Sewe-en-negentig van die 174 Triegies wat matriekuitslae ontvang het, verkry universiteitstoelating. In daardie kategorie is die skool 11de in Limpopo en ontvang ‘n trofee. Die skool het ook ‘n Klub-50 trofee ontvang vir meer as 50 leerlinge

Horror crash on N1-north A man lost his life in a gruesome accident on the N1-north early on Wednesday morning. The accident happened near Musekwaspoort on the N1-north. Abortion suspect charged with murder the 26­year­old resident from uganda, Juko Moses, who is suspected of running an illegal abortion clinic in the back alleys of Makhado (Louis tri­ chardt), has now been charged with murder. Moses was arrested in July 2011 after a 29-year-old woman, who wanted to terminate her five-month pregnancy, had put the police on Moses’s trail. At first he was charged with the illegal termination of a pregnancy.

This charge was changed to murder when Moses appeared in the Louis Trichardt Regional Court on Monday. The woman, who cannot be identified without her informed consent, responded to one of the many illegal abortion advertisements that are plastered all over town. She allegedly paid R1000 for five Cytotex tablets, which are used to terminate pregnancies. Her baby died as a result of major complications caused by

her taking the Cytotex tablets. According to information supplied, the State feels that it has enough evidence to prove a case of murder against Moses. In the meantime, Moses has been in custody since September last year. His case had to be postponed on Monday, due to the fact that he had failed to pay his attorney. Moses will remain in custody until 14 January, when his case is expected to continue.

Still no sentence the sentencing of businessman Yahya shoeb Jiwa of Makhado (Louis trichardt) has been post­ poned yet again. The 45-year-old Jiwa appeared in the Musina Regional Court on Wednesday. He had already pleaded guilty in July last year on charges relating to restricted activities on a special protected species without the necessary permits. Jiwa was arrested in February 2011 when he tried to buy rhino horns from an undercover police agent. Since pleading guilty, Jiwa has been awaiting his sentencing. In-

stead, his defense team has asked for yet another postponement. They requested a pre-sentencing report to be compiled by the Department of Correctional Services to support a petition to ask the court for correctional supervision of Jiwa rather than a jail sentence. This report was not complete and could not be handed in as evidence on Wednesday. Jiwa’s lawyer confirmed that the report will be ready by 18 January, when it will be handed to the magistrate. Die stortingsterrein was so tot oorlopens toe vol dat talle nie kanse wou waag om in te ry nie en het begin om hul

Volgens die permitvoorwaardes, wat ingevolge die Wet op Omgewingsbewaring van 1997 aan die Makhado Munisipaliteit toegeken is, is die munisipaliteit verplig om ‘n buffersone van the 400m om die terrein te handhaaf. Dit is ooglopend nie die geval nie, met vullis wat tot teen-

aan die heiningdrade om die terrein gestort word. Die permit vereis ook dat die toegangspad na die terrein gangbaar en sonder enige vullis moet wees, wat ook nie die geval was nie. Verder moet vullis daagliks ook met ten minste 150mm grond toegestoot word en vullishope mag nie hoër as 1,5m wees nie. Beide laasgenoemde twee permitvoorwaardes word ooglopend ook nie nagekom nie. Die Zoutpansberger het Dinsdag navrae oor die administrasie en beheer van die stortingsterrein aan beide die munisipale woordvoerder, mnr. Louis Bobodi, en die munisipale bestuurder, mnr. Sakkie Mutshinyali, gerig. In die navrae is daar spesifiek melding gemaak van die ooglopende oortredings van die permitvoorwaardes.

Teen druktyd is daar steeds op antwoorde vanaf die munisipaliteit gewag, aangesien hulle nog skynbaar gewag het vir ‘n ondersoekverslag. Mutshinyali het Dinsdag aan die koerant gesê dat so ‘n ondersoekverslag gewoonlik twee dae duur om saam te stel. “Julle sal nie hierdie week ‘n antwoord kry nie,” het hy gesê. Die permitverskaffer, die Limpopo Departement van Ekonomiese Ontwikkeling, Omgewingsake en Toerisme, is ook genader en gevra wanneer hulle laas inspeksie gedoen het by die terrein om seker te maak dat die munisipaliteit hul permitvoorwaardes nakom. Teen druktyd was daar ook steeds geen antwoord van hulle af nie.

