A court order was issued on Friday last week, compelling the Makhado Municipality to reconnect the electricity supply of members of the Soutpansberg Ratepayers Association (SRPA).

This after the legal teams of the municipality and the SRPA reached a settlement before court proceedings started, during which the SRPA aimed to get an interdict to stop the municipality from cutting its members’ electricity supply. The municipality was ordered to comply with its undertaking to reconnect the electricity supply of SRPA members who would continue to “make payments as set out in their founding affidavit.”

The founding affidavit explained that the SRPA had declared a dispute with the municipality in August 2008 and that the dispute had not been resolved. The total amount appearing on the municipal accounts is paid into a trust fund, after which certain components are paid over

to the municipality. The full component of the electricity consumption is paid over to the municipality.

The municipality was ordered, pending the finalisation of the application, not to terminate services of current members of the SRPA, subject to their continuing to make payments as set out in their affidavit to the court.

The three respondents, who are the Makhado Municipality, municipal manager Mr Shadrack Tshikalange and Mr R Radzilani, were ordered to file their responding affidavit (if any) on or before 24 February.

The applicants, who are members of the SRPA, may file their responding affidavits thereafter. If an opposing affidavit is filed, the matter may be set down on the Opposed Motion Roll. If no opposing affidavit is filed, the applicants may set the application down on the unopposed roll.

The application is expected to be finalised in March.

Municipal spokesperson Mr Louis Bobodi declined to answer questions on the agreement to reconnect the electricity supply or on who was going to take the financial responsibility for all the costs incurred.“The matter is still sub judice as both parties still have to meet at the High Court before the end of February,” Bobodi said on Tuesday.

“The agreement is a victory for service delivery and a giant leap for justice,” was the response of SRPA executive committee member Ms Jana Smith on Friday.

“This agreement is very positive for the fight for service delivery, but we will have to see the reaction of the municipality as the case progresses. It is fantastic that the court order was proposed by the advocate of the municipality. We are very satisfied,” said Mr Jaap Kelder, chairperson of the National Taxpayers Union (NTU) where the SRPA is affiliated.

Ten die in N1 horror crash Among the carnage of Tuesday morning’s horror crash which left 10 people dead, a child stood crying helplessly for his mother. The accident occurred near Bandelierkop on the N1 south.

According to police information, the accident took place just after 06:00 when a truck collided with a minibus taxi that was carrying passengers to Zimbabwe.

Preliminary investigations indicate that the truck driver was on the wrong side of the road, when the truck’s trailer hooked the trailer of the passing minibus. Almost instantly, both the truck and minibus spun out of control and left the road.

The truck driver was crushed to death behind the steering wheel on impact. The minibus overturned, leaving nine people dead on the scene.

female and one was a little boy. All were Zimbabweans on their way from Johannesburg to the border.

A further 15 passengers were rushed to the Elim and Louis Trichardt state hospital for treatment.

Among them was the truck’s codriver. He managed to escape with minor injuries.While rescue workers were franticly trying to assist injured passengers next to the road, traffic piled up for several kilometres in both directions. The road remained closed for several hours, with police awaiting the arrival of a special investigation unit from Johannesburg. It was reopened around midday.

A case of culpable homicide is being investigated. In the meantime, South African police are working closely with Home Affairs to try and identify the bodies of the deceased.

“We are also trying to re-unite the surviving passengers with their families in Zimbabwe,” said Sadike.

In the meantime, the SRPA has approached President Jacob Zuma, the Public Protector, the Auditor General and the MEC for Local Government and Housing. “The Makhado Municipality … is taking vengeance on the people who have declared a dispute, as appears clearly form the application

documents. The cutting of electricity while the consumption has been paid, is unlawful, causing harm and disorder contrary to the interest of the public in the Makhado Municipal area,” the SRPA writes through its attorney. An investigation was requested to ascertain, among others, “whether any person can be held responsible for this chaos and possible misappropriation of public funds.”

Skokkende ouditverslag vir munisipaliteit

There is nothing wrong with Louis Trichardt´s water supply ... So says the Makhado Municipality, even though it looks funny, as in this photograph that a reader sent in. For more than three weeks now, residents in the greater part of Louis Trichardt have had to use filthy-looking water that smells like something has died in it. Municipal spokesperson Mr Louis Bobodi says the water´s appearance can be blamed on the fact that reservoirs are in the process of being cleaned. “It is still fit for human consumption. We know this because the water is subject to regular testing,” he said.

