Commercial Property Owners Owed Billions ££££££ An estimated 96% of all commercial property owners are paying too much tax by not claiming your capital allowances. So what exactly are Capital Allowances? Capital Allowances are retrospective claims based on the purchase price of a commercial property. This is not a contentious tax avoidance scheme or loophole, but is based on established UK Statutory law dating back to 1878. Every building has claimable allowances inherent within the purchase price and these are a valuable form of non-conflicting relief. The legislation was rewritten

in 2000 and is incorporated in the Capital Allowance Act 2001. Claims can be made retrospectively: there is no time limit on how far back you can go in your ownership of the property. You can even go back four tax years for a tax refund. Many of you will be aware that your accountants claim capital allowances for “movable” fixtures and fittings, plant and machinery. You will also be aware that you can’t claim such allowances for the “immovable” fabric of the building which is viewed as a non-depreciating asset. The grey and normally overlooked opportunity exists with the class of assets in the area between “movable” and “immovable”. Clearly office furniture is movable and the roof is immovable. But what about fixtures such as air-conditioning, emergency lighting and alarm systems? These are normally considered by accountants as “freehold improvements” and therefore not eligible, but HMRC will agree otherwise provided you approach them in the correct way, with the correct information presented in the approved manner.

Capital allowances are tax relief on capital expenditure on qualifying machinery or plant and on certain types of buildings or structures that can be set off against taxable profits. Expenditure can be incurred either by way of the acquisition, construction or refurbishment of a property. Capital allowances can also be claimed on: Patents, know-how, dredging, intellectual property rights and goodwill. You can also claim then on cleaning up sites like old petrol stations, asbestos removal and on some ‘green’ energy systems. All commercial property, of whatever age or Specification, may have an element of capital allowances contained within them. How much depends on cost and how much has been spent on it. Accountants may claim some capital allowances for items that are moveable and have an invoice, for example office furniture and computers. However, some things are attached to a building, CCTV, fire escapes, fire alarms, signs, lights, even items such as lift shafts and swimming pools are all items which are both fixed and moveable. Many accountants don’t differentiate between accounting treatment and tax treatment for these items. In most major building work payment is by stage payments. These just state how much has been spent; they don’t describe how it was spent, so your accountant will not know. This means that there could be thousands of pounds unclaimed! Whether its Chennai, Bangalore or Mysore, whether the beautiful Cochin or the wild Periyar, you can fill your visit with memorable events such as an elephant ride, kath kali dance performance or enchanting boat cruise at Alleppey. Desert camel safaris in India are now one of Asia's fastest selling adventure holidays. These include camel treks ranging from short rides around Jaisalmer to extensive trips that remind you of Lawrence of Arabia on his epic journey across the Sahara or Marco Polo on the historic silk route. They are a great way to see the desert and to enjoy a novel and adventurous holiday. The Great Indian Desert may not have great expanses of sand dunes and incredible spaces of wilderness as large as those of the Sahara and Namibia, but it offers some glorious citadels and extremely colourful and unspoilt villages. The Camel Safari Circuit in India covers Jaisalmer, Jodhpur and Bikaner, all in Rajasthan. They were the princely kingdoms in the desert belt of India, each comparable in size to many modern nations of Europe. All the former capitals prospered from trade with the camel caravans that travelled from west Asia and Europe to Mongolia and were impressively fortified to protect these riches. The result was a wealth of palaces built for royalty, havelis or courtyard mansions built for merchants and nobility and intricately carved temples for the subjects.

A camel safari is a great way to see the desert, visiting the villages, seeing wildlife and riding across the open desert sands. Typical camel safaris organised around Jaisalmer take in the architectural ruins of Lodurva, which was the former capital of the Bhatti Rajput desert kingdom before the founding of Jaisalmer, the Anasagar oasis, the sand dunes of Samm and the water source of Moolsagar where village women gather with pitchers at dusk. Night halts on basic safaris are at villages on the way or temporary bivouac camps in the desert scrub, where camels are hobbled and let out to graze. Packing the right clothing is important on one of these holidays as the climate is extreme. In the desert afternoons may seem much hotter than the actual 26-30 degree temperature may suggest and night temperatures may drop below zero on the dunes. It is essential to take both woollen and cotton clothing. Shorts and skirts are comfortable for camel safaris, but remember, some of the off beat routes visit villages that have not have seen many tourists and locals may look askance at ladies who do not wear ankle length clothing and men in shorts. Sun hats with large rims or cotton caps that can be dipped in water when it gets too hot around midday are essential, preferably with a balaclava or scarf for covering the neck and forehead. If prone to sickness you should carry suitable medication against the swaying gait of the camel. Finally patience is an important piece of baggage on a camel safari as it takes time to get to grips with camel travel. There's a huge variety of other special interests that can be catered for in India, including angling and fishing, gliding, mountaineering and rock climbing, skiing and winter sports plus white water rafting and, of course, elephant safaris. Trout fishing in the rivers and ice-fed mountain streams is a great sport. You may pit your wits against the wily trout - both brown and rainbow - while those who enjoy solitude can spend hours in quiet contemplation of the beauty around. The fast flowing clear water streams and high altitude lakes of the upper Himalayas are excellent for trout fishing. The challenge and thrill of an encounter with the powerful mahseer, the hardest fighting fish on the planet, attracts anglers from all over the world. It offers a holiday with a fish, which not only rules the Indian waters like the tiger does the jungle, but also battles the way, no other can.

