. 21 of 2011 concerning OJK, the authority of OJK is to supervise Financial Service Institutions (LJK) in exercising its authority.

According to the constitution, the OJK only has the authority to supervise agencies that are included in the LJK, while the perpetrators of these fraudulent investments come from agencies that are not registered in it.

Therefore, the OJK doesn’t have the authority to take direct action regarding these cases.

Despite the limited authority, OJK still has several important actions that can be a solution to these problems The first is to build a coordination framework with institutions, especially with Bank Indonesia (BI) to exchange information related to investment data as well as cooperate with the Investment Alert Task Force as a party that can take direct action against perpetrators who have been reported to the OJK. The next action is to take preventive measures, such as initiating outreach activities to the public regarding knowledge about fundraising management and illegal investments prevention with the aim of educating the public further as well as giving warnings to remain cautious in investing.

Financial Service Authority’s Measures in Mitigating Damages Caused by Binomo By: Callista Putri Bourdeau and Kyla Lintang Ruchita

Binomo is a trading platform to generate money easily.

Binomo uses a convenient and simple mechanism to invest and trade assets such as forex, stocks, gold, silver, etc.

Binomo uses a binary option system, where it’s relatively easy to use but is prone to cause harm to its traders. Binomo’s “gamble-like” system became one of the reasons why it is illegal to use in Indonesia. Illegal investment applications like Binomo has been one of the major problems in Indonesia, where it has caused its users great loss of assets and money.

When investing, the profit is directly proportional to the risk.

The higher the profit obtained, the higher the risk. Meanwhile Binomo offers little capital investment with big profits.

Therefore, Binomo is a fraud. People who promoted Binomo were not traders, they were gamblers. Binomo should work the same as other trading platforms where the players will win and lose. But in reality, there is no purchase of any assets whatsoever, making them not a legit trading site.

Binomo has been announced as illegal by the Commodity Futures Trading Regulatory Agency because it’s not registered and licensed as legal by Indonesia’s regulators. Despite its illegal status, Binomo is still roaming around the application store freely even though it has been blocked by the Ministry of Communication and Information several times. At least 10.000 people are victims of Binomo, and one of the most famous cases was where Indra Kenz was reported by Maru Nazara. He said that he lost approximately Rp500 million in six months. Looking at the risks and harm it has caused to the citizens, Indonesia must take further effort to put an end to all illegal investments like Binomo.

To mitigate the damages caused by illegal investments such as Binomo, we can maximize the role of the Financial Services Authority to provide solutions to these kinds of issues. Based on Law No. 21 of 2011 concerning Otoritas Jasa Keuangan. Article 28 paragraph 1, Financial Authority Services (OJK) regulates legal protection as providing information and socialization to the public. Financial Services Authority or OJK as Indo financial authority should be more active in educating about fraudulent investment and should start creating an investment task force. OJK has regulations that can overcome future cases of illegal investments, including the regulations regarding legal protection for those who are victims from illegal investments.

One of their roles in overcoming this issue is by providing several measures as stated in Article 29 of Law No. 21 of 2011, where the Financial Services Authority may provide complaint service for consumer, such as: 1. Prepare an adequate equipment for providing service to consumer complaints that have been harmed by actors in Financial Services Institutions; 2. Create a complaint mechanism for consumers who are harmed by actors in Financial Services Institutions; and 3. Facilitate settlements for consumer complaints that have been harmed by actors in Financial Services Institutions in accordance with the laws and regulations in the financial services sector.

In brief, OJK’s role in eradicating illegal investment is by providing supervision, education, anticipation, and investigation. In hopes that in the future, cases and complaints from citizens regarding fraud and scam by illegal investments can be diminished.

What is the effectiveness and form of legal regulations in Indonesia regarding illegal investments?

An investment is generally defined as one that does not have a permit from the applicable state institution (in finance, it is mostly regulated by the Financial Services Authority (OJK)).

Illegal investment is an act that fulfills the elements of a criminal act as defined by various laws and regulations in Indonesia, including the Criminal Code ("KUHP"), Banking Law No. 10 of 1998 concerning Amendments to Law No. 7 of 1992 concerning Banking ("Banking Law"), Law No. 7 of 2014 concerning Trade as amended

by law No. 11 of 2020 concerning Job Creation ("Trade Law"), Law No. 17 of 2012 concerning Cooperatives ("Cooperative Law"), Law no. 8 of 2010 concerning the Prevention and Eradication of the Crime of Money Laundering (“Law on Money Laundering”), Law no. 21 of 2008 concerning Sharia Banking (“Banking Law”), Law Number 19 of 2016 concerning amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions (“ITE Law”).

Thus, law enforcement officers are now able to use the regulations and/or articles relating to illegal investments to entrap business actors who have deceived and/or embezzled public funds, as seen in the cases of Asuransi Jiwasraya, ASABRI, Indra Kenz, and Doni Salmanan. need foresight and the ability to string facts together so that crimes can be caught and punished It should also be noted that, as digital investment transactions evolve, law enforcement officers are expected to be able to employ existing laws to arrest business actors who have harmed the public.