Regter Goody van die NoordGautengse Hooggeregshof het Dinsdag beslis dat die polisie R220 000 skadevergoeding aan mnr. Piet Boshoff (72) van die plaas Parma moet betaal. Dit nadat daar reeds vroeër beslis is dat sy arrestasie en dié van sy twee voormanne, mnre. Godfrey Moyo en Simon Ndlovu, onregmatig was.

Die saak spruit uit ‘n voorval in Maart 2009 op Boshoff se plaas.

Op die 18de van daardie maand is ‘n 30-jarige plaaswerker gevang, terwyl hy mangos gesteel het op die plaas. Moyo en Ndlovu het die werker hieroor gekonfronteer en, nadat hy skuld erken het, het hy bedank. Die werker het sy besittings bymekaar gemaak, waarna Moyo en Ndlovu vir

Boshoff gevra het om die mangodief met die bakkie hoofpad toe te neem. Die vier mans is toe daar weg.

Twee dae later het die ma van die 30-jarige mangodief by die polisiestasie op Alldays opgedaag en op blote hoorsê ‘n klag van ontvoering gelê.

Dit nadat haar seun nie huistoe gekom het nie.

Die polisie het geen tyd verspil om vir Moyo en Ndlovu te arresteer en aan te hou in die selle op Alldays nie. Intussen het Boshoff sy prokureur, mnr. Hennie Erwee van Musina, geskakel en die twee is saam na die polisiestasie. Daar aangekom, is beide mans ont­slaan, nadat die polisie op skrif erken het dat Moyo en Ndlovu nie verbind kon word met die man se verdwyning nie.

Twee dae later, op 20 Maart, het lede van die polisie se Georganiseerde Misdaadeenheid in Polokwane op die plaas opgedaag en weer vir Moyo en Ndlovu, asook vir Boshoff, op dieselfde klagte gearresteer. Die

drie is daarna in die polisieselle in Polokwane gegooi, waar hulle vir twee dae aangehou is.

Die saak is intussen oorgeplaas na die hof op Louis Trichardt en op 22 Maart van daardie jaar het al drie mans op ‘n klag van ontvoering verskyn. Al drie het borg gekry en die saak is uitgestel. Klagte teen die drie is egter later heeltemal laat vaar, nadat die mangodief opgespoor is en ‘n verklaring afgelê het dat hy nooit ontvoer is nie. Hy het blykbaar net op ‘n ander plaas gaan werk, sonder om vir sy ma daarvan te sê.

Skadevergoedingseise van R180 000 elk is reeds in Oktober 2010 aan Moyo en Ndlovu toegestaan. Boshoff se saak in die Hooggereghof is behartig deur prokureur Hennie Erwee en Adv Jaap Cilliers.

Erwee het gesê die Minister van Polisie het 30 dae om die eis uit te betaal.

“As hulle nie betaal nie, hou ons veiling,” het Erwee ná die uitspraak opgemerk.

Die Makhado Munisipaliteit het weereens swak gevaar wat betref sy finansiële praktyke, met die Ouditeur-Generaal (OG) wat sy mening weerhou het ten opsigte van die munisipaliteit se finansiële state vir die jaar eindigende 30 Junie 2011. In die vorige verslag het die OG ook sy mening weerhou (disclaimer of opinion).

Die Makhado Munisipaliteit het nie die verslag op 31 Januarie tydens die Raadsvergadering beskikbaar gestel soos wat die OG van hom verwag nie.

Die Zoutpansberger het plaaslike geöktrooieerde rekenmeesters van Venter, Viljoen en Malan gevra om die ouditverslag te vertolk. “Hierdie is nie ‘n mening wat oor die oudit van die OG uitgespreek word deur Venter, Viljoen en Malan nie, maar slegs ‘n vertolking van die OGl se ouditverslag,” sê mnr. Ferreira Nel en me. Elanie Havinga.

Die rekenmeesters verduidelik dat daar drie menings uitgespreek kan word. ‘n Ongekwalifiseerde mening beteken dat die finansiële state in alle wesenlike opsigte ‘n akkurate voorstelling van die stand van sake is. Tweedens is daar ‘n gekwalifiseerde me­ning, ook genoem ‘n “afgesien van” mening. Afgesien van die feite wat in die basis vir ‘n ouditmening genoem word, is die finansiële state in alle wesenlike opsigte ‘n akkurate voorstelling van die stand van sake. Derdens is daar die ergste - ‘n weerhouding van mening, waar die onsekerhede so wesenlik is dat

dit nie moontlik was om voldoende ouditbewyse te vind om ‘n mening oor die finansiële state te vorm nie. Dus spreek die ouditeur geen mening oor die finansiële state uit nie.

