The widow of the late Mbulaeni Mulaudzi, Tondani, is involved in a court battle with her husband’s parents in connection with his estate. Mulaudzi, a former 800 metre world champion and Olympic silver medallist, died in a vehicle accident on 24 October, at the age of 34. According to her, Mbulaeni’s parents took all the contents of their house at Muduluni after his funeral. “With the help of attorney Wisani Baloyi of Wisani Baloyi Inc, I won the case in the Thohoyandou High Court. The sheriff engaged with the Mulaudzi family at Muduluni Village and they recently collected the contents of the house,” she said. According to attorney Baloyi, Mulaudzi married Tondani in community of property and as such the widow is the joint owner of the estate. “In terms of Section 26 (1) of the Administration of Estates Act 66 of 1966, the executrix in a deceased matter is charged with a duty to take into her custody and control all the assets of the deceased’s estate,” he said. “The collected goods include a six
cubic metre Tata Tipper, a dining room table with three chairs, black bench, yellow sofa, round glass coffee table, two TV stands, flat screen TV, PVR decoder, small silver decoder, two carpets, a big mirror, music system, long brown frame mirror, big wall painting and two leisure chairs,” he said. The widow, Tondani, is self-employed and taking care of Mbulaeni’s biological child, Denga. “The deceased had a R500 000 retirement annuity builder contract with Liberty Life and his mother is the beneficiary. My client intends to bring a court application wherein the beneficiary status as nominated by the deceased will be cancelled and that the court should declare that the proceeds of this policy be paid to the estate for the benefit of the deceased’s wife and children of the deceased,” he said. “Mbulaeni’s mother was requested not to proceed to lodge a claim against the policy until the court has made a finding on our client’s application,” said Baloyi. Mulaudzi was the third-born and only son of Daniel and Luvhengo Mulaudzi.