The justification that current legal regulations have not been able to reach digital-based investment cases must be abandoned by returning to basic principles of criminal law, especially Mens Rea (the perpetrator's inner attitude - the intention to commit a crime) and Actus Reus (the essence of the act committed). without the right of the victims to demand civil compensation from the perpetrators of the crime. On the other hand, regulatory developments are required to encourage prevention (preventive activities), because the law must respond to societal trends. How to identify and differentiate legal and illegal investment instruments?

Why are the perpetrators of crimes that often occur with money laundering crimes, such as cases of investment in illegal binary options trading and how should the perpetrator be held accountable?

Business actors who invest illegally, of course, will try to find the proceeds of their crime by paying the proceeds of crime to legal and legal goods/or businesses, such as purchasing luxury vehicles, luxury objects, art objects, securities in the form of companies and debt securities, insurance policies, and so on. This action is being made to protect the proceeds of the crime; if the crime is not revealed in the future, it is intended that law enforcement officers will have difficulty checking and confiscating the crime's assets. The perpetrators of money laundering violations can then be held criminally responsible, and business actors who invest illegally can be held civilly responsible for the victims' losses.

Why is illegal investment often associated with cyber crime and how is the legal protection for it?

The link between illegal investment and cyber crime cannot be separated from the investment instruments offered through electronic media.

The development of digitalization has also reached out to the financial industry, especially investment instruments that are now offered through electronic media to consumers. Along with the rapid development of digitalization and the increasing number of community members who have access to electronic media, an increasing number of consumers are placing their funds into investments offered through these electronic media. As previously explained, there are legal investment instruments and illegal investment instruments.

The offer of illegal investment instruments through electronic media is a factor behind cyber crimes (“cyber crimes”) in the form of fraud or what is often known as “spoofed investments”.

Broadly speaking, cybercrimes are all criminal acts that use facilities or with the help of electronic systems. The crime referred to in the context of illegal investment is regulated in Article 378 of the Criminal Code regarding fraud.

More specific provisions regarding fraud committed electronically are contained in Law Number 11 of 2008 as amended by Law Number 19 of 2016 concerning Information and Electronic Transactions ("UU ITE"). Article 28 paragraph (1) of the ITE Law which prohibits the spread of false and misleading news that results in consumer losses in electronic transactions can be imposed on illegal investment actors. This is because the victim of illegal investment fulfills the formulation of the elements of the provision through transactions of illegal investment instruments that he carries out through electronic media which causes losses for him. Victims of cybercrime can file several types of legal remedies, either through civil law or criminal law.

In the realm of civil law, the victim can file a lawsuit against the law in accordance with Article 1365 of the Civil Code against the perpetrator of the cyber crime. Through the civil lawsuit, the victim can ask for compensation for the investment he made. Victims of cybercrime can also file for bankruptcy against the

perpetrators of the cybercrime based on Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations. Illegal investment schemes through electronic media generally involve many victims, so these victims can easily meet the requirements for filing a bankruptcy application which requires at least two creditors. The bankruptcy mechanism allows the process of recouping victims' damages through debt settlement for cybercriminals carried out by the curator. Based on the Criminal Procedure Code, the decision regarding compensation for victims only concerns compensation for the costs that have been incurred by the victim. In addition, victims of cybercrimes can also apply for restitution to the court through the LPSK based on Law Number 13 of 2006 as amended by Law Number 31 of 2014 concerning Protection of Witnesses and Victims.

In contrast to previous legal remedies, this effort requires that the victim as the applicant of the effort has been proven to be a victim of a crime, so that this effort to apply for restitution can be carried out before or after the court decision related to the cybercrime crime case has obtained legal force.

NATIONAL CHAPTER OPINION Maria Santhosh Academic Affairs Directors at ALSA National Chapter Singapore An insight into how Singapore deals with money laundering and illegal investments Money laundering and illegal investments are crimes that have existed for centuries, the advent of technology and the heightened access to it, has only made money laundering and illegal investments easier and more widespread. Singapore being a global financial centre and cosmopolitan hub, has taken the regulation of money laundering and illegal investments very seriously. Singapore has done this through: (1) robust AML/CFT legislation, (2) close partnership with the business community, (3) strict enforcement action and ongoing supervision and (4) active international cooperation This essay aims to give a broad overview of the measures that Singapore has put in place to combat financial crime.