Die OG kon nie by die munisipaliteit voldoende ouditbewyse vind om hulleself te vergewis van die korrekte voorstelling van die syfers vir die balanse, eiendom, aanleg en toerusting, bank en kontant, debiteure en krediteure in die balansstaat nie.

“Die balanse kon dus meer of minder op jaareinde gewees het en die omvang van die verskille kon ook nie bepaal word nie. In die lig van beduidende verskille en wesenlike onsekerhede en die feit dat die OG nie toereikende en toepaslike ouditbewyse kon vind vir ‘n basis vir ‘n ouditmening nie, het hy sy ouditmening weerhou,” sê Havinga.

Hieronder word slegs drie vanuit ‘n hele aantal van die mees beduidende verskille genoem. * Onbekende deposito’s is in die bank ontvang ten bedrae van amper R18.9m. Dit is minder as die vorige jaar se onbekende deposito’s van R48.7m. Aan die anderkant is kwitansies uitgereik vir R19.6m, wat nie aan ‘n spesifieke deposito in die bank verbind kan word nie. * ‘n Aansienlike hoeveelheid eiendomme is geregistreer in die munisipaliteit se naam by die aktekantoor, maar is nie in die finansiële rekords opgeneem nie.

Bates wat nie aan die munispa­ liteit behoort nie verskyn ook in die finansiële rekords.

* Bates ten gunste van die munisipaliteit van R57.2m kon nie bevestig word nie. Dit bestaan uit ‘n bedrag van sowat R48.9m wat aangetoon is as ontvangbaar vanaf die distriksmunisipaliteit.

Voldoende ondersteunende dokumentasie kon nie gevind word om hierdie bedrag te bevestig nie.

Verder kon ‘n bedrag van R8.3m in die debiteure kontrolerekening (clearing account) nie verduidelik word nie. “Dit is die verantwoordelikheid van die bestuur om toereikende en doeltreffende beheermaatreëls in plek te stel om bedrog en foute te voorkom,” sê Nel. Verskeie tekortkominge van die munisipale bestuur word in die verslag uitgelig. Dit sluit ondermeer in: * Die munisipale bestuurder het nie redelike maatreëls in plek gestel om ongewone en onnodige uitgawes te voorkom nie; * Die munisipale bestuurder het nie redelike bestuurs-, rekenkundige en inligtingsi­ steemmaatreëls in plek gehad om te verseker dat daar behoorlik vir die krediteure van die munisipa­ liteit verantwoording gedoen kan word nie; * Die munisipale bestuurder het nie alle redelike stappe toegepas om te verseker dat voldoende en effektiewe interne beheer oor die bates van die munisipaliteit toegepas word nie; * Kontrakte is toegeken aan persone in diens van staatsinstellings; en * Bedrae verskuldig deur die munispaliteit is nie altyd binne 30 dae betaal nie.

SBBV-lede betaal hul munisipale rekening se geld by ‘n trustfonds in. Die verbruikgedeelte word maandeliks aan die munisipaliteit oorbetaal en die res word in die fonds teruggehou. Die weerhoudingsaksie vind plaas volgens ‘n wettige dispuut wat die SBBV in Augustus 2008 met die munisipaliteit verklaar het oor swak dienslewering en wanbestuur.

Vanaf 24 Januarie het die munisipaliteit begin om van die lede se krag af te sny.

Die vraag ontstaan waarom die munisipaliteit besluit het om te skik en die krag aan te sluit. Die munisipale woordvoerder, mnr. Louis Bobodi, se antwoord was dat die saak sub judice is, aangesien “beide partye nog in die hof moet ontmoet voor einde Februarie.”

Die hofbevel is intussen beskikbaar gestel (sien voorbladberig).

Die groot vraag is wie al die onkostes gaan dra. Dié vraag is ook deur Bobodi ontduik met die gebruiklike “sub judice” antwoord. Gilfillan het gesê dat hulle poog om ‘n kostebevel teen die munisipaliteit te verkry wat die regskostes en ook die kos­tes van die kragopwekkers en brandstof sal insluit. Die aansoek behoort binne twee of drie maande voor te kom.

MARCH • EBENEZER MILE & 3000M SWIM The beautiful Ebenezer Dam will once

again be the venue for the very popular Ebenezer Mile & 3 000m swim on 18 March.

Men and women of all ages may enter this open-water mile (1 609m) swim.

The age categories are under 13 years, 14 to 30 years, and 31 years and older. There is also a 3 000m course for SA national “B” championship qualification. The first race is at 08:00 (3000m), followed by the mile event at 10:00 for all female swimmers, with the three age categories swimming together. The main event starts at 11:30 for males - again the three age categories will swim the course together. A short-course development and introduction swim will take place 12:30.

