As we close out the quarter, I want to take a moment to reflect on and celebrate the incredible progress we’ve made together. ABC South Texas continues to set a high bar—and it’s because of you.
This quarter, our chapter was awarded a 4-year Accreditation from ABC National—the highest level a chapter can receive and a historic first for ABC South Texas. This achievement recognizes our commitment to excellence in leadership, governance, and service. We were also honored at the recent ABC Legislative Conference with the Grassroots Advocacy Silver Award for our efforts in 2024—an award we haven’t received since 2021. These accolades place us among the top-performing chapters in the nation, standing shoulder to shoulder with the best of the best across 67 ABC chapters.
These milestones are not just awards—they are the result of the tireless work of our Board of Directors, committee leaders, volunteers, and dedicated staff. As William Arthur Ward said, “Feeling gratitude and not expressing it is like wrapping a present and not giving it.” Please know how deeply thankful I am for each of you and the work you do to strengthen our chapter every day.
But we’re not done yet. The next steps in our journey include increasing STEP participation to ensure more of our members are building strong safety cultures, applying for Accredited Quality Contractor (AQC) status to join the ranks of elite performers nationally, and improving our support for the Trimmer Construction Education Foundation, which funds training initiatives critical to our industry’s future. We must also continue to grow contributions to the Free Enterprise Alliance, reinforcing our advocacy efforts for fair and open competition.

This is a testament to her commitment and dedication to ABC South Texas, but more importantly to living her WHY! Advocating for a Level Playing Field
This year, ABC South Texas took to Capitol Hill to stand up for the principles of the Merit Shop and to champion our 2025 theme: Advocating for a Level Playing Field.
We kicked things off with a National Board of Directors meeting—huge thank you to Chris Martinez and Mark Baublit for your leadership at both the local and national level, serving not only on the board but also on key national committees.
Our team completed nine effective congressional visits, using their voices to educate lawmakers and staff on key issues affecting our industry, including government-mandated Project Labor Agreements (PLAs), tax and fiscal policy, labor and employment law, workforce development, and immigration priorities.
We remain committed to protecting free enterprise, ensuring fairness in federal contracting, and creating opportunities for all. “Get into politics or get out of business” still holds true.
We were also honored to have our chapter recognized at the national level with the 2024 Grassroots Award for advocacy—a true testament to the strength and dedication of our State Team and Government Affairs Committee and their tireless efforts throughout the year. Their leadership and engagement continue to elevate our presence and impact at every level of government.
We also had the opportunity to celebrate ABC’s 75th Anniversary with a special gala event with former President George W. Bush—an incredible reminder of the legacy, strength, and vision that continues to define our association. These gatherings go far beyond policy—they’re about relationships. This year, we reconnected with members and leaders we’ve known for over 20 years. That kind of longevity and shared commitment is what makes ABC so dynamic and deeply rooted in the industry we serve.

Independent Contractors—New Rules?

In January 2021, during the last days of the first Trump Administration, the Department of Labor (“DOL”) issued new, simplified regulations to determine whether a worker was an independent contractor or an employee. Although there was a total of five factors listed, only two of them were considered “core factors”: (1) nature and degree of control exercised over the work and (2) the worker’s opportunity for profit or loss.
If Trump was “for” something, you knew the Biden administration would be against it. Sure enough, in February 2021 the Biden DOL announced it would delay the effective date of the Trump rule, and in May 2021 it rescinded the rule. In January 2024, the Biden “totality of the circumstances rule” went into effect. It replaced the two-core factor test with six factors to evaluate: (1) the nature and degree of an employer’s control over the worker; (2) the worker’s opportunity for profit or loss; (3) a comparison of any investments by the worker and the employer; (4) the degree of permanence of the working relationship; (5) the extent to which the work performed is integral to the business; and (6) the amount of specialized skill and business initiative required. The net result of the totality of the circumstances test was a high degree of difficulty and uncertainty for employers who sought to properly classify workers as independent contractors. Also, a lot of business groups filed a myriad of lawsuits alleging that the Biden rules were not supported by the law.
When Trump returned to the White House, many assumed he would reverse Biden’s policies and revert to his former rules of engagement, particularly with respect to independent contractor analysis. That has not happened (at least, not yet). Instead, Trump’s DOL has taken the position in the lawsuits challenging the Biden rule that it is reconsidering the rule and whether it should be rescinded. Until a final decision has been made, it will not enforce the Biden rule. That’s good news if your business is being audited or sued by DOL. However, private litigants can still use the burdensome totality of the circumstances rule until a final rule has been issued.
As for government enforcement, DOL has announced it is reverting to the “economic realities” test on an interim basis, until it decides what its final rule will be. Under the economic realities test, the following criteria are used in making the independent contractor/employee determination: (1) the extent to which the services rendered are an integral part of the business; (2) the permanency of the relationship; (3) the amount of the worker’s investment in facilities and equipment; (4) the nature and degree of control by the business; (5) the worker’s opportunities for profit and loss; and (6) the amount of initiative, judgment, or foresight in open market competition with others required for the success of the worker.
While the economic realities test is generally considered easier for employers than the totality of the circumstances test, neither of those tests are as easy to use than the original Trump rule. Whether DOL will revert to the original Trump rule, stick to the economic realities test, or do something else remains to be seen. Stay tuned!

ABC South Texas was honored to host an inspiring evening at the Tobin Center with Dee Ann Turner, former Vice President of Talent at Chick-fil-A and best-selling author. Known for her role in shaping one of the most admired workplace cultures in the nation, Turner shared her powerful message on creating remarkable cultures, building talent, and winning with WHO.
Throughout the evening, Turner emphasized the importance of hiring with purpose, leading with values, and creating environments where people are empowered to thrive. Her message resonated deeply with attendees from across the construction industry, offering practical, values-based strategies that can be applied at every level—from the field to the boardroom.