Gagging order against Limpopo Mirror lifted The Limpopo Mirror, the Zoutpansberger’s sister publication, succeeded with its application to have a gagging order lifted. In September last year, the newspaper was prohibited from writing about the feud between a local building contrac­ tor and one of his customers. Magistrate BVM Bvuma ruled in December that the gagging order should not be made permanent. He refused the request of Robert Mulaudzi, the applicant, and stated that pre-publication interdicts could not be entertained by the court. The legal battle started on 24 September last year when court papers were served on the editor of the Limpopo Mirror. It then materialised that a building contractor from the Vuwani area, Robert Mulaudzi, had instructed his lawyer to obtain an interim court order forcing the paper not to write about a dispute between him and a client, Mrs Azwitamisi Minah Mutheyiwana. The dispute concerns a house that Mulaudzi had renovated for the Mutheyiwana family. He claims they did not make payments as they were supposed to, whereas they claim that he didn’t deliver on his promises. The family contacted one of the Mirror’s reporters and asked him to investigate the matter. Instead of commenting on the allegations and trusting the newspaper to write a balanced report, Mr Mulaudzi approached the Vuwani Magistrate’s Court. In the absence of any of the defendants, he managed to obtain an interim court interdict, prohibiting the newspaper from disclosing any details about the feud. The gagging order stated that the newspaper could not publish “any article about the applicant and/or his business, which publication may have the current or long-term potential to adversely impact on (the applicant) or his business.”

The Limpopo Mirror opted to challenge the gagging order, but did so without any legal representatives in court. On October 30 last year, Anton van Zyl, manager of the Limpopo Mirror and Zoutpansberger, argued in court that the interim order was obtained in an irregular manner. The newspaper was never given the opportunity to oppose the application. He also argued that a permanent interdict, such as requested, would lead to a ludicrous situation where the Limpopo Mirror would, in perpetuity, be barred from writing anything that is perceived to be negative about the applicant, irrespective of the applicant’s actions. “Newspapers play an important role in disseminating information … and also need to play a watchdog role should there be transgressions,” he said and made reference to various laws that protect consumers. “Should the applicant not abide by any such legislation, consumers must feel free to complain about this and the press should not be afraid to write about it,” he argued. Mulaudzi’s lawyer, TA Netshinombelo, argued that publication of such articles would tarnish his client’s good reputation and would also affect his business. “No publication has a licence to publish malicious rumours and/or personal vendetta(s) against a person … particularly if the motive of publication is pressure from the first respondent,” the court heard. The first respondent in the case is a family member of Mrs Mutheyiwana, a certain Mr Joseph Mulaudzi. Joseph Mulaudzi contacted the newspaper and asked that the reporter investigate what was happening. Joseph was also being accused of sending threatening SMSes to Robert Mulaudzi (the applicant in the case). Magistrate Bvuma eventually made a ruling on 14 December last year. He referred to the rights of the applicant in the case and said Mr Robert Mulaudzi had been within his rights when he approached the court to try and protect his good name and his business. He referred to cases where the courts had ruled that people did not have to wait for the actual damage to happen, but should try and stop such action. He felt, however, that Mr Mulaudzi had had other remedies available and should not expect the court to issue pre-publication interdicts for protection. Magistrate Bvuma referred to the fact that the Limpopo Mirror subscribes to the Press Ombudsman’s Code of Conduct and stated that Mr Mulaudzi was at liberty to approach this body and complain about any perceived biased reporting. The Limpopo Mirror was assisted in this case by Willem de Klerk, an attorney specialising in media law. He was delighted with the outcome of the case and described it as a victory for press freedom in South Africa. Van Zyl said that this was part of an escalating problem where the freedom of expression was being suppressed by litigation. “People should not be afraid to ask courts to protect their individual rights, but these rights should be weighed up against the rights of the broader public,” he said. “The media should be held accountable and should act in a responsible manner,” he said but urged readers to trust the newspaper to report in a fair and unbiased manner. “If we do not live up to the expectations, readers should rather approach the relevant industry bodies, such as the Press Ombudsman,” he said.