The steps Singapore has taken to prevent financial crime and protect consumers Singapore has always been very quick to identify areas of potential risk and initiate ways to prevent them. The Parliament of Singapore passed the Payment Services Act (“PSA”) in 2019, this piece of legislation is a “forward looking and flexible framework” to regulate payment systems and payment service providers in Singapore. The passing of the PSA provides regulatory certainty and consumer safeguards, all the while encouraging the innovation and growth of financial technology. The PSA is enforced by the Monetary Authority of Singapore (“MAS''), a Government agency which is the central bank and financial regulatory authority of Singapore. The MAS administers and regulates the legislation pertaining to the financial sector, it investigates allegations of money laundering. For example, the high profile 1Malaysia Development Bhd scandal was investigated and pursued by the MAS. The case involved a plethora of financial crimes, including money laundering. The law enforcement agency which is appointed to investigate money laundering and similar financial crimes is the Commercial Affairs Department of the Singapore Police. The Suspicious Transaction Reporting Office receives and analyses Suspicious Transaction Reports and Cash Movement or Transaction Reports, to detect financial crime such as money laundering, terrorism financing. The Attorney-General of Singapore prosecutes money laundering and illegal investments. The MAS has also issued requirements for bank and financial institutions in Singapore to institute controls to “detect and deter the flow of illicit funds through Singapore's financial system”. These include: correspondent banking and wire transfers, record keeping, suspicious transaction reporting, internal policies, compliance, audit and training.

CONCLUSIONS Singapore’s hard stance against money laundering and illegal investments, act as deterrence to financial criminals. Singapore, in ensuring its’ position as a global financial hub, has put in place measures to maintain its flexibility in addressing and adapting to the continuously evolving financial crimes.

What is your opinion on the government's follow-up in tackling cases of illegal investment in binary options trading?

The rise of illegal investment practices in binary options has concerned the public and the Indonesian government. This is because binary options are viewed as a form of online gambling, rather than a form of asset trade like stock, currency, or commodity trading.

Even though it is generally viewed as gambling and unsafe, many still fall to its deceptive advertisements.

The reason that people are easily lured to binary options is because of its advertisements on profits and the image of instant success.

TIn dealing with rise of illegal investment practices in binary options trading, the Indonesian government has regarded this practice as uncertain due to its gambling characteristics. Government institutions has worked together in facing this issue and give pressure by convicting the affiliates and blocking numerous illegal trading platforms. Even though the legal protection that is specially intended to regulate binary option is still in question, there are legal basis we can look upon and adhere to within our laws. With the Legal basis of Article 303 of the Criminal Code, Binary option indicates that it is actually similar to the elements of gambling. In facing this issue, I believe that the best step the Indonesian government and the OJK should carry out is to educate and increase awareness upon trading services and financial products that are safe and is profitable for the community. The emergence of these illegal trade websites will not stop. This is because most of the creators of illegal trading platforms are living abroad. No matter how many of them are blocked by the government and the police, illegal websites shall continue to appear. Rather than focusing on eradicating the platforms, socializing to the public on the dangers of illegal trading would be far more beneficial.

When Charlie goes away I hate it when my brother Charlie has to go away. My parents constantly try to explain to me how sick he is. That I am lucky for having a brain where all the chemicals flow properly to their destinations like undammed rivers. When I complain about how bored I am without a little brother to play with, they try to make me feel bad by pointing out that his boredom likely far surpasses mine, considering his confine to a dark room in an institution.

I always beg for them to give him one last chance. Of course, they did at first.

Charlie has been back home several times, each shorter in duration than the last.

Every time without fail, it all starts again. The neighbourhood cats with gouged out eyes showing up in his toy chest, my dad’s razors found dropped on the baby slide in the park across the street, mom’s vitamins replaced by bits of dishwasher tablets. My parents are hesitant now, using “last chances” sparingly. They say his disorder makes him charming, makes it easy for him to fake normalcy, and to trick the doctors who care for him into thinking he is ready for rehabilitation. That I will just have to put up with my boredom if it means staying safe from him.

I hate it when Charlie has to go away. It makes me have to pretend to be good until he is back or they’ll know it was me.

Our Father is a Netflix documentary film released in 2022 and lucie Jordan's debut as a director. This film tells the true story of a fertility doctor named Dr. Donald Cline who inseminates his patients with his sperm. The film features interviews with the original victims and additional scenes from the actors. It begins with the testimony of Jacoba Ballard, an adult woman who has anxiety because she does not look like her family. In 2014, she used a self-testing DNA service called 23andMe. It was revealed that she was not his father's biological child, and then the mother said that she had consulted with fertility doctor, Dr. Cline. Dr. Cline inseminated her until she became pregnant.

Jacoba contacted Dr. Cline to find out who his biological father is. However, Dr. Cline said the patient data had been destroyed. Dr. Cline also said that the sperm used belonged to a young resident doctor and had not been used on more than three patients. Judging by the 23andMe website, Jacoba has seven half-siblings and the number continues to grow.

Jacoba who did not accept Dr. Cline’s lies tried to make this story viral in various media, as well as contacting and inviting his half brothers and sisters to come together and discuss it. Throughout the film, we will see testimonies of the misery experienced by the 'children' of Dr. Cline. How they become confused about their identity and have to face the harsh reality that their father is not their biological father.

The anger and disappointment they felt were not welcomed by Dr. Cline, Dr. Cline just didn't want to admit what he had done.