Don’t Take In A Stranger Whilst You Are Gone. More than half of us are likely to lose the ability to make decisions at some stage in our lives: • • • • • • •

Most people think that their parents, spouse or adult child would be able to administer their affairs. But without a Lasting Power of Attorney (LPA) none of them would have a legal right to take charge. Your friends or family will want to help but to do so legally they will have to apply to the Court of Protection to be appointed as your “Deputy” (a restricted version of the Attorney you could have appointed under an LPA). This could prove to be expensive and time consuming. You should also be aware that the Court of Protection will not know if your friends or family can be trusted so they are

more likely to appoint a professional stranger to be sure they do not choose the wrong person. In this situation and often in good faith someone you know may dispute the Court of Protection appointment. But they are unlikely to be aware it is you that will end up paying all of those legal costs. Those costs could start at a couple of thousand pounds but easily end up being tens of thousands of pounds. If someone who does not have your interests at heart takes over that could be a personal disaster. But what really can be a financial disaster is that the Court of Protection will in the absence of a good candidate for the role of your “Deputy” appoint a solicitor to do everything for you. Just imagine paying £180 to £300 an hour for a solicitor to pay your bills, make your decisions and come to see you to check up on you. If that doesn’t cost £10,000 a year you will be very lucky. So why not make an LPA today? LPAs allow you to decide, in advance, who will look after your financial affairs or deal with health and welfare decisions for you. A Special Funeral How many of us think about our death? It’s not an easy subject for most of us to consider. If we did though; wouldn’t we want a funeral specially made for our family and friends to say goodbye in a way that we would like them to remember us? Wouldn’t we want a ceremony that reflects our passions, loves, interests and philosophies? Many of us may not want a full religious service; some of us may want a ‘mix and match,’ a hymn, maybe a prayer, maybe none of this, maybe a combination of good music, poetry, some jokes and heartfelt words? Some of us feel close to nature or to our friends and family and want this to be the main focus. I am a Civil Celebrant and I love how a funeral ceremony can be so different. My first experience of such a funeral was that of a friend whose wife wanted something special. The ceremony was stunning; it reflected his choice of music - he was a musician and played in local pubs. The service was led by a warm, friendly celebrant, who spoke about my friend’s unique qualities in a detailed way that made me feel he was with us during the ceremony. The coffin was adorned with photos of him and his guitar lay on the top. This event was the catalyst for me to change my profession. I trained with an organisation called Green Fuse and have learnt how to help a family create a ceremony for their loved one which acknowledges the life of that person in a truthful way and give thanks for that life in all it’s richness and diversity. I respect the beliefs of the person who has died and the wishes of the family. This might be an acknowledgement of their loss and asking for the safe transition of the person into whatever is believed to lie beyond, or to accept that the person’s life has ended and there is no beyond – in both cases the life lived has been precious and unique. Some families choose to read words, decorate the coffin, light a candle, record their favourite music or find a special physical reminder of the deceased to lay on the coffin. Other families want the celebrant to lead and plan the whole ceremony. A good civil celebrant will enable the family to have the ceremony as they would like. I have found such happiness in doing this work. Families and friends feel very raw at this time and it is a privilege to listen to their memories, hear about the challenges their loved one faced in life and help them weave together a ceremony that is friendly, respectful and heart-warming. THE BIG BOOB BOOM Breast enlargements were once thought of as tacky and the domain of glamour models and footballers' wives, but it seems the taboo has lifted, as more of us are opting for this procedure. When it comes to cosmetic surgery, forget facelifts, liposuction and tummy tucks, breast enlargement is the most popular procedure and has been for the past 20 years.
Unlike the boob jobs of old - think Pamela Andersen and Jordan - the breast enlargements of today are less obvious and more natural. Typically, 10 years ago, 48 per cent of breast augmentation patients went up by three cup sizes, whereas over the past couple of years the most popular size increase was a more modest two cup sizes. The most popular implant is currently the "round high profile", which produces a more rounded appearance to the upper breast, while "contoured" breast implants are designed to reflect the slope of the breast but are not as effective for improving cleavage. Silicone has always been the implant of choice as it gives a more natural shape and feel than some of the alternatives. However, its not just breasts that have changed: our attitudes, too, have changed dramatically from 10 years ago. Having breast surgery is no longer kept secret and women are now happy to flaunt their new look and tell others about their operations.