When the Zoutpansberger visited the border post, there were long queues of both human and vehicular traffic waiting to be cleared by customs and immigration officials on the departure side. Gwede said, however, that they were managing the situation. “I can safely say right now that everything is under control and our officers are efficiently managing the queues. We have also created separate immigration counters for buses as a way of easing congestion and ensuring a smooth movement of travellers,” he said. Gwede said that as part of the decongestion drive they were working with the police to control the movement of traffic into the border area. He said on average they handled between 80 and 120 buses on either side during the extra high peak period. On the arrival side, it was less busy, with short queues and the volume of traffic had also gone down substantially, compared to the period during the run-up to Christmas.

Border Control Operation Coordinating Committee (BCOCC) spokesperson Mr Patrick Moengs said that they were reviewing plans to address congestion at the border. “We want to ensure a smooth flow of traffic at the Beit Bridge border as it will be coming from the other side of the border. The situation is not unusual, however, because we know that every year at this time people will be coming back into the country, including those who will be going to look for jobs. We have increased staff and equipment to make sure that we manage the pressure,” he said. Moeng said they had processed 54 299 travellers between Saturday and Sunday. Meanwhile, the Ministers of Home Affairs for Zimbabwe and South Africa, Mr Kembo Mohadi and Ms Naledi Pandor, also discussed the issue of congestion at the border post. Mohadi said: “I talked to Minister Pandor over the issue of delays and congestion at the Beit Bridge Border Post and she promised to engage the Home Affairs director general, so that they deploy more personnel as well as create more mobile makeshift offices at their side of the border to help speed up the clearance of travellers,” he said.

Youth conference was a huge success a pioneering project took place in December last year when a local christian youth group opened up the way and hosted a national youth conference in Mauritius. “The conference was a great success, taking into consideration that the entire venture was very pioneering in nature. There is room for improvement with regard to future projects, but in general we are overwhelmed by the results of this very first Mauritian Youth Conference,” said Pastor Marcel van Niekerk of the Agapé Christian Centre in Makhado (Louis Trichardt), who headed up the conference. The

other conference speakers were Pastor Grant Clifton and Pastors Sam and Dalene van Niekerk of Agapé, and they were accompanied by a group of 28 local young people. “Both the Mauritian and South African young people benefitted greatly from this conference. The team from Agapé gained a lot of perspective about the global church. Their eyes were also opened to the many privileges we should be grateful for as South Africans. Valuable connections have been established between the young people from the two different nations and we trust that these relationships will be sus-

tained over time,” Marcel said. The conference stretched over two-and-a-half days and around 150 Mauritian young people from 10 congregations attended. The conference was hosted in the city of Curepipe under the auspices of the ISAAC (International Strategic Alliance of Apostolic Churches) network. The general feedback that was received from the Mauritian youth was that it was their first time to be exposed to young people who serve the Lord with so much commitment. After the conference, the Agapé group also experienced three days of sightseeing. They described it as a wonderful opportunity to see, taste, hear and feel the Mauritian culture. “After being away from 6 to 14 December, each one of us returned home with a sense of accomplishment, spiritual enrichment and gratefulness. We are looking forward to future ventures that will help us to break out of our personal comfort zones and result in building and establishing God’s kingdom,” Marcel said. The Mauritian outreach demanded a lot of work, finances and effort. The Agapé group would like to thank every individual who had contributed to making the outreach possible.