Race timing will be will be handled with electronic timing chips worn by competitors.

Two men suspected of planning a business robbery in Eltivillas have had the charges against them withdrawn.

Reuben Moloto (39) and Christopher Maleka, both from Polokwane, appeared in the Louis Trichardt Regional Court on Monday. Their co-accused, Tsepo Moepi (39) of Seshego and Alfred Nkuna (40) of Mamelodi,

were, however, not that lucky.

All four the men appeared on a single count of the illegal possession of a firearm.

Their court case follows Moepi and Nkuna’s arrest in December 2010. According to information, the two were arrested after local police received a tip-off regarding a robbery that was being planned. When the police

searched the vehicle that they were driving, they found two unlicensed 9mm pistols.

Following Moepi and Nkuna’s arrest, they implicated Moloto and Maleka, who were subsequently arrested. On Monday, the State withdrew their case against Moloto and Maleka, due to a lack of physical evidence that links them to the case.

Let me pay a special tribute to those very special women of 40+

alentine’s Day is upon us and, as usual, we have to scamper around at the very last minute to find something to show our better halves that we still appreciate them.

Fortunately, they have come to know us by now (20 years of marriage give you plenty of time to figure out the habits of us ordinary folk) and they don’t expect too much. Still, it has to be said that we cannot imagine life without them and even if it is for just one day, we need to spoil them.

A few weeks ago, someone emailed me a transcript of a Andy Rooney show which was aired on the programme 60 Minutes. In this piece, he talks about the virtues of women over the age of 40. I had to forward it to my wife immediately (so this is no surprise to her), but I think some other women may appreciate it as well.

Whether Rooney wrote it before his death or not doesn’t really matter. It is still well worth a read:

The Way, the Truth and the Life

S

ome people today question their identity and wonder about their worth. Sometimes they may be treated as second-class citizens. They may ask, “Is my life really significant?”

The Bible tells answers that question in the very first chapter, where we see that God made both Man and Woman in His own image. Gen. 1:26 - Then God said: “Let Us make man in Our image, in Our likeness and let them rule ...” Verse 27: “So God created man in His own image, in the image of God He created him; male and female He created them.” Verse 31a: “God saw all that He had made, and it was very good.”

What does it mean that God created both male and female in His own image? It means that God made Adam and Eve to rule over creation on his behalf, to represent Him, to be like Him. (See Ephesians 4:24). It means that both man and woman was created for relationship with God and with each other.

Both were given reason; they could relate and communicate and make choices. Both were given souls that would never die.

There is no hint of superiority or inferiority. Every single human being has been made in the image of God. Every time we catch ourselves inwardly despising another human being we offend the God who made them.

Every single human being is to be respected, because each is made in the image of God. But there is an even higher privilege and dignity for those who are Christian believers. Read Galatians 3:26-28. Therefore every Christian is a fellow heir with Christ.

Paul argues that Jews and Gentiles are equal before God. Rich and poor are equal before God. Men and women are equal before God. All Christians are sons and heirs of God. There should be no higher privilege. So Peter commands husbands to treat their wives with respect because their wives are fellow heirs with them. (1 Pet 3:7).

So if a Christian asks: Who am I, and what am I worth? the answer is the same for men and women. You have been made in the image of God to serve and glorify Him for ever.

You have been united with Christ, and so you are an heir with Christ of eternal blessings.

That is your dignity, your meaning and your destiny.

Each one of us has been created by God just the way we are, for a reason. We have been created as spiritually equal, there are no second-class citizens in heaven.

Die Soutpansberg Muurbalklub het op 28 Januarie die jaarlikse Louis Trichardt/Kentron-vriendskapstoernooi gespeel. Hierdie toernooi word nou reeds vir 15 jaar gespeel. Die naweek is die vorige aand op hoë noot begin met ‘n mini houtraket-uitdaging. Soutpansberg het hier baie talent gehad en die toernooi gewen. Saterdag kon Soutpansberg ongelukkig nie die knoop deurhaak nie en die trofee het in Kentron agtergebly. Soutpansberg het nie genoeg spelers gehad nie en Kentron het drie spelers voorsien om hul span vol te maak. Laerskool Louis Trichardt lewer albei kampioen van kampioene op tydens die ses-skole atletiekbyeenkoms by Laerskool Krugerpark in Mokopane op 28 Januarie. Hierdie groep atlete is die goue medalje wenners. Voor, van links is Gideon Joubert, Alida du Preez, LJ Fick, Daniël Joubert (kampioen van kampioene van die seuns) en Modjadji Sefole (kampioen van kampioene van die meisies). Agter is Nsuku Baloyi, Allie Sefole, Dewald Stroebel, DJ du Preez en Franco Knoetze.

