67th Annual parade of homes Welcome to the 67th annual Parade of Homes! The Parade started in Milwaukee as a means to encourage home ownership and we continue the tradition not only to showcase our local home builders but also to provide the foundation for our consumers to “build a lifestyle”. Parade homes highlight the latest building trends, illustrate how easy technology and comfort can be added to your home and showcase the details that enrich family life. In past Parade models the emphasis has been on green building and energy efficiency and these 2012 models are no exception. In addition, this year’s homes highlight the many multi-generational features that today’s home buyers are looking for. These features make the difference for many families looking to stay in their homes longer or accommodate aging parents. As you tour the homes let our builders know what you think by returning the People’s Choice ballot you received when you entered the Parade site. Each attendee has the chance to vote not only for their favorite model but also to vote on their choice for Best Room, Best Landscaping and Best Interior Design at each site. Ballots will be collected in the drop boxes as you exit the Parade site and one lucky attendee from each site will have the chance to win a fabulous prize.

president’s message On behalf of the Metropolitan Builders Association, welcome to the 2012 Parade of Homes. Many people may not know this, but the MBA Parade of Homes is first and the longest running Parade in the country! Since 1945, the MBA has organized 67 consecutive Parades each showcasing top builders in the metro Milwaukee area and featuring the most innovative design ideas. This year’s Parade is no different. Right now, is a great time to build or buy a new home. Low interest rates, available lots, and reasonable prices are all reasons that now is a great to build. Many builders also have brand new homes that are move-in ready. All the homes you will see on the Parade can be built anywhere in our area and can be customized to meet your needs. Representing 15% of our nation’s economy, more than four million jobs are directly related to the home building industry. For every single new home build, three full-time jobs are created. This economic power is why the housing market has always been seen as a gauge by which we can measure U.S. economic performance. In every recent economic decline it has been the housing industry that has spearheaded the return to prosperity. A slow return from the housing downturn leads to a slow economic recovery. two simple words brought on by one simple action – copying. If you want your home building experience to be a positive one, stick with the plans you know are legitimate. The homes you tour during the 66th Annual Parade of Homes are a true testament to the vision of Parade builders. What starts out as a design concept develops into a fabulous architectural plan. From there, a majestic home takes shape. Decisions are made regarding every component that will go into the home. What kind of flooring should be used? What type of lighting? A Parade builder must address all the issues you will need to consider when it comes time to build your new home. The biggest difference is a Parade builder must plan on building his or her home to impress the varying personalities of thousands of visitors. Because there is so much work that goes into the design and construction of a home, there are also laws in place that protect each home’s unique design. Just as there has been copyright protection in place to safeguard the original works of authors of literary, dramatic, musical and artistic works, in 1990, copyright protection was extended to include architectural works. With respect to new home construction, the federal copyright laws protect the copying of all or a portion of a home design. Protection is found in two different areas: The protection of the design plans (including blueprints and floor plan layouts). The protection of the completed structure. This extends to its overall interior and exterior appearance. This means that while you are welcome to tour the Parade homes, you need to remember that the plans builders have available for you, detailing the layout and the exterior of the home, are for educational purposes only. You may not copy those plans. If you bring plans

gathered at the Parade of Homes to another builder and ask him or her to duplicate the same home for you, you would be in direct violation of the 1990 Copyright law. Many copyright infringement cases in southeastern Wisconsin have resulted in extensive litigation, and significant judgments. The consequences for plan stealing are very serious and can result in substantial financial penalties. Recent parties convicted of architectural copyright infringement have been required to pay anywhere from $15,000 to $125,000. In future cases, penalties may be higher or lower depending on the extent of copyright infringement. Consumers who are interested in building new homes should consider the following advice to avoid copyright infringement claims: 1) N  ever ask one builder to copy all or part of the design or finished appearance of another builder. 2) W  hen interviewing builders and shopping for different home designs, ask each builder you interview whether he or she has a home design that incorporates the style or features you are looking for. Explain the style or features by giving examples; but keep in mind that copying is prohibited. 3) M  ake sure that you are purchasing the rights to a legitimate plan by asking the builder to confirm that he or she has the right to build the plan or design that you have selected.

If you see a specific feature, like a sunroom, in a home that you like, you could ask the builder you would like to work with if they have something similar in one of their home designs or if they could design something similar. The key to avoiding copyright infringement is to understand that copying any part of another builder’s plan is against the law. If you ask your builder to construct the same exact feature found in another builder’s home, it is a violation. Keep in mind that individual standard features or design elements that are functionally required may not be copyrighted (such as doors, windows and stairs). One question frequently encountered by area attorneys is how handwritten sketches are viewed with regard to the copyright law. Many homeowners believe that when they contribute their own sketch to a builder, detailing ideas for a floor plan or a specific design idea, that they have rights to the final design of the home. In reality, the copyright is owned by the person who puts the ideas into final form. When an owner’s sketch is incorporated into an architectural design it becomes part of the architectural design and becomes the property of the person who drew the plan. While the homeowner still has rights to his or her sketch, that is the only part of the plan he or she may take to another builder without having to worry about infringing on the copyright owned by another party.