Net voor Kersfees was daar egter vir my ‘n Kersgeskenk op my bankstaat: my deposito, uiteindelik!” vertel Venter. Venter sê dat sy graag mense wil waarsku om nie sommer die biertuin te huur nie. “Ek het foto’s op my dogter se kamera gehad, maar sy het gevra of sy dit asseblief kan afvee, omdat dit haar so naar maak,” het Venter gesê. Inwoners van Levubu wat die biertuin naby die skousaal vir ‘n funksie in Augustus verlede jaar gehuur het, het ontdek dat daar geen krag en geen water was nie en dat die toilette verstop en heeltemal oorspoel was sodat die vloere nat en die stank ondraaglik was. Court halts installing of two new chiefs an application for an urgent interim interdict was granted in the thohoyandou High court in December 2012, stopping thovhele Kennedy tshivhase from installing two new chiefs in the phiphidi and ramulongo villages. The feud between different royal structures in Venda seems to be spreading and this case is one of several that are now being contested in the courts. On 28 December last year, the Makanga Royal Family and the Mafunzwaini Royal Family, together with two headmen, Muthuhathonwi Edison Nemakanga and Edzisani Phineas Mafunzwaini, approached the High Court. They asked that an interim interdict be granted to stop the installation of two new chiefs. In the affidavits filed in court, the parties argue that Thovhele Kennedy Tshivhase is continuing with plans to elevate two headmen, Jerry Tshivhase and Gumani Samson Ramulongo, to the status of Thovhele. This would mean they have jurisdiction over Headman Nemakanga and Headman Mafunzwaini’s areas. The installation event was, according to the court documents, planned for 29 December. In Muthuhathonwi Edison Nemakanga’s affidavit, he describes how they were informed of the decision of Kennedy Tshivhase by two “messengers” on 24 December 2012. Both Nemakanga and Mafunzwaini were against the elevation of a fellow headman to that of chief. They described Headman Jerry Tshivhase as a troublemaker and accused him of deliberately violating their boundaries in the past and carrying out activities in other headmen’s areas. Their pleas to Thovhele Kennedy Tshivhase to intervene and act against the irregular behaviour apparently fell on deaf ears. The two royal families discussed the matter and decided that they had no other option than to put up a legal fight to stop the actions. From the court documents filed it appears that the Department of Co-operative Governance, Human Settlements and Traditional Affairs was also not informed about the planned installation of new chiefs. In a letter sent to the two headmen, dated 27 December, the department distances itself from the actions and states that the proposed installation is not in terms of the Limpopo Traditional Leadership and Institutions Act.

It further seems that the elevation of the status of the headmen may have had a price tag attached to it. In a confirmatory affidavit filed, Langanani Jackson Mafunzwaini describes how he tried to resolve the matter by speaking to the parties involved. He alleges that he had a telephone conversation with headman Gumani Samson Ramulongo on 25 December, asking him to reject the proposed appointment as “deputy Thovhele”. “… he responded by informing me that he would not, as he had already paid an amount of R30 000,” Mafunzwaini states in his affidavit. Thovhele Kennedy Tshivhase has been the subject of some controversy in the past months. He is being accused of unilaterally pushing ahead with plans to divide the area into 25 regions, each with an own “Thovhele” and “deputy Thovhele”. In Nemakanga’s affidavit, he alleges that Thovhele Kennedy Tshivhase even ignored the advice of a delegation from the House of Traditional Leaders to stop appointing chiefs. Incidents of violence have been reported in Tshisahulu and Maungani villages where Tshivhase was going to install new chiefs. Approached for comment, Mailausumbwa Kennedy Tshivhase (as he is now being called) said the interdict was irrelevant as they were not replacing the existing chiefs. He said some traditional leaders felt threatened and thought that they were being demoted when they heard of new chiefs being installed. “There is no threat to the existing chiefs. We are just strengthening the Tshivhase kingdom for the sake of good governance and efficient service delivery. There is no sinister motive behind the installations,” said Tshivhase. He also denied that he was charging people an amount of R30 000 for them to be chiefs. “Chieftainship is not a profession and cannot be bought. As traditional leaders, we do not have to wait for government to tell us to install chiefs. We know whom to install and we will continue doing so until we reach our target,” he said. The parties will be in court again on 12 February, when judge PZ Ebersohn will have to decide on whether the interdict should become a final order. The respondents must file their answering affidavits before the end of January.