Triegie-atlete gekroon as kampioen van kampioene Laerskool Louis Trichardt spog met 17 eersteplekke, asook die seuns- én meisieskampioen van kampioene tydens ‘n ses-skole atletiekbyeenkoms in Mokopane.

Laerskool Pietersburg–Oos stof die Triegies met ‘n skrale 14 punte uit om die eersteplek onder die ses skole in te neem. Die gasheerskool, Laerskool Krugerpark, is derde en Pietersburg-Suid vierde.

Die ander twee laerskole wat aan hierdie byeenkoms op 28 Januarie deelgeneem het, is Nylstroom en Eugene Marais. Buiten die 17 goue medaljes, het die Triegies ook 15 silwer en 24 brons medaljes ingepalm. Al die kampioen van kampioene wedlope is deur Triegies gewen. Daar ding atlete van alle ouderdomme op ‘n voorgeebasis mee. Klein Modjadji Sefole is maar O/9, maar sy was die kampioen van kampioene van die meisies deur die 60m en 80m te wen.

By die seuns is Daniël Joubert die kampioen van kampioene. Daniël het in die 100m onder sy teenstand-

ers, wat almal kop en skouer bo hom uitgetroon het, uitgeseil. ‘n Rekord wat al 24 jaar gestaan het, is verpletter. Daniël se rekordtyd was 12.3s, wat vinniger is as die 12.4s kwalifiserende tyd vir die Suid-Afrikaanse kampioenskappe.

Dit is ook sy persoonlike beste tyd. Die vorige rekord was 12.7s en is gehou deur R. Venter, ook ‘n Triegie-atleet! Daniël het verder ook die verspring rekord verbeter van 4.83m na 5.01m.

Nog ‘n rekord aan die Triegiekant staan langs die naam van die O/10 atleet, LJ Fick, wat die gewig 8.99m ver gestoot het.

Die ander goue medalje-wenners is Gideon Joubert (SO/8, 80m), Franco Knoetze, (SO/10, 80m en 100m) , Nsuku Baloyi (SO/11, 100m), Alida du Preez (DO/11 80m, 100m en 70mH), DJ du Preez (SO/12 gewigstoot en spiesgooi), Dewald Stroebel (SO/13 200mH) en Allie Sefole (SO/13 200m, gewigstoot en diskus).

Jonandi Aucamp, O/16 blits van Hoërskool Louis Trichardt, wen die 100m, 200m en 400m tydens die vriendskaplike vyf-skole atletiekbyeenkoms wat op 4 Februarie by die skool se sportveld gehou is. Hier hardloop Jonandi die 100m in 13.2s.

Marnus Uys van Hoërskool Piet Potgieter breek die rekord in die 100m vir seuns onder 14. Sy rekordtyd was 12 sekondes. Die geleentheid was die vriendskaplike vyf-skole atletiekbyeenkoms wat op 4 Februarie by Hoërskool Louis Trichardt se sportveld gehou is. Die ander drie besoekende skole was Hoërskool Frans du Toit, Hoërskool Tom Naudé en Falcon College (Zimbabwe).

Mudzanani wins annual Hyundai Mountain Race Fhatuwani Mudzanani won the Hyundai Mountain Race in a record time of 1:13:16 on Saturday.

Thompson Magagane of Polokwane Athletics Club ended in the second position in 1:15:15 and Sam Munyai of the Nedbank Athletic Club finished in third position (1:16:00).

The ladies category was won by Joyce Makwarela of Bonitas Athletics Club in 1:32:29, with ML Jennet of Fourways in second position (1:35:29).

Thompson Mbombi of Greater Elim Athletics Club was the first master's athlete to finish the race (1:34:16.)

The 10 km ladies race was won by Denga Mashavha, with veteran Amanda Kruger ending

in second position. The third position went to an athlete from Polokwane, Hannelie Viviers. The first man to cross the finishing line in the 10km race was Livhuwani Netshaulu. Engedzani Muswobi finished the race in second position and XT Nkanayani was third.

The 5km race for girls was won by the 11-year-old Khuliso Nthangeni. She was followed by Tiny Masia (14), with Nyeleti Chauke (13) in third position. All three athletes are from Vhembe Athletics Club.

According to the manager of Hyundai in Louis Trichardt, Mr Hamid Karim, they will continue, and possibly increase, the sponsorship. "The sponsorship is a token of appreciation for the support we are getting from our local communities," he said.

Mr Stanley Thompson of the local athletics club thanked Hyundai and others sponsors for their efforts to develop athletics in the rural areas.
